Dr. Boswell was certified by the American <strong>Board</strong> <strong>of</strong> Anesthesiology in 1988, and he<br />
obtained subspecialty certification in pain medicine from the same board in 1993. Further,<br />
in 1995, Dr. Boswell was certified by the American <strong>Board</strong> <strong>of</strong> Pain Medicine, for which he<br />
recertified in 2004. Finally, in 2005, Dr. Boswell became a Fellow in Interventional Pain<br />
Practice. (St. Ex. 46)<br />
Dr. Boswell testified that he is licensed to practice medicine in <strong>Ohio</strong>, Texas, Oregon, and<br />
Arizona. (Tr. at 17)<br />
31. Since 1988, Dr. Boswell has held academic appointments. These include academic<br />
appointments at CWRU and University Hospitals <strong>of</strong> Cleveland from 1990 through 2005. In<br />
1990, Dr. Boswell joined the faculty as an Assistant Pr<strong>of</strong>essor and Chief <strong>of</strong> the Pain<br />
Medicine Service in the Department <strong>of</strong> Anesthesiology. Further, in 1996, he obtained<br />
appointments as Associate Pr<strong>of</strong>essor in the Department <strong>of</strong> Anesthesiology and Director <strong>of</strong><br />
the Pain Medicine Fellowship. In 2005, Dr. Boswell left CWRU and University Hospitals<br />
<strong>of</strong> Cleveland for Texas Tech University Health Sciences Center in Lubbock, Texas. At the<br />
time <strong>of</strong> the hearing, Dr. Boswell was Pr<strong>of</strong>essor and Chair <strong>of</strong> the Department <strong>of</strong><br />
Anesthesiology and Director <strong>of</strong> the Messer Racz Pain Center at that institution. (St. Ex. 46)<br />
32. Dr. Boswell testified concerning the interventional pain management program at Texas<br />
Tech University. Dr. Boswell testified that the founding chairman <strong>of</strong> the Department <strong>of</strong><br />
Anesthesiology at Texas Tech had been Gabor Racz, M.D. Dr. Boswell testified that<br />
Dr. Racz “was the founding chairman, I believe, in about 1977, and he was a pioneer in<br />
pain medicine and anesthesiology.” Dr. Boswell further testified:<br />

[Dr. Racz] was involved in, as far as I could tell, in the same pain medicine<br />
community that ultimately founded the American <strong>Board</strong> <strong>of</strong> Pain Medicine,<br />
was involved with that group and with Dr. Leak as well. * * * [Dr.] Racz<br />
developed a well recognized pain medicine program at Texas Tech, lectured<br />
widely * * * and developed an international following with the program.<br />
33. Dr. Boswell testified that the pain medicine program at Texas Tech is one <strong>of</strong> the top ten<br />
pain medicine programs in the country. (Tr. at 38)<br />
Subspecialty Certification in Pain Medicine<br />
34. Three ABMS-member certifying boards <strong>of</strong>fer subspecialty certification in pain medicine:<br />
the American <strong>Board</strong> <strong>of</strong> Anesthesiology, the American <strong>Board</strong> <strong>of</strong> Psychiatry and Neurology,<br />
and the American <strong>Board</strong> <strong>of</strong> Physical Medicine and Rehabilitation. However, Dr. Chelimsky<br />
testified that the same certifying examination is used by each board. (Tr. at 1536-1537)
