● Do other women want him?<br />

■ When the defendant bashes the victim in his testimony. Show the<br />

difference between the time of the rape and now.<br />

● He liked her enough then to have sex with her–why does he have<br />

negative things to say now?<br />

● Contrast the romantic descriptions of the encounter vs. negative<br />

descriptions of the victim.What happened to change things, if not<br />

the rape? Corroborate the lack of pre-rape conflict.<br />

● Did the victim’s behavior change after the rape?<br />

● What motive does she have to lie? If she is normally a liar, why<br />

was he with her?<br />

■ If there is evidence that the defendant manipulated the victim, lied to<br />

her, or tricked her, ask about it.<br />

■ Inconsistent actions. Did the defendant say one thing but act inconsistently?<br />

Does he have a girlfriend? A wife? If so, why was he with the<br />

victim?<br />

■ Post-rape behavior that shows consciousness of guilt. Is his behavior<br />

consistent with consensual sex? Actions speak louder than words. Show<br />

any changes in the defendant’s behavior and inconsistent acts.<br />

■ Does the defendant believe rape myths and stereotypes? Be cautious<br />

with this line of questioning. It will only be effective if the jury recognizes<br />

that the defendant’s beliefs are false.“<strong>Sexual</strong>ly assaultive men<br />

often describe women who drink in bars as ‘loose,’ immoral women<br />

who are appropriate targets for sexual aggression.” 101 “For example,<br />

incarcerated rapists often rationalize that their victim either desired or<br />

deserved to experience forced sexual acts.” 102<br />

● What behavior does he think constitutes consent?<br />

• Kissing?<br />

• Fondling?<br />

• Drinking?<br />

• Wearing certain clothing?<br />

• Going to a bar by herself?<br />

When cross-examining, remember that some men may purposely get<br />

drunk when they want to act sexually aggressive, in order to use intoxi-<br />
