Equality with nati<strong>on</strong>als extends also to emergency medical care (Art. 28) 20 and to social<br />

security (Art 27), although it is not insignificant that <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> links <strong>the</strong> right to social<br />

security to <strong>the</strong> fulfillment <strong>of</strong> requirements that may exist in applicable domestic legislati<strong>on</strong><br />

and bilateral and multilateral treaties. Children <strong>of</strong> a migrant worker have <strong>the</strong> right <strong>of</strong> access to<br />

educati<strong>on</strong> <strong>on</strong> <strong>the</strong> basis <strong>of</strong> equality <strong>of</strong> treatment with nati<strong>on</strong>als <strong>of</strong> <strong>the</strong> State c<strong>on</strong>cerned (Art. 30).<br />

• C<strong>on</strong>fiscati<strong>on</strong> <strong>of</strong> identity documents<br />

The C<strong>on</strong>venti<strong>on</strong> prohibits <strong>the</strong> practice <strong>of</strong> c<strong>on</strong>fiscati<strong>on</strong> by employers <strong>of</strong> migrant workers’<br />

passports and states clearly that <strong>on</strong>ly public <strong>of</strong>ficials duly authorised by law are allowed to<br />

c<strong>on</strong>fiscate or destroy identity documents, entry permits, residence permits or work permits<br />

(Art. 21).<br />

• Transfer <strong>of</strong> earnings<br />

Up<strong>on</strong> <strong>the</strong> terminati<strong>on</strong> <strong>of</strong> <strong>the</strong>ir stay in <strong>the</strong> State <strong>of</strong> employment, all migrant workers and<br />

members <strong>of</strong> <strong>the</strong>ir families have <strong>the</strong> right to transfer <strong>the</strong>ir earnings and savings as well as <strong>the</strong>ir<br />

pers<strong>on</strong>al effects and bel<strong>on</strong>gings (Art. 32).<br />

• Right to informati<strong>on</strong><br />

<strong>Migrant</strong> workers and members <strong>of</strong> <strong>the</strong>ir families have <strong>the</strong> right to be informed by States <strong>of</strong><br />

origin, <strong>of</strong> transit and <strong>of</strong> employment about <strong>the</strong>ir rights arising from <strong>the</strong> present C<strong>on</strong>venti<strong>on</strong> as<br />

well as <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> <strong>the</strong>ir admissi<strong>on</strong>, and <strong>the</strong>ir rights and obligati<strong>on</strong>s in those States. Such<br />

informati<strong>on</strong> should be made available to migrant workers free <strong>of</strong> charge and in a language<br />

understood by <strong>the</strong>m (Art. 33).<br />

• Respect for cultural identity<br />

States parties shall ensure respect for <strong>the</strong> cultural identity <strong>of</strong> all migrant workers and members<br />

<strong>of</strong> <strong>the</strong>ir families and shall not prevent <strong>the</strong>m from maintaining cultural links with <strong>the</strong>ir country<br />

<strong>of</strong> origin (Art. 31). States parties must also respect <strong>the</strong> liberty <strong>of</strong> parents to ensure <strong>the</strong><br />

religious and moral educati<strong>on</strong> <strong>of</strong> <strong>the</strong>ir children in c<strong>on</strong>formity with <strong>the</strong>ir own c<strong>on</strong>victi<strong>on</strong>s (Art.<br />

12, para. 4).<br />

• Obligati<strong>on</strong> to comply with local law<br />

All migrant workers and members <strong>of</strong> <strong>the</strong>ir families have <strong>the</strong> obligati<strong>on</strong> to comply with <strong>the</strong><br />

laws and regulati<strong>on</strong>s <strong>of</strong> any State <strong>of</strong> transit or <strong>of</strong> employment as well as <strong>the</strong> obligati<strong>on</strong> to<br />

respect <strong>the</strong> cultural identity <strong>of</strong> <strong>the</strong>ir inhabitants (Art. 34).<br />

20 O<strong>the</strong>r human rights treaties go bey<strong>on</strong>d <strong>the</strong> protecti<strong>on</strong> provided in <strong>the</strong> ICRMW. The Internati<strong>on</strong>al<br />

Covenant <strong>on</strong> Ec<strong>on</strong>omic, Social and Cultural Rights (ICESCR) in its Article 12 states that: “The States<br />

Parties to <strong>the</strong> present Covenant recognize <strong>the</strong> right <strong>of</strong> every<strong>on</strong>e to <strong>the</strong> enjoyment <strong>of</strong> <strong>the</strong> highest<br />

attainable standard <strong>of</strong> physical and mental health.” The Committee <strong>on</strong> Ec<strong>on</strong>omic, Social and Cultural<br />

Rights (CESCR), which supervises <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> this Covenant has emphasised, in its General<br />

Comment No. 14 <strong>on</strong> Article 12, that “(…) States are under <strong>the</strong> obligati<strong>on</strong> to respect <strong>the</strong> right to health<br />

by, inter alia, refraining from denying or limiting equal access for all pers<strong>on</strong>s, including pris<strong>on</strong>ers or<br />

detainees, minorities, asylum seekers and illegal immigrants, to preventive, curative and palliative<br />

health services (…)”.<br />
