1.9<br />

∗ A programs <strong>of</strong> work <strong>of</strong> this <strong>tender</strong> so as to complete the same within the time requited <strong>by</strong><br />

the <strong>tender</strong>er.<br />

It will be obligator for the Tender keep their open for acceptance for a period <strong>of</strong>180 days from<br />

the date <strong>of</strong> its opening.<br />

1.10 Conditional <strong>tender</strong> shall not be considered valid.<br />

1.11 Authority is reserved to reject any or all <strong>tender</strong>s received or to all to the work to one or more<br />

contractor without assigning any reason.<br />

1.12 In the case <strong>of</strong> successful <strong>tender</strong>er (hereinafter called contractor) the amount <strong>of</strong> E.M. will be<br />

transferred to wards the initial security deposit (I.S.D) which will have to be augmented so that<br />

I.S.D. will be 5% <strong>of</strong> approved amount <strong>of</strong> <strong>tender</strong> and further 5% shall be deducted form the bills.<br />

1.13 The earnest money <strong>of</strong> successful <strong>tender</strong>er, which accompanied the <strong>tender</strong> will be forfeited in<br />

case the <strong>tender</strong>er fails to turn upto sing the agreement or to deposit the balance amount <strong>of</strong> I.S.D.<br />

within 10 days <strong>of</strong> being called upon to do so.<br />

1.14 Tender notice through press this (N.I.T) enclosures accompanying the <strong>tender</strong> document Ministry<br />

<strong>of</strong> Road Transport & Highway specifications for Road & Bridges (Fourth Revision) and all<br />

correspondences leadings to final disposals <strong>of</strong> <strong>tender</strong> will form part <strong>of</strong> the contract documents.<br />

1.15 (a) Departmental materials if supplied <strong>by</strong> the department will be charged from the contractor at<br />

issue rates & at the place <strong>of</strong> delivery as mentioned below against each item. (Carriage or<br />

transportation <strong>of</strong> these materials <strong>of</strong> the work site is to be done <strong>by</strong> the contractor at his own cost.<br />

Note:-<br />

∗ In case bulk bitumen is <strong>issued</strong> arrangement for empty drums and its filling in to empty<br />

drums and its transportation handling etc. and other incidental expenses in this regard shall<br />

be borne <strong>by</strong> contractor is shall not be reimbursed in any case.<br />

∗ Issue rate <strong>of</strong> the bulk Bitumen shall be equals to that <strong>of</strong> the packed bitumen and the<br />

contractors shall not question the issuing authority regarding the type be delivered.<br />

∗ Damage or flattened empty bitumen drums will not be taken back and therefore its cost will<br />

be recovered @Rs 170/- each. Damage empty cement bags also will not be taken back and<br />

therefore its cost will be recovered @ ` 3.20 each.<br />

∗ Hire charges <strong>of</strong> <strong>road</strong> roller not above does not include the cost <strong>of</strong> P.O.I. but its cost <strong>of</strong><br />

included in the departmental rates mentioned in chapter-5 <strong>of</strong> the <strong>tender</strong> documents therefore<br />

the contractor has to bear the additional cost <strong>of</strong> P.O.L. which shall neither be repaid to him<br />

not an claim shall be accepted in this regard.<br />

∗ (a) Roller shall be delivered at a place where it is available on the same shall be carried to<br />

work site <strong>by</strong> the contractor at this own cost and his will return beak the roller to the nearest<br />

NH stores as per the direction <strong>of</strong> E/I at his own cost. Expenditure on this account shall not<br />

be recourse.<br />

(b) All materials (including bitumen grade 60/70 polymer modified or any other grade as the<br />

case may be will be supplied <strong>by</strong> the contractor. Recovery will be done @ Rs 85/- each for<br />

damaged/flattened drums because the cost <strong>of</strong> packed bitumen is finally borne <strong>by</strong> the<br />

department short all in return <strong>of</strong> empty bitumen drums shall be recovered at penal rate vide<br />

clause 3.17 <strong>of</strong> chapter-3 (Special revision) <strong>of</strong> <strong>tender</strong> document.
