Title of Rule and Other Identifying Information: The<br />

department of ecology (ecology) proposes to adopt amendments<br />

to certain portions of the sediment management standards<br />

(SMS) regulations, chapter 173-204 WAC. This rule<br />

defines the requirements for managing contaminated sediments<br />

in Washington.<br />

Purpose of the Proposal and Its Anticipated Effects,<br />

Including Any Changes in Existing Rules: SB 5259 was<br />

passed in the 2012 legislative session. The bill allows small<br />

wineries to report annually instead of monthly. Five rules<br />

need to be revised in chapter 314-19 WAC and one rule in<br />

chapter 314-19 WAC needs to be repealed to allow monthly<br />

reporting for small wineries. In addition, two rules in chapter<br />

314-24 WAC need to be revised.<br />

Reasons Supporting Proposal: Current rules need to be<br />

revised for this allowance.<br />
