D. Any proposed use or structure which has been included in an approved tentative plan<br />
must be approved by the Commissi<strong>on</strong> or at its discreti<strong>on</strong>, the <strong>Guam</strong> Chief Planner, before<br />
issuance of any building permits.<br />
E. A performance b<strong>on</strong>d or undertaking shall be required for any development undertaken<br />
pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> an approved tentative plan within an “H” Z<strong>on</strong>e as otherwise provided in the<br />
regulati<strong>on</strong>s. The amount of the b<strong>on</strong>d shall be One Hundred and Ten Percent (110%) of<br />
the infrastructure costs of the project, and not less than Two Thousand Dollars ($2,000).<br />
The entire b<strong>on</strong>d or any undertaking of any porti<strong>on</strong> thereof shall be forfeited as determined<br />
by the Commissi<strong>on</strong> or failure <str<strong>on</strong>g>to</str<strong>on</strong>g> comply with any applicable land use, water quality, or<br />
z<strong>on</strong>ing regulati<strong>on</strong> except as allowed for under prior granting of a variance or other legal<br />
excepti<strong>on</strong> from such requirement: including, but not limited <str<strong>on</strong>g>to</str<strong>on</strong>g>, erosi<strong>on</strong> and grading<br />
standards, landscaping, height and setback requirements, the tentative development plan<br />
as approved by the Commissi<strong>on</strong> and any applicable z<strong>on</strong>e regulati<strong>on</strong>s. The entire b<strong>on</strong>d or<br />
any porti<strong>on</strong> thereof shall be forfeited as is required <str<strong>on</strong>g>to</str<strong>on</strong>g> complete the site preparati<strong>on</strong> and<br />
infrastructure features of the project should these not be completed by the developer.<br />
F. The Commissi<strong>on</strong> shall approve a maximum time period within which all of the<br />
improvements authorized in the tentative development plan shall be completed. The time<br />
period shall be no less than six m<strong>on</strong>ths, and no more than four years. The time period<br />
shall be based <strong>on</strong> the size, character, and complexity of the authorized improvements.<br />
The Commissi<strong>on</strong> may, for good cause shown, grant any extensi<strong>on</strong> of time.<br />
G. Up<strong>on</strong> completi<strong>on</strong> or any porti<strong>on</strong> of the project in accordance with the tentative plan,<br />
the Department of Public Works shall certify <str<strong>on</strong>g>to</str<strong>on</strong>g> the Commissi<strong>on</strong> that the project has<br />
been completed in accordance with the tentative plan.<br />
H. <str<strong>on</strong>g>Requirements</str<strong>on</strong>g> or preparati<strong>on</strong> of tentative development plans and posting of<br />
performance b<strong>on</strong>ds as outlined in this secti<strong>on</strong> shall not apply <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> of singlefamily<br />
dwellings in that area in Tum<strong>on</strong> z<strong>on</strong>ed “H” under Public Law 14-41, as amended.<br />
