Overview This Interim Instruction Notice (IIN) provides information regarding Electronic
Benefit Transfer (EBT) electronic theft.
The California Department of Social Services (CDSS) issued interim
instructions for restoring EBT CalWORKs benefits lost due to electronic theft
as mandated by Assembly Bill (AB) 2035. AB 2035 requires the prompt
restoration of lost benefits, effective 1/1/2013.
CDSS will release detailed instructions at a later date, which will include:
Notice of Action language,
Claiming and tracking process, and
Implementation regulations.
Definition Electronic theft occurs when a customer has not lost physical possession of
his/her EBT card and money is stolen electronically from the EBT account
(also called skimming).
Interim
process
During the interim process, the customer is required to file a police report and
complete form TEMP 2259 - Report of Electronic Theft of Cash Aid. The
police report information will be included on the TEMP 2259. The customer
is not required to attach a copy of the police report to the TEMP 2259.
Counties may process the TEMP 2259 without the filing of a police report if:
There is good cause for the police report or the police report number not
being submitted, and
CDSS has been consulted and approves the good cause.
Note: Some police departments will only provide a police report number and
not the actual report to the customer.
