Citation to the Statute Creating the Organization and to other Statutes Governing or Administered by<br />
the Organization; Citation to the Administrative Rules Adopted by the Organization<br />
Certain sections <strong>of</strong> statutes apply to all state agencies and are not listed here. The following chapters and<br />
sections <strong>of</strong> statutes create the duties and powers <strong>of</strong> the <strong>Board</strong> <strong>of</strong> <strong>Pharmacy</strong> and/or are administered by the<br />
<strong>Board</strong>.<br />
1. <strong>Minnesota</strong> Statutes Chapter 151 is the primary chapter that creates the <strong>Board</strong> and that the <strong>Board</strong><br />
administers.<br />
2. <strong>Minnesota</strong> Statutes Chapter 214 contains provisions that apply to all health licensing boards, including<br />
the <strong>Board</strong> <strong>of</strong> <strong>Pharmacy</strong>.<br />
3. <strong>Minnesota</strong> Statutes Chapter 152 is the state’s Controlled Substances Act. Some <strong>of</strong> the <strong>Board</strong>’s powers<br />
and duties derive from portions <strong>of</strong> this chapter.<br />
4. <strong>Minnesota</strong> Statutes §609B.130 contains provisions relating to certain disciplinary actions and references<br />
back to Section 151.06.<br />
5. <strong>Minnesota</strong> Statutes Chapter 319B contains provisions relating to pr<strong>of</strong>essional firms <strong>of</strong> which the <strong>Board</strong><br />
must be cognizant.<br />
6. <strong>Minnesota</strong> Statutes §299A.297 requires the Commissioner <strong>of</strong> Public Safety to “provide information and<br />
assistance upon request to the <strong>State</strong> <strong>Board</strong> <strong>of</strong> <strong>Pharmacy</strong> with respect to the board’s enforcement <strong>of</strong><br />
chapter 152”.<br />
7. A number <strong>of</strong> other sections <strong>of</strong> statutes reference the <strong>Board</strong> but they are not administered by the <strong>Board</strong>,<br />
nor do they govern the <strong>Board</strong>. (e.g. – there are sections that define controlled substances as those that are<br />
either listed in Chapter 152 <strong>of</strong> the statutes or that are listed in the rules promulgated by the <strong>Board</strong> in<br />
Chapter 6800).<br />
The rules promulgated by the <strong>Board</strong> <strong>of</strong> <strong>Pharmacy</strong> are found in <strong>Minnesota</strong> Rules Chapter 6800.<br />
