Article 52 <strong>of</strong> the Cyber Crime <strong>Law</strong> charges<br />

the Ministry <strong>of</strong> Justice and Ministry<br />

<strong>of</strong> Information and Communications<br />

Technology with the task <strong>of</strong> developing<br />

international partnerships to fight<br />

computer crimes.<br />

Given the fundamental flaws <strong>of</strong> the Cyber<br />

Crime <strong>Law</strong>, ARTICLE 19 urges any entity<br />

approached by the <strong>Iran</strong>ian Government in<br />

furtherance <strong>of</strong> this objective to take note<br />

<strong>of</strong> the analysis contained in this Comment<br />

and deny any assistance that may help<br />

with the implementation <strong>of</strong> the <strong>Computer</strong><br />

<strong>Crimes</strong> <strong>Law</strong> or the propagation <strong>of</strong> its<br />

values.<br />

Article 53 <strong>of</strong> the Cyber Crime <strong>Law</strong><br />

provides that where computer or<br />

telecommunication systems have been<br />

used to commit a crime not covered by<br />

the <strong>Computer</strong> <strong>Crimes</strong> <strong>Law</strong>, resort must<br />

be made to existing penal laws. Article<br />

53 demonstrates that in the absence<br />

<strong>of</strong> the <strong>Computer</strong> <strong>Crimes</strong> <strong>Law</strong> there are<br />

many alternative means available for the<br />

<strong>Iran</strong>ian authorities to target and suppress<br />

expression that it finds disagreeable.<br />

Amendments to the <strong>Computer</strong> <strong>Crimes</strong> <strong>Law</strong><br />

must be complemented by significant<br />

reforms to the <strong>Iran</strong>ian Constitution, the<br />

Press <strong>Law</strong> <strong>of</strong> 1986 and the <strong>Islamic</strong> Penal<br />

Code.
