This is a petition for mandamus, seeking to compel the West Chicago
Park Commissioners to reinstate the relator, a policeman, who was
discharged by the Civil Service Board in April, 1913, before the present
administration of the West Chicago Park Commissioners. The petition
attacks the constitutionality of the Civil Service Act and has caused w!despread
interest. A demurrer has been interposed to this petition for
mandamus.
The attorney for the Board has appeared twice before Judge Goodwin;
each time, however, ·the argument upon the demurrer has been
continued on the motion of the petitioner. It is now set for argument
January 24, 1914.
It is respectfully recommended that the duties involved in the position
of Law, Contract and Special Assessment Clerk are merely the duties
of an assistant to the attorney for the Board; that the office was created
for the purpose of establishing a Civil Service position for an assistant
to the attorney for the Board and thereby to prevent your Honorable
Board from filling said position with an assistant to the attorney of your
own choice as provided by the statute. The purpose of the statute was to
leave unembarrassed the legal work of your Honorable Board, which
covers a mUltiplicity of cases involving many and varied questions and
matters. This work naturally requires each administration to have
attorneys of its own choosing.
It is therefore respectfully recommended that the position of Law.
Contract and Special Assessment Clerk be abolished.
In this connection, it is a pleasure to report that the emergent work
performed by Mr. Myer Gladstone, as an assistant to the department, has
been distinguished by care, ability and attention to duty. It is therefore
respectfully recommended that your Honorable Board employ Mr. Myer
Gladstone as assistant to the attorney for the ensuing year.
The work of indexing all of the ordinances and resolutions has been
found necessary and has been commenced. This will be the beginning
of a complete and formal compilation of the ordinances and resolutions
of the West Chicago Park Commissioners, which is necessary to the
proper prosecution of the work of the Board, its officers and servants.
