Comments<br />

(1996) The purpose of this rule is to curb unprofessional conduct at<br />

depositions.<br />

(2001) Local Rule 30.1.A.3 is amended to conform to the December 2000<br />

amendment of Federal Rule of Civil Procedure 30.<br />

(<strong>2010</strong>) Amended to conform tabulation to the style used in the federal<br />

rules of procedure.<br />

Rule 34.1 Marking Documents<br />

A party producing documents in discovery shall sequentially number the<br />

pages produced and precede the numbers with a unique prefix, unless so<br />

marking a document would materially interfere with its intended use or<br />

materially damage it (e.g., an original promissory note or other original<br />

document of intrinsic value). If documents were obtained from a<br />

non-party via subpoena duces tecum or other means, the party producing<br />

the documents shall mark them with a distinctive alphanumeric prefix<br />

indicating their source. In the event a party produces documents as kept<br />

in the ordinary course of business, the producing party's obligation to<br />

sequentially number the pages applies only to the documents selected for<br />

copying by the receiving party.<br />
