Strict supervisi<strong>on</strong> <strong>of</strong> recruitment operati<strong>on</strong>s in countries <strong>of</strong> origin is also an important tool in<br />

preventing unlawful practices, including trafficking. Article 66 <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> restricts <strong>the</strong><br />

right to undertake operati<strong>on</strong>s for <strong>the</strong> recruitment <strong>of</strong> migrant workers to <strong>the</strong> public services <strong>of</strong><br />

<strong>the</strong> country <strong>of</strong> origin, <strong>the</strong> public services <strong>of</strong> <strong>the</strong> country <strong>of</strong> employment <strong>on</strong> <strong>the</strong> basis <strong>of</strong> an<br />

agreement between <strong>the</strong> two countries or a body established by virtue <strong>of</strong> a bilateral or<br />

multilateral agreement. As far as private agencies or employers are c<strong>on</strong>cerned, <strong>the</strong>y should<br />

<strong>on</strong>ly be allowed to recruit migrant workers if <strong>the</strong>y have obtained <strong>the</strong> requisite authorisati<strong>on</strong> by<br />

<strong>the</strong> public authorities <strong>of</strong> <strong>the</strong> countries c<strong>on</strong>cerned and operate under <strong>the</strong>ir supervisi<strong>on</strong>.<br />

States Parties c<strong>on</strong>cerned shall co-operate as appropriate in <strong>the</strong> adopti<strong>on</strong> <strong>of</strong> measures regarding<br />

<strong>the</strong> orderly return <strong>of</strong> migrant workers and members <strong>of</strong> <strong>the</strong>ir families to <strong>the</strong> state <strong>of</strong> origin. The<br />

States <strong>of</strong> origin must take appropriate measures to promote adequate ec<strong>on</strong>omic c<strong>on</strong>diti<strong>on</strong>s for<br />

<strong>the</strong> resettlement <strong>of</strong> those who return, including irregular migrants, and facilitate <strong>the</strong>ir social<br />

and cultural reintegrati<strong>on</strong> (Art. 67).<br />

3. M<strong>on</strong>itoring <strong>the</strong> C<strong>on</strong>venti<strong>on</strong><br />

• Committee <strong>on</strong> <strong>Migrant</strong> <strong>Workers</strong><br />

In accordance with Article 72 <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>, <strong>the</strong> Committee <strong>on</strong> <strong>the</strong> Protecti<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

Rights <strong>of</strong> All <strong>Migrant</strong> <strong>Workers</strong> and Members <strong>of</strong> Their Families reviews <strong>the</strong> implementati<strong>on</strong> <strong>of</strong><br />

<strong>the</strong> C<strong>on</strong>venti<strong>on</strong>. The Committee held its inaugural sessi<strong>on</strong> from 1 to 5 March 2004 in Geneva.<br />

Since <strong>the</strong>n, it has held two sessi<strong>on</strong>s a year.<br />

From its formati<strong>on</strong>, <strong>the</strong> Committee has c<strong>on</strong>sisted <strong>of</strong> ten experts <strong>of</strong> high moral standing,<br />

impartiality and recognised competence in <strong>the</strong> field covered by <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>. However,<br />

with <strong>the</strong> forty-first ratificati<strong>on</strong> <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> in March, 2009, <strong>the</strong>ir number will now be<br />

increasing to fourteen. As is <strong>the</strong> case with o<strong>the</strong>r treaty bodies, Committee members are<br />

nominated and elected by <strong>the</strong> States parties to <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>.<br />

Article 74 <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> sets out <strong>the</strong> role <strong>of</strong> <strong>the</strong> Committee and its functi<strong>on</strong>s, which can<br />

be described as follows:<br />

• C<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> States parties’ reports<br />

The primary task <strong>of</strong> <strong>the</strong> Committee is to study reports by States parties <strong>on</strong> <strong>the</strong> legislative,<br />

judicial, administrative and o<strong>the</strong>r measures <strong>the</strong>y have taken to give effect to <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>’s<br />

provisi<strong>on</strong>s. A State Party is requested to present a first report within <strong>on</strong>e year <strong>of</strong> <strong>the</strong> entry into<br />

force <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> for <strong>the</strong> State Party c<strong>on</strong>cerned, and <strong>the</strong>reafter every five years. At its<br />

sec<strong>on</strong>d sessi<strong>on</strong>, held in Geneva in April 2005, <strong>the</strong> Committee adopted its guidelines for <strong>the</strong><br />

submissi<strong>on</strong> <strong>of</strong> initial reports by States parties. The guidelines request <strong>the</strong> States parties<br />

c<strong>on</strong>cerned to provide informati<strong>on</strong> <strong>of</strong> a general nature c<strong>on</strong>cerning <strong>the</strong> framework governing <strong>the</strong><br />

implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>, any agreements entered into with o<strong>the</strong>r States c<strong>on</strong>cerning<br />

migrati<strong>on</strong>, <strong>the</strong> characteristics and nature <strong>of</strong> migrati<strong>on</strong> flows, <strong>the</strong> practical situati<strong>on</strong> with regard<br />

to <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>, <strong>the</strong> measures taken to promote <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> and<br />

<strong>the</strong>ir cooperati<strong>on</strong> with civil society. As to <strong>the</strong> informati<strong>on</strong> <strong>on</strong> <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

C<strong>on</strong>venti<strong>on</strong>, in view <strong>of</strong> <strong>the</strong> length <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>, <strong>the</strong> guidelines suggest that reporting<br />

States group <strong>the</strong> informati<strong>on</strong> per clusters <strong>of</strong> articles. At its 8 th sessi<strong>on</strong>, <strong>the</strong> Committee adopted<br />

guidelines for <strong>the</strong> presentati<strong>on</strong> <strong>of</strong> fur<strong>the</strong>r periodic reports by States.<br />

The c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> <strong>the</strong> report takes place in two public meetings in <strong>the</strong> presence <strong>of</strong> a<br />

delegati<strong>on</strong> <strong>of</strong> <strong>the</strong> State Party. Intergovernmental organisati<strong>on</strong>s, United Nati<strong>on</strong>s organisati<strong>on</strong>s,<br />
