from JOBS participation, hours of<br />

required JOBS participation, or<br />

sanctions for noncompliance with JOBS<br />

participation).<br />

(c) Correspond<strong>in</strong>g to <strong>the</strong><br />

<strong>in</strong>consistencies certified by <strong>the</strong><br />

Governor under § 260.75:<br />

(1) We will calculate <strong>the</strong> State’s work<br />

participation rates, by:<br />

(i) Exclud<strong>in</strong>g c<strong>as</strong>es exempted from<br />

participation under <strong>the</strong> demonstration<br />

component and, if applicable,<br />

experimental and control c<strong>as</strong>es not<br />

o<strong>the</strong>rwise exempted, <strong>in</strong> calculat<strong>in</strong>g <strong>the</strong><br />

rate;<br />

(ii) Def<strong>in</strong><strong>in</strong>g work activities <strong>as</strong> def<strong>in</strong>ed<br />

<strong>in</strong> <strong>the</strong> demonstration component <strong>in</strong><br />

determ<strong>in</strong><strong>in</strong>g <strong>the</strong> numerator; and<br />

(iii) Includ<strong>in</strong>g c<strong>as</strong>es meet<strong>in</strong>g <strong>the</strong><br />

required number of hours of<br />

participation <strong>in</strong> work activities <strong>in</strong><br />

accordance with demonstration<br />

component policy, <strong>in</strong> determ<strong>in</strong><strong>in</strong>g <strong>the</strong><br />

numerator.<br />

(2) We will determ<strong>in</strong>e whe<strong>the</strong>r a State<br />

is tak<strong>in</strong>g appropriate sanctions when an<br />

<strong>in</strong>dividual refuses to work b<strong>as</strong>ed on <strong>the</strong><br />

State’s certified waiver policies.<br />

(d) We will use <strong>the</strong> data submitted by<br />

States pursuant to § 265.3 of this chapter<br />

to calculate and make public a State’s<br />

work participation rates under both <strong>the</strong><br />

<strong>TANF</strong> requirements and <strong>the</strong> State’s<br />

alternative waiver requirements.<br />

§ 260.74 How do exist<strong>in</strong>g welfare reform<br />

waivers affect <strong>the</strong> application of <strong>the</strong> <strong>Federal</strong><br />

time-limit provisions?<br />

(a)(1) If a State is implement<strong>in</strong>g a<br />

time-limit component under a waiver,<br />

<strong>in</strong> accordance with this subpart, <strong>the</strong><br />

provisions of section 408(a)(7) of <strong>the</strong> Act<br />

will not apply <strong>in</strong> determ<strong>in</strong><strong>in</strong>g if a<br />

penalty should be imposed, to <strong>the</strong><br />

extent that <strong>the</strong>y are <strong>in</strong>consistent with<br />

<strong>the</strong> waiver.<br />

(2) For <strong>the</strong> purpose of determ<strong>in</strong><strong>in</strong>g if<br />

<strong>the</strong> State’s demonstration h<strong>as</strong> a timelimit<br />

component, <strong>the</strong> waiver list for <strong>the</strong><br />

demonstration must <strong>in</strong>clude provisions<br />

that directly correspond to <strong>the</strong> timelimit<br />

policies enumerated <strong>in</strong> section<br />

408(a)(7) of <strong>the</strong> Act (i.e., address which<br />

<strong>in</strong>dividuals or families are subject to, or<br />

exempt from, term<strong>in</strong>ations of <strong>as</strong>sistance<br />

b<strong>as</strong>ed solely on <strong>the</strong> p<strong>as</strong>sage of time or<br />

who qualifies for extensions to <strong>the</strong> time<br />

limit).<br />

(b)(1) Generally, under an approved<br />

waiver, except <strong>as</strong> provided <strong>in</strong> paragraph<br />

(b)(3) of this section, a State will count,<br />

toward <strong>the</strong> <strong>Federal</strong> five-year limit, all<br />

months for which <strong>the</strong> head-ofhousehold<br />

or spouse of <strong>the</strong> head-ofhousehold<br />

subject to <strong>the</strong> State time limit<br />

receives <strong>as</strong>sistance with <strong>Federal</strong> <strong>TANF</strong><br />

funds, just <strong>as</strong> it would if it did not have<br />

an approved waiver.<br />

(2) The State need not count, toward<br />

<strong>the</strong> <strong>Federal</strong> five-year limit, any months<br />

for which a head-of-household or<br />

spouse of <strong>the</strong> head-of-household<br />

receives <strong>as</strong>sistance with <strong>Federal</strong> <strong>TANF</strong><br />

funds while that <strong>in</strong>dividual is exempt<br />

from <strong>the</strong> State’s time limit under <strong>the</strong><br />

State’s approved waiver.<br />

(3) Where a State h<strong>as</strong> cont<strong>in</strong>ued a<br />

time limit under waivers that only<br />

term<strong>in</strong>ates <strong>as</strong>sistance for adults, <strong>the</strong><br />

State need not count, toward <strong>the</strong> <strong>Federal</strong><br />

five-year limit, any months for which an<br />

adult subject to <strong>the</strong> State time limit<br />

receives <strong>as</strong>sistance with <strong>Federal</strong> <strong>TANF</strong><br />

funds.<br />

(4) The State may cont<strong>in</strong>ue to provide<br />

<strong>as</strong>sistance with <strong>Federal</strong> <strong>TANF</strong> funds for<br />

more than 60 months, without a<br />

numerical limit, to families provided<br />

extensions to <strong>the</strong> State time limit, under<br />

<strong>the</strong> provisions of <strong>the</strong> terms and<br />

conditions of <strong>the</strong> approved waiver.<br />

(c) Correspond<strong>in</strong>g to <strong>the</strong><br />

<strong>in</strong>consistencies certified by <strong>the</strong><br />

Governor under § 260.75, we will<br />

calculate <strong>the</strong> State’s time-limit<br />

exceptions by:<br />

(1) Exclud<strong>in</strong>g, from <strong>the</strong> determ<strong>in</strong>ation<br />

of <strong>the</strong> number of months of <strong>Federal</strong><br />

<strong>as</strong>sistance received by a family:<br />

(i) Any month <strong>in</strong> which <strong>the</strong> adult(s)<br />

were exempt from <strong>the</strong> State’s time limit<br />

under <strong>the</strong> terms of an approved waiver<br />

or any months <strong>in</strong> which <strong>the</strong> children<br />

received <strong>as</strong>sistance under a waiver that<br />

only term<strong>in</strong>ated <strong>as</strong>sistance to adults;<br />

and<br />

(ii) If applicable, experimental and<br />

control group c<strong>as</strong>es not o<strong>the</strong>rwise<br />

exempted; and<br />

(2) Apply<strong>in</strong>g <strong>the</strong> State’s waiver<br />

policies with respect to <strong>the</strong> availability<br />

of extensions to <strong>the</strong> time limit.<br />

§ 260.75 If a State is claim<strong>in</strong>g a waiver<br />

<strong>in</strong>consistency for work requirements or<br />

time limits, what must <strong>the</strong> Governor certify?<br />

(a) The Governor of <strong>the</strong> State must<br />

certify <strong>in</strong> writ<strong>in</strong>g to <strong>the</strong> Secretary that:<br />

(1) The applicable policies have been<br />

cont<strong>in</strong>ually applied <strong>in</strong> operat<strong>in</strong>g <strong>the</strong><br />

<strong>TANF</strong> program, <strong>as</strong> described <strong>in</strong><br />

§ 260.72(c);<br />

(2) The <strong>in</strong>consistencies claimed by <strong>the</strong><br />

State are with<strong>in</strong> <strong>the</strong> scope of <strong>the</strong><br />

approved waivers, <strong>as</strong> described <strong>in</strong><br />

§ 260.72(b);<br />

(b) The certification must identify <strong>the</strong><br />

specific <strong>in</strong>consistencies that <strong>the</strong> State<br />

chooses to cont<strong>in</strong>ue with respect to<br />

work and time limits.<br />

(1) If <strong>the</strong> waiver <strong>in</strong>consistency claim<br />

<strong>in</strong>cludes work provisions, <strong>the</strong><br />

certification must specify <strong>the</strong> standards<br />

that will apply, <strong>in</strong> lieu of <strong>the</strong> provisions<br />

<strong>in</strong> subparts B and C of part 261 of this<br />

chapter, to determ<strong>in</strong>e:<br />

(i) The number of two-parent and allparent<br />

c<strong>as</strong>es that are exempt from<br />

participation, if any, for <strong>the</strong> purpose of<br />

determ<strong>in</strong><strong>in</strong>g <strong>the</strong> denom<strong>in</strong>ator of <strong>the</strong><br />

work participation rate;<br />

(ii) The number of nonexempt twoparent<br />

and all-parent c<strong>as</strong>es that are<br />

participat<strong>in</strong>g <strong>in</strong> work activities for <strong>the</strong><br />

purpose of determ<strong>in</strong><strong>in</strong>g <strong>the</strong> numerator<br />

of <strong>the</strong> work participation rate, <strong>in</strong>clud<strong>in</strong>g<br />

standards applicable to;<br />

(A) Countable work activities; and<br />

(B) Required hours of work for<br />

participation for <strong>in</strong>dividual participants;<br />

and<br />

(iii) The penalty aga<strong>in</strong>st an <strong>in</strong>dividual<br />

or family when an <strong>in</strong>dividual refuses to<br />

work.<br />

(2) If <strong>the</strong> waiver <strong>in</strong>consistency claim<br />

<strong>in</strong>cludes time-limit provisions, <strong>the</strong><br />

certification must <strong>in</strong>clude <strong>the</strong> standards<br />

that will apply, <strong>in</strong> lieu of <strong>the</strong> provisions<br />

<strong>in</strong> § 264.1 of this chapter, <strong>in</strong><br />

determ<strong>in</strong><strong>in</strong>g:<br />

(i) Which families are counted toward<br />

<strong>the</strong> <strong>Federal</strong> time limit; and<br />

(ii) Whe<strong>the</strong>r a family is eligible for an<br />

extension of its time limit on federally<br />

funded <strong>as</strong>sistance.<br />

(3) If <strong>the</strong> State is cont<strong>in</strong>u<strong>in</strong>g policies<br />

for evaluation purposes <strong>in</strong> accordance<br />

with § 260.76:<br />

(i) The certification must specify any<br />

special work or time-limit standards<br />

that apply to <strong>the</strong> control group and<br />

experimental group c<strong>as</strong>es; and<br />

(ii) The State may choose to exclude<br />

c<strong>as</strong>es <strong>as</strong>signed to <strong>the</strong> experimental and<br />

control groups, which are not o<strong>the</strong>rwise<br />

exempt, for <strong>the</strong> purpose of calculat<strong>in</strong>g<br />

<strong>the</strong> work participation rate or<br />

determ<strong>in</strong><strong>in</strong>g State compliance related to<br />

limit<strong>in</strong>g <strong>as</strong>sistance to families <strong>in</strong>clud<strong>in</strong>g<br />

adults who have received 60 months of<br />

<strong>Federal</strong> <strong>TANF</strong> <strong>as</strong>sistance. In do<strong>in</strong>g so,<br />

<strong>the</strong> State may effectively exclude all<br />

experimental group c<strong>as</strong>es and/or control<br />

group c<strong>as</strong>es, not o<strong>the</strong>rwise exempt, but<br />

may not exclude <strong>in</strong>dividual c<strong>as</strong>es on a<br />

selective b<strong>as</strong>is.<br />

(c) The certification may <strong>in</strong>clude a<br />

claim of <strong>in</strong>consistency with respect to<br />

hours of required participation <strong>in</strong> work<br />

activities only if <strong>the</strong> State h<strong>as</strong> written<br />

evidence that, when implemented, <strong>the</strong><br />

waiver policies established specific<br />

requirements related to hours of work<br />

for nonexempt <strong>in</strong>dividuals.<br />

(d)(1) The Governor’s certification<br />

must be provided no later than October<br />

1, <strong>1999</strong>.<br />

(2) If a State modifies its waiver<br />

policies <strong>in</strong> a way that h<strong>as</strong> a substantive<br />

effect on <strong>the</strong> determ<strong>in</strong>ation of its work<br />

sanctions, or <strong>the</strong> calculation of its work<br />

participation rates or its time-limit<br />

exceptions, it must submit an amended<br />

certification no later than <strong>the</strong> end of <strong>the</strong><br />

fiscal quarter <strong>in</strong> which <strong>the</strong><br />

modifications take effect.
