JOHN WATKINS, M.P., Minister for Corrective Services Minister for Fair Trading Minister for Sport and Recreation CRIMINAL PROCEDURE (PRE TRIAL DISCLOSURE) ACT 2001 PRACTICE NOTE NO. 59 The Criminal Procedure (Pre Trial Disclosure) Act 2001 contains provisions requiring the prosecution to present an indictment within four weeks after the committal of the accused for trial. The purpose of the amendment to the Act was to ensure a quick resolution of trial matters and to bring certainty into the progress of trials at the earliest opportunity. In Sydney, in particular, there has been a practice for some time for the prosecution to present a draft indictment as early as one or two weeks after the committal of a case for trial. It is desirable for that practice to be encouraged and it is desirable that the new provisions do not discourage the prosecution from presenting an earlier indictment. For that reason, the Court will adopt a policy of granting leave to the prosecution to amend the indictment if an indictment is presented prior to the expiration of one month from committal and the variation is sought to be made within one month after committal. It will, of course, be necessary for the prosecution to notify the defence of the proposed amendment before application is made to the Court. The Hon. Justice R.O.
