CHAPTER – 1 

1.1 INFORMATIONS FOR SUBMISSION OF TENDER 

1.1.1 Sealed tender on approved quantity to be eventually drawn in P.W.D. form No. F2 will be 

received from experience contractor registered in appropriate category in R.C.D. upto 3pm on 

20-10-2011 the Executive Engineer, Road Construction Department, Road Division 

Latehar/Superintending Engineer, Road Construction Department, Road Circle, 

Daltonganj/Chief Engineer, Road Construction Department, Jharkhand, Ranchi for the work 

mentioned in NIT below and will be opened by the concerned receiving officers or persons duly 

authorized by them on 20-10-2011 at 3.30P.M. in presence of Tenders the authorized agents. 

1.1.2 In case of some reasons or the other tender receiving and opening office is closed on the date of 

receipt of tenders, tenders be received by the said officers on the next working day at the same 

time and in the same manner as mentioned in para 1.1.1 above. 

1.1.3 The clause of the contract form in Para 1.1.1 and Chapter-II of Tender Document (General rules 

of the guidance of tenderer) must be gone through by the tenderer prior to submission of the 

tender. 

1.1.4 The plan, specifications or any other information in connection with the concerned work can be 

seen in the office of the Executive Engineer Road Construction Department, Road Division 

Latehar on any working day during office hours before the date of receipt of tender. 

1.1.5 There may be difference from press notices in estimated cost, amount contract/quantum of work 

to be executed. 

1.2 SALE OF TENDER DOCUMENT (B.O.Q) 

1.2.1 For purchases of tender documents intending tenderer shall submitted an application along with 

attested copies of: 

∗ Contract Registration letter 

∗ Character Certificate 

∗ Income Tax & Sale tax Certificates 

∗ Labour License letter 

∗ Documents showing ownership of machineries must be produced to the officers mentioned 

in Para 1.1.1 above latest up to 1:00 PM preceding the date of receipt. 

OR can be downloaded from the website of Jharkhand government www.jharkhand.gov.in and 

submitted after attaching Demand draft for the cost of tender document as stated in item no. 2 of 

chapter 4 along with other documents in absence of which the tender shall be rejected. 

1.2.2 The Applications so received will thereafter be scrutinized by the officers authorized for the 

purpose and the tender documents shall be issued to those tenderers only who qualify for the 

purchase of Tender Document on payment of full cost of the same in the shape of account payee 

bank draft drawn in favour of Executive Engineer Road Construction Department, Road 

Division Latehar payable at the State Bank of India Latehar. 

1.2.3 The applications not accompanied with the document stated in Para1.2.1 shall be treated as 

invalid. 

1.3 EARNEST MONEY (E.M.) 

1.3.1 Each tender must be accompanied with the required amount of earnest Money as shown in NIT 

in the shape of one or combination thereof from among the following only:- 

∗ National saving Certificates 

∗ Post office Time Deposit (3 years and above) and the same must be Pledged to the 

Executive Engineer, Road Construction Department, Road Division Latehar. 

1.3.2 Tenders not accompanied with the requisite Earnest Money shall be summarily rejected at the 

time of their opening.

1.3.3 Duly pledged E.M. if any lying with the concerned E.M. against work already completed shall 

not be adjusted by transfer. In such cases the tenderer is required to get the same refunded and 

then attach the same with tender duly pledged a fresh against the work for which tender is filed. 

1.4 DOCUMENTS ACCOMPANYING TENDER PAPER 

1.4.1 Under noted documents (certified photo copies) must be enclosed with the tender paper. 

∗ All these documents required at the time of purchasing tender documents. 

∗ Description of machineries owned by the tender in the Performa place at appendix-1 of the 

tender documents along with sale letter of the manufacturer. 

∗ An affidavit swearing that the Machinery statement at Appendix-I is true. 

∗ The documents required specifically for the work as enumerated in Para 1.8 below # . 

∗ In case of tenderer being a firm the deed of the firm & the power of attorney if any. 

∗ In case the tender documents downloaded from the website of Jharkhand government 

www.jharkhand.gov.in cost of tender document in form of Bank Draft payable to Executive 

Engineer, R.C.D. Road Division Latehar, in State bank of India, Latehar. 

1.4.2 Tenders with incomplete documents shall outright be rejected. 

1.5 OWNERSHIP OF MACHINERIES. 

1.5.1 Tenders who do not own/hire machineries confirming to relevant BIS or IRC standard required 

for the work as notified in NIT should not purchase the tender document for that at work in case 

the tender are submitted the work they will be summarily rejected of the tenderer do not 

produce the ownership of required machineries. 

1.5.2 For bituminous work requiring use of hot mix plants specifications as laid down in I.S 5890- 

1970 only will be accepted. 

1.6 QUOTING RATE TIME. 

1.6.1 Tenderer should quote their rate only at the space earmarked in the document in percentage, 

above or below the items mentioned in B.O.Q. (on overall not item wise) both in figures and 

words. 

1.6.2 The quoted rates. 

∗ Must not have anomaly in figure and words. 

∗ Must be initialed to there is cutting or overwriting 

∗ Must not be indefinite such as at estimated rates or at………% above/below inclusive of 

material etc. 

∗ Failing which the offer with invalided. 

1.6.3 In case among of offer on overall rate quoted by a tendered is lower than15% the offer will be 

treated as unworkable and will invalidate the offer. 

1.6.4 B.O.Q. also provides information of the cut off percentage (calculated on the basis of…) above 

which tenders will be invalid. 

1.6.5 The quoted rate shall be deemed to include 2% sales tax and 1% labor surcharge. 

1.6.6 Time allowed to complete the work should be carefully scrutinized by the tenderer and in case 

the notified time of completion is not suited the tenderer may quote his own time. 

1.7 WORK DISCIPLINE 

1.7.1 Only MORTH/LS/IRC specifications shall be followed during execution of work. 

1.7.2 Site order book will have to be maintained at site. 

1.7.3 Works and Account codes & Financial Rules of Govt. of Jharkhand along with guidance from 

T.E.C. & Ministry of Road Transport & Highways shall be concurrently applicable in the entire 

processes leading to final completion of work. 

1.8 ADDITIONAL DOCUMENTS TO ACCOMPANY TENDER PAPER. 

1.8.1 Documents required to accompany the tender are enumerated in Para 1.4.1 However the 

following additional documents must accompany the tender paper as referred in Para 1.4.1 

marked #. 

∗ A certificate of competent authority showing similar nature of work executed by the tender. 

∗ A list of work in the hands of Tenderer containing information in appendix-II accompanying 

the tender document.

∗ A programs of work of this tender so as to complete the same within the time requited by 

the tenderer. 

It will be obligator for the Tender keep their open for acceptance for a period of180 days from 

the date of its opening. 

1.10 Conditional tender shall not be considered valid. 

1.11 Authority is reserved to reject any or all tenders received or to all to the work to one or more 

contractor without assigning any reason. 

1.12 In the case of successful tenderer (hereinafter called contractor) the amount of E.M. will be 

transferred to wards the initial security deposit (I.S.D) which will have to be augmented so that 

I.S.D. will be 5% of approved amount of tender and further 5% shall be deducted form the bills. 

1.13 The earnest money of successful tenderer, which accompanied the tender will be forfeited in 

case the tenderer fails to turn upto sing the agreement or to deposit the balance amount of I.S.D. 

within 10 days of being called upon to do so. 

1.14 Tender notice through press this (N.I.T) enclosures accompanying the tender document Ministry 

of Road Transport & Highway specifications for Road & Bridges (Fourth Revision) and all 

correspondences leadings to final disposals of tender will form part of the contract documents. 

1.15 (a) Departmental materials if supplied by the department will be charged from the contractor at 

issue rates & at the place of delivery as mentioned below against each item. (Carriage or 

transportation of these materials of the work site is to be done by the contractor at his own cost.

Note:- 

∗ In case bulk bitumen is issued arrangement for empty drums and its filling in to empty 

drums and its transportation handling etc. and other incidental expenses in this regard shall 

be borne by contractor is shall not be reimbursed in any case. 

∗ Issue rate of the bulk Bitumen shall be equals to that of the packed bitumen and the 

contractors shall not question the issuing authority regarding the type be delivered. 

∗ Damage or flattened empty bitumen drums will not be taken back and therefore its cost will 

be recovered @Rs 170/- each. Damage empty cement bags also will not be taken back and 

therefore its cost will be recovered @ ` 3.20 each. 

∗ Hire charges of road roller not above does not include the cost of P.O.I. but its cost of 

included in the departmental rates mentioned in chapter-5 of the tender documents therefore 

the contractor has to bear the additional cost of P.O.L. which shall neither be repaid to him 

not an claim shall be accepted in this regard. 

∗ (a) Roller shall be delivered at a place where it is available on the same shall be carried to 

work site by the contractor at this own cost and his will return beak the roller to the nearest 

NH stores as per the direction of E/I at his own cost. Expenditure on this account shall not 

be recourse. 

(b) All materials (including bitumen grade 60/70 polymer modified or any other grade as the 

case may be will be supplied by the contractor. Recovery will be done @ Rs 85/- each for 

damaged/flattened drums because the cost of packed bitumen is finally borne by the 

department short all in return of empty bitumen drums shall be recovered at penal rate vide 

clause 3.17 of chapter-3 (Special revision) of tender document.

1.16 As per order contained in letter no A2-C.W-Tender-17/93-4065(E) dt.-1/9/93 of the Engineer in 

chief cum addl. Commissioner cum Special Secretary, R.C.D. Govt. of Bihar, it is essential for 

the tenderers to have ownership of the following Road making machineries in working 

condition. 

∗ For that work the estimated cost of which is more than Rs. 1.00 (one) crore only. 

Diesel Road Roller – 2 Nos. 

Mini Hot Mix Plant- 1 (one) number. 

Tar Boiler - 1 (one) number. 

∗ For that work the estimated cost of which is more than Rs. 20.00 (Twenty) Lacs only. 



1.17 Tenders having ownership of Earth moving machinery in working condition will be given 

preference in allotment if that work the estimated cost of which is more than Rs. 1.00 (One) 

crore only. 

1.18 Tenders having ownership of Diesel Road Roller and Tar boiler etc. ie. road making machinery 

in working condition may be considered to be given preference in allotment of work the 

estimated cost of which is less than Rs. 20.00 (Twenty) Lakhs. 

1.19 Tenderers required to attach with their tenders authorized valid certificate regarding their actual 

ownership of the Road Making Machinery and earth moving machinery mentioned in clause 

1.17 to 1.19 above failing with their claim for allotment of the work may be rejected. 

1.20 The authorized valid certificates of actual ownership of the above mentioned Road making 

machineries and earth moving machineries to be attached with the tenders must prove that the 

tenderer/tenders himself/themselves/and earth moving machineries and the same are in working 

condition. 

1.21 Payment will be made subject to availability of fund

CHAPTER – 2 

General Rules for Guidance of Tenderer 

2.1. The complete tender with all its enclosures shall be contained in sealed envelope and delivered 

to any one of the receiving officers mentioned in Para 1.1 so as to reach him on the day & 

before the stipulated time in the N.I.T. 

2.2. The tender may mention in all forwarding letter list of all documents submitted with the tender. 

2.3. The tender shall contain the full name Address residence and place of business of person of 

persons filling the tender in case there is subsequent change in address it must be I informed to 

the excreted E.E. and circle Daltongunj by registered post. 

2.4. All pages of the tender documents including copy of Tender Notice through press shall initialed 

at the lower left hand corner by the tender or a person holding power of attorney authorizing 

him to sign on behalf of the tender before submission of the tender failure to comply with this 

clause will invalidate the offer. 

2.5. In the event of the tender being submitted by a firm it must be signed by each partner thereof 

and in the event of the absence of any of the partners it should be signed on his behalf by person 

holding power of attorney authorizing him to do so and the same shall be produced on demand 

all signature shall be dated. 

2.6. No tender shall file tender for more than one work in one sealed envelope if tenderer desires to 

submit for more than one work be should submit in separate scaled envelope for each work on 

appearance and duly purchased bill quantity the name of the work should be written on the 

sealed envelope. 

2.7. The rates quoted by the tenderers shall be inclusive of royalty cess sales tax income tax other 

state or central taxes. Other P.O.L. Charges carriage of materials fares freight wages of all staffs 

labour chowkidar. 

2.8. The tenderer shall be presumed to carefully examine the conditions of the contract and 

specifications of the work. The tenderer will also be deemed to have inspected the work site and 

have satisfied himself/themselves independently as to the nature extent and practicability of all 

work. Approaches and other means of communication and accesses to the site as regards land 

buildings available for accommodation that may be required for temporary purposes in 

connection with the contract of work as also to availability of construction material location of 

quarry site including climate of work site and other geological characteristics availability or 

skilled semi skilled unskilled laborers and all other aspects incidental to the work before quoting 

rates. The consequence of the lack of necessary knowledge will be at the risk and cost of the 

tenderer. 

2.9. Income tax, Sales Tax, Royalty cess etc. shall be deducted at source from each bill as per 

relevant rules of the Govt. prevailing at as amended or revised from time to time covering entire 

period of the work. 

2.10. If the tenderer is Registered as contractor in a class other than the for which he/they is/are filling 

this tender he/they should furnish details or registration in other class as well.

CHAPTER - 3 

SPECIAL CONDITION FOR F2/H CONTRACT 

3.1. All terms & conditions given in the press tender notice and Chapter-1 to 4 of the tender 

document and those stipulated I the P.W.D. From F2 will be concurrently binding on the 

contractor wherever stipulations of one differ from the other, those suited best in the interest of 

the Govt. shall prevail over the other. 

3.2. The Contractor should always remain available at the work site but where it is not so possible 

for him, he must appoint representative for the purpose who would be duly authorized by the 

contractor to receive instructions & carry out instructions of departmental officers, and also to 

receive letters, He may also delegate his any other powers as he thinks fit, but in every case he 

will inform immediately the concerned JE, SDO & EE regarding appointment of such 

representative along with his name & authenticated photo for his identify by registered Post. In 

case of failure to do as aforesaid instructions give to any representative or workman engaged in 

work will be deemed to have been receive by the contractor. 

3.3. The successful tenderer, hereinafter called contractor must maintain a site order book at each 

work site which will be produced when asked for by the departmental officers for needful. Any 

order or instruction passed on the site order book by the inspecting officer should be 

communicated to SDO, EE, SE and concerned inspecting officers by JE of the work. A copy of 

same should also be kept by the JE. The site order book may be submitted to EE with running 

account bills, if needed but must be submitted with final bill. 

3.4. If the royalty clearance certificate for mines/mineral uses in the work is not produced with the 

bill royalty will be deducted by the department form the running bill at the rates prevailing at the 

time of execution of work to which the bill relates. Production of royalty along with the final 

bill of the work failing which final bill will be not paid and for such nonpayment or delay in 

payment the whole and full responsibility will be of the contractor alone. 

3.5. Recovery of cost of materials supplied by the department will be made at the rates stipulated in 

the NIT and or agreement. For departmental materials found to be in excess of actual 

consumption calculated on the basis of approved design drawing and specifications and or field 

or laboratory tests with the contractor recovery will be at panel rate of the market rate prevailing 

at the time of effecting recovery plus 10% whichever is higher as per rules provided the same is 

not returned back in good and acceptable conditions to the departmental stores at his cost. 

3.6. The contractor shall furnish sufficient plant, equipments and labour & shall work such hours 

and shift as may be necessary to maintain the progress schedule. The working and shift hours 

shall comply with all Govt. Rules and Regulations in force from time to time during the entire 

period of construction. 

3.7. The contractor shall make adequate arrangement for the safety of the labour during execution of 

work. He will be responsible for any compensation for the same & will have to be paid by him 

as desired by the competent authority. 

3.8. The contractor shall have to get tested the strength of cement concrete (both plain and 

reinforced) for each days casting as per IRC code. Although achievement of the prescribed cube 

strength is a must concrete given lower value may be rejected or accepted at a suitable reduced 

rate under specific orders of the competent authority. The cost of concrete cube moulds during 

carriage of cubes to and from the testing laboratory and all other incidental charges incurred in 

this regard shall be born by the contractor. 

3.9. For works containing more than 50 Lakhs it will be obligatory for contractor to keep a properly 

supplied testing laboratory near the work site at his own cost where he will get the sample as 

tested by the department. 

3.10. Normally plants/equipments required for the job are notified in N.I.T. However, even if any 

such equipment not specifically indicated in N.I.T. is require in the N.I.T. 

∗ Entire cost of propulsion of the equipment shall be borne by the contractor erectly even 

if the same is tent from the Department. 

∗ Equipment obtained from the Department, recovery shall be made from the contractor's 

bill at double the rates of hire charge prevalent at the time issue of equipment.

3.11. The department materials shall be issue to the contractor if available, on proper hand Receipt & 

farther rules to this effect shall be subject to the N.I.T. Agreement P.W.D. code and department 

instruction otherwise required materials will have to be arranged by the contractor on his own. 

∗ Where it is envisaged that contain if to return the same should be returned in good 

condition. In case Contractor does not return the same in good condition the cost of 

container at all, the cost of same along with materials will be recovered from the 

contractor's bill at penal rate since when the contractor does not return the container at 

all, it will be deemed that there has nonissue of department & of materials along with 

container shall be recovered at penal rate. 

3.12. The contractor shall if required by the E/I arrange to test of other materials will other portion of 

work at his own cost of proven their quality soundness and sufficiency if after quality of 

materials appeals to be inferior or the portion of the work is found to be defective and unsound 

the contractor may be asked to remove &/or pull down and re-execute the same at his own cost 

of in case such defect is found out of by departments to the soundness of the structures he shall 

be paid at suitably reduced rates for items of work involved in such work. The contractor shall 

bear the all cost of in this regard. 

3.13. The contractor should get the sample of the all materials approved by the engineer in charge 

before collecting the get of the site before use in work. The simple in sealed glass jars shall be 

kept in the custody of the Engineer-in charge. Cost of jar shall be come by the contractor at his 

own cost. 

3.14. Quality control test shall be carried out as required as per MORTH specification. If the quality 

of materials fails below the acceptable standard, the contractor shall have to remove such 

inferior materials at his own cost. 

3.15. Beside clause 3.12 to 3.14 the contactor will be held wholly responsible for the supply and use 

of substandard road building materials and will have to remove and rectify the same at their own 

cost as per specification and direction of E/I Failure to comply, will lead to their disqualification 

in future tenders. 

3.16. M.S. Bars joints, Angles etc. will be issued in length available in the departmental stores. Their 

cut pieces in lengths less than 15% shall not be taken back. While assessing the quantity of 

consumption in the work, wastage in such materials may be allowed upto maximum limit of 5% 

after due consideration of the department. Cost of quantity allowed as wastage shall be 

recovered at issue rate of such materials as prescribed in para 1.15 of NIT. 

3.17. Issue rate of supply of bitumen as mentioned in para 1.15 includes cost of bitumen drums hence 

the empty bitumen drums are to be returned back in good condition to the stores from where it 

was issued failing which its cost will be recovered from the contractor Rs. 170/- per drum. 

3.18. The actual lead of materials like stone metals, stone chips, boulder, bricks, sand, moorum, etc is 

found to be less than the lead provided in BOQ then its payment will be made on proportion at 

reduced rate reduction in rate will be made in the ratio of approved rate and rate provided in the 

BOQ remaining the same in case the actual lead is more than the lead provided in the BOQ it 

will be mandatory to obtain prior consent of the authority, who approved the tender before 

commencement of supply of such materials from the increased lead. 

3.19. The contractor will have to use his own machinery as per clause 1.5.1 to 1.5.2 for the 

completion of the work within the time specified in the contract. The carriage of machinery do 

different sites under this contract from one place to another for this work will be the 

responsibility of the contractor and all expenses in this regard will be borne by him. 

3.20. It will be essential to do all items of road works in sequence from on and in a scientific way so 

as to complete the works from the and it should not be done in haphazard way such as collection 

of materials in same miles base cutting in other miles consolidation work in patches etc. which 

leads to progress. All items of work simultaneously mile wise quantity wise always from age 

and so that the complete road is available for the use in one stretch. 

3.21. After completion of work the contractor will remove all debris fill up vats etc. as desired by E/I 

and live the site clear and tidy at his own cost. 

3.22. The department reserves right of omitting or suspending the construction or changing site etc. if 

considered necessary at subsequent stage.

3.23. The following shall not be paid extra and the tendered rates shall be inclusive of these:- 

∗ Site clearance such as clearing of shrubs bush wood under growth and small trees not 

exceeding 254mm to 305mm in girth measured at height of 900mm above ground. 

∗ Setting out work profile layout etc. 

∗ Unauthorized battering or benching or excavation of foundation trenchers. 

∗ Forming of laying Tell-Tele or witness in borrows pits and their removal after 

measurement However, deduction will be made in quantity of each work for these. 

∗ Excavation for inserting of planking and shuttering. 

∗ Forming (or leaving)step in sides of deep excavation and their removal after 

∗ Bailing out rain water and surface water along with consequential desalting in the case 

the excavated foundation trenches were filled upto these during entire period of 

contraction. 

∗ Removing slips on falls in extenuation 

∗ Fraction and/or establishing Yard site Store site office etc. 

∗ Making vats mixing platform watering channel etc. 

3.24. The contractor may use his own machinery for the completion of work within the time 

stipulated in the contract the carriage of machinery to different sites under this contract from one 

place to another for this work will be the responsibility of the contractor and all expenses in this 

regard will be born by him. 

3.25. Other machinery like asphalt mixer, tar boiler, pump vibrator, concrete mixer etc. if available in 

the stores of the concern division may be issued to the contractor on his written requisition hire 

or free of cost as the case may be on the terms quoted in his tender covers. This hire charges, if 

applicable along with its called expense as detailed below in sub paras 3.26.1 to 3.26.10 which 

are to be by the departmental machinery, the condition laid down in sub paras 3.26.1 to 3.26.10 

will apply into departmental road roller issued to contractor. 

3.25.1. Hire charges of road roller has been indicated in para 1.15 of NIT. Hire charges of other 

machineries will be communicated on and the same shall have to be accepted by the 

contractors. 

3.25.2. Carriage and running charges of machineries if any including on incidental and 

contingent charges for transporting the same from place of delivery to the work site 

and their return to the place of issue shall be borne by the contractor on his own cost. 

3.25.3. Salary of roller driver, khalasi, operator of other machineries will be borne by the 

contractor. The period spent in its transport from place of issue to work site and back 

shall also be for their purpose, it will be responsibility of the contractor to obtain 

necessary information regarding salary of the departmental staff. 

3.25.4. The cost of fuel and lubricants for running the machinery will be borne by the 

contractor. 

3.25.5. The plants and machineries issued on hire or free of cost to the contractor the department 

will have to be maintained properly daily in addition to its general daily maintenance 

and in case of roller it shall also cleaned in a week & stores required for cleaning i.e. 

Kerosene oil, soap, jute, grease, Mobil, etc. will have to be supplied by the contractor 

at his own cost. Mobil oil will have to change after 200 (Two hundred) of running 

hours, C. oil shall be changed after 1000 (One thousand) of running hour at his own 

cost. The quality of all the materials supplied by the contractor will have to be 

approved by the E/I before use. 

3.25.6. During the operator period the machinery is on work with the contractor all minor 

repairs or break down costing up to Rs. 100/- at a time will be responsibility of the 

contractor and such be completed within maximum period of 3 days under intimation 

to concerned J.E, SDO, EE. 

3.25.7. In case the contractor fails to supply the required fuel, lubricants & other stores required 

for running and proper maintenance of departmental machineries & proper or free of 

cost to the contractor for using the same shall be supplied by the department, its full

cost inclusive of handling, procurement & all other incidental charges shall be 

recovered from the contractor. 

3.25.8. If the departmental road roller remains idle for due to contractor’s fault, its cost will be 

recovered from the contractor Rs 331.66 per hour. 

3.25.9. Hire plus establishment and other charges for idle or repair periods shall be payable by 

the contractor. 

3.25.10. In the event or loss or theft of the machinery of any of its components in part or full 

when its stand issued to the contractor, the value of the lost particles will be recovered 

from the contractor at the price fixed by the S.E, or E.E concerned. 

3.26. Claims are not admissible under following circumstances. 

∗ Extra items of work down without written order of departmental officer. 

∗ In case of sudden fluctuant and or increase in rates of labour materials royalty various 

taxes railway freight fuel lubricant carriage cost etc. at any stage of the work. 

∗ Short supply and/or non-supply delay in supply of department materials and/or 

equipment and/or petrol diesel K. oil etc. 

∗ Non availability of local labour of a category required for the work. 

∗ Labour sitting idle due to any cause. 

∗ Delay in communication of decision regarding any change or modification in design 

drawing specification alteration addition etc. 

∗ Loss sustained due to. 

Acts of enemies including agitation public Rangdari and riot 

Transportation and procurement difficulties. 

Natural inanities. 

Any other circumstances which are beyond human control. 

3.27. In case bulk bitumen issued to the agency, no extra cost will be paid on account of lifting bulk 

bitumen in departmental, empty bitumen drums and carriage of the same from the R.C.D. 

godown to the site of work and these operation will have to be carried out at the own cost of the 

agency. 

3.28. Extension of time, if justified may be granted by the officer for different periods of time for 

different types & values of woks, otherwise penalty for non fulfillment of the contract may be 

imposed giving due consideration for poor progress at different stages of works without valid 

and satisfactory reasons. More payments of running on accounts bills keeping back certain 

amount for non extension of time as a does not qualify as a valid ground for grant of extension 

of time as a matter of right. The officer competent to grant such extension of time has the full 

liberty to wait & examine the circumstances which lead to the applicable for the fulfillment of 

the contract and use his own discretion for final order which will be final, binding & conclusive 

in the contractor. 

3.29. The contractor shall if required by the E/I arrange to test the materials at site or get them tested 

in recognized departmental testing laboratories at his own cost in order to prove their soundness 

and sufficiency as per specification lay down. The number of tests required for different items 

will be specified by E/I. 

3.30. The estimated output of roller for 8 hours working is as follows:- 

Compaction of Gravel/Moorum 255 m 3 /day 

Compaction of earth work 566 m 3 /day 

Consolidation of Grade-I 35 m 3 /day 

Consolidation of Grade-II 30 m 3 /day 

Consolidation of Grade-III 30 m 3 /day

3.31. The contractor shall make his own efficient arrangement to receive communication of the 

department. In case this rate complied with a proof dispatch of any communication shall be 

deemed to have been served on him.

CHAPTER – 2 


The complete tender with all its enclosures shall be contained in sealed envelope and delivered to 

any one of the receiving officers mentioned in Para 1.1 so as to reach him on the day & before 

the stipulated time in the N.I.T. 

The tender may mention in all forwarding letter list of all documents submitted with the tender. 

The tender shall contain the full name Address residence and place of business of person of persons 

filling the tender in case there is subsequent change in address it must be I informed to the 

excreted E.E. and circle Ranchi by registered post. 

All pages of the tender documents including copy of Tender Notice through press shall initialed at 

the lower left hand corner by the tender or a person holding power of attorney authorizing him 

to sign on behalf of the tender before submission of the tender failure to comply with this clause 

will invalidate the offer.

CHAPTER - 3 


All terms & conditions given in the press tender notice and Chapter-1 to 4 of the tender document 

and those stipulated I the P.W.D. From F2 will be concurrently binding on the contractor 

wherever stipulations of one differ from the other, those suited best in the interest of the Govt. 

shall prevail over the other. 

The Contractor should always remain available at the work site but where it is not so possible for 

him, he must appoint representative for the purpose who would be duly authorized by the 







The successful tenderer, hereinafter called contractor must maintain a site order book at each work 

site which will be produced when asked for by the departmental officers for needful. Any order 

or instruction passed on the site order book by the inspecting officer should be communicated to 

SDO, EE, SE and concerned inspecting officers by JE of the work. A copy of same should also 

be kept by the JE. The site order book may be submitted to EE with running account bills, if 

needed but must be submitted with final bill. 

If the royalty clearance certificate for mines/mineral uses in the work is not produced with the bill 

royalty will be deducted by the department form the running bill at the rates prevailing at the 


bill of the work failing which final bill will be not paid and for such non payment or delay in 


Recovery of cost of materials supplied by the department will be made at the rates stipulated in the 

NIT and or agreement. For departmental materials found to be in excess of actual consumption 

calculated on the basis of approved design drawing and specifications and or field or laboratory 

tests with the contractor recovery will be at panel rate of the market rate prevailing at the time of 

effecting recovery plus 10% whichever is higher as per rules provided the same is not returned 

back in good and acceptable conditions to the departmental stores at his cost. 

The contractor shall furnish sufficient plant, equipments and labour & shall work such hours and 

shift as may be necessary to maintain the progress schedule. The working and shift hours shall 

comply with all Govt. Rules and Regulations in force from time to time during the entire period 

of construction. 

The contractor shall make adequate arrangement for the safety of the labour during execution of 



The contractor shall have to get tested the strength of cement concrete (both plain and reinforced) 

for each days casting as per IRC code. Although achievement of the prescribed cube strength is 

a must concrete given lower value may be rejected or accepted at a suitable reduced rate under

substandard road building materials and will have to remove and rectify the same at their own

Other machinery like asphalt mixer, tar boiler, pump vibrator, concrete mixer etc. if available in the 

stores of the concern division may be issued to he contractor on his written requisition hire or 

free of cost as the case may be on the terms quoted in his tender covers. This hire charges, if

period spent in its transport from place of issue to work site and back shall also be for 

their purpose, it will be responsibility of the contractor to obtain necessary information 

regarding salary of the departmental staff. 

The cost of fuel and lubricants for running the machinery will be born by the contractor. 

The plants and machineries issued on hire or free of cost to the contractor the department will 

have to be maintained properly daily in addition to its general daily maintenance and in 

case of roller it shall also cleaned in a week & stores required for cleaning i.e. Kerosene 

oil, soap, jute, grease, Mobil, etc. will have to be supplied by the contractor at his own 

cost. Mobil oil will have to change after 200 (Two hundred) of running hours, C. oil 

shall be changed after 1000 (One thousand) of running hour at his own cost. The quality 

of all the materials supplied by the contractor will have to be approved by the E/I before 

use. 

During the operator period the machinery is on work with the contractor all minor repairs or 

break down costing up to Rs. 100/- at a time will be responsibility of the contractor and 

such be completed within maximum period of 3 days under intimation to concerned J.E, 

SDO, EE. 

In case the contractor fails to supply the required fuel, lubricants & other stores required for 

running and proper maintenance of departmental machineries & proper or free of cost to 

the contractor for using the same shall be supplied by the department, its full cost 


from the contractor.

If the departmental road roller remains idle for due to contractor’s fault, its cost will be

In the event or loss or theft of the machinery of any of its components in part or full when its

CHAPTER – 2 


The complete tender with all its enclosures shall be contained in sealed envelope and delivered to 

any one of the receiving officers mentioned in Para 1.1 so as to reach him on the day & before 

the stipulated time in the N.I.T. 

The tender may mention in all forwarding letter list of all documents submitted with the tender. 

The tender shall contain the full name Address residence and place of business of person of persons 

filling the tender in case there is subsequent change in address it must be I informed to the 

excreted E.E. and circle Ranchi by registered post. 

All pages of the tender documents including copy of Tender Notice through press shall initialed at 

the lower left hand corner by the tender or a person holding power of attorney authorizing him 

to sign on behalf of the tender before submission of the tender failure to comply with this clause 

will invalidate the offer. 

In the event of the tender being submitted by a firm it must be signed by each partner there of and in

CHAPTER - 3 


All terms & conditions given in the press tender notice and Chapter-1 to 4 of the tender document 

and those stipulated I the P.W.D. From F2 will be concurrently binding on the contractor 

wherever stipulations of one differ from the other, those suited best in the interest of the Govt. 

shall prevail over the other. 

The Contractor should always remain available at the work site but where it is not so possible for 

him, he must appoint representative for the purpose who would be duly authorized by the 







The successful tenderer, hereinafter called contractor must maintain a site order book at each work 

site which will be produced when asked for by the departmental officers for needful. Any order 

or instruction passed on the site order book by the inspecting officer should be communicated to 

SDO, EE, SE and concerned inspecting officers by JE of the work. A copy of same should also 

be kept by the JE. The site order book may be submitted to EE with running account bills, if 

needed but must be submitted with final bill. 

If the royalty clearance certificate for mines/mineral uses in the work is not produced with the bill 

royalty will be deducted by the department form the running bill at the rates prevailing at the 


bill of the work failing which final bill will be not paid and for such non payment or delay in 


Recovery of cost of materials supplied by the department will be made at the rates stipulated in the 

NIT and or agreement. For departmental materials found to be in excess of actual consumption 

calculated on the basis of approved design drawing and specifications and or field or laboratory 

tests with the contractor recovery will be at panel rate of the market rate prevailing at the time of 

effecting recovery plus 10% whichever is higher as per rules provided the same is not returned 

back in good and acceptable conditions to the departmental stores at his cost. 

The contractor shall furnish sufficient plant, equipments and labour & shall work such hours and 

shift as may be necessary to maintain the progress schedule. The working and shift hours shall 

comply with all Govt. Rules and Regulations in force from time to time during the entire period 

of construction. 

The contractor shall make adequate arrangement for the safety of the labour during execution of 



The contractor shall have to get tested the strength of cement concrete (both plain and reinforced) 

for each days casting as per IRC code. Although achievement of the prescribed cube strength is 

a must concrete given lower value may be rejected or accepted at a suitable reduced rate under 

specific orders of the competent authority. The cost of concrete cube moulds during carriage of 

cubes to and from the testing laboratory and all other incidental charges incurred in this regard

Beside clause 3.12 to 3.14 the contactor will be held wholly responsible for the supply and use of 

substandard road building materials and will have to remove and rectify the same at their own

Other machinery like asphalt mixer, tar boiler, pump vibrator, concrete mixer etc. if available in the 

stores of the concern division may be issued to he contractor on his written requisition hire or 

free of cost as the case may be on the terms quoted in his tender covers. This hire charges, if

Carriage and running charges of machineries if any including on incidental and contingent 

charges for transporting the same from place of delivery to the work site and their return

period spent in its transport from place of issue to work site and back shall also be for 

their purpose, it will be responsibility of the contractor to obtain necessary information 

regarding salary of the departmental staff. 

The cost of fuel and lubricants for running the machinery will be born by the contractor. 

The plants and machineries issued on hire or free of cost to the contractor the department will 

have to be maintained properly daily in addition to its general daily maintenance and in 

case of roller it shall also cleaned in a week & stores required for cleaning i.e. Kerosene 

oil, soap, jute, grease, Mobil, etc. will have to be supplied by the contractor at his own 

cost. Mobil oil will have to change after 200 (Two hundred) of running hours, C. oil 

shall be changed after 1000 (One thousand) of running hour at his own cost. The quality 

of all the materials supplied by the contractor will have to be approved by the E/I before 

use. 

During the operator period the machinery is on work with the contractor all minor repairs or 

break down costing up to Rs. 100/- at a time will be responsibility of the contractor and 

such be completed within maximum period of 3 days under intimation to concerned J.E, 

SDO, EE. 

In case the contractor fails to supply the required fuel, lubricants & other stores required for 

running and proper maintenance of departmental machineries & proper or free of cost to 

the contractor for using the same shall be supplied by the department, its full cost 


from the contractor.

If the departmental road roller remains idle for due to contractor’s fault, its cost will be

In the event or loss or theft of the machinery of any of its components in part or full when its
