1- Sri J. Ramanaiah, the then Asst./Shroff, Laddu Sales Counter,<br />
Sri T.T., Tirumata was punished with stoppage of his next periodical<br />
increment without cumulative effect for having committed certain irregularities<br />
and in having possession of Laddu tokens unauthorisedly, in Proc.<strong>Roc</strong>.<strong>No</strong><br />
D3/24721 /97, dt. 1 CM 2-98.<br />
2. Aggrieved by the said orders of punishment, he preferred an<br />
appeal to the <strong>TTD</strong> <strong>Board</strong> of Trustees under Section 120(i) of Act 30/87 within<br />
the time stipulated duly affixing the requisite court fee stamps, with a request<br />
to set-aside the orders of punishment and to do justice.<br />
FACTS OF THE CASE IN BRIEF:<br />
3. The Asst.Exe.Officer(Potu), Sri T.T., Tirumala in his report dated<br />
5-6-97 stated that Sri J. Ramanaiah, Asst./Shroff, Laddu Sales Counter, Sri<br />
T.T., Tirumala was caught red-handedly by the Crime Police, Tirumala while<br />
he was selling 20 numbers of un-punched Laddu Tokens to a private person<br />
by name Sri Srinivasulu in block market at Rs. 10/- and while taking him to the<br />
custody, 30 more un-punched Loddu tokens were alsp found with him. The<br />
S.I of Police, Crime Station, Tirumala has also confirmed the above facts in<br />
his repot dated 5-6-97 besides stating that a case was registered against<br />
Sri J. Ramanaish, Asst./Shorff in Cr..<strong>No</strong>. 93/97 Under Section 420 read with<br />
511 IPC. The xerox copies of FIR and report dated 5-6-97 of S.I of Police,<br />
Crime Station, Tirumala was also enclosed by the Asst.Exe.Officer(Potu), Sri<br />
T.T., Tirumala.<br />
4. Basing on the said report, Sri J.Ramanaiah was placed under<br />
suspension vide Memo <strong>Roc</strong>.<strong>No</strong>. DA3/24721 /97, dt. 19-6-97 and the following<br />
three charges were also leveled against him in Memorandum of Charge <strong>Roc</strong>.<br />
<strong>No</strong>. DA3/24721 /97, dt. 16-7-97.
Charge <strong>No</strong>. 1: "that after your duty in laddu sales counter <strong>No</strong>.1, Sri TT,<br />
Tirumala from 4 PM on 4-6-97 to 8 AM on 5-6-97, at about<br />
11.30 AM on 5-6-97, you were caught red handed by the crime<br />
police, Tirumala while you were selling 20 un-punched laddu<br />
tokens to an outsider by name Sri Srinivasulu in black market<br />
at Rs.10/- per token for your unlawful monetary gain and the<br />
police have registered a case against you as Cr. <strong>No</strong>. 93/97<br />
under Section 420 and 420 r / w 511 IPC. Thus you have<br />
resorted to commit an offence involving moral turpitude and<br />
exhibited your misconduct".<br />
Charge <strong>No</strong>. 2: "that when the police have taken you into custody at about<br />
11.30 AM on 5-6-97 for selling 20 laddus to an outsider by<br />
name Sri Srinivasulu in black market, you were found in<br />
possession of 30 more unpunched laddu tokens with you(total<br />
50 laddu tokens), which were suspected to have been collected<br />
and retained with you with a malafide intention to sell them to<br />
dalalies in black market for your illegal personal gain. Thus<br />
you have not accounted for the 50 <strong>No</strong>s. of laddu tokens after<br />
completion of your duty period on 5-6-97 intentionally with a<br />
malafide intention and cheated the administration which is<br />
unbecoming of a <strong>TTD</strong> employee and exhibited your<br />
misconduct".<br />
Charge <strong>No</strong>. 3: "that by selling laddu tokens to an outsider in black market for<br />
your personal unlawful gain, you have demeaned the<br />
reputation of the institution in the minds of pilgrim public and<br />
exhibited your misconduct".<br />
5. Sri J. Ramanaiah, Asst./Shroff submitted his explanation to the<br />
said Memorandum of charge dt. 16-7-97, denying all the charges leveled<br />
against him. In his explanation he stated that the Police has foisted a false<br />
case against him in view of the recent incident happened between Police and<br />
<strong>TTD</strong> employees.<br />
6. As J. Ramanaiah, Asst./Shroff has opted for oral enquiry, as per<br />
the Form-I submitted along with his explanation. The<br />
Asst.Exe.Officer(Jewellary) was appointed as Enquiry Officer to enquire into<br />
the case and to submit his enquiry report and findings vide Proc.<strong>Roc</strong>.<strong>No</strong>.<br />

7. The Enquiry Officer conducted enquiry as per the procedure<br />
established under CCA Rules, recorded the statements of the appellant and<br />
the following witnesses.<br />

2) Sri N.R. Ramamurthy, <strong>No</strong>. 392, Balaji Nagar, Tirumala.<br />
3) Sri P.Srinivasulu, Cool Drinks Seller, N.I.R. Nelayam, Tirumala.<br />
4) Sri S.K. Murthy, P.C.<strong>No</strong>. 1924, l-Town P.S., Tiruimala.<br />
5) Sri Nagaraj, P.C.NO. 702, l-Town P.S., Tirumala.<br />

and submitted his enquiry report and findings disproving the charges leveled<br />
against the appellant, since the appellant after completion of his duty hours in<br />
Laddu Counter, handedover the charge to his successor without any variation.<br />
The balance of laddus, punched tokens and the sale proceeds were tallied<br />
and the amount was also handed over to the Vagapadi shroff duly accounted<br />
for. Further, there is no scope for the appellant to secure unpunched laddu<br />
tokens.<br />
8. Further, the appellant was also acquitted from the Criminal Case<br />
<strong>No</strong>.276/97as per the Judgement dt. 18-6-98 of the IIADMM, <strong>Tirupati</strong>.<br />
9. Though the charges leveled against the appellant were not held<br />
proved during Departmental enquiry as per the Enquiry report and findings of<br />
the Enquiry Officer, it is evident with the statements recorded by the Enquiry<br />
Officer (i.e., the statement of Sri S.K. Murthy, P.C.<strong>No</strong>. 1924 and Sri Nagaraj,<br />
P C.<strong>No</strong>. 702 of I -Town Police Station, Tirumala) that the appellant was<br />
caught while possessing Laddu tokens. Therefore, Sri J. Ramanaiah was<br />
punished with stoppage of one increment without cumulative effect as per<br />
Proc. DA3/ 24721/97, dt. 10-12-98.<br />
10. Aggrieved by the said orders of punishment he preferred the<br />
present appeal before tne <strong>TTD</strong> <strong>Board</strong> of Trustees with a request to set-aside<br />
the orders of punishment and to do justice. The remarks on the grounds of<br />
appeal are furnished as annexure.<br />
11. In view of the above the appeal of Sri J. Ramanaiah, Asst./Shroff<br />
is placed before the <strong>TTD</strong> <strong>Board</strong> of Trustees for taking a decision.<br />
