considered acceptable.<br />
11. AL<strong>TO</strong>ONA TESTING REQUIREMENTS<br />
If the Federal Transit Administration requires testing at the Altoona Bus Testing Facility<br />
for the category <strong>of</strong> vehicle being purchased, documentation certifying that said testing<br />
has been completed and a copy <strong>of</strong> the test results shall be forwarded to the MTA<br />
Procurement operations prior to contract award.<br />
12. FTA DBE REQUIREMENTS<br />
The Federal Transit Administration requires that each bidder supply a copy <strong>of</strong> their<br />
approval or certification from the FTA concerning their DBE goals.<br />
13. RIDER CLAUSE<br />
Pursuant to Article 41, Section 18-201 <strong>of</strong> the Annotated Code <strong>of</strong> Maryland, except as<br />
provided in (B) the following entities may purchase materials, supplies and equipment<br />
under this contract:<br />
1. A county or Baltimore City<br />
2. A municipal corporation<br />
3. A government agency in the State <strong>of</strong> Maryland<br />
4. A public or quasi-public agency that receives State money and is exempt from<br />
taxation under Section 501 (C) (3) <strong>of</strong> the Internal Revenue Code.<br />
5. A private element or secondary school that either has been issued a certificate or<br />
approval from the State Board <strong>of</strong> Education or is accredited by the Association <strong>of</strong><br />
Independent Schools and/or<br />
6. A nonpublic institution <strong>of</strong> higher education under Section 17-106 <strong>of</strong> the<br />
Education Article<br />
The contractor shall extend to any or all <strong>of</strong> the transit systems, or non-pr<strong>of</strong>it agencies<br />
operating human service transportation in the State <strong>of</strong> Maryland the right to directly<br />
purchase buses from the Contractor in accordance with the rates and terms <strong>of</strong> this<br />
contract with the consent <strong>of</strong> the MTA.<br />
1. Any participating transit system in the State <strong>of</strong> Maryland that utilizes this Rider<br />
Clause will place their orders directly with the Contractor, however, there shall be<br />
no obligation on the part <strong>of</strong> any participating transit system to utilize this rider<br />
clause.<br />
2. It is the Contractor’s responsibility to notify the participating transit systems <strong>of</strong><br />
the availability <strong>of</strong> the contract rates and terms that are available through this rider<br />
clause.<br />
