90A. [CONDITION ADDED BY STAFF] Supply deliveries, loading; and unloading<br />

P. AIR POLLUTION:<br />

91. If fireplaces are utilized in the development, the Applicant is required to install gas<br />

fireplaces to reduce air pollution and odors. Animal screens must be installed on<br />

92. Contractors shall not cause or permit vehicles to idle for more than 10 minutes when<br />

93. The applicant shall provide and locate two additional fire hydrants to the approval <strong>of</strong> the<br />

Director <strong>of</strong> Code Administration. (Code) (DSUP 2006-0021)<br />

R. HOUSING:<br />

94. [CONDITION AMENDED BY STAFF]<br />

a. The developer shall make a contribution <strong>of</strong> $1.50 per square foot on the first<br />

222,744 gross square feet <strong>of</strong> permitted ("by right") floor area for commercial and<br />

residential rental units ($334,116) and a contribution <strong>of</strong> $2.75 per square foot<br />

on the remaining 327,146 gross floor area <strong>of</strong> the project ($899,651). This<br />

results in a total contribution <strong>of</strong> $1,233,767 payable at certificate <strong>of</strong> occupancy<br />

as defined in (b). and provided the residential portion <strong>of</strong> such floor area is<br />

developed as rental. (The base contribution on the permitted gross floor area <strong>of</strong><br />

condominium development is $2.00 per square foot).<br />

b. The affordable housing contribution shall be paid as follows:<br />

i. At certificates <strong>of</strong> occupancv, the developer shall pay $1 per Sq. ft. <strong>of</strong><br />

all GFA = $549,890.<br />

ii. The balance <strong>of</strong> the contribution ($683,877) will be due upon<br />

determination bv the Citv that the <strong>Landmark</strong>Nan Dorn planning;<br />

area has entered Phase I1 as defined bv the Plan. Pavment <strong>of</strong> the<br />

balance due shall be made at the time <strong>of</strong> the first capital event (sale or<br />

refinancing) followine that determination.
