<strong>Agency</strong>’s Comments on Draft <strong>Report</strong><br />
This is in response to your January 24, 2013, email providing an opportunity to comment on the<br />
draft Office of Inspector General report and requesting feedback on concurrence or nonconcurrence<br />
with the findings and proposed recommendations from the OIG’s audit of the<br />
Tennessee Department of Transportation’s American Recovery and Reinvestment Act (Recovery<br />
Act) Diesel Emissions Reduction Act (DERA) Project Grant, EPA Grant No. 2A-95425709. The<br />
U.S. <strong>Environmental</strong> <strong>Protection</strong> <strong>Agency</strong>, Region 4, has reviewed the draft report and compared<br />
the findings and recommendations to the information available in the project file and<br />
supplemental information provided by the grantee. Based on this information, we offer the<br />
following response on the draft report which concluded that: (1) TDOT did not ensure<br />
compliance with the Buy American requirements stipulated in the Recovery Act for its EPA<br />
DERA truck stop electrification (TSE) cooperative agreement; and (2) TDOT potentially<br />
overstated project results and the project may not achieve expected environmental and human<br />
health benefits.<br />
Response to Finding 1:<br />
1. The EPA provided a written determination to the TDOT that the Buy American<br />
provisions do not apply to its truck stop electrification project. While we continue to<br />
believe that this is an accurate determination, we contacted TDOT to see if it had any<br />
additional information that would factually address the concerns raised in the draft report<br />
