SPECIAL CONDITION<br />

1. Tenderers must examine the site and the various aspect likely to affect the construction and cost and<br />

then quote with full knowledge of site conditions.<br />

2. The work must be carried out strictly as per P.W.D.& M.O.S.T., specification.<br />

3. All rates quoted on the tender should be for completed job including all carriage royalty, Sales tax,<br />

income tax and other taxes, the payment of which will be whole responsibility of the contractor.<br />

4 Rules laid down in Motors vehicle Act will have also to be followed if any vehicles are used by the<br />

contractor in Department works.<br />

5. Labour Rules fixed from time to time have also to be followed and quoted rates should include for<br />

all such items.<br />

6. Stone Chips, Stone metal, lime, bricks and jhama should be got approved by the Engineer-incharge<br />

before use. The contractor will have to remove all dust foreign materials and unapproved<br />

materials at his own cost.<br />

7. Tenderers have to made his complete arrangements for all accessories plants and machineries<br />

required for the execution of work.<br />

8. The Contractor shall not be entitled to claim any compensation for the loss suffered by him onaccount<br />

of (i) failure or delay by or on behalf of Govt. In the supply of materials of stores which the<br />

Govt. may have under taken (ii) natural calamities, (iii) transport and procurements difficulties,(iv)<br />

Circumstances beyond the control of Govt.<br />

9. Department materials should be used in works strictly in accordance with the actual requirement<br />

and for any differences the cost will be recovered at panel rates which will be double the issue rate.<br />

The contractor should also maintain proper accounts for such materials and should be in a position<br />

to submit the same when ever required.<br />

10. The Contractor will be full responsibility for watch and award of the materials supplied by or to the<br />

Department and the materials will be open to inspection by the Departmental Officer No claim will<br />

be entertained in the case of theft, damages of materials at site till completion of the work.<br />

11. Contractors has to maintain necessary technical organtsation for proper execution of works and<br />

should employ only such persons who are skilled and experienced in the similar nature of works &<br />

the Executive Engineer shall be at liberty of object and enquire the contractor who in his opinion<br />

mis-conducts him self or is incompetent or neg egent in performacne of his duties and such persons<br />

shall not be employed by the contractor whout permission of the Executive Engineer.<br />

12. No Conditional tender will be accepted.<br />

13 Stone chips & Stone metal as per requirement will have to collected in full quantity in advance and<br />

stacked as per direction of E/I and be verified before consumption in the work.<br />

14. Leveling dressing and clearing of the site will be done after completion of works as per direction of<br />

Engineer-in-Charge.<br />

15. Empty drums and empty cement bags shall be returned by the contractor to the Department in good<br />

condition at P.W.D. Godown at their own cost. In case of loss of empty drums and ampty cement<br />

bags the cost will be recovered from the contractor double rate of schedule rate .<br />

16. The letters sent to the contractor at the address given in the agreement and returned undelivered will<br />

be treated as to have been served.<br />

17. The Contractor invariably in all kinds of works will have to maintain a site order book at his own<br />

cost duly certified by the S.D.O. or Executive Engineer. The site order book should always be kept<br />

at site and should be produced properly when demanded by inspecting officer for loss of the book<br />

the contractor will be wholly responsible.<br />

18. Entries in the site order Book will not be made by any officer les then the rank of S.D.O.,R.C.D.<br />

But the site order book will be the properly of the department.<br />

19. Any addition ordteration in the work must be done under the order of competent authority for which<br />

contractor should get order written on order book duly certified by Gazetted officer of the<br />

Department. the site order book should always be kept at the work sites.<br />

20. Royalty and cess will be recovered from each on account bill in case contractor will fail to produce<br />

royalty clearance certificate at this time of passing of bills.

21. The value of work to be done should not exceed the agreement amount without the proper<br />

permission of the competent authority.<br />

22. Payment will be made subject to the availability of fund.<br />

23. If the contractor supply boulder, stone metal moorum grave, bricks etc from less distance than<br />

those mentioned in the Bill of quantity then their rates will be reduced propopertionately on basis of<br />

the approved rate of the contractor if the contractors are required to supply the materials from<br />

longer distance then prior approval of the officer who has approved the tender shall have to be<br />

obtained.<br />

24. In case of sectional measurement of earth work, the initial long and cross section of existing ground<br />

will be taken by the Departmental officer in presence of the contractor of their authorized agent and<br />

graphs papers will be prepared showing existing ground level and proposed formation level which<br />

with also from part of the agreement the section plotted on graphs will entered in measurement<br />

book and the contractor will have to sign both the graphs sheets and measurement book for taken of<br />

his acceptance before commencement of the work.<br />

25. Earth work in filling be dons in the layers not exceeding 225mm layers. The surface of the unrolled<br />

earth will be made as per designed grads and cross section after breaking the coldness to the<br />

maximum size of 63mm rolling will be done after censuring that the earth to be rolled have<br />

moisture content within the permissible limit of the obtimum moisture content. The subsequent<br />

26. The Item of roller and compection includes the work of breaking the clouds to a maximum to 63<br />

mm, cube and placing the earth in layers not exceeding 225 mm thick and shaping and dressing the<br />

earth in required grades and profile.<br />

27. The decution of sale tax will be made from the contractor bill as per order of Jh<strong>ark</strong>hand Govt. from<br />

time to time (Conlained in Bihar F.D.(Coml. taxes) No.2138 dt.19-1-84 will be binding on the<br />

contractor.)<br />

28. The rate quoted less than 15% of estimated cost including Government materials will not be<br />

entertained & the rate to be quoted after decimal point should but no more than two degists.<br />

29. In case of tender filled by registered firm of company character certificate should be enclosed of all<br />

30. Quantities given in Bill of quantity are subject to variation and no claim of this score will be<br />

entertained.<br />

31. All other terms & conditions contained in vigilance department letter no.1/Est.27/83-2347 T.E.C.,<br />

Patna dt. 31.12.83 will be binding on the contractors.<br />

32. Vide Engr.-in – Chief Memo No. 2553 (E) dt. 4-5-90 the supply of Materials of different sizes and<br />

grated should be stacked at work site with proper size and for which no claim will be entertained.<br />

33. For maintating temperature Every agency must have their own rate thermometer during the<br />

execution of bitumen work.<br />

34. The contractor will be responsible for making good to the Road/Bridge/Culvert repaired by him<br />

of any damage of failure occurs in the road on his own cost up to period<br />

35. Contractor must have to be establish a quality control laboratory at the work site at his own cost.<br />

As per direction of MOST & Quality Control. The Agency will have to submit time to time the<br />

quality control test reports of the materials and the work done with the bill.<br />

36. Payment will be done only after finding Satisfactory test reports of the work done.<br />

37. Agreement for work will be done after acquisition of land for purpose approach road.<br />
