That <strong>Council</strong> grant approval for six animal shelters with variation to side<br />

boundary setback in the Primary Industries Zone Provisions on land at 1260<br />

Oldina Road, Oldina subject to the following conditions:<br />

1. The development as shown on the endorsed plan(s) is not to be<br />

altered or modified for any reason without the consent of the<br />

Planning Authority.<br />

2. All costs associated with the proposed development are to be<br />

met by the Developer.<br />

3. No material is to be deposited onto the road.<br />

4. No damage is to be caused to the road, footpath or other<br />

facility.<br />

5. No materials, machinery or operational construction is to be<br />

located on the road, footpath, nature strip or road reservation.<br />

6. Upgrade the vehicular access with a bitumen sealed surface<br />

from the property to the edge of Lowries Road, in accordance<br />

2. Summary<br />

The application is for the construction of six animal shelters at 1260 Oldina<br />

Road, Oldina.<br />

The site is located within the Primary Industries zone. The application is<br />

discretionary as it relies on assessment against the Performance Criteria in<br />

relation to the setback standards.<br />

3. Background<br />

The subject property is located on Oldina Road within a rural area. Lowries<br />

Road dissects the site through a southern portion of the site. The site has a<br />

total area of 34.9 hectares. The site currently contains a dwelling house,<br />

sheds, the six animal shelters and horses. Adjacent properties are<br />

predominantly larger farms.<br />

4. Statutory Requirements<br />

The application is subject to the following statutory instruments:<br />

Land Use Planning and Approvals Act <strong>19</strong>93<br />

<strong>Waratah</strong> <strong>Wynyard</strong> Planning Scheme 2000<br />

5. Finances<br />

Financial costs may arise in relation to any appeal against the determination of<br />

the application by the Planning Authority.<br />

6. Discussion<br />

Application<br />

The application is for the approval of six equine and livestock weather<br />

shelters. The shelters have already been constructed on site without planning<br />

approval.<br />

Five of the shelters have dimensions of 7 metres by 7 metres and the<br />

remaining shelter is six metres by 12 metres wide. The height of the shelters<br />

is approximately three metres. The sides and facia of the shelters are a cream<br />

colour and the roof is a blue colour.<br />

Advertising<br />

The application was advertised for a period of 14 days in accordance with the<br />

provisions of the Land Use Planning and Approvals Act <strong>19</strong>93. During this<br />

time <strong>Council</strong> received three representations raising concerns with the proposal.<br />

Issue Raised:<br />

These shelters are an eyesore and take up too much valuable paddock space.<br />

My main concern is being hit by flying sheets of roof iron in the heavy winds.<br />

Planning Comment<br />

The visual amenity of the area comprises a rural landscape typical of the<br />

northwest. In such rural landscapes sheds and storage structures are a normal<br />

visual element. A structural engineering certificate for the sheds was<br />

submitted with the application, which states the sheds will comply with the<br />

relevant standards when constructed in accordance with the engineering design<br />

documents. The assessment required under the Building Approval stage of the<br />

application will ensure that the structures are constructed in accordance with<br />

the structural engineering certificate.<br />

Issue Raised:<br />

The shelters in question are already insitu and take up a large area that<br />

detracts from the beauty of the area and surrounding countryside. The colour<br />

of the shelters detracts from the surrounds.<br />

Issue Raised:<br />

The plans show the sheds built 29 metres from my boundary. There has<br />

already been a situation between myself and Maggie Boyd in regards to myself<br />

shooting vermin up to my fence line.<br />

Planning Comment<br />

From the site plan it appears the shelters will be within 29 metres of the<br />

boundary from 1258 Oldina Road and not 1182 Oldina Road. The issue of<br />

shooting vermin is a domestic issue and not a planning one.<br />

Assessment<br />

The site is zoned Primary Industries under the <strong>Waratah</strong>-<strong>Wynyard</strong> Planning<br />

Scheme 2000. The animal shelters will be used for sheltering horses and other<br />

livestock on site from the weather. The use relates to the primary industries<br />

use on site and therefore the appropriate use classification is the Resource<br />

Development Use class. The Resource Development use class is a primary<br />

use class within the Primary Industries Zone<br />

Standards for development in the Primary Industries zone are provided in Part<br />

9 of the Planning Scheme. As the application relies on assessment against the<br />

Performance Criteria in relation to development standards relating to siting, it<br />

requires discretionary approval under Section 57 of the Land Use Planning<br />

and Approvals Act <strong>19</strong>93 (LUPAA).<br />

The following section provides an assessment against the relevant Planning<br />

Scheme provisions.<br />

9.0 PRIMARY INDUSTRIES ZONE<br />

9.1 Values of the zone<br />

9.1.1 This zone incorporates predominantly primary industry related<br />

use or development of significant tracts of land from the coast<br />

through to the southern extremities of the planning area. It<br />

includes land used for farming, forestry, quarrying or mineral<br />

extraction processing works and a range of non-urban uses<br />

such as roads and rail networks, electricity distribution lines,<br />

water supply utilities and the like on private land, State<br />

Reserves, State Forests and Crown Land.<br />

9.1.2 The values associated with those areas in the zone are specified<br />

in Part 2 of the planning scheme<br />

9.2 Intent of the zone<br />

(a)<br />

(b)<br />

To protect and allow for the sustainable use and development<br />

of the natural and non-natural resources on which agriculture,<br />

aquaculture, forestry and mining depend; and<br />

To allow a range of uses in ways and in locations that do not<br />

affect the viability of use or development associated with the<br />

primary uses of the zone.<br />

The provision of the animal shelters on site relates to the primary use of the<br />

site being for grazing of horses and other livestock. he proposal should not<br />

affect the use of surrounding land for agricultural activities. Moreover,<br />

visually the shelters shed will appear similar to many agricultural structures in<br />

the vicinity.<br />

The application is assessed as follows against Scheme criteria specific to the<br />

application:<br />

Relevant Standards for use or development in the Primary Industries Zone<br />

9.4.1 Issue 11.0: - Design and Form<br />

Objective: To design and sit rural buildings in a manner that protects rural<br />

amenity and maintains appropriate rural character.<br />

Acceptable Solution<br />

11.1 Building that are not occupied by<br />

sensitive uses and to be setback a<br />

minimum of:-<br />

(a) 30 metres from a road<br />

boundary (unless a greater<br />

setback from Category I, II or<br />

III road is required in<br />

accordance with Table 14.2.1<br />

Issue 5.0:- Setbacks for<br />

Buildings and Structures.);<br />

and<br />

(b) 10 metres from any other<br />

boundary.<br />

11.2 The maximum building height is<br />

7.5 metres.<br />

Performance Criteria<br />

11.1 The required setbacks may be<br />

varied where it can be<br />

demonstrated that:<br />

(a) the location of proposed<br />

building or structures<br />

compliments the setbacks of<br />

existing buildings or<br />

structures in the immediate<br />

area; or<br />

(b) the design and location of<br />

proposed buildings or<br />

structures compliments the<br />

amenity and character of the<br />

locality and is not visually<br />

intrusive; or<br />

(c) the design of the proposed<br />

building or structures<br />

minimises the earth works<br />

associated with construction<br />

and responds appropriately to<br />

the particular size, shape,<br />

contours or slope of the land.<br />

11.2 Building height may be varied<br />

where it is demonstrated that<br />

buildings or structures are<br />

designed and sited in a manner<br />

that does not result in a high level<br />

of contrast with the prevailing<br />

landscape elements. Matters to<br />

be considered include the shape,<br />

height, bulk, materials and<br />

colours of buildings and<br />

structures, and their appearance<br />

in relation to skylines, and to<br />

existing and proposed vegetation.<br />

The setbacks for five of the proposed shelters comply with the setback<br />

requirements, however one of the shelters is within 23 metres of Oldina Road<br />

and therefore relies on assessment against the Performance Criteria. The<br />

location of the shelter within 30 metres of the boundary to Oldina Road is not<br />

visually obtrusive in the area and will not detrimentally impact the amenity in<br />

the area. The location of the shelter and its low height means that it wont have<br />

any impacts in terms of overshadowing.<br />

All the proposed shelters are less than 7.5 metres in height (only 3 metres) and<br />

comply with the acceptable solution.<br />

The proposal meets the performance criteria.<br />

7. Risk<br />

There is a risk the applicant or representors may appeal the determination of<br />

the Planning Authority to the Resource Management and Planning Appeal<br />

Tribunal.<br />

IN FAVOUR<br />

8. Conclusion<br />

The application involves the construction of six animal shelters on site on a lot<br />

within the Primary Industries Zone. The land is currently utilised for grazing<br />

of horses and other livestock and a residential dwelling. The animal shelters<br />

are related to the primary industries use on site.<br />

The application is seeking a variation to the setback requirements for one of<br />

the animal shelters. The application is considered to not affect the amenity of<br />

the area, or affect the attainment of the zone or planning scheme objectives.<br />

2. Summary<br />

This report has been prepared to enable the timing of Ordinary Meetings to be<br />

altered to allow for a pre-meeting meal, and to decide on two alternative<br />

Ordinary Meeting locations in <strong>2009</strong>.<br />

For <strong>Council</strong> to be open and accountable to its community, consistency in the<br />

meeting schedule is suggested as this allows residents to know with some<br />

certainty when <strong>Council</strong> meetings are normally held.<br />

3. Background<br />

For the past year it has been normal practice for <strong>Council</strong> to conduct Ordinary<br />

<strong>Council</strong> meetings on the third Monday of each month commencing at 5:30 pm.<br />

Prior to this meetings were held on the third Monday of each month<br />

commencing at 7:30pm.<br />

4. Statutory Requirements<br />

The Local Government (Meeting Procedure) Regulations 2005 states:<br />

(1) A meeting is not to start before 5 p.m. unless otherwise determined by<br />

the council by absolute majority or by the council committee by simple<br />

majority.<br />

(2) After each ordinary election, a council and a council committee are to<br />

review the times of commencement of meetings.<br />

5. Finances<br />

The conduct of any <strong>Council</strong> meeting has costs associated with it, additionally<br />

there will be a cost associated with catering. It is envisioned that meals will be<br />

served at the <strong>Council</strong> Chambers, <strong>Wynyard</strong> at approximately 5:15pm. The<br />

meals will cater for <strong>Council</strong>lors and Staff formally attending the meeting.<br />

Sandwiches would no longer be provided after the meeting.<br />

6. Discussion<br />

The <strong>Council</strong> may determine the most appropriate timing for ordinary<br />

meetings. The only provision included within the Regulations is that an<br />

ordinary meeting is to be conducted at least once per month. All meetings are<br />

to commence after 5:00 pm unless determined otherwise by the <strong>Council</strong> by<br />

absolute majority.<br />

The proposed 6:00pm commencement time will allow for a meal to be served<br />

immediately prior to an Ordinary meeting. It is also noted that Circular Head<br />

<strong>Council</strong> holds its Ordinary meetings on the third Thursday of each month<br />

commencing at 6:00pm following a meal.<br />

Community Respect Order Program<br />

A Memorandum of Understanding (MoU) has been signed between the<br />

Department of Police and Emergency Management (DPEM) and <strong>Waratah</strong>-<br />

<strong>Wynyard</strong> <strong>Council</strong>. The purpose of this MoU is to define the responsibilities of<br />

both the DPEM and <strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong> in relation to the Community<br />

Respect Orders program.<br />

The Community Respect Orders program is an early intervention diversionary<br />

option based on a restorative justice approach, used by Tasmania Police, for<br />

youth and young adults, whereby the offender performs reparation work in the<br />

community under the supervision of Tasmania Police.<br />

TVIN Visitor Experience Assistant Grant<br />

The Wonders of <strong>Wynyard</strong> received a grant for $5,000 under the TVIN Visitor<br />

Experience Assistance Grants. The grant will enable the WOW to implement a<br />

more efficient on-line booking system. Acquisition of the Book Easy Booking<br />

System will make the <strong>Wynyard</strong> Visitor Centre compatible with Tier 1 and Tier<br />

3 Visitor Centres in Tasmania.<br />

The project involves a training component for Centre staff. This will enable<br />

the Centre to have a 24 hour, 7 days per week sales presence which is<br />

important as it will ensure that the Veteran Car Exhibition can be marketed<br />

and promoted more effectively to tour groups. With 34,000 visitors last<br />

financial year, this system will maximise the Centre’s yield and provide an<br />

industry standard booking service.<br />

Social and Economic Impact Study into Gambling in Tasmania<br />

The Tasmanian Gaming Commission's (TGC) report on the Social and<br />

Economic Impact Study into Gambling in Tasmania was released on 11<br />

December 2008 by the Treasurer, The Hon. Michael Aird MLC.<br />

The original Social and Economic Impact Study (SEIS) into Gambling in<br />

Tasmania, which was published on 22 July 2008, was commissioned by the<br />

State Department of Treasury and Finance Tasmania and was prepared by the<br />

South Australian Centre for Economic Studies. The complete copies of both<br />

reports may be accessed from the State Treasury website.<br />

A summary of both reports are laid on the table.<br />

Waste Management and Climate Change Conference and Exhibition<br />

The Tasmanian Department of Economic Development & Tourism, with<br />

support from the Tasmanian Climate Change Office, the Environment<br />

Protection Authority and WMAA, would like to extend their invitation to<br />

attend the Managing Waste in a Changing Climate Conference & Exhibition<br />

in Launceston from 4 to 6 March <strong>2009</strong>. If you are interested in attending<br />

Serrata Crescent – Auction of <strong>Council</strong> Owned Blocks<br />

Five blocks at Serrata Crescent, Sisters Beach have been listed for public<br />

auction at 12:00pm on Saturday 31 <strong>January</strong> <strong>2009</strong>.<br />

Blocks 7, 8, 13, 21 and 28 will be auctioned, with the additional purpose of<br />

marketing the remaining unsold blocks at Serrata Crescent (thirteen not<br />

including the five for public auction) – to date thirteen blocks have sold.<br />

Expressions of interest were invited from local real estate agents to undertake<br />

the auction in mid-December 2008, with Dean Chamley & Associates Pty Ltd<br />

being the successful applicant.<br />

Advertising for the auction has been conducted through the internet, on-site<br />

signage, window-display at the auctioneer’s <strong>Wynyard</strong> branch and in the<br />

Advocate’s Domain Property Guide.<br />

CHILDREN’S SERVICES<br />

Parent interviews took place in December with approximately six families in<br />

each room meeting with staff to discuss their children’s progress.<br />

The annual Christmas party was held on the 17 th December with<br />

approximately 60 families attending. There was plenty of entertainment<br />

including a jumping castle, face painting, magician and balloon artist. Santa<br />

arrived at around 7.00pm on the fire engine with treats for the children. This<br />

is a wonderful social event for families to come together.<br />

The children from the Little Goldie Street program participated in the<br />

Christmas parade on Christmas Eve with most children and some family<br />

members joining in. The children and staff walked in the parade dressed as<br />

reindeers - a banner that the staff and children had worked on was carried with<br />

the Centre’s name and details displayed.<br />

Information Report<br />

A report is being prepared for consideration by <strong>Council</strong> regarding the<br />

establishment of an after school care program at the Yolla District High<br />

School. Initial investigations of the site have identified a possible venue at the<br />

school. The school has carried out surveys to determine interest from the<br />

school community and is keen to provide this service on site.<br />

The Education Department’s Child Care Unit has approached Children’s<br />

Services to be involved in the trial of the proposed new processes for the<br />

approval of four year olds in OSHC. The trial will commence in <strong>2009</strong>.<br />

TOURISM AND WONDERS OF WYNYARD EXHIBITION CENTRE<br />

The permanent display depicting the Tommeginer people has been installed at<br />

the Exhibition Centre. This permanent display has been placed in the WOW<br />

to promote the community’s indigenous history to visitors and encourage them<br />

to visit Freestone Cove and the fish traps.<br />

Further information has been received from Stephen Hite from Burnie Sports<br />

and Events regarding incorporating a tour of the WOW into the itinerary for<br />

the cruise ship market. Mr. Hite advised that one of the on-shore operators is<br />

interested in including the WOW on this seasons itinerary. Heritage Tours<br />

will be making contact to organise the inclusion of the WOW for upcoming<br />

cruise ship visits.<br />

The final meeting of the Literacy/Arts program was held at Table Cape<br />

Primary School in early December. This group has worked hard to improve<br />

educational outcomes for local indigenous students over the past three years.<br />

Projects have focussed on the Tommeginer people with several exhibitions<br />

being held over this time.<br />

Planning has commenced to offer the Community Recreation Leaders Award<br />

in April <strong>2009</strong>. The program is of an introductory nature and equips<br />

participants to deliver a variety of recreational programs. Several <strong>Council</strong><br />

facilities will be used as training venues.<br />

The Tasmanian Youth Forum was held in Launceston and was attended by the<br />

Community Development Officer along with local youth representative Dillon<br />

Roberts. The forum focussed on innovative projects/programs to address youth<br />

homelessness in Tasmania.<br />

Support was provided for the Carols by Candlelight evening in Gutteridge<br />

Gardens at an alternative area due to work in progress on the stage and<br />

surrounds. Lighting and seating were provided.<br />

The Norfolk Pine on the corner of Arthur and Pelissier streets in Somerset was<br />

selected to be illuminated as a Christmas tree. The tree has generated<br />

considerable interest in the community. Unfortunately there wasn’t any follow<br />

up from the media. Next year an official lighting up event will be organised to<br />

increase media attention.<br />

Work has commenced on documenting walkways/ pathways in Somerset and<br />

<strong>Wynyard</strong> with a view to identifying extensions, links and circuits to improve<br />

walker experiences. This project is proposed to be funded from financial<br />

assistance package from the Commonwealth Government announced recently.<br />

The Caring for our Country funding has been announced. A boardwalk for<br />

Penguin tours at Doctors Rocks was approved along with environmental work<br />

on Sisters Creek. <strong>Council</strong> will auspice the latter project with Cradle Coast<br />

looking after the former one.<br />

<strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong>’s Learn to Swim program is well underway. The<br />

program comprises two courses, to be held over four weeks. Each course runs<br />

over a two week period, with an hourly lesson each weekday. The classes<br />

being offered are Under 4’s, Water Orientation, Beginners and Basic Stoke<br />

Development. Initial bookings have been very good. There are approximately<br />

115 children currently enrolled.<br />

Immunisations<br />

The Public Health Act <strong>19</strong>97 requires that <strong>Council</strong>s offer immunisations against<br />

a number of diseases. The following table will provide <strong>Council</strong> with details of<br />

the rate of immunisations provided through <strong>Council</strong> clinics. A monthly clinic<br />

is held at <strong>Wynyard</strong>, excepting December, with bi-monthly clinics at <strong>Waratah</strong>.<br />

Appeal 390/08P, 301 Pages Road, Moorleah – Dwelling. The representor<br />

has appealed <strong>Council</strong>’s determination to approve the proposal. An initial<br />

Directions Hearing was held for this appeal on <strong>19</strong> December 2008.The<br />
