1.5.1 Tenderers are required to deposit E.M amounting to Rs.---------------- in shape <strong>of</strong> Bank Guarantee,<br />

Note: -Insurance Guarantee Bond/Cash/Cheque/Bank Draft/ in place <strong>of</strong> those specified above shall not<br />

be accepted.<br />

1.5.2 Duly pledged E.M if any lying with <strong>the</strong> concerned Executive Engineer against work already completed<br />

shall not be adjusted by transfer. In such case <strong>the</strong> tenderer is required to get <strong>the</strong> same refunded and<br />

<strong>the</strong>n attach <strong>the</strong> same with tender , duly pledged afresh against <strong>the</strong> work <strong>for</strong> which tender is filled.<br />

1.5.3 Tender not accompanied with required E.M in <strong>the</strong> prescribed manner shall be out right rejected and will<br />

have no place in <strong>the</strong> comparative statement.<br />

1.5.4 Clauses 1.5.2 to 1.5.3 shall not apply to tenderers who are exempted from depositing E.M but such<br />

tenderers must enclose Photostat copy <strong>of</strong> <strong>the</strong> exemption certificate issued by <strong>the</strong> competent authority<br />

in this respect.<br />

1.6 Tenderer should quote his/her/<strong>the</strong>ir rate on overall items(not item-wise) in percentage above or below (both in<br />

figure & words) over <strong>the</strong>ir rates mentioned in <strong>the</strong> bill <strong>of</strong> quantity issued by <strong>the</strong> authorized <strong>of</strong>ficer.<br />

1.7 In case <strong>the</strong> overall rates quoted by <strong>the</strong> tenderer are less than 15 (Fifteen) %, this will be treated as unworkable<br />

& <strong>the</strong> tender may be treated as invalid.<br />

1.8 It will be obligatory on <strong>the</strong> part <strong>of</strong> <strong>the</strong> tenderer to keep <strong>the</strong>ir <strong>of</strong>fer open <strong>for</strong> acceptance <strong>for</strong> a period <strong>of</strong> 180<br />

days from <strong>the</strong> date <strong>of</strong> opening <strong>of</strong> tender.<br />

1.9 Tenderers shall enclose photostat copy <strong>of</strong> his/her/<strong>the</strong>ir registration & exemption certificate(if any) in absence <strong>of</strong><br />

which <strong>the</strong> tenders may not be considered.<br />

1.10 Sales Tax/Income Tax clearence certificate,Labour License & Letter <strong>of</strong> Registration as contractor should be submitted by<br />

<strong>the</strong> tenderer <strong>for</strong> works costing more than 10,000/- o<strong>the</strong>rwise it may be rejected.<br />

1.11 Authority is reserved to reject any or all <strong>the</strong> tenders received or to allot <strong>the</strong> work to one or more contractors without<br />

assigning any reason.<br />

1.12 In <strong>the</strong> case <strong>of</strong> successful tenderer(hereinafter called contractor) <strong>the</strong> amount <strong>of</strong> E.M will be transferred towards Initial<br />

Security Deposit in such a manner so that <strong>the</strong> security deposit will be 5% <strong>of</strong> approved amount <strong>of</strong> tender & <strong>the</strong> remaining<br />

5% shall be recoverable from <strong>the</strong> subsequent bills.<br />

1.13 The Earnest Money <strong>of</strong> successful tenderer (hereinafter called <strong>the</strong> contractor)which accompany <strong>the</strong> tender will be <strong>for</strong>feited<br />

in case <strong>the</strong> tenderer declines to sign <strong>the</strong> agreement or fails to deposit Security Money within 10 days <strong>of</strong> being called upon<br />

to do so,after approval <strong>of</strong> tender by Competent Authority.<br />

Those contractors, who are exempted from depositing E.M,will deposit initial security money within 10 days <strong>of</strong><br />

being called upon to do so.If <strong>the</strong>y fail to do so or decline to sign <strong>the</strong> agreement within <strong>the</strong> stipulated period,requisit sum <strong>of</strong><br />

money will be <strong>for</strong>feited by way <strong>of</strong> adjustment from any sum to be paid to him by <strong>the</strong> department <strong>for</strong> o<strong>the</strong>r works, including<br />

his security money and in addition he will be Black Listed and his registration will be cancelled.<br />

1.14 The N.I.T with general rules and special conditions will <strong>for</strong>m part <strong>of</strong> <strong>the</strong> Contract Documents.<br />

1.15 The following departmental materials/equipments,if supplied by <strong>the</strong> department, <strong>the</strong>ir issue rates will be charged from <strong>the</strong><br />

1.16 As per order contained in Letter No.A2-C.W-Tender-17 /93-4605(E) Dtd.1/9/93 <strong>of</strong> Engineer-in-Chief cum<br />

Addl.Commissioner cum <strong>Special</strong> Secretary,R.C.D,Govt.Of Bihar,it is essential <strong>for</strong> <strong>the</strong> tenderers to have ownership <strong>of</strong> <strong>the</strong><br />

following <strong>Road</strong> Making Machineries in working condition:-<br />

(A) For works,<strong>the</strong> estimated cost <strong>of</strong> which is more than Rs.ONE Crore :-<br />

(I) Diesel <strong>Road</strong> Rollers – 2(two) numbers.<br />

(II) Mini Hot-Mix Plant – 1(one) number.<br />

(III) Tar Boiler – 1(one) number.<br />

(B) For works,<strong>the</strong> estimated cost <strong>of</strong> which is more than Rs.20(Twenty) Lakh :-<br />

(I) Diesel <strong>Road</strong> Roller – 1(one) number.<br />

(II) Tar Boiler –1(one) number.<br />

1.17 Tenderers having ownership <strong>of</strong> Earth Moving machineries in working condition will be given preference in allotment <strong>of</strong><br />

those works,<strong>the</strong> estimated cost <strong>of</strong> which is more than Rs.1.00(One)Crore only.<br />

1.18 Tenderers having ownership <strong>of</strong> Diesel <strong>Road</strong> Roller and Tar Boiler etc. i.e <strong>Road</strong> making machineries in working condition<br />

may be considered to be given preference in allotment <strong>of</strong> those works,<strong>the</strong> estimated cost <strong>of</strong> which is less than<br />

Rs.20.00(Twenty) Lacs only<br />

1.19 Tenderers are required to attach with <strong>the</strong>ir tenders authorized and valid certificates regarding <strong>the</strong>ir actual ownership <strong>of</strong> <strong>the</strong><br />

<strong>Road</strong> making machineries and Earth Moving machineries mentioned in clause 1.17 to1.18 above, failing which <strong>the</strong>ir claim<br />

<strong>for</strong> allotment <strong>of</strong> <strong>the</strong> work may be rejected.<br />

1.20 The authorized and valid certificates <strong>of</strong> actual ownership <strong>of</strong> <strong>the</strong> above mentioned <strong>Road</strong> making machineries and Earth<br />

Moving machineries to be attached with <strong>the</strong> tenders must prove that <strong>the</strong> tenderer/tenderers himself/ <strong>the</strong>mselves are actual<br />

bonafied owners <strong>of</strong> those <strong>Road</strong> making machineries and Earth Moving machineries and <strong>the</strong> same are in working condition.<br />

1.21 Payment will be made subject to availability <strong>of</strong> fund.<br />

2.1 The complete Tender with all its enclosures shall be enclosed in sealed envelope and delivered / sent by Registered Post<br />

to <strong>the</strong> Chief Engineer (Communications),R.C.D, Jharkhand, Ranchi / Superintending Engineer, R.C.D, <strong>Road</strong> Circle, Ranchi<br />

/ Executive Engineer, RCD, <strong>Road</strong> Division, Ranchi as <strong>the</strong> case may be so as to reach him on or be<strong>for</strong>e <strong>the</strong> date and time<br />

as stipulated in N.I.T para 1.2<br />

2.2 The tenderer should mention in his <strong>for</strong>warding letter a list <strong>of</strong> all documents submitted with <strong>the</strong> tender.<br />

2.3 The tender shall contain <strong>the</strong> full name, address <strong>of</strong> residence and place <strong>of</strong> business <strong>of</strong> person or persons filling <strong>the</strong> tender.<br />

In case <strong>the</strong>ir is subsequent change in address, it must be in<strong>for</strong>med to <strong>the</strong> concerned E.E, S.E, C.E by Registered Post with<br />

A/D.<br />

2.4 All pages <strong>of</strong> Tender Document, General Rules and <strong>Special</strong> Conditions must be initialed at <strong>the</strong> lower left hand corner , as<br />

person, where required in <strong>the</strong> tender papers by <strong>the</strong> tenderer or as person holding power <strong>of</strong> attorney authorizing to sign on<br />

behalf <strong>of</strong> <strong>the</strong> partners be<strong>for</strong>e submission <strong>of</strong> <strong>the</strong> tender.<br />

2.5 In <strong>the</strong> event <strong>of</strong> <strong>the</strong> tender being submitted by a firm, it must be signed by each partner <strong>the</strong>re<strong>of</strong>, and in <strong>the</strong> event <strong>of</strong> absence<br />

<strong>of</strong> any <strong>of</strong> <strong>the</strong> partner <strong>the</strong> power <strong>of</strong> attorney authorizing him to do so must be produced on demand. All signatures shall be<br />

dated.<br />

2.6 No tenderer shall file tender <strong>for</strong> more than one work in one sealed envelope. Tenderer desirous <strong>of</strong> submitting tender <strong>for</strong><br />

more than one work shall submit tender in separate sealed envelope <strong>for</strong> each work on appropriate and duly purchased<br />

B.O.Q. The name <strong>of</strong> <strong>the</strong> work should be clearly written on <strong>the</strong> sealed envelope.<br />

2.7 The rates quoted by <strong>the</strong> tenderer shall be inclusive <strong>of</strong> Income Tax, Sales Tax, Royalty or any o<strong>the</strong>r Provincial and Central<br />

Taxes applicable at that time.<br />

2.8 The tenderer shall be presumed to have carefully examined <strong>the</strong> conditions <strong>of</strong> <strong>the</strong> contract and specifications <strong>of</strong> <strong>the</strong> work.<br />

The tenderer will also be deemed to have inspected <strong>the</strong> work site and to have satisfied himself/herself/<strong>the</strong>mselves<br />

independently as to <strong>the</strong> nature, extent and practicality <strong>of</strong> all works and required road approaches & o<strong>the</strong>r means <strong>of</strong><br />

communication & access to <strong>the</strong> site, as referred to lands, buildings, available <strong>for</strong> accommodation that may be required <strong>for</strong><br />

temporary purpose in connection with <strong>the</strong> contract <strong>of</strong> work,as also availability <strong>of</strong> construction materials, location <strong>of</strong> work site<br />

including its climate & o<strong>the</strong>r geological characteristic, availability <strong>of</strong> skilled, semi-skilled & un-skilled labourers. The<br />

consequences <strong>of</strong> <strong>the</strong> lack <strong>of</strong> necessary knowledge will be at <strong>the</strong> risk and cost <strong>of</strong> tenderer.<br />

2.9 Generally, Specifications <strong>for</strong> road & bridge woks (4 Th Revision) <strong>of</strong> Ministry <strong>of</strong> <strong>Road</strong> Transport & Highways, Government <strong>of</strong><br />

India (MORt&H) would be followed <strong>for</strong> <strong>the</strong> execution <strong>of</strong> works. Those works, which are not covered by MORT&H<br />

specifications, . R.C.D specifications or Circle specification s will be followed.<br />

2.10 The tenderer may submit a program <strong>of</strong> <strong>the</strong> work to be executed with <strong>the</strong> tender.<br />

2.11 The tenderer will maintain watch guards <strong>for</strong> <strong>the</strong> safety <strong>of</strong> <strong>the</strong> materials, if any, supplied by <strong>the</strong> department at his own cost.<br />

2.12 All labourers engaged in <strong>the</strong> work are to be paid as per Minimum Wages Act. in <strong>for</strong>ce at <strong>the</strong> time <strong>of</strong> execution <strong>of</strong> contract<br />

work.<br />

2.13 The tenderer will provide to <strong>the</strong> labourers ,hut <strong>for</strong> shelter, drinking water and medical facilities at site and keep <strong>the</strong> site clean<br />

at his own cost.<br />

2.14 Extension <strong>of</strong> time on valid reasons may be granted by <strong>the</strong> competent authorities as per Government rules and circulars in<br />

<strong>for</strong>ce and as revised from time to time.<br />

2.15 The tenderer must return all <strong>the</strong> tender papers duly signed on each page while submitting <strong>the</strong> tender paper, failing which<br />

<strong>the</strong> same may be declared invalid.<br />

2.16 On receipt <strong>of</strong> <strong>the</strong> written order from <strong>the</strong> Executive Engineer, RCD. <strong>Road</strong> Division Ranchi <strong>the</strong> successful tenderer will first<br />

deposit <strong>the</strong> balance amount <strong>of</strong> initial security deposit (ISD)within <strong>the</strong> specified period <strong>of</strong> ten days and <strong>the</strong>n enter into an<br />

agreement with Executive Engineer on <strong>the</strong> basis <strong>of</strong> <strong>the</strong> stipulation in <strong>the</strong> approved tender documents along with subsequent<br />

terms as mutually agreed upon be<strong>for</strong>e <strong>the</strong> issue <strong>of</strong> work order. Written order to commence <strong>the</strong> work shall be issued by <strong>the</strong><br />

Executive Engineer after acceptance <strong>of</strong> <strong>the</strong> agreement by <strong>the</strong> competent authority.<br />

2.17 (a) If <strong>the</strong> rate quoted by <strong>the</strong> tenderer above <strong>the</strong> BOQ rate and <strong>the</strong> competent <strong>of</strong>ficer approved above <strong>the</strong> BOQ<br />

rate, <strong>the</strong>n <strong>the</strong> enhancement over <strong>the</strong> BOQ rates shall not be applicable over <strong>the</strong> cost <strong>of</strong> bitumen .<br />

(b) It <strong>the</strong> tenderer quotes <strong>the</strong> rate below <strong>the</strong> BOQ rate and <strong>the</strong> competent <strong>of</strong>ficer approves it, <strong>the</strong>n <strong>the</strong> reduction over<br />

<strong>the</strong> BOQ rate shall be applicable on all items <strong>of</strong> work including <strong>the</strong> cost <strong>of</strong> bitumen.<br />

C H A P T E R - I I I<br />

SPECIAL CONDITIONS FOR F2 / H CONTRACT<br />

3.1 The successful tenderer (hereinafter called <strong>the</strong> Contractor)must maintain a site order book at each work site which will be<br />

produced when asked <strong>for</strong> by <strong>the</strong> departmental <strong>of</strong>ficers <strong>for</strong> needful. Any order or instruction passed on <strong>the</strong> site order book by<br />

<strong>the</strong> inspecting <strong>of</strong>ficer should be communicated to <strong>the</strong> SDO,EE,SE and concerned inspecting <strong>of</strong>ficers by <strong>the</strong> J.E in charge <strong>of</strong><br />

<strong>the</strong> work. A copy <strong>of</strong> <strong>the</strong> same should be kept by <strong>the</strong> J.E. The site order book may be submitted to E.E with running account<br />

bills ,if required, but must be submitted with final bill.<br />

3.2 The contractor should always remain available at <strong>the</strong> work site ,but where it is not so possible <strong>for</strong> him to do so, he must<br />

appoint a representative <strong>for</strong> <strong>the</strong> purpose who would be duly authorized by <strong>the</strong> contractor to receive instructions and carry<br />

out instruction <strong>of</strong> departmental <strong>of</strong>ficers ,and also to receive letters. He may also delegate him any o<strong>the</strong>r power as hr thinks<br />

fit ,but in every case he will in<strong>for</strong>m immediately <strong>the</strong> concerned J.E,S.D.O and E.E regarding appointment <strong>of</strong> such<br />

representative along with his name and identity in writing by Regd. Post with A/D.<br />

3.3 If <strong>the</strong> Royalty clearance certificate <strong>for</strong> mines/minerals used in <strong>the</strong> work is not produced with <strong>the</strong> bill, Royalty will be<br />

deducted from <strong>the</strong> concerned running bill, at <strong>the</strong> rates prevailing at <strong>the</strong> time <strong>of</strong> execution <strong>of</strong> work, by <strong>the</strong> department.<br />

Production <strong>of</strong> royalty clearance certificate along with <strong>the</strong> final bill is a must, failing which final bill will nei<strong>the</strong>r be passed nor<br />

paid, and <strong>for</strong> such non-payment or delay in payment, <strong>the</strong> whole and sole responsibility will be <strong>of</strong> <strong>the</strong> contractor alone.<br />

3.4 Recovery <strong>of</strong> cost <strong>for</strong> materials supplied by <strong>the</strong> department will be made at <strong>the</strong> rates stipulated in <strong>the</strong> N.I.T and or agreement.<br />

For departmental materials found to be in excess <strong>of</strong> actual consumption calculated on <strong>the</strong> basis <strong>of</strong> approved design,<br />

drawing and specifications and/or field or laboratory tests with <strong>the</strong> contractor, recovery will be made at penal rate <strong>of</strong> <strong>the</strong><br />

market rate prevailing at <strong>the</strong> time <strong>of</strong> effecting recovery plus 10%,whichever is higher as per rules, provided <strong>the</strong> same is not<br />

returned back by him in good and acceptable conditions to <strong>the</strong> departmental stores at his own cost.<br />

3.5 The contractor shall provide sufficient plant, equipments and labour and shall work such hours and shifts as may be<br />

necessary to maintain <strong>the</strong> progress schedule. The working and shift hours shall comply with all Govt, rules and regulations<br />

in <strong>for</strong>ce from time to time during <strong>the</strong> entire period <strong>of</strong> execution <strong>of</strong> <strong>the</strong> contract work.<br />

3.6 The contractor shall make adequate arrangement <strong>for</strong> <strong>the</strong> safety <strong>of</strong> <strong>the</strong> labourers during execution <strong>of</strong> <strong>the</strong> contract work. He<br />

will be responsible <strong>for</strong> any compensation <strong>for</strong> <strong>the</strong> same and will have to be paid by him as decided by <strong>the</strong> competent<br />

authority.<br />

3.7 The contractor should get <strong>the</strong> sample <strong>of</strong> all <strong>the</strong> materials approved by <strong>the</strong> E/I, be<strong>for</strong>e collecting <strong>the</strong> same <strong>for</strong> use at work<br />

site. The sample in sealed glass jars shall be kept in <strong>the</strong> custody <strong>of</strong> <strong>the</strong> E/I.<br />

3.8 The contractor shall have to get tested <strong>the</strong> strength <strong>of</strong> cement concrete(both plain & rein<strong>for</strong>ced)<strong>for</strong> each days casting as per<br />

IRC codes. Although achievement <strong>of</strong> <strong>the</strong> <strong>the</strong> prescribed cube strength is a must, concrete given lower value may be<br />

rejected or accepted at suitable reduced rate under specific orders <strong>of</strong> <strong>the</strong> competent authority. The cost <strong>of</strong> concrete cubes<br />

moulds, curing, carriage <strong>of</strong> cubes to and from <strong>the</strong> testing laboratory and all o<strong>the</strong>r incidental charges incurred in this regard<br />

shall be borne by <strong>the</strong> contractor.<br />

3.9 The contractor shall , if required by <strong>the</strong> E/I, must arrange <strong>for</strong> test <strong>of</strong> o<strong>the</strong>r materials at his own cost. If <strong>the</strong> quality <strong>of</strong> materials<br />

appears to be inferior or <strong>the</strong> portion <strong>of</strong> <strong>the</strong> work is found to be defective or unsound,<strong>the</strong> contractor may be asked to remove<br />

and or pull down and re-execute <strong>the</strong> same at his own cost or in case such defect is found out due to departmental fault he<br />

shall be paid at suitably reduced rates <strong>for</strong> that item <strong>of</strong> work .The contractor shall bear all cost in this regard.<br />

3.10 For works exceeding Rs.50 (Fifty) Lacs, it will be obligatory <strong>for</strong> <strong>the</strong> contractor to keep a properly equipped testing laboratory<br />

near <strong>the</strong> work site at his own cost, where he will get <strong>the</strong> samples tested by <strong>the</strong> department.<br />

3.11 All rejected materials will have to removed from <strong>the</strong> site by <strong>the</strong> contractor, after <strong>the</strong>ir rejection, within seven days from <strong>the</strong><br />

date <strong>of</strong> written order <strong>of</strong> E.E, failing which <strong>the</strong> E.E will get <strong>the</strong>se removed in whatsoever manner he thinks fit and will recover<br />

<strong>the</strong> cost involved <strong>for</strong> such removal from <strong>the</strong> contractor after lapse <strong>of</strong> seven days time.<br />

3.12 M.S.Bars, joint angles etc. will be issued in length available in <strong>the</strong> departmental stores. Their cut pieces in<br />

length less than 1/10 th shall not be taken back. While assessing <strong>the</strong> quantity <strong>of</strong> consumption in <strong>the</strong> work,<br />

wastage in such materials may be allowed up to maximum limit <strong>of</strong> 5% after due consideration by <strong>the</strong><br />

department. Cost <strong>of</strong> quantity allowed as wastage shall be recovered at issue rate <strong>of</strong> such materials as<br />

prescribed in para 1.15 <strong>of</strong> N.I.T.<br />

3.13 Issue rate <strong>of</strong> supply <strong>of</strong> Bitumen as mentioned in Para 1.15,includes cost <strong>of</strong> its drums, hence <strong>the</strong> empty<br />

bitumen drums are to be returned back in good condition to <strong>the</strong> stores from where it was issued, failing<br />

which its cost will be recovered from <strong>the</strong> bill <strong>of</strong> contractors @ Rs.75/-(seventy five) per drum.<br />

3.14 If <strong>the</strong> actual lead <strong>of</strong> materials like stone metal, stone chips, boulder, bricks, sand , moorum etc., is found to be less than <strong>the</strong><br />

lead provided in <strong>the</strong> BOQ, <strong>the</strong>n its payment will be made proportionately on reduced rate. (Reduction in rate will be made in<br />

<strong>the</strong> ratio <strong>of</strong> approved rate and rate provided in <strong>the</strong> BOQ remaining <strong>the</strong> same). In case <strong>the</strong><br />

actual lead is more than <strong>the</strong> lead provided in <strong>the</strong> BOQ it will be mandatory to obtain prior consent <strong>of</strong> <strong>the</strong> authority, who<br />

approved <strong>the</strong> tender, be<strong>for</strong>e commencement <strong>of</strong> supply <strong>of</strong> such materials from <strong>the</strong> increased lead.<br />

3.15 It will be essential to do all items <strong>of</strong> road works (Original work) in sequence from one end in scientific way, so as to<br />

complete <strong>the</strong> works up to next end. It should not be done in haphazard way such as collection <strong>of</strong> materials in same<br />

Kilometer, box- cutting in o<strong>the</strong>r Kilometers, consolidation work in patches etc., which leads to progress <strong>of</strong> all items <strong>of</strong> work<br />

simultaneously Kilomete-rwise,quantity- wise always from one edge end,so that <strong>the</strong> complete road is available <strong>for</strong> use in<br />

one strech from that end after completing <strong>the</strong> work in particular Kilometer,and <strong>the</strong>n only take up work in next Kilometer.<br />

3.16 After completion <strong>of</strong> work <strong>the</strong> contractor will remove all debris and fill up vats etc.,as desired by E/I and leave <strong>the</strong> site clear<br />

and tidy at his own cost.<br />

3.17 The department reserves <strong>the</strong> right <strong>of</strong> omitting or suspending <strong>the</strong> construction or changing site etc., if considered necessary<br />

stage.<br />

3.18 The following shall not be paid extra and <strong>the</strong> tendered rates shall be inclusive <strong>of</strong> those:-<br />

(i) Site clearance such as clearing <strong>the</strong> shrubs, bush, wood-undergrowth & small trees not exceeding 12” in girth measured<br />

at 3’ above <strong>the</strong> ground.(ii) Setting out works, pr<strong>of</strong>ile, lay-out etc. (iii) Venderurised battering or benching or excavation <strong>of</strong><br />

foundation trenches. (iv) Forming or loving “Toll – Tate” or witness in burrow pits and <strong>the</strong>ir removal after measurement.<br />

However deduction will be made in quantity <strong>of</strong> earth work <strong>for</strong> those.(v) Excavation <strong>for</strong> inserting <strong>of</strong> planking and<br />

shuttering.(vi) Forming (or leaving) stop in sides <strong>of</strong> deep excavation & <strong>the</strong>ir removal after measurement.(vii) Bailing out rain<br />

water/and or surface water in case <strong>the</strong> excavated foundation trenches were filled up by <strong>the</strong>se during entire period <strong>of</strong><br />

construction.(viii) Removingslipes <strong>of</strong> fells in excavation. (ix) Making vats, plat<strong>for</strong>m, channel etc.<br />

3.19 The contractor may use his own machinery <strong>for</strong> completion <strong>of</strong> <strong>the</strong> work within <strong>the</strong> time stipulated in <strong>the</strong> contract, <strong>the</strong> carriage<br />

<strong>of</strong> machinery to different sites under this contract from one place to ano<strong>the</strong>r <strong>for</strong> this work will be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong><br />

contractor and all expenses in this regard will be born by him.<br />

3.20 O<strong>the</strong>r machinery like asphalt, mixer, tar-boiler, pump, vibrator, concrete mixer etc., if available in <strong>the</strong> stores <strong>of</strong> <strong>the</strong> concerned<br />

division , may be issued to <strong>the</strong> contractor on his written request(on hire or free <strong>of</strong> cost as <strong>the</strong> case may be)on <strong>the</strong> terms<br />

quoted in his tender covers. Their hire charges, if applicable, along with its called expenses as detailed below in sub-paras<br />

3.20.1 to 3.20.10 which are to be <strong>for</strong> departmental machinery. The condition laid down in sub-para 3.20.1 to 3.20.10 will<br />

apply to departmental road roller issued to contractor.<br />

3.20.1 Hire charges <strong>of</strong> roller has been indicated in Para 1.15 <strong>of</strong> N.I.T. Hire charges <strong>of</strong> o<strong>the</strong>r machineries will be communicated<br />

on , and <strong>the</strong> same shall have to be accepted by <strong>the</strong> contractor. Prayer <strong>for</strong> reduction <strong>of</strong> hire charges so fixed shall not be<br />

entertained.<br />

3.20.2 Carriage and running charges <strong>of</strong> machineries, if any, including on incidental and contingent charges <strong>for</strong> transporting <strong>the</strong><br />

same from place <strong>of</strong> delivery to <strong>the</strong> work site and <strong>the</strong>ir return to <strong>the</strong> place <strong>of</strong> issue, shall be borne by <strong>the</strong> contractor on his<br />

own cost.<br />

3.20.3 Salary <strong>of</strong> roller driver, khalasi, operator <strong>of</strong> o<strong>the</strong>r machineries will be borne by <strong>the</strong> contractor <strong>for</strong> <strong>the</strong> period <strong>the</strong><br />

machineries in question remaining with <strong>the</strong> contractor. The period spent on it’s transport from place <strong>of</strong> issue to work site<br />

and back shall also be <strong>for</strong> <strong>the</strong>ir purpose. It will be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> contractor to obtain necessary in<strong>for</strong>mation<br />

regarding salary <strong>of</strong> <strong>the</strong> departmental staff.<br />

3.20.4 The cost <strong>of</strong> fuel and lubricants <strong>for</strong> running <strong>the</strong> machinery will be borne by <strong>the</strong> contractor.<br />

3.20.5 The plants and machineries issued on hire or free <strong>of</strong> cost to <strong>the</strong> contractor by <strong>the</strong> department will have to be maintained<br />

properly. In addition to its general daily maintenance and in case <strong>of</strong> roller, it shall also be cleaned in a week &<br />

stores required <strong>for</strong> cleaning i.e. kerosene oil, jute, grease, mobil etc. will have to be supplied by <strong>the</strong><br />

contractor at his own cost. The Mobil oil and C.Oil will have to be changed after 200(two hundred) &<br />

1000(one thousand) running hours respectively at his own cost.The quality <strong>of</strong> all <strong>the</strong> above materials, used,<br />

must be approved by <strong>the</strong> E/I be<strong>for</strong>e use.<br />

3.20.6 During <strong>the</strong> operation period, while <strong>the</strong> machinery is on work with <strong>the</strong> contractor, all minor repairs or break<br />

down ,costing up to Rs.1000/- at a time will be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> contractor and such repair should be<br />

completed within a maximum period <strong>of</strong> 3 days under intimation to concerned J.E, S.D. O & E.E.<br />

3.20.7 In case <strong>the</strong> contractor fails to supply <strong>the</strong> required fuels, lubricants and o<strong>the</strong>r stores required <strong>for</strong> running and<br />

proper maintenance <strong>of</strong> <strong>the</strong> departmental machineries, issued to contractor on hire or free <strong>of</strong> cost <strong>for</strong> using <strong>the</strong> same in<br />

<strong>the</strong> work, <strong>the</strong> same shall be supplied by <strong>the</strong> department & full cost, inclusive <strong>of</strong> handling, procurement and all o<strong>the</strong>r<br />

incidental charges shall be recovered from <strong>the</strong> contractor from next available bill. It will be responsibility <strong>of</strong> <strong>the</strong> concerned<br />

J.E and S.D.O to keep <strong>the</strong> contractor, E.E. and S.E in<strong>for</strong>med <strong>of</strong> such expenses well in time<br />

3.20.8 If <strong>the</strong> departmental road roller remains idle due to contractor’s fault, it’s cost will be recovered<br />

from <strong>the</strong> Contractor as per Schedule Rate <strong>for</strong> this item applicable at that time.<br />

3.20.9 Hire,establishment and o<strong>the</strong>r charges <strong>for</strong> <strong>the</strong> Idle or repair periods shall be borne by <strong>the</strong> contractor.<br />

3.20.10 In <strong>the</strong> event <strong>of</strong> loss or <strong>the</strong>ft <strong>of</strong> <strong>the</strong> machinery or any <strong>of</strong> its components in part or full when it stands issued to <strong>the</strong> contractor,<br />

NOT APPLICABLE <strong>the</strong> value <strong>of</strong> such lost articles will be recovered from <strong>the</strong> contractor at <strong>the</strong> price fixed by <strong>the</strong> S.E or<br />

E.E concerned.<br />

3.21 CLAIM NOT ADMISSIBLE under following circumstances :-<br />

a) Extra items <strong>of</strong> work done without written order <strong>of</strong> competent departmental <strong>of</strong>ficer.<br />

b) In case <strong>of</strong> sudden fluctuation and / or increase in rates <strong>of</strong> labour, materials, royalty, various taxes, railway freight, fuel,<br />

lubricants, carriage cost etc. at any stage <strong>of</strong> <strong>the</strong> work<br />

c) Short supply and / or non-supply and / or delay in supply <strong>of</strong> departmental materials and / or equipments.<br />

d) Non-availability <strong>of</strong> labour <strong>of</strong> any category required <strong>for</strong> <strong>the</strong> work.<br />

e) Labour sitting idle due to any reason / cases.<br />

f) Delay in communication regarding any charges or modification in design, drawing, specification, alteration & addition etc.<br />

g) Loss sustained due to :-<br />

1) Acts <strong>of</strong> enemies including agitation by Public and Riot.<br />

2) Transportation and Procurement difficulties.<br />

3) Natural Calamities.<br />

4) Any o<strong>the</strong>r circumstances out <strong>of</strong> bound <strong>of</strong> human control.<br />

h) Iron materials not issued in required length.<br />

3.22 In case Bulk Bitumen is issued by <strong>the</strong> department to <strong>the</strong> agency, no extra cost will be paid on account <strong>of</strong> lifting bulk<br />

bitumen from departmental godown in drums, empty <strong>the</strong>m and carriage <strong>of</strong> <strong>the</strong> same from <strong>the</strong> R.C.D godown to <strong>the</strong> site <strong>of</strong><br />

work and <strong>the</strong>se operations will have to be done by <strong>the</strong> contractor at his own cost.<br />

3.23 Proportionate deduction shall be made from <strong>the</strong> bill <strong>of</strong> <strong>the</strong> contractors <strong>for</strong> less leads <strong>of</strong> stone aggregates and moorum from<br />

<strong>the</strong>ir sources <strong>of</strong> actual receipt in comparison to those provided in <strong>the</strong> B.O.Q, but no extra payment will be made <strong>for</strong> more<br />

leads if any actually involved.<br />

3.24 Extension <strong>of</strong> time, if justified, may be granted by <strong>the</strong> different competent <strong>of</strong>ficers <strong>for</strong> different periods <strong>of</strong> time, <strong>for</strong> different<br />

types and values <strong>of</strong> works as noted below, o<strong>the</strong>rwise penalty <strong>for</strong> non-fulfillment <strong>of</strong> <strong>the</strong> contract may be imposed, after<br />

giving due consideration <strong>for</strong> poor progress at different stages <strong>of</strong> works without valid and satisfactory reasons. More<br />

payments <strong>of</strong> running account bills, keeping back certain amount <strong>for</strong> non-extension <strong>of</strong> time, does not qualify as a valid<br />

ground <strong>for</strong> grant <strong>of</strong> Extension <strong>of</strong> time as a matter <strong>of</strong> right. The Officer granting such extension <strong>of</strong> time has <strong>the</strong> full liberty to<br />

weight & examine <strong>the</strong> circumstances which led to such requirement <strong>for</strong> fulfillment <strong>of</strong> contract, and use his own discretion<br />

<strong>for</strong> passing final orders, which shall be treated as final and shall be binding and conclusive <strong>for</strong> <strong>the</strong> contractor.<br />

1. Executive Engineer i) Up to Any period <strong>for</strong> <strong>Repair</strong> Works.<br />

RCD,<strong>Road</strong> Division,Ranchi.ii) For Any period <strong>for</strong> Original works valued up to Rs.10,000/-<br />

iii) Up to 50 % above <strong>the</strong> contract period <strong>for</strong> original work valued between Rs.10,000/- to<br />

50,000/-<br />

2. Superintending Engineer i) Up to Any period <strong>for</strong> Original Works <strong>of</strong> value between Rs.10 to 50 thousand.<br />

RCD,<strong>Road</strong> Circle,Ranchi ii) Up to 100 % above <strong>the</strong> contracted period <strong>for</strong> <strong>the</strong> original work <strong>of</strong> value between<br />

50,000/- to 50 lakhs.<br />

3. Chief Engineer( Com. ) i) Up to Any o<strong>the</strong>r period <strong>for</strong> work up to Rs.5 Lacs.<br />

RCD, Jharkhand, ,Ranchi. ii) 100 % above <strong>the</strong> contracted period in case <strong>of</strong> Original Works <strong>of</strong> 5 lakh to 10 lac<br />

iii) For granting extension beyond 100 % <strong>of</strong> time <strong>of</strong><br />

completion in respect <strong>of</strong> work <strong>of</strong> <strong>the</strong> value between Rs. 5 Lacs & Rs.10 Lacs and <strong>for</strong> any extension to Rs. 5 Lacs &<br />

Rs.10 Lacs and <strong>for</strong> any extension to work <strong>of</strong> value above Rs. 10 Lacs,<strong>the</strong> Chief Engr will grant extension<br />

after bringing into <strong>the</strong> notice <strong>of</strong> <strong>the</strong> Government.<br />

3.25 The contractor shall, if required by <strong>the</strong> E/I arrange to test materials at site or get <strong>the</strong>m tested in recognised departmental<br />

testing laboratories at his own cost in order to prove <strong>the</strong>ir soundness and sufficiency as per specifications laid down. The<br />

number <strong>of</strong> tests required <strong>for</strong> different items will be specified by <strong>the</strong> E/I.<br />

3.26 The estimated output <strong>of</strong> <strong>the</strong> roller <strong>for</strong> 8 hours working is as follows :-<br />

Compaction <strong>of</strong> Moorum / Gravel. 566.00 m3<br />

Compaction <strong>of</strong> Earth Work. 566.00 m3<br />

Consolidation <strong>of</strong> Grade – I 25.00 m3<br />

Consolidation <strong>of</strong> Grade – II 25.00 m3<br />

3.27 The Contractor will have to give an affidavit <strong>for</strong> <strong>the</strong> Hot Mix Plant and o<strong>the</strong>r equipments shown as credential will be<br />

deployed <strong>for</strong> completion <strong>of</strong> this specific work on top most priority basis.<br />

3.28 (i) In case <strong>of</strong> <strong>the</strong> rate <strong>of</strong> tender is accepted above <strong>the</strong> B.O.Q. rate by <strong>the</strong> competent authority, <strong>the</strong><br />

enhanced% <strong>of</strong> rate shall not be applicable over <strong>the</strong> cost <strong>of</strong> bitumen.<br />

(ii) In case <strong>of</strong> rate quoted by <strong>the</strong> Agency is less than <strong>the</strong> B.O.Q. rate <strong>the</strong>n <strong>the</strong> less% <strong>of</strong> rate shall be<br />

applicable on <strong>the</strong> cost <strong>of</strong> bitumen also.<br />
