SECTION 39. Coordination between establishments and the Treatment<br />
Facility. The aforementioned establishments shall closely coordinate with the authorized<br />
personnel of the treatment facility in the collection, transport, storage and treatment of said<br />
medical and health care wastes.<br />
SECTION 40. Penalty. Violation of this <strong>Ordinance</strong> shall, upon conviction be meted<br />
the penalty of:<br />
a. 1st Offense - a fine of FIVE THOUSAND PESOS (P5, 000.00) to be paid by the<br />
owner or manager of the establishment and the closure of the said business<br />
establishment concerned until such time that the responsible officers of the said<br />
establishment complies herewith.<br />
b. 2nd Offense - a fine of FIVE THOUSAND PESOS (P5,000.00) and imprisonment<br />
of One (1) month to be paid by the owner or manager of the establishment and the<br />
closure of the said business establishment concerned until such time that the<br />
responsible officers of the said establishment complies herewith.<br />
c. 3rd and succeeding Offense - a fine of FIVE THOUSAND PESOS (P5, 000.00)<br />
and imprisonment of Six (6) months to One (1) year upon the discretion of the<br />
court to be paid by the owner or manager of the establishment and the closure of<br />
the said business establishment concerned until such time that the responsible<br />
officers of the said establishment complies herewith.<br />
SECTION 41. Repealing Clause. All other <strong>Ordinance</strong>s or parts thereof which are<br />
inconsistent with the provision of this <strong>Ordinance</strong> are herby repealed, amended and/or<br />
modified accordingly<br />
SECTION 42. Separability Clause. Should any provision of this <strong>Ordinance</strong> be<br />
declared void by a proper court of law, all the other provisions hereof that are not affected<br />
by such declaration shall continue to have legal force and effect.<br />
SECTION 43. Effecttvtty. This <strong>Ordinance</strong> shall take effect fifteen (15) Days upon<br />
publication in two (2) newspapers of local circulation.<br />
