(2000) Amendments to subpart 5 (a) dispenses with the need for reference<br />

to the Division of the <strong>Court</strong> to avoid confusion resulting from the<br />

requirement to file papers, in accordance with Local Rule 5.1.B, in the<br />

Division where the assigned Judge is chambered, which is different from<br />

the Division in which the case is venued. A corresponding change is made<br />

to the sample form following the Local Rule.<br />

(2001) The amendments to Subsection A are intended to facilitate the<br />

process of document imaging by reducing the time spent on disassembling<br />

documents in preparation for scanning and decreasing the frequency of<br />

equipment failure caused by undetected fastening material.<br />

(2003) The addition of Local Rule 5.1.D is intended to assist the <strong>Court</strong><br />

in understanding the purpose for which materials are filed.<br />

(2007) Amended to conform to CM/ECF Administrative Procedures by making<br />

distinction between form required for papers filed conventionally and<br />

those filed electronically (paragraphs A & B) , eliminating the reference<br />

to three-judge court filings (paragraph C) , and renumbering the<br />

paragraphs accordingly (D becomes C; E becomes D).<br />

(2009) Amended to eliminate the requirement to file multiple copies of<br />

initial process, which CM/ECF renders unnecessary, and to supply<br />

additional formatting requirements for pleadings, motions, and other<br />

papers filed with the <strong>Court</strong>.<br />

(<strong>2010</strong>) Amended to conform tabulation to the style used in the federal<br />

rules of procedure.<br />

Rule 5.2 Proof of Service and Service by Publication<br />

ftr(a) Certification of Service. Each pleading or paper required by<br />

Federal Rule of Civil Procedure 5 to be served on the other parties shall<br />

include a certificate of service that complies with Form B to the CM/ECF<br />

Administrative Procedures and, if service includes a method other than<br />

CM/ECF, that states the persons or firms served, their relationship to<br />

the action or proceeding, the date, method and address of service.<br />

Signature by the party or its attorney on the original constitutes a<br />

representation that service has been made.<br />

B-r(b) Initial Process. Initial process shall be issued by the Clerk's<br />

Office upon submission of an original and three (3) copies.<br />

G^-(c) Publication. Publication required by law or rule of court shall be<br />

made in a newspaper of general circulation. The Daily Business Review<br />

and such other newspapers as the <strong>Court</strong> from time to time may indicate are<br />

designated as official newspapers for the publication of notices<br />

pertaining to proceedings in this <strong>Court</strong>; provided, however, that<br />

publication shall not be restricted to the aforesaid periodicals unless<br />

an order for publication specifically so provides.<br />
