SECTION 39. Coordination between establishments and the Treatment
Facility. The aforementioned establishments shall closely coordinate with the authorized
personnel of the treatment facility in the collection, transport, storage and treatment of said
medical and health care wastes.
SECTION 40. Penalty. Violation of this Ordinance shall, upon conviction be meted
the penalty of:
a. 1st Offense - a fine of FIVE THOUSAND PESOS (P5, 000.00) to be paid by the
owner or manager of the establishment and the closure of the said business
establishment concerned until such time that the responsible officers of the said
establishment complies herewith.
b. 2nd Offense - a fine of FIVE THOUSAND PESOS (P5,000.00) and imprisonment
of One (1) month to be paid by the owner or manager of the establishment and the
closure of the said business establishment concerned until such time that the
responsible officers of the said establishment complies herewith.
c. 3rd and succeeding Offense - a fine of FIVE THOUSAND PESOS (P5, 000.00)
and imprisonment of Six (6) months to One (1) year upon the discretion of the
court to be paid by the owner or manager of the establishment and the closure of
the said business establishment concerned until such time that the responsible
officers of the said establishment complies herewith.
SECTION 41. Repealing Clause. All other Ordinances or parts thereof which are
inconsistent with the provision of this Ordinance are herby repealed, amended and/or
modified accordingly
SECTION 42. Separability Clause. Should any provision of this Ordinance be
declared void by a proper court of law, all the other provisions hereof that are not affected
by such declaration shall continue to have legal force and effect.
SECTION 43. Effecttvtty. This Ordinance shall take effect fifteen (15) Days upon
publication in two (2) newspapers of local circulation.
