DISCIPLINARY MANUAL
DISSIPLINêRE HANDLEIDING
ENGLISH PAR. AFRIKAANS
THE PURPOSE OF THIS MANUAL
The purpose of this manual is to provide
guidelines to the principle, deputy-principle,
educators and disciplinary committee with
regard to the handling of disciplinary matters
within the school situation in accordance with
the disciplinary procedure and code of
conduct.
DISCIPLINARY PROCEDURE VS CODE OF
CONDUCT
The disciplinary procedure prescribes the
basic rules which must be complied with when
applying discipline, whether informal or
formal discipline. The procedure has been
written in simple language and is easy to
understand. When circumstances necessitate
that a learner be disciplined, the rules
contained in the disciplinary procedure must
be strictly adhere to.
The code of conduct contains the types of
behavior of learners, which are not acceptable
to the principle, deputy-principle, educators,
community and governing body, in other
words the various offences of the school. The
code has been set out in two columns, namely
serious offenses in the left column and less
serious offenses in the right column.
Offences in the left column could result entire
discharge of a learner for a first offence. The
circumstances and merits of each case will be
decisive. Offenses contained in the right-hand
column are such that a first offence does not
justify entire discharge. Any disciplinary
measures, from a corrective measure to a
suspension can however be imposed, once
again with due consideration of the
circumstances and merits of each particular
case.
Guidelines for a Code of Conduct for
learners
Section 8 of the South African Schools Act
provides that a governing body of a public
school must adopt a Code of Conduct. The
Code of Conduct must aim at establishing a
discipline and purposeful environment to
facilitate effective education and learning in
schools
2.2
2.2.1
2.2.1.1
dissipline. Die prosedure is in eenvoudige taal
geskryf en maklik om te verstaan. Wanneer
is in twee kolomme ingedeel, naamlik ernstige
deurslaggewend wees. Oortredings vervat in die
regterkantste kolom
is sodanig dat dit nie by eerste oortreding ‘n
permanente uitsluiting sal regverdig nie. Enige
‘n openbare skool ‘n Gedragskode moet aanvaar.
Die Gedragskode moet gerig wees op die
vestiging van ‘n gedissiplineerde en doelgerigte
omgewing om doeltreffende onderwys en studie
in skole te aanvaar.
ENGLISH PAR. AFRIKAANS
This document sets out guidelines for
consideration by governing bodies of public
schools in adopting a Code of Conduct for
learners to ensure that there is order and
discipline in schools.
The Code of Conduct must be subject to the
Constitution of the Republic of South Africa,
1996, the South African Schools Act, 1996
and provincial legislation. It must reflect the
constitutional democracy, human rights and
transparent communication, which underpin
South African society.
The code of conduct must inform the learners
of the way in which they should conduct
themselves at school in preparation for their
conduct and safety in civil society. It must set
a standard of moral behaviour for learners and
equip them with the expertise, knowledge and
skills they would be expected to evince as
worthy and responsible citizens. It must
promote the civic responsibilities of the school
and it must develop leadership. The main
focus of the Code of Conduct must be positive
discipline; it must not be punitive and
punishment oriented but facilitates
constructive learning.
Each school must develop its own Code of
Conduct. In formulating a Code of Conduct
as a consensus document and before adopting
it, the governing body must involve the
parents, learners, educators, and noneducators
at that school. After the adoption of
the Code of Conduct, each stakeholder must
receive a copy thereof. The above
stakeholders must also be consulted when the
Code of Conduct is reviewed annually or
when any amendments are made.
The purpose of a Code of Conduct is to
promote positive discipline, self- discipline
and exemplary conduct, as learners learn by
observation and experience.
All key stakeholders should be committed to
the Code of Conduct despite its being directed
specifically at learners.
The Code of Conduct must suit the
development of the learners and be
appropriate to the different school levels. The
language used must be easily understandable
to make the content accessible. The format
should be user-friendly.
2.2.1.2
2.2.1.3
2.2.1.4
2.2.1.5
2.2.1.6
2.2.1.7
2.2.1.8
vestig.
Elke skool moet sy eie Gedragskode ontwikkel.
In die formulering van ‘n Gedragskode as
konsepdokument, en voordat dit aanvaar word,
moet die Beheerliggaam die ouers, leerders,
opvoeders en nie-opvoeders van die skool afskrif
daarvan ontvang.
word.
Die Gedragskode moet aanpas by die
ontwikkeling van die leerders en toepaslik wees
vir die verskillende skoolvlakke. Die taal wat
gebruik word moet maklik verstaanbaar wees om
die inhoud toeganklik te maak. Die formaat moet
gebruikers- vriendelik wees.
ENGLISH PAR. AFRIKAANS
The Code of Conduct must contain a set of
moral values, norms and principles that the
school community should uphold. However,
the Code of Conduct is only enforceable
against learners and no other person.
The Code of Conduct should clarify and
promote the roles and responsibilities of
various stakeholders in the creation of a proper
learning environment in schools.
The Code of Conduct should contain the
following components which aim at providing
appropriate mechanisms and avenues for
stakeholders to air their grievances, and also
provide for legitimate disciplinary measures:
The preamble to a Code of Conduct
The legal authority for the control
and discipline of learners
Principles and values : the rights of
learners
Rights and responsibilities of learners
Responsibilities of parents with
respect to the Code of Conduct
Discipline
Punishment
Dispute resolution
Prevention, proactive advice,
counseling, penalties and corrective
measures
Offences that may lead to suspension
Suspension and expulsion
Due process
Serious misconduct and the law
2.2.1.9
2.2.1.10
2.2.1.11
Die Gedragskode moet ‘n stel morele waardes
bevat, asook norm en beginsels wat die
skoolgemeenskap moet handhaaf. Die
Gedragskode is egter slegs op leerders
afdwingbaar en op geen ander persoon nie.
Die Gedragskode moet die rolle en
verantwoordelikhede van die onderskeie
belanghebbendes in die skep van ‘n behoorlike
leeromgewing in skole bevorder en duidelik
maak.
Die Gedragskode moet die volgende komponente
bevat en daarop gerig wees om toepaslike
meganismes en geleenthede vir belanghebbendes
CONTROL AND MAINTENANCE OF
DISCIPLINE
The maintenance of discipline is the
responsibility and prerogative of the
principle, deputy-principle and educators
with due consideration of the following:
Corrective action
When applying discipline the emphasis will
be on guidance and rehabilitation rather
than on imposing punishment. Fair
suspension should however also serve as a
deterrent.
Uniformity
Discipline must be applied uniformly
trough out the school on all levels. One of
the surest methods of undermining a
disciplinary procedure is to take
disciplinary action against some learners
and not against others.
Fairness
Disciplinary action must always be
procedurally and substantively fair.
Procedural fairness is ensured by strictly
adhering to the disciplinary procedure. On
the other hand substantive fairness means
that any disciplinary action/ imposition of
disciplinary measures must always be fair.
The nature and circumstances of the
specific offence, as well as the school
record of the learner concerned must thus
be considered before a specific disciplinary
measure is decided upon. Substantive
fairness is thus implies nothing other than
that the disciplinary measure must be in
line with and applicable to the offence and
personal profile of the transgressor.
The balance between uniformity and fairness
The objective must be to strive to maintain
a healthy balance between uniformity and
fairness at all times. When considering
disciplinary action an attempt must be
made to treat the specific learner concerned
fairly at all times without compromising
uniformity.
BESTUUR EN HANDHAWING VAN
DISSIPLINE
Die handhawing van dissipline is die
verantwoordelikheid en prerogief van die
Hoof, Adjunkhoof en Opvoeders met
inagneming van die volgende:
Korrektiewe aksie
By die toepassing van dissipline sal die
klem val op leidinggewing en rehabilitasie
eerder as om straf toe te deel. Billike
skorsing behoort egter ook as afskrikmiddel
te dien.
Eenvormigheid
Billikheid
Dissiplinêre optrede moet altyd prosedurieel
asook substantief billik wees. Prosedurele
billikheid word verseker deur die
dissiplinêre prosedure nougeset na te kom.
Substantiewe billikheid daarenteen beteken
dat enige dissilpinêre optrede of oplê van
dissiplinêre maatreël altyd regverdig moet
wees.
Substantiewe billikeid is dus niks
anders as dat die dissiplinêre maatreël in lyn
en toepaslik moet wees met die oortreding
en persoonlike profiel van die oortreder.
Die balans tussen eenvormigheid en billikheid
Daar moet deurgaans gestrewe word na die
handhawing van ‘n gesonde balans tussen
eenvormigheid en billikheid. By oorweging
ENGLISH PAR. AFRIKAANS
Lapse of time between the offence and the
taking of disciplinary action
The general rule is that disciplinary action
must be taken as soon as possible after the
allege offence. The rule must be strictly
adhering to.
Hearing prior to entire discharge
No learner shall, irrespective of the
seriousness of an offence, be dismissed on
disciplinary grounds before a disciplinary
hearing has been held. It does happen that
a learner may request that a formal hearing
involving him/her is not held or he/she may
refuse to attend such a hearing. In such
cases a proper written record must be kept
of the request/refusal and two (2) witnesses
must sign such refusal/ request. The
hearing may then be held in his/her
absence.
Social / Psychological services
Where applicable, social and or
psychological services can be utilized to
gather background information.
Follow-up
Follow-up discussions with learners who
commit offences will be aimed at
rehabilitation and guidance to confirm
corrective actions.
Knowledge of the disciplinary procedure/code
Every learner/parent/guardian (one per
family) of the school must be provided
with a disciplinary procedure and code of
conduct (new learners upon entrance into
school). Receipt of acknowledgement
must be in written. Apart from this a copy
of the disciplinary procedure and code of
conduct must be available at the principle,
deputy-principle, educators and
administrative office.
3.5
3.6
3.7
3.8
3.9
Tydverloop tussen die oortreding en die neem
van dissiplinêre maatreëls
Die algemene reël is dat dissipline so gou as
In sodanige gevalle moet daar behoorlike
skriftelike rekord gehou word van die
versoek/weiering, en twee getuies moet
daarby teken. Die verhoor kan dan in
sy/haar afwesigheid gehou word.
Maatskaplike / Sielkundige Dienste
Waar toepaslik kan Maatskaplike en/of
Sielkundige Dienste betrek word by die
inwin van agtergrond inligting.
Opvolging
leerders by inname in skool).
Ontvangserkenning moet skriftelik geskied,
wat veilig bewaar moet word.
Hierbenewens moet afskrifte van die
dissiplinêre prosedure en Gedragskode ter
insae by die Hoof, Adjunkhoof, Opvoeders
en administratiewe kantoor beskikbaar
wees.
RELATION BETWEEN COURT CASES
AND DISCIPLINARY ACTION
Offenses within school context
Offences within the school context will be
dealt with at the hand of the disciplinary
procedure and code of conduct irrespective
of whether or not the offender lands in
court as a result of the offence.
Offences outside of the school context
If a court case is pending against a learner
and such court case has arisen from
circumstances which are not related to the
school, the matter will not be dealt with by
means of a disciplinary procedure.
However, if the schools image is
negatively affected by the offence or if
there is a relation between the offence and
the schools interests, 4.1 above is
applicable.
Offenses which result in imprisonment
If a learner is sentenced to imprisonment,
he/she could be summarily discharge from
school.
Oortredings binne skoolverband
Misdrywe buite skoolverband
Indien ‘n hofsaak teen ‘n leerder hangend is
daardeur geraak is of indien daar ‘n ander
Nasionale Onderwysbeleid, Wet No. 27 van
1996, moet die Minister van Onderwys die
Nasionale Onderwysbeleid vir die beheer en
dissipline van leerders by onderwysinrigtings
bepaal.
ENGLISH PAR. AFRIKAANS
The South African School Act, Act No. 84 of
1996, section 8(1) empowers a governing body
of a school to maintain discipline in a school.
The Code of Conduct must prescribe behavior
that respects the rights of learners and
educators.
The Code of Conduct of a public school must
be displayed at the school and as far as possible
be given to each learner in the official language
of teaching of the learner when he/she enrolls
at a school. As learners are compelled to
comply with the Code of Conduct of the school
they attend they must be informed about its
contents, which must list, in positive terms, the
things learners may not do, or should do, as
well as communication channels, grievance
procedures and due process in conducting a fair
hearing.
Learners must understand that action may be
taken against them if they contravene the Code
of Conduct. When action is taken against
learners they should be informed why their
conduct is considered as misbehavior or
misconduct and why they are to be disciplined
or punished. The punishment must suit the
offence.
Nothing shall exempt a learner from complying
with the Code of Conduct of the school.
An educator at the school shall have the same
rights as a parent to control and discipline the
learner according to the Code of Conduct
during the time the learner is in attendance at
the school, any classroom, school function or
school excursion or school related activities.
The principle or an educator, upon reasonable
(sufficient information), has the legal authority
to conduct a search of any learner or property
in possession of the learner for a dangerous
weapon, firearm, drugs, or harmful dangerous
substance, stolen property, or pornographic
material brought on to the school property. (A
search may be performed in terms of the
following Acts of general applications: Control
of Access to Public Premises and Vehicles Act,
1985, Act No. 53 of 1985; Drugs and Drug
‘n Gedragskode moet by die skool vertoon word
en sover moontlik aan elke leerder verskaf word
in die amptelike taal van onderrig van die
leerder wanneer hy/sy by ‘n skool inskryf.
leerders nie mag doen nie, of moet doen, asook
die kommunikasiekanale, grieweprosedure en
die behoorlike regsproses wat tydens die
verloop van ‘n regverdige verhoor gevolg moet
word.
Leerders moet verstaan dat daar teen hulle
opgetree kan word indien hul die Gedragskode
sou verbreek. Wanneer daar stappe teen
leerders gedoen word, moet hulle ingelig word
waarom hulle gedrag as wangedrag beskou
word en waarom hulle gedissiplineer of gestraf
gaan word. Die straf moet strook met die
oortreding.
‘n Opvoeder by die skool sal oor dieselfde regte
asook enige klas, skoolfunksie of skooluitstappe
Decision making
ENGLISH PAR. AFRIKAANS
give the learner a chance to give
evidence and describe the incident
and give reasons for his behavior;
give the learner / his
representative a chance to ask the
principal questions;
if there were witnesses and their
evidence is necessarily and
available called them individually
to give their evidence;
give the learner / his
representative the chance to cross
question the witness;
request the witnesses to leave the
room after they have given
evidence;
continually summarize the
evidence given by those involved;
ask the offender to leave the room
before a decision of guilty or notguilty
is made.
The Chairman will ask the offender / his
representative as well as the principal to
use the information available to give their
view if the alleged offender is guilty and
give reasons for the decision.
After hearing the views the Chairman in co
– operation with the rest of the committee
will decide if the learner is guilty. The
Chairperson will base his conclusion of
guilty or not on a “weight of probabilities”
(rather than on the concept of “above
reasonable doubt” which is used in the
criminal procedure.) He will convey his
decision and reasons to the offender and
other concerned persons present.
7.2.2
Besluitneming
indien daar getuies was en hulle
getuienis is nodig en
beskikbaar, sodanige getuies
afsonderlik inroep om getuienis
te lewer;
die leerder/sy verteenwoordiger
die geleentheid gee om enige
getuies onder kruisverhoor te
neem;
elke getuie versoek om die
getuienis afgehandel is;
deurlopend die getuienis wat
deur elke betrokkene gelewer
is, opsom;
die leerder versoek om die
lokaal te verlaat voordat ‘n
besluit geneem word of hy
skuldig of onskuldig is.
so dink.
Na aanhoor van genoemde sienings sal
die Voorsitter in samewerking met res
van Tugkomiteelede, self besluit of die
leerder skuldig of onskuldig is. Die
Voorsitter sal sy besluit ten aansien van
skuldig, al dan nie, basseer op ‘n
“oorwig van waarskynlikhede” (in
teenstelling met die beginsel van “bo
redelike twyfel” wat in die Strafproses
prosedure gebruik word). Hy sal sy
besluit en die redes daarvoor aan die
beskuldigde leerder en die ander partye
teenwoordig oordra.
29

ENGLISH PAR. AFRIKAANS
If there is any doubt, the Chairperson may
postpone the hearing for a short while until
the necessary information has been
obtained. To illustrate the difference
between “above reasonable doubts” vs.
“weight of probabilities” the following
definitions are given.
Above reasonable doubt
The required onus probandi to succeed in
criminal procedures. This onus is higher
than those in civil – right procedures. The
chairperson must be approximately 75%
certain that the person is guilty. The
chairperson does not have to be 100%
certain of guilt, a margin of reasonable
doubt is allowed.
Weight of probabilities
The required onus to achieve in a civil –
right procedure. The onus is lower than
that of a criminal procedure. The party at
issue whose evidence of the incidence
seems to be the most probable (with a
minimum of 51% credibility) has the right
to have the verdict in his favor.
Determining disciplinary measures in the of a
conviction
It must be made sure that the learner’s
school record is available at the hearing.
When disciplinary measures are
determined, the following factors must be
considered:
the seriousness of the
transgression;
the circumstances in which the
offence took place;
the nature and number of
previous offences by the learner
that are still valid;
7.2.3
Indien daar twyfel bestaan kan die
Voorsitter die verhoor vir ‘n kort tyd
verdaag of uitstel totdat die nodige
inligting bekom is. Om die verskil
tussen “bo redelike twyfel” vs “oorwig
van waarskynlikhede” te illustreer volg
‘n kernagtige definisie van die
onderskeie beginsels hieronder.
Bo redelike twyfel
Die vereiste bewyslas om te slaag in
strafregtelike verrigtinge. Die
bewyslas is hoër as in siviele-regtelike
verrigtinge. Die voorsittende beampte
moet min of meer 75% seker wees dat
die persoon skuldig is. Die
voorsittende beampte hoef nie absoluut
100% seker te wees nie – ‘n mate van
redelike twyfel word toegelaat.
Op ‘n oorwig van waarskynlikhede
Die vereiste bewyslas om te slaag in
siviele-regtelike verrigtinge. Die
bewyslas is laer as in strafregtelike
verrigtinge. Die gedingsparty wie se
weergawe van die feite die
waarskynlikste blyk te wees dit wil sê
gedingsparty se weergawe(ten minste
51% geloofwaardig), is geregtig op
uitspraak in sy guns.
Bepaling van dissiplinêre maatreël in die geval
van skuldigbevinding
Daar moet seker gemaak word dat die
leerder se rekord by die dissiplinêre
verhoor beskikbaar is, met ander
woorde sy skoolrekord.
By die bepaling van dissiplinêre
maatreëls sal die volgende faktore in ag
geneem word:
die erns van die oortreding;
die omstandighede waaronder
die oortreding plaasgevind
het;
die aard en aantal vorige
oortredings deur die leerder
wat nog geldig is;
After hearing the opinions the chairperson
Duties of secretary during hearings
Take minutes during hearing
The secretary’s duty is to take minutes
accurately during the hearing procedure.
Procedures as well as what was said by
different parties must be written down
accurately and detailed. This prevents
differences of opinion which may occur at
a later stage.
Format of minutes
APPEAL
Aim
The format of the minutes must be
according to the list of control. An
example of minutes has been attached for
your convenience. The secretary must
take note that if a question is asked and
then answered, it must be written down as
such. The names of all persons that give
witness or ask questions must be written
down clearly for reference purposes. If
applicable the minutes must be typed
neatly and kept on file.
The aim of an appeal is to give the learner
the opportunity to call on higher authority
against any disciplinary measures taken
against such a learner.
The grounds on which the learner may
appeal are stipulated in the procedure:
Delegation of authority
Appeal cases are handled by the line
authority (one level higher) in
correspondence with the approved school
APPèL
Doel
Die formaat van die notule moet
volgens die kontrolelys geskied, en
word ‘n voorbeeld van ‘n notule vir
gerief aangeheg. Sekretaris/esse se
aandag word daarop gevestig, dat
wanneer ‘n vraag gevra en ‘n antwoord
gegee word, dit so genotuleer moet
word. Alle persone wat getuig of vrae
vra se name moet ook duidelik uitgestip
word, vir latere verwysing. Indien van
toepassing moet notule netjies getik
place. The principal then gives
written notice to all relevant persons
at least seven (7) days before the
hearing. Notice must be given to the
learner and his parents on the
required documents. (annexure F
and F(1))
b) The appeal board has the right to call
in any person he can provide
information needed for the hearing.
objection from the learner and gives
the Disciplinary committee a chance
to motivate their decisions.
c) The learner has the right to have
representation such as that allowed
at the disciplinary hearing.
d) Members of the Disciplinary
Committee may only be called in as
witnesses at the Appeal Hearing if
necessary. Like any other witness
verhoordatum van die appèl aan
al die betrokkenes. Kennis moet
aan die leerder en ouers op die
voorgeskrewe vorms (bylae F en
.
verteenwoordiging soos by ‘n
Tugkomitee verhoor.
(d) Die lede van die Tugkomitee
verhoor mag alleenlik as getuies
by die Appèlverhoor betrek word,
