4. Prior to the conclusion of a contract, whether or not advice is given, the insurance
intermediary or insurance undertaking shall give the customer the relevant
information about the insurance product in a comprehensible form to allow the
customer to make an informed decision, while taking into account the complexity of
the insurance product and the type of costumer.

Information exemptions and flexibility clause
41. The information referred to in paragraphs 1,2 and 3 Articles 16, 17 and 18
need not be given when the insurance intermediary or insurance undertaking
mediates in the insurance of large risks, nor in the case of mediation by reinsurance
intermediaries or reinsurance undertakings, or in relation to professional
customers as specified in the Annex .
52. Member States may maintain or adopt stricter provisions regarding the information
requirements referred to in paragraph 1 Articles 16, 17 and 18 provided that
such provisions comply with Community Union law. Member States shall
communicate to EIOPA and the Commission the such national
provisions set out in the first subparagraph.
3. In order to establish a high level of transparency by all appropriate means, the
Commission EIOPA shall ensure that the information it receives relating to
national provisions is also communicated to consumers, and insurance intermediaries
and insurance undertakings .

1. All information to be provided to customers in accordance with Articles 12 16,
17 and 18 shall be communicated to the customers :
(a) on paper or on any other durable medium available and accessible to the
customer;
