The Corps‟ permit review process includes reviews by interested local agencies and<br />
organizati<strong>on</strong>s and may involve a public hearing. The ACOE will not issue a permit until<br />
all applicable Terri<str<strong>on</strong>g>to</str<strong>on</strong>g>rial regulati<strong>on</strong>s have been satisfied. In some cases, however, the<br />
ACOE may issue “provisi<strong>on</strong>al” permits before required local approvals such as the CZM<br />
c<strong>on</strong>sistency statement or Secti<strong>on</strong> 401 Water Quality Certificati<strong>on</strong> have been issued.<br />
These “provisi<strong>on</strong>al” permits make it clear that the permit is not valid until these approvals<br />
have been issued or waived. Review time may be reduced by simultaneous processing. If<br />
there are no objecti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed activity, a permit may be issued within 3 m<strong>on</strong>ths<br />
after completed applicati<strong>on</strong> is submitted unless the project meets the requirements of a<br />
nati<strong>on</strong>wide permit in which case final acti<strong>on</strong> <strong>on</strong> processing normally takes two weeks.<br />
The permit is $10 for n<strong>on</strong>-commercial uses and $100 for commercial and industrial uses.<br />
Copies of Permit Applicati<strong>on</strong> Forms are reproduced as ACOE-1. Nati<strong>on</strong>al Wetlands<br />
Inven<str<strong>on</strong>g>to</str<strong>on</strong>g>ry Maps of areas over which the ACOE exercises permit jurisdicti<strong>on</strong> are available<br />
for review at the local ACOE office; however, these maps are <strong>on</strong>ly useful as general<br />
guide and are not a reliable way <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure wetlands are not <strong>on</strong> a particular site. The <strong>on</strong>ly<br />
way <str<strong>on</strong>g>to</str<strong>on</strong>g> be sure if there are wetlands <strong>on</strong> site is for a qualified wetland delinea<str<strong>on</strong>g>to</str<strong>on</strong>g>r <str<strong>on</strong>g>to</str<strong>on</strong>g> inspect<br />
the entire site.<br />
Violati<strong>on</strong>s of pertinent laws may result in the following penalties: removal of materials<br />
followed by res<str<strong>on</strong>g>to</str<strong>on</strong>g>rati<strong>on</strong>; fines from $500 <str<strong>on</strong>g>to</str<strong>on</strong>g> $5,000 per day; fines for unpermitted<br />
work can be as high as $25,000 per day; and/or impris<strong>on</strong>ment for up <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>on</strong>e year.<br />
