Once <strong>the</strong>re is clarity about <strong>the</strong> compatibility <strong>of</strong> <strong>the</strong> domestic legislati<strong>on</strong> and <strong>the</strong> desirability <strong>of</strong><br />

becoming bound by <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>, it has to be approved in accordance with <strong>the</strong> procedure<br />

set out in <strong>the</strong> State’s C<strong>on</strong>stituti<strong>on</strong>. As noted above, usually this involves seeking <strong>the</strong> approval<br />

<strong>of</strong> <strong>the</strong> treaty in questi<strong>on</strong> by <strong>the</strong> nati<strong>on</strong>al legislature and may entail <strong>of</strong>ficial publicati<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

treaty. Good practice would also require publicati<strong>on</strong> in an easily accessible <strong>of</strong>ficial journal.<br />

The ICRMW designates <strong>the</strong> Secretary-General <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s as <strong>the</strong> depositary <strong>of</strong> <strong>the</strong><br />

C<strong>on</strong>venti<strong>on</strong>. This means that all instruments <strong>of</strong> ratificati<strong>on</strong> or accessi<strong>on</strong> have to be deposited<br />

with <strong>the</strong> Secretary-General in order to be valid. Instruments <strong>of</strong> ratificati<strong>on</strong> or accessi<strong>on</strong> have<br />

to be signed by <strong>the</strong> Head <strong>of</strong> State, <strong>the</strong> Head <strong>of</strong> Government or <strong>the</strong> Minister <strong>of</strong> Foreign Affairs.<br />

For signature, it is possible that <strong>the</strong> Head <strong>of</strong> State, <strong>the</strong> Head <strong>of</strong> Government or <strong>the</strong> Minister <strong>of</strong><br />

Foreign Affairs provide full powers to a designated representative in order to sign <strong>the</strong> treaty.<br />

Accessi<strong>on</strong> has <strong>the</strong> same legal effect as ratificati<strong>on</strong>. However, unlike ratificati<strong>on</strong>, which must<br />

be preceded by signature to create binding legal obligati<strong>on</strong>s under internati<strong>on</strong>al law, accessi<strong>on</strong><br />

requires <strong>on</strong>ly <strong>on</strong>e step, namely, <strong>the</strong> deposit <strong>of</strong> an instrument <strong>of</strong> accessi<strong>on</strong>.<br />

• Implementati<strong>on</strong><br />

The ICRMW enters into force for <strong>the</strong> State c<strong>on</strong>cerned <strong>on</strong> <strong>the</strong> first day <strong>of</strong> <strong>the</strong> m<strong>on</strong>th following<br />

a period <strong>of</strong> three m<strong>on</strong>ths after <strong>the</strong> date <strong>of</strong> deposit <strong>of</strong> its instrument <strong>of</strong> ratificati<strong>on</strong> or accessi<strong>on</strong><br />

(Art. 87). Within <strong>on</strong>e year <strong>of</strong> <strong>the</strong> entry into force <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> for <strong>the</strong> State c<strong>on</strong>cerned,<br />

<strong>the</strong> State party is required to submit an initial report <strong>on</strong> <strong>the</strong> legislative, judicial, administrative<br />

and o<strong>the</strong>r measures it has taken to give effect to <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> (Art.<br />

73(1)(a)). These reports shall also indicate factors and difficulties, if any, affecting <strong>the</strong><br />

implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> and shall include informati<strong>on</strong> <strong>on</strong> <strong>the</strong> characteristics <strong>of</strong><br />

migrati<strong>on</strong> flows in which <strong>the</strong> State party is involved (Art. 73(2)). After <strong>the</strong> initial report,<br />

States parties are required to submit a periodic report to <strong>the</strong> Committee every five years and<br />

whenever <strong>the</strong> Committee so requests (Art. 73(1)(b)). After recepti<strong>on</strong>, <strong>the</strong> Committee<br />

examines <strong>the</strong> reports submitted by States parties and transmits to <strong>the</strong> State c<strong>on</strong>cerned its<br />

comments and recommendati<strong>on</strong>s (Art. 74).<br />

The Committee <strong>on</strong> <strong>the</strong> Protecti<strong>on</strong> <strong>of</strong> <strong>the</strong> Rights <strong>of</strong> All <strong>Migrant</strong> <strong>Workers</strong> and Members <strong>of</strong> Their<br />

Families, <strong>the</strong> body <strong>of</strong> experts m<strong>on</strong>itoring implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> by all States<br />

Parties, has issued guidelines for <strong>the</strong> submissi<strong>on</strong> <strong>of</strong> initial reports (HRI/GEN/2/Rev.2/Add.1).<br />

The Committee’s guidelines for <strong>the</strong> submissi<strong>on</strong> <strong>of</strong> periodic reports were adopted in April<br />

2008 (CMW/C/2008/1).<br />

2. Practical Effects <strong>of</strong> Implementati<strong>on</strong><br />

Most <strong>of</strong> <strong>the</strong> States Parties to <strong>the</strong> ICRMW have moved to put in place nati<strong>on</strong>al policy and<br />

practice largely in accord with <strong>the</strong> standards specified in <strong>the</strong> C<strong>on</strong>venti<strong>on</strong>; <strong>the</strong>ir compliance<br />

with <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> is m<strong>on</strong>itored by <strong>the</strong> Committee <strong>on</strong> <strong>Migrant</strong> <strong>Workers</strong>. As recognised by<br />

several States Parties, <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> serves as reference for <strong>the</strong> development and definiti<strong>on</strong><br />

<strong>of</strong> comprehensive nati<strong>on</strong>al labour migrati<strong>on</strong> policies, which pay due attenti<strong>on</strong> to <strong>the</strong> human<br />

rights <strong>of</strong> migrant workers and members <strong>of</strong> <strong>the</strong>ir families. It assists States in generating<br />

c<strong>on</strong>diti<strong>on</strong>s that promote more harm<strong>on</strong>ious relati<strong>on</strong>s am<strong>on</strong>g different populati<strong>on</strong> groups and<br />

respect for <strong>the</strong> culture and rights <strong>of</strong> migrant workers and members <strong>of</strong> <strong>the</strong>ir families.<br />

Am<strong>on</strong>g o<strong>the</strong>r things, <strong>the</strong> Committee <strong>on</strong> <strong>Migrant</strong> <strong>Workers</strong> identifies and promotes good<br />

practices through its examinati<strong>on</strong> <strong>of</strong> reports <strong>of</strong> States Parties. Examples <strong>of</strong> innovative as well<br />

as standard good practices include:<br />
