<strong>Russia</strong>n foreign agents. The def<strong>in</strong>itions of NKOs do not exclude governmental organizations if they<br />

are not foreign NKOs, so the def<strong>in</strong>ition <strong>in</strong> this perspective is broader than the def<strong>in</strong>ition of nongovernmental<br />

organization (NGO).<br />

The sixth section of the second article of the NKO Law (consultantplyus.) makes the basic<br />

dist<strong>in</strong>ction and def<strong>in</strong>ition of the NKO's as foreign agents as follow<strong>in</strong>g:<br />

• A non-commercial organization act<strong>in</strong>g as a foreign agent <strong>in</strong> the present Federal law is<br />

a <strong>Russia</strong>n NKO that receives money and other property from foreign states and their<br />

public authorities, <strong>in</strong>ternational and foreign organizations, foreign citizens, stateless<br />

persons or persons authorized by them, and (or) from the <strong>Russia</strong>n legal entities that<br />

receive money and other property from specified sources (except for public companies<br />

with state participation, and their subsidiaries), and is <strong>in</strong>volved <strong>in</strong> political activities <strong>in</strong><br />

the <strong>Russia</strong>n Federation.<br />

In mak<strong>in</strong>g the basic dist<strong>in</strong>ction of be<strong>in</strong>g an NKO act<strong>in</strong>g as a foreign agent, the codification implies<br />

that an NKO cannot be def<strong>in</strong>ed as a foreign agent if it is not <strong>Russia</strong>n NKO. It must receive benefits<br />

from non-<strong>Russia</strong>n sources or <strong>Russia</strong>n sources which receive money from abroad consequently<br />

mak<strong>in</strong>g each source of organization f<strong>in</strong>anc<strong>in</strong>g and donations throughoutly accounted. All the NKOs<br />

receiv<strong>in</strong>g foreign money are required by the NKO Law's article 32’s third section to report on all the<br />

funds received from foreign sources or foreign agent NKOs and to detail how these funds are<br />

allocated or used <strong>in</strong> their annual reports to authorities. Further supported by amendments to the<br />

article, the def<strong>in</strong>ition of a foreign agent NKO does not apply to organizations with any direct<br />

<strong>Russia</strong>n public (state or municipal) adm<strong>in</strong>istrational participation <strong>in</strong> them. The <strong>Russia</strong>n juridical<br />

basic unit NKO compared to the <strong>in</strong>ternationally established NGO <strong>in</strong>stitutions, do not make<br />

exclusion to governmental agency <strong>in</strong> the organization thus mak<strong>in</strong>g already the start<strong>in</strong>g po<strong>in</strong>t per se<br />

different compared to the popular western idea of NGOs as basic units of civil society. Consider<strong>in</strong>g<br />

this basic idea of NKOs with the def<strong>in</strong>ition accord<strong>in</strong>g to which domestic adm<strong>in</strong>istrative<br />

participation <strong>in</strong> an NKO is a repeal<strong>in</strong>g factor for the foreign agent recognition, the idea of foreign<br />

agent NKOs can be considered to have relatively much state <strong>in</strong>fluence compared to the basic idea of<br />

NGOs where civil movements work <strong>in</strong>dependently.<br />

The list of foreign sources of money and other property is holistically <strong>in</strong>clusive. Compared<br />

to the def<strong>in</strong>itions of political action of foreign agent, which as well is relatively <strong>in</strong>clusive, the<br />

def<strong>in</strong>ition of foreign assets of foreign agents could be almost anyth<strong>in</strong>g. Neither is there any<br />

m<strong>in</strong>imum proportion of foreign assets for an NKO to be def<strong>in</strong>ed a foreign agent. Such a wide scope<br />

comprehension of foreign assets <strong>in</strong> foreign agent def<strong>in</strong>ition without any exceptions except the
