ARTICLE 29 - DISCIPLINE<br />
The imposition of discipline without just cause by the <strong>Division</strong> or any agent thereof in the<br />
form of written warning(s) and/or suspension(s) with or without pay shall be subject to<br />
the following provisions:<br />
(1) Where the <strong>Division</strong> or person(s) acting on behalf of the <strong>Division</strong> so disciplines<br />
any person covered by this Collective Agreement and where the affected person<br />
is not satisfied that the discipline is for just cause, the <strong>Division</strong>’s action shall be<br />
deemed to be a difference between the parties to or persons bound by this<br />
Collective Agreement under Article 5 – Provisions for Settlement of Disputes.<br />
(2) When such a difference is referred to a Board of Arbitration under Article 5, the<br />
Board of Arbitration shall have the power to:<br />
(a) uphold the discipline;<br />
(b) rescind the discipline;<br />
(c) vary or modify the discipline;<br />
(d) order the Board to pay all or part of any loss of pay and/or benefits in<br />
respect of the discipline;<br />
(e) do one or more of the things set out in sub-clause (a), (b), (c) and (d)<br />
above.<br />
(3) The written warning(s) shall not include Performance Assessment and<br />
Development done pursuant to the Supervision for Growth Plan and any<br />
regulations and amendments thereto (hereinafter referred to as the policy), except<br />
where the implementation of said policy against a person covered by this<br />
Collective Agreement is for the purpose of disciplining said person.<br />
(4) The Association agrees that the <strong>Division</strong> has the right to suspend an employee<br />
with or without pay for just cause.<br />
ARTICLE 30 - TRANSFER<br />
30.01 The <strong>Division</strong> shall exercise its discretion to transfer in a manner which is fair and<br />
reasonable. The <strong>Division</strong> shall, wherever possible, consult with teachers who are<br />
being involuntarily transferred prior to making a final decision.<br />
30.02 Notification of any proposed transfer shall be communicated by registered letter<br />
to the teacher concerned and include the proposed date of transfer and location to<br />
which the teacher is to be transferred.<br />
30.03 Notification of transfer, to be effective the next school year, must be<br />
communicated to the teacher concerned as outlined in 30.01 on or before May<br />
15 th . Such transfer to be effective the first day of the fall term following.<br />
30.04 Transfers within the <strong>Division</strong> at any other time as mentioned in.30.02 shall be by<br />
mutual consent.<br />
