This is a petition for mandamus, seeking to <strong>com</strong>pel the West <strong>Chicago</strong><br />
Park Commissioners to reinstate the relator, a policeman, who was<br />
discharged by the Civil Service Board in April, 1913, before the present<br />
administration of the West <strong>Chicago</strong> Park Commissioners. The petition<br />
attacks the constitutionality of the Civil Service Act and has caused w!despread<br />
interest. A demurrer has been interposed to this petition for<br />
mandamus.<br />
The attorney for the Board has appeared twice before Judge Goodwin;<br />
each time, however, ·the argument upon the demurrer has been<br />
continued on the motion of the petitioner. It is now set for argument<br />
January 24, 1914.<br />
It is respectfully re<strong>com</strong>mended that the duties involved in the position<br />
of Law, Contract and Special Assessment Clerk are merely the duties<br />
of an assistant to the attorney for the Board; that the office was created<br />
for the purpose of establishing a Civil Service position for an assistant<br />
to the attorney for the Board and thereby to prevent your Honorable<br />
Board from filling said position with an assistant to the attorney of your<br />
own choice as provided by the statute. The purpose of the statute was to<br />
leave unembarrassed the legal work of your Honorable Board, which<br />
covers a mUltiplicity of cases involving many and varied questions and<br />
matters. This work naturally requires each administration to have<br />
attorneys of its own choosing.<br />
It is therefore respectfully re<strong>com</strong>mended that the position of Law.<br />
Contract and Special Assessment Clerk be abolished.<br />
In this connection, it is a pleasure to <strong>report</strong> that the emergent work<br />
performed by Mr. Myer Gladstone, as an assistant to the department, has<br />
been distinguished by care, ability and attention to duty. It is therefore<br />
respectfully re<strong>com</strong>mended that your Honorable Board employ Mr. Myer<br />
Gladstone as assistant to the attorney for the ensuing year.<br />
The work of indexing all of the ordinances and resolutions has been<br />
found necessary and has been <strong>com</strong>menced. This will be the beginning<br />
of a <strong>com</strong>plete and formal <strong>com</strong>pilation of the ordinances and resolutions<br />
of the West <strong>Chicago</strong> Park Commissioners, which is necessary to the<br />
proper prosecution of the work of the Board, its officers and servants.<br />
