<strong>Crimes</strong> <strong>Law</strong><br />
The <strong>Computer</strong> <strong>Crimes</strong> <strong>Law</strong> 45 is made up <strong>of</strong> 56 articles divided into 3 parts: Part One,<br />
<strong>Crimes</strong> and Punishment; Part Two, Civil Procedure; Part Three, Other Regulations. No<br />
article in the legislation indicates the overarching purpose <strong>of</strong> the law, and the law contains<br />
no guarantee for the right to freedom <strong>of</strong> expression or access to information.<br />
At the outset, ARTICLE 19 notes that the <strong>Computer</strong> <strong>Crimes</strong> <strong>Law</strong> contains no definitions<br />
<strong>of</strong> key terms used throughout the law. For example, the lack <strong>of</strong> defintions for the terms<br />
“illegal access”, “access”, “confidential data”, “disruption”, “interception” is problematic,<br />
since they can be interpreted in various ways. A handful <strong>of</strong> generally inadequate definitions<br />
are provided for with sporadic specificity in footnotes to a minority <strong>of</strong> articles, but provoke<br />
more ambiguity than they resolve. Furthermore, the Cyber Crime <strong>Law</strong> does not specify<br />
whether the crimes enumerated in the law have to be committed intentionally (or at least<br />
with dishonest intent) or whether unintentional or negligent <strong>of</strong>fences warranty the same<br />
penalties.<br />
This section analyses the most problematic provisions <strong>of</strong> the Cyber Crime <strong>Law</strong> in greater<br />
detail and points out discrepancies between the <strong>Law</strong> and the international freedom <strong>of</strong><br />
expression standards outlined above.
