nati<strong>on</strong>al human rights instituti<strong>on</strong>s and n<strong>on</strong>-governmental organisati<strong>on</strong>s can all provide<br />

informati<strong>on</strong> to <strong>the</strong> Committee, ei<strong>the</strong>r in writing or orally 22 . The ILO is expected to review and<br />

provide comments <strong>on</strong> reports by States Parties in light <strong>of</strong> its mandate and complementary<br />

standards <strong>on</strong> migrant workers. The c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> <strong>the</strong> reports ends with <strong>the</strong> adopti<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

c<strong>on</strong>cluding observati<strong>on</strong>s by <strong>the</strong> Committee, which are transmitted to <strong>the</strong> State Party at <strong>the</strong> end<br />

<strong>of</strong> <strong>the</strong> sessi<strong>on</strong> and made public 23 .<br />

• C<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> communicati<strong>on</strong>s received under Articles 76 and 77 <strong>of</strong> <strong>the</strong><br />

C<strong>on</strong>venti<strong>on</strong><br />

Opti<strong>on</strong>al article 76 <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> provides for <strong>the</strong> c<strong>on</strong>siderati<strong>on</strong> by <strong>the</strong> Committee <strong>of</strong><br />

communicati<strong>on</strong>s from a State Party claiming that ano<strong>the</strong>r State Party is not fulfilling its<br />

obligati<strong>on</strong>s under <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>. Opti<strong>on</strong>al article 77 provides for <strong>the</strong> c<strong>on</strong>siderati<strong>on</strong> by <strong>the</strong><br />

Committee <strong>of</strong> communicati<strong>on</strong>s received from or <strong>on</strong> behalf <strong>of</strong> individuals who claim that <strong>the</strong>ir<br />

individual rights as established by <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> have been violated by a State Party. The<br />

articles require, however, that ten States parties make <strong>the</strong> declarati<strong>on</strong> before <strong>the</strong> procedure<br />

enters into force. So far, Guatemala is <strong>the</strong> <strong>on</strong>ly State Party that has made <strong>the</strong> declarati<strong>on</strong> under<br />

article 76; Guatemala and Mexico have made <strong>the</strong> declarati<strong>on</strong> under article 77.<br />

• Annual reports<br />

In accordance with article 74, paragraph 7, <strong>the</strong> Committee presents an annual report to <strong>the</strong><br />

General Assembly <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s <strong>on</strong> <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>, c<strong>on</strong>taining<br />

its c<strong>on</strong>siderati<strong>on</strong>s and recommendati<strong>on</strong>s.<br />

• Complementary activities<br />

The Committee has been actively engaged in <strong>the</strong> <strong>on</strong>going discussi<strong>on</strong> <strong>on</strong> Internati<strong>on</strong>al<br />

Migrati<strong>on</strong> and Development. On 15 December 2005, it organised a Day <strong>of</strong> General<br />

Discussi<strong>on</strong> under <strong>the</strong> title: “Protecting <strong>the</strong> rights <strong>of</strong> all migrant workers as a tool to enhance<br />

development”. The Committee was inspired in its choice <strong>of</strong> subject by <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

General Assembly to organise a High-Level Dialogue <strong>on</strong> Internati<strong>on</strong>al Migrati<strong>on</strong> and<br />

Development in New York <strong>on</strong> 14-15 September 2006, and aimed at emphasising <strong>the</strong><br />

importance <strong>of</strong> human rights in this c<strong>on</strong>text. 24<br />

Following <strong>the</strong> Day <strong>of</strong> General Discussi<strong>on</strong>, <strong>the</strong> Committee adopted a written c<strong>on</strong>tributi<strong>on</strong> to<br />

<strong>the</strong> General Assembly’s High-Level Dialogue <strong>on</strong> Internati<strong>on</strong>al Migrati<strong>on</strong> and Development.<br />

In its c<strong>on</strong>tributi<strong>on</strong>, <strong>the</strong> Committee noted that migrants are above all human beings with rights,<br />

as well as active agents <strong>of</strong> development. Therefore, for <strong>the</strong> Committee, <strong>the</strong> questi<strong>on</strong> <strong>of</strong><br />

migrati<strong>on</strong> must be approached from a human rights perspective, in c<strong>on</strong>formity with <strong>the</strong><br />

Universal Declarati<strong>on</strong> <strong>on</strong> Human Rights as well as State obligati<strong>on</strong>s under core internati<strong>on</strong>al<br />

human rights treaties. The Committee fur<strong>the</strong>r emphasised that <strong>the</strong> c<strong>on</strong>cept <strong>of</strong> development<br />
