The <strong>University</strong><strong>of</strong> <strong>California</strong> <strong>Davis</strong> requests a temporary <str<strong>on</strong>g>variance</str<strong>on</strong>g> from Title 8, <strong>California</strong> Code <strong>of</strong><br />

Regulati<strong>on</strong>s, §5154.1 (e)(3)(A), as allowed under the <strong>California</strong> Labor Code. Title 8, §5154.1<br />

(e)(3)(A) requires all laboratory <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s, by Jauary 1, 2008, be equipped with a quantitative<br />

airflow m<strong>on</strong>itor that c<strong>on</strong>tinuously indicates whether air is flowing into the exhaust system during<br />

operati<strong>on</strong>. Due to c<strong>on</strong>straints and challenges scheduling the installati<strong>on</strong> c<strong>on</strong>tractor and coordinating<br />

the installati<strong>on</strong> <strong>of</strong> the m<strong>on</strong>itors with class schedules and active research occurring in <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s, the<br />

<strong>University</strong> <strong>of</strong> <strong>California</strong> <strong>Davis</strong> hereby requests an effective date <strong>of</strong> October 1, 2008 for the<br />

installati<strong>on</strong> <strong>of</strong> the quantitative flow m<strong>on</strong>itors <strong>on</strong> all required laboratory <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s at the <strong>University</strong><br />

<strong>of</strong> <strong>California</strong> <strong>Davis</strong>. Costs for compliance with this new regulatory requirement will be in excess <strong>of</strong><br />

$100,000.<br />

Existing Inventory and Progress to Date:<br />

The opti<strong>on</strong>s for m<strong>on</strong>itors have been reviewed and, in cooperati<strong>on</strong> with Envir<strong>on</strong>mental Health and<br />

Safety and Facilities Management pers<strong>on</strong>nel, the optimal m<strong>on</strong>itor to be installed identified. UC<br />

<strong>Davis</strong> currently has a total <strong>of</strong> 1600 laboratory <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s. All <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s requiring m<strong>on</strong>itors will<br />

be identified by February 15, 2008 and installati<strong>on</strong> <strong>of</strong> the first 60 or so m<strong>on</strong>itors completed. As <strong>of</strong><br />

January 1, 2008, buildings in the campus “core” have been surveyed with 254 <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s requiring<br />

m<strong>on</strong>itors identified. Surveys <strong>of</strong> outlying buildings c<strong>on</strong>tinues.<br />

Compliance Schedule:<br />

The <strong>University</strong> <strong>of</strong> <strong>California</strong> <strong>Davis</strong> proposes the following compliance schedule for the installati<strong>on</strong><br />

<strong>of</strong> the quanitative flow m<strong>on</strong>itors <strong>on</strong> laboratory <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s:<br />

• By January 1, 2008 a c<strong>on</strong>tractor engaged to effect installati<strong>on</strong> and the first 100 m<strong>on</strong>itors<br />

ordered.<br />

• By February 15, 2008, have all <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s that require a m<strong>on</strong>itor identified.<br />

• By May 15, 2008, a minimum <strong>of</strong> 75% <strong>of</strong> the m<strong>on</strong>itors will be installed.<br />

• By October 1, 2008, the remaining 25% <strong>of</strong> the m<strong>on</strong>itors will be installed.


This schedule assumes the m<strong>on</strong>itor manufacturer can meet demand and provide m<strong>on</strong>itors to UC<br />

<strong>Davis</strong> in a timely manner.<br />

Employee Notificati<strong>on</strong>:<br />

As required by the <strong>California</strong> Labor Code, the <strong>University</strong> <strong>of</strong> <strong>California</strong> <strong>Davis</strong> certifies employees<br />

have been notified regarding this applicati<strong>on</strong> for a temporary <str<strong>on</strong>g>variance</str<strong>on</strong>g> and <strong>of</strong> the employees’ right to<br />

petiti<strong>on</strong> the Divisi<strong>on</strong> <strong>of</strong> Occupati<strong>on</strong>al Safety and Health for a hearing regarding this temporary<br />

<str<strong>on</strong>g>variance</str<strong>on</strong>g>. The <str<strong>on</strong>g>variance</str<strong>on</strong>g> was distributed through our Department Safety Coordinators and posted <strong>on</strong><br />

our Envir<strong>on</strong>mental Health & Safety website. Safety Coordinators were requested to distribute the<br />

<str<strong>on</strong>g>variance</str<strong>on</strong>g> to their departments and post the <str<strong>on</strong>g>variance</str<strong>on</strong>g> request in a public locati<strong>on</strong>.<br />

Qualitative m<strong>on</strong>itors remain in place <strong>on</strong> all <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g>s requiring m<strong>on</strong>itors not yet installed. End<br />

users, as part <strong>of</strong> the UC <strong>Davis</strong> Injury and Illness Preventi<strong>on</strong> Program and Laboratory Standard, are<br />

trained <strong>on</strong> what to do if the end user suspects the <str<strong>on</strong>g>hood</str<strong>on</strong>g> is not operating properly.<br />

In c<strong>on</strong>clusi<strong>on</strong>, the <strong>University</strong> <strong>of</strong> <strong>California</strong> <strong>Davis</strong> requests the Divisi<strong>on</strong> <strong>of</strong> Occupati<strong>on</strong>al Safety and<br />

Health grant a temporary <str<strong>on</strong>g>variance</str<strong>on</strong>g> from Title 8, <strong>California</strong> Code <strong>of</strong> Regulati<strong>on</strong>s, §5154.1 (e)(3)(A)<br />

until October 1, 2008 to allow for completi<strong>on</strong> <strong>of</strong> quantitative <str<strong>on</strong>g>fume</str<strong>on</strong>g> <str<strong>on</strong>g>hood</str<strong>on</strong>g> m<strong>on</strong>itor installati<strong>on</strong>.<br />
