Sub:- T.T.D. - Engg. Dept. - Construction of Kalyana
Mandapam at Bapatla, Guntur District - Proposals
submitted - Approval - Requested - Regarding.
Sri M. Seshagiri Rao, M.L.A., Bapatla, in his letter
dt.12.12.1995 has initiated the proposals requesting the T.T.D.
to construct a Kalyana Mandapam at Bapatla. In view of the
policy decision taken by the T.T.D. Specified Authority in
Res.No.1151, dated 31.3.1995, not to sanction any new Kalyana
Mandapam after 1.4.1995 all proposals/ sanctions for
construction of Kalyana Mandapams at various places, where
conditions are not fulfilled, stand cancelled. Accordingly, Sri
M.Seshagiri Rao,M.L.A., Bapatla, who sponsored Construction of
Kalyana Mandapam at Bapatla, was informed on 26.2.1996 about the
decision of the Specified Authority. Thereupon, Sri M. Seshagiri
Rao, M.L.A., Bapatla filed a Writ Petition No:6992/96 in the
High Court of Andhra Pradesh questioning the action of T.T.D.,in
rejecting the request for Construction of Kalyana Mandapam at
Bapatla. The Hon'ble High Court of Andhra Pradesh, Hyderabad
made the following order on 24.9.1997 on the writ filed by the
sponsor, in W.P.No.6992 of 1996 :
" The Petitioner could be permitted to make a fresh
representation before the T.T.D. Trust Board which has now been
constituted and on such representation being made by the
petitioner seeking permission to construct T.T.D. Kalyana
Mandapam in Bapatla Town, in the back ground of the petitioner
coming forward to give the land to an extent of Ac. 1.00 and also
Rs.5.00 lakhs from the Bapatla Constituency Development Scheme,
it would be appropriate that T.T.D. Trust Board take a positive
decision in favour of the petitioner's request. It is desired
that the T.T.D.Trust Board shall take a decision as indicated
above within a period of two months from the date of petitioner
making such a representation as indicated above."
In pursuance of the above High Court Order, the Municipal
Commissioner, Bapatla in his letter dt.6.11.1997 sent a Cheque
for Rs.5.00 lakhs towards contribution for the above work,
enclosing the letter from the sponsor (M.L.A.dt.6.11.1997,
addressed to the Chairman, T.T.D., Tirupati to take a favourable
decision within a period of 2 months as indicated in the court
order.
The contribution fixed for Municipalities having more
than 50,000/- population and area being forward!; is
Rs .5,30,000/- at 20% of the cost of the estimate of the Kalyana
Mandapam of Rs.26.50 lakhs. Accordingly, the Municipal
Commissioner was addressed on 2.1.1998 to pay Rs,30,Q00/towards
balance contribution and also to alienate/register site

of 1 acre, as per the Court Order, but there was no reply from
the Municipal Commissioner, Bapatla.
On the judgment given by the High Court of Andhra
Pradesh, Hyderabad, the T.T.D. filed a Writ Appeal on 24.11.97
aaainst the order of the High Court dt. 24. 9.1997 in
W P No. 6992/96. The Division Bench of the Hon'ble High Court
has "passed the following order dt. 2.2.1998.
" The order of the learned Trial Judge stands modified to
the extent that the representation as directed by the learned
Trial Judge be considered by the T.T.D. Trust Board in
accordance with law within a period for 8 weeks from the date of
their order, having due regard to the existing policies of the
Devasthanams. n
Now, the Commissioner of Bapatla Municipality, Bapatla
in the letter dt. 7.3.1998 has paid the balance contribution of
.Rs.30,000/- in the form of Demand Draft. Now, the total
contribution of Rs.5.3 0 lakhs is received from the Sponsor as
per the guidelines. As regards the site, the Municipal Council,
Bapatla, in their Res.No.226, dt.30.11.95 offered to provide 1
acre of land for the above purpose.
In the light of the Judgment dated 2.2.1998 of the
Division Bench of Andhra Pradesh High Court in W.A.No.59 of
1998, the T.T.D. Board is requested to take a decision to
approve the proposal for Construction of Kalyana Mandapam at
Bapatla, Guntur District in as much as the public contribution
of Rs.5.30 lakhs at 20% of the cost of estimate is received and
the sponsor offered to provide free of cost one acre of
municipal land to T.T.D. for the said purpose.
