Failing an administrator certificate exam or electrician<br />

certificate of competency examination.<br />

(((9))) (8) Anyone failing an administrator or electrician<br />

competency examination may retake the examination by<br />

making arrangements with the testing agency and paying the<br />

retesting fee.<br />

(((10))) (9) If the individual makes a failing score, the<br />

individual must wait two weeks before being eligible to<br />

retest.<br />

(((11))) (10) If the individual fails an electrician examination<br />

or a part of an administrator or master electrician<br />

examination three times within a one-year period, the individual<br />

must wait three months to retake the failed portion of<br />

the examination.<br />

(((12))) (11) Anyone failing an electrician competency<br />

examination may continue to work in the electrical trade if<br />

they have a valid electrical training certificate and work<br />

under the direct supervision of a certified journeyman or specialty<br />

electrician in the proper ratio, per RCW 19.28.161.<br />

Cheating on an examination.<br />

(((13))) (12) Anyone found cheating on an examination,<br />

attempting to bribe a proctor or other agent involved in<br />

administering an examination, or using inappropriate materials/equipment<br />

during an examination will be required to wait<br />

at least eleven months before being allowed to reexamine. All<br />

such reexaminations will be administered by the department<br />

in Tumwater, Washington and the candidate will be required<br />

to apply and schedule for the examination with the chief electrical<br />

inspector. The department may also file a civil penalty<br />

action under chapter 19.28 RCW.<br />

Examination confidentiality.<br />

(13) All examination questions are confidential. Examination<br />

candidates and persons who have taken an examination<br />

are not allowed to copy or otherwise make note of or<br />

share examination content, in any manner, outside the individual's<br />

examination environment. Examination candidates<br />

must agree, prior to beginning an examination, to keep all<br />

examination content confidential. The department may also<br />

file a civil penalty action under chapter 19.28 RCW.<br />

AMENDATORY SECTION (Amending WSR 11-12-018,<br />

filed 5/24/11, effective 6/30/11)<br />

WAC 296-46B-970 Continuing education and classroom<br />

education requirements. (1) DEFINITIONS - For purposes<br />

of this section.<br />

(((a))) "Applicant" means the entity submitting an application<br />

for review.<br />

(((b))) "Application" means a submittal made by an<br />

applicant seeking instructor or class approval.<br />

(((c))) "Calendar day" means each day of the week,<br />

including weekends and holidays.<br />

(((d))) "Class" means continuing education or basic<br />

trainee class ((or course)).<br />

(((e) "Contractor" means the entity who has contracted<br />

with the department to review and approve/deny continuing<br />

education classes and instructors.<br />

(f))) "Currently adopted code," for this section means the<br />

code adopted in WAC 296-46B-010(1) or any more recently<br />

published National Electric Code.<br />

"Date of notification" means the date of a request for<br />

additional information from the ((contractor)) department or<br />

the approval/denial letter sent to the applicant by the ((contractor))<br />

department.<br />

(((g))) "Examination" is any examination required by<br />

this section. Each examination must be unique and must provide<br />

randomized questions, except for classroom training.<br />

Each examination question bank must be at least two times<br />

larger than the number of questions in any individual examination.<br />

Examinations must not direct or point the individual<br />

to a correct answer or reference. Individuals must be responsible<br />

to determine the correct answer without the assistance<br />

of the sponsor. No more than twenty percent of an examination's<br />

questions may have a true/false answer. Competency is<br />

demonstrated by scoring at least seventy-five percent on the<br />

examination.<br />

"Individual" means ((an)) a master electrician, administrator<br />

or electrician seeking credit for continuing education or<br />

a trainee seeking credit for basic trainee class for renewal or<br />

certification.<br />

(((h))) "Instructor" means an individual who is authorized<br />

to instruct an approved continuing education or basic<br />

trainee class.<br />

(((i))) "Working day" means Monday through Friday,<br />

excluding state of Washington holidays.<br />

(2) GENERAL.<br />

(a) The department and the electrical board have the<br />

right to monitor all approved classes without notice and at no<br />

charge.<br />

If the department or electrical board determines that the<br />

class or instructor does not meet or exceed the minimum<br />

requirements for approval ((or)), course length, or instructor<br />

qualifications, the department may revoke the class and/or<br />

instructor approval and/or reduce the number of credited<br />

hours for the class.<br />
