Summary:<br />

Facts: Plaintiffs filed a lawsuit seeking the payment of three instalments for the hire of a piano.<br />

Plaintiff explained that defendants had signed an agreement whereby they undertook<br />

to hire the use of piano with the possibility of purchasing the piano. Plaintiff explained that<br />

before signing the contract he explained the contents thereof to defendants in particular<br />

clause 7 thereof whereby if defendant decided to purchase the piano within 6 months the<br />

loan paid would be deducted from the price of the piano and the piano can be bought by instalments.<br />

However if the piano is bought within two years half the loan paid would be deducted<br />

from the value of the piano.<br />

Reasons: The Tribunal held that this case related to the hire of a piano whereby one had<br />

the facility of also buying the piano. From the evidence submitted it resulted that defendants<br />

were happy to continue using the piano without actually buying it. It resulted that defendants<br />

never took any steps to terminate the agreement of hire and return the piano. The Tribunal<br />

noted that this was a case where both parties were fully aware of the applicable terms and<br />

conditions and that no one tricked anyone. Defendants in defence of their case were contesting<br />

on the basis of fairness the terms of the agreement. The Tribunal however questioned<br />

whether it is fair that one continued to use a product and when asked to pay refuses<br />

to do so. The Tribunal further noted that contrary to what was alleged there was no breach<br />

of articles 44 and 45 regulating the use of unfair terms and decided to up-hold the claims of<br />

plaintiffs<br />

Ra r-RISPOSTA tal-konvenuti formulata hekk:-<br />

1. In-nullita’ tal-kuntratt tal-11 ta’ Jannar 2002 illi abbazi tieghu qieghda ssir din il-kawza,<br />

stante illi fih klawzoli mhux gusti ai termini tal-Artikli 44 u 45 tal-att dwar l-Affarijiet tal-<br />

Konsumatur (Kap 378 tal-Ligijiet ta’ Malta)<br />

il-kerrej jiddeciedi li jixtri lpjanu fi zmien sitt xhur, il-kera kollha tigi mnaqqsa millvalur talpjanu<br />

u l-pjanu jkun jista’ jinxtara ‘by installments’, izda jekk il-pjanu jinxtara fi zmien sentejn,<br />

nofs il-kera mhallsa tigi mnaqqsa mill-valur tal-pjanu.<br />

3 ____ Il-hlas miftiehem ta’ sitt xhur bil-quddiem, qatt ma kienet puntwala fih minkejja ghadd<br />

ta’ reminders – bilposta xi drabi b’kopja lir-ragel, u bit-telefon.<br />

4 _____Ara, per ezempju l-ittra Dok C a fol 25. Dwar irreminders giet esibita l-formula Dok B<br />

(a fol 26). Din ilformula fiha provvediment dwar eventwali xiri tal-pjanu.<br />

5 ______ Finalment ix-xhud qal li l-quantum ta’ €1,088.46 jirraprezenta tliet skadenzi ta’ kera<br />

B1 _______John Formosa qal li hu kien konxju ta’ dak li ghamlet martu u diversi pagamenti<br />

saru minnu. Matul issnin hallsu xi €4,000 plus VAT. Hu rrifjuta li jhallas ammont ta’ €1102.21<br />

billi hu kien ga hallas aktar mill-valur tal-pjanu u “kont ghidtilhom jigu jigbru l-pjanu jekk iridu.<br />

Din ghadha l-pozizzjoni tieghi”.<br />

2 Hu ma rax il-kuntratt. Il-pjanu ma rritornahx u meta<br />

jridu l-atturi jistghu imorru ghalih jew jibghatulhom hu.<br />

3 Dwar ic-cirka €4000 li hallas, ipprometta li jgib lista bid-dati.<br />

KONSIDERAZZJONIJIET<br />

It-TRIBUNAL ikkonsidra kif gej:<br />

1. _________Hawn ghandna kuntratt ta’ kiri ta’ pjanu, kuntratt bilmiktub li joffri wkoll il-facilita’<br />

lil min jikri l-pjanu li jixtrih. Kollox imnizzel bid-dettalji: il-valur tal-pjanu u t-termini talakkwist,<br />

anke bin-nifs. Hemm ukoll kif l-akkwirenti ikun jista jibbenifika mir-rati ta’ kiri mhallsa.<br />

2. Il-kuntratt iffirmatu Mrs Formosa izda zewgha stqarr li kien jaf bih u anke hallas xi pagamenti<br />

tal-kera. Mela hawn ghandna “patti chiari” ghall-konjugi Formosa.<br />

3. ___ L-atturi qed jitolbu tliet rati ta’ kera’ fl-ammont komplessiv ta’ €1088.46 – mela €362.82<br />

kull skadenza. Il-valur tal-pjanu hu fid-Dok A moghti bhala LM1490 – illum €2654.73. Ilkuntratt<br />

hu datat 11 ta’ Jannar 2002 – oltre 8 snin ilu. B’danakollu il-konvenuti kienu kuntenti<br />

li ma jutilizzawx l-ghazla li jakkwistaw il-pjanu imma li jibqghu f’relazzjoni ta’ kirja.<br />

4. _Wiehed ma jistax ma josservax l-attitudni ta’ John Formosa li tittrapela mix-xhieda tieghu:<br />

a) Kien konxju tal-ftehim tant li anke ghamel xi pagamenti hu, pero’ l-kuntratt qatt ma rah.<br />

b) “kont ghidtilhom jigbru l-pjanu jekk iridu”<br />

c) Waqt li jigi mfakkar li John Formosa kien qed jixhed fl-udjenza tas-16 ta’ Dicembru 2010 –<br />

mela kwazi 10 snin fuq il-firmar tal-kuntratt ta’ kiri (bix-xiri prospettat bhala “option” li setghu<br />

juzufruwixxu ruhhom minnha lkonvenuti), ir-relazzjoni bejn il-kontendenti baqghet dejjem dik<br />

gejja minn kirja u l-konvenuti qatt, b’mod inekwivoku ma daru ghall-akkwist tal-pjanu.<br />

d) Sa meta kien jixhed, John Formosa qal “Jiena ma rritornajtx lura l-pjanu, jiena ghidt lis-<br />

Sur Barbara biex jigi ghalih meta jrid. Jekk irrid nista nirritornahulu lura”. B’danakollu lkonvenuti<br />

qatt ma hadu passi definitivi biex<br />

jitterminaw il-kija u jirritornaw il-pjanu. Hu legittmu li wiehed jahseb li fil-familja Formosa dan<br />

il-pjanu mhux qed semplicement iharsu lejh jew iqisuh bhala xi ornament filkamra fejn qieghed!<br />

e) John Formosa wieghed li ser jipprezenta lista ta’ pagamenti – haga li qatt ma saret – hu<br />

x’inhu s-siwi ta’ tali dokument.<br />

5. _________ Hawn ghandna ftehim kummercjali fejn kull naha kienet konsapevoli ta’ kulma<br />

kien qed isir. Hadd ma qarraq b’hadd. Il-konvenuti, quddiem il-principju baziku in materia illi<br />

pacta servanda sunt qed javanzaw l-ekwita. U hawn tigi l-kosiderazzjoni: hu ekwu li wiehed<br />

jibqa jinqeda bl-oggett ghat-tul ta’ zmien li jaghzel hu u meta jigi ssikkat ghall-hlas jghid li ttotal<br />

imhallas bhala rati ta’ kirja jizboq il-prezz tal-oggett? Hu ekwu li min ikollu f’idejh loggett<br />

ma jghid qatt: “daqshekk” u jibghat l-oggett lura?<br />

6. ________ F’dawn ic-cirkostanzi ma hemm l-ebda ksur ta’ dak indikat fl-artikolu 44 u 45 tal-<br />

Kap 378 tal-Ligijiet ta’ Malta. It-TRIBUNAL meta jqis ic-cirkostanzi tal-kaz u fuq principju ta’<br />

ekwita’ ihoss li dak li qed jitolbu l-atturi hu dovut lilom mill-konvenuti.<br />

DECIZJONI<br />

Meqjus dak kollu kunsidrat it-Tribunal wara li jichad leccezzjonijiet tal konvenuti jikkundannahom<br />

in solidum ihallsu lill-atturi l-quantum ta’ elf, mija u zewg Ewro wiehed u ghoxrin centezmi<br />

(€1,102.21c) kif mitlub in solidum, blimghax mid-9 ta’ Dicembru 2009 sal-jum talpagament<br />

effettiv. Il-konvenuti ghandhom ihallsu l-ispejjes talkawza.<br />
