189. Appeal at Navigation Point Middleton Road<br />
(APP/H0724/A/11/2167553) (Assistant Director, Regeneration<br />
and Planning)<br />
Members were informed of the outcome of an appeal in relation to the<br />
refusal of the Local Planning Authority to grant planning permission for the<br />
above development.<br />
It was noted that the Inspector had allowed the appeal subject to conditions<br />
and the Appellant was awarded costs in relation to unreasonable behaviour<br />
by the <strong>Council</strong> which resulted in unnecessary expense. A copy of the<br />
decision letters were attached to the report.<br />
Members requested details of the costs awarded, when known, be reported<br />
to a future meeting.<br />

190. Local Government (Access to Information) (Variation<br />
Order) 2006<br />
Under Section 100(A)(4) of the Local Government Act 1972, the press and<br />
public were excluded from the meeting for the following items of business<br />
on the grounds that they involved the likely disclosure of exempt information<br />
as defined in the paragraphs referred to below of Part 1 of Schedule 12A of<br />
the Local Government Act 1972 as amended by the Local Government<br />
(Access to Information) (Variation) Order 2006.<br />

Planning This item contains exempt information under Schedule 12A Local<br />

a claim to legal professional privilege could be maintained in legal<br />
proceedings (para 5) and information which reveals that the authority<br />
proposes (a) to give under any enactment a notice under or by virtue of<br />
which requirements are imposed on a person; or (b) to make an order or<br />
