3.11. The department materials shall be issue to the contractor if available, on proper hand Receipt &<br />

farther rules to this effect shall be subject to the N.I.T. Agreement P.W.D. code and department<br />

instruction otherwise required materials will have to be arranged <strong>by</strong> the contractor on his own.<br />

∗ Where it is envisaged that contain if to return the same should be returned in good<br />

condition. In case Contractor does not return the same in good condition the cost <strong>of</strong><br />

container at all, the cost <strong>of</strong> same along with materials will be recovered from the<br />

contractor's bill at penal rate since when the contractor does not return the container at<br />

all, it will be deemed that there has nonissue <strong>of</strong> department & <strong>of</strong> materials along with<br />

container shall be recovered at penal rate.<br />

3.12. The contractor shall if required <strong>by</strong> the E/I arrange to test <strong>of</strong> other materials will other portion <strong>of</strong><br />

work at his own cost <strong>of</strong> proven their quality soundness and sufficiency if after quality <strong>of</strong><br />

materials appeals to be inferior or the portion <strong>of</strong> the work is found to be defective and unsound<br />

the contractor may be asked to remove &/or pull down and re-execute the same at his own cost<br />

<strong>of</strong> in case such defect is found out <strong>of</strong> <strong>by</strong> departments to the soundness <strong>of</strong> the structures he shall<br />

be paid at suitably reduced rates for items <strong>of</strong> work involved in such work. The contractor shall<br />

bear the all cost <strong>of</strong> in this regard.<br />

3.13. The contractor should get the sample <strong>of</strong> the all materials approved <strong>by</strong> the <strong>engineer</strong> in charge<br />

before collecting the get <strong>of</strong> the site before use in work. The simple in sealed glass jars shall be<br />

kept in the custody <strong>of</strong> the Engineer-in charge. Cost <strong>of</strong> jar shall be come <strong>by</strong> the contractor at his<br />

own cost.<br />

3.14. Quality control test shall be carried out as required as per MORTH specification. If the quality<br />

<strong>of</strong> materials fails below the acceptable standard, the contractor shall have to remove such<br />

inferior materials at his own cost.<br />

3.15. Beside clause 3.12 to 3.14 the contactor will be held wholly responsible for the supply and use<br />

<strong>of</strong> substandard <strong>road</strong> building materials and will have to remove and rectify the same at their own<br />

cost as per specification and direction <strong>of</strong> E/I Failure to comply, will lead to their disqualification<br />

in future <strong>tender</strong>s.<br />

3.16. M.S. Bars joints, Angles etc. will be <strong>issued</strong> in length available in the departmental stores. Their<br />

cut pieces in lengths less than 15% shall not be taken back. While assessing the quantity <strong>of</strong><br />

consumption in the work, wastage in such materials may be allowed upto maximum limit <strong>of</strong> 5%<br />

after due consideration <strong>of</strong> the department. Cost <strong>of</strong> quantity allowed as wastage shall be<br />

recovered at issue rate <strong>of</strong> such materials as prescribed in para 1.15 <strong>of</strong> NIT.<br />

3.17. Issue rate <strong>of</strong> supply <strong>of</strong> bitumen as mentioned in para 1.15 includes cost <strong>of</strong> bitumen drums hence<br />

the empty bitumen drums are to be returned back in good condition to the stores from where it<br />

was <strong>issued</strong> failing which its cost will be recovered from the contractor Rs. 170/- per drum.<br />

3.18. The actual lead <strong>of</strong> materials like stone metals, stone chips, boulder, bricks, sand, moorum, etc is<br />

found to be less than the lead provided in BOQ then its payment will be made on proportion at<br />

reduced rate reduction in rate will be made in the ratio <strong>of</strong> approved rate and rate provided in the<br />

BOQ remaining the same in case the actual lead is more than the lead provided in the BOQ it<br />

will be mandatory to obtain prior consent <strong>of</strong> the authority, who approved the <strong>tender</strong> before<br />

commencement <strong>of</strong> supply <strong>of</strong> such materials from the increased lead.<br />

3.19. The contractor will have to use his own machinery as per clause 1.5.1 to 1.5.2 for the<br />

completion <strong>of</strong> the work within the time specified in the contract. The carriage <strong>of</strong> machinery do<br />

different sites under this contract from one place to another for this work will be the<br />

responsibility <strong>of</strong> the contractor and all expenses in this regard will be borne <strong>by</strong> him.<br />

3.20. It will be essential to do all items <strong>of</strong> <strong>road</strong> works in sequence from on and in a scientific way so<br />

as to complete the works from the and it should not be done in haphazard way such as collection<br />

<strong>of</strong> materials in same miles base cutting in other miles consolidation work in patches etc. which<br />

leads to progress. All items <strong>of</strong> work simultaneously mile wise quantity wise always from age<br />

and so that the complete <strong>road</strong> is available for the use in one stretch.<br />

3.21. After completion <strong>of</strong> work the contractor will remove all debris fill up vats etc. as desired <strong>by</strong> E/I<br />

and live the site clear and tidy at his own cost.<br />

3.22. The department reserves right <strong>of</strong> omitting or suspending the construction or changing site etc. if<br />

considered necessary at subsequent stage.
