File Reference: DA 34/2007
Council Meeting Date: 16 April 2007
1. Recommendation
That the Planning Authority approve the proposed Hydrotherapy
Centre to be constructed at 45 Goldie Street, Wynyard, subject to the
following conditions:
1. The development as shown on the endorsed plan(s) is not to be
altered or modified for any reason without the consent of the
Director of Development Services.
2. The premises is only to be open for the use hereby permitted
between the following hours:
Monday to Friday - 6:00 a.m. to 9:00 p.m.
inclusive
Saturday - 6:00 a.m. to 9:00 p.m. inclusive
Sundays and Public Holidays - 6:00 a.m. to 9:00
p.m. inclusive
3. Prior to the commencement of the use the applicant is to pay to
Council cash in lieu for car parking spaces not provided on site
to the sum of $5,154. Calculation of Value of Cash in Lieu for
the seven (7) retail spaces unable to be provided is as follows:
Area of car parking spaces not provided = 100m 2 , divided by
land area 776m 2 X $40,000 (unimproved capital value of land) =
$5,154 cash in lieu requirement.
4. At no time is the right of way marked as C, D, E & F on the title
known as CT149065/1, and the right of way on the title known as
CT55948/2 to be obstructed by the parking of cars (except for
vehicles associated with plant maintenance operations) or
storage of materials either during or after the construction phase
of the development.
5. All deliveries to the development are to be made via the Goldie
Street frontage of the premises.
6. No advertising signs other than those indicated in the
development proposal are to be erected without the approval of
the Director Development Services.
7. No part of the sign hereby permitted is to be internally or
externally illuminated.
8. The use of this development is not to result in the generation of
environmental harm or nuisance as defined in the Environmental
Management and Pollution Control Act 1994.
9. Erosion and sediment controls are to be installed for the duration
of the construction phase so as to limit the loss of soils and other
debris from the site.
10. No material is to be deposited on the road.
11. No damage is to be caused to the road, footpath or other facility.
12. No materials, machinery or operational construction are to be
located on the road, footpath, nature strip or road reservation.
13. The footings of the development are to be constructed such that
no additional loading is placed upon the Council stormwater
drainage line that traverses the property. The developer is to
ensure that access remains to inspection openings in the
drainage line and be responsible for ensuring that the drainage
line is maintained in a clear state so that normal stormwater
flows are unimpeded. The footing and access design system is to
be to the satisfaction of Council’s Director Engineering Services.
14. The developer is to be responsible for the cost of connection of
the development to the Council sewerage network.
15. All costs associated with the proposed development are to be met
by the Developer.
2. Summary
The proposal is for the construction of a Hydrotherapy Centre on land zoned
as Business & Civic at 45 Goldie Street, Wynyard. The proposal involves the
construction of a building to house a heated swimming pool, change rooms,
spa, sauna, and a physiotherapist/masseuse consultant’s room.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 11
Planning Authority Reports
The application is discretionary under clause 3.3.3(a) of the Waratah-Wynyard
Planning Scheme 2000 as although it constitutes a primary use class within the
Business & Civic Zone, it partly relies on performance criteria within the Car
Parking Schedule.
3. Background
This report assesses the proposal against the Waratah-Wynyard Planning
Scheme 2000, State Policies and other relevant legislation and takes into
account representations received during the public notification period.
The subject property is located within the Central Business District of the
town of Wynyard. The site for the proposed hydrotherapy pool comprises flat
land that currently supports a residential dwelling (89m 2 ), a garage (32m 2 ),
and a retail outlet (249m 2 ). The title is within proximity to existing
commercially developed sites and is also close to residentially zoned and
developed land. Access to the site includes street frontage to Goldie Street
and a right of way access from Inglis Street.
4. Statutory Requirements
The application is subject to the following statutory instruments:
• Land Use Planning and Approvals Act 1993
• Waratah Wynyard Planning Scheme 2000
5. Finances
There are no financial implications arising for Council as a result of this
development. If an appeal were lodged in relation to this application Council
would incur costs associated with defending its position.
6. Discussion
Application
The proposal is for the construction of a Hydrotherapy Centre to include a
hydrotherapy pool on land zoned as Business & Civic at 45 Goldie Street,
Wynyard. The proposal involves the construction of a building to house a
heated hydrotherapy pool, change rooms, spa, sauna, and a
physiotherapist/masseuse consultant’s room. As well as the therapeutic
services, the business will provide water safety education, private swimming
instruction and water aerobic classes.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 12
Planning Authority Reports
As the closest facility of this nature is located 20 kilometres away in Burnie
the hydrotherapy pool will provide local access for elderly and convalescing
members of the Wynyard community. Furthermore, the business will benefit
the wider community through providing employment during and after the
construction phase of the proposal.
The subject title proposed for development currently supports a residence
(89m 2 ), a garage (32m 2 ), and a retail outlet (249m 2 ). The proposed building
will cover a total area of 211 square metres.
The proposal was advertised for a period of two weeks in accordance with the
provisions of the Land Use Planning and Approvals Act, 1993. During this
time Council received two (2) representations. The first was from Kylie
Anderson of 47 Goldie Street, Wynyard, and the second from Richard K.
Ruddle of Solicitors Kay & Ruddle on behalf of E & JG Duyst, owners of 8A
& 8B Inglis Street.
REPRESENTORS:
1. Kylie Anderson - 47 Goldie Street, Wynyard 7325
2. Richard K. Ruddle from Kay & Ruddle on behalf of E. & J.G. Duyst –
owners of 8A & 8B Inglis Street.
Representor: Kylie Anderson - 47 Goldie Street, Wynyard 7325
Issue Raised:
The height of the eastern wall is to be raised to allow for windows and this
will increase the existing problem of natural light to my property.
Planning Comment:
The titles for both the proposed development and the representor’s property
are within the Business & Civic Zone. The proposal is consistent with the
provisions of the zone and the residential use is not afforded a protection from
overshadowing under the zone.
Issue Raised:
The western wall is to be 3.2 metres in height right to the footpath boundary.
This will make it difficult for exiting my driveway, as visibility will be greatly
reduced. With the medical centre opposite there are a lot of people who pass
my property in gophers, prams, and wheelchairs etc.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 13
Planning Authority Reports
Planning Comment:
The proposal is for a primary use within the Business & Civic Zone and is
located within an existing Business & Civic area. Within the Business &
Civic Zone, the Planning Scheme allows for structures to be built to
boundaries, and is generally the case for a large percentage of commercial
buildings. The proposal meets the Acceptable Solutions for development
within the Business & Civic Zone. Consequently, the above issue is
considered to be within the scope of standard driver safety and awareness as
would be the normal case for vehicles manoeuvring in the Business and Civic
Zone.
Issue Raised:
The increased parking in an already problem area is also a major concern
because people park in no parking area making it impossible to access my
driveway. A lot of the parking is taken up by medical centre staff and the
business submitting the proposal.
Planning Comment:
A condition of permit stipulates:
‘Prior to the commencement of the use the applicant is to pay to Council cash
in lieu for car parking spaces not provided on site to the sum of $5,154.
Calculation of Value of Cash in Lieu for the seven (7) retail spaces unable to
be provided is as follows: Area of car parking spaces not provided = 100m 2 ,
divided by land area 776m 2 X $40,000 (unimproved capital value of land) =
$5,154 cash in lieu requirement.’
This payment under the Car parking and Access Schedule of the Scheme is to
“provide parking for those spaces in a location suitable for users of the use or
development”. The developer has identified that additional street car parking
may become available where there is currently an access driveway to the
premises. The payment should be used to augment and control parking in this
area to assist with the issues raised in the representation.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 14
Planning Authority Reports
Representors: Richard K. Ruddle from Kay & Ruddle on behalf of E. & J.G.
Duyst - owners of 8A & 8B Inglis Street.
Issue Raised:
The right of way (ROW) over 8A & 8B Inglis Street is not currently used for
the parking of vehicles, nor as a storage area. There is permanent parking at
the rear of these premises, not on any part of the right of way. The owners of
8A & 8B Inglis Street are concerned that the proposed plans do not appear to
provide for any permanent parking at the rear of the developers property at 45
Goldie Street, and consequently fear that the right of way area marked CDEF
on the title known as CT149065/1 may be in constant use as permanent and
semi-permanent parking space for the developer, especially during the
construction phase with the delivery of building materials and equipment, and
that the right of way will be in constant use during this period by tradesmen
and subsequently by customers, who may be tempted to park more or less
permanently on the right of way itself.
Planning Comment:
A condition of permit will stipulate that at no time is the right of way marked
as C, D, E & F on the title known as CT149065/1, and the right of way on the
title known as CT55948/2 to be obstructed by the parking of cars (except for
vehicles associated with plant maintenance operations) or storage of materials
either during or after the construction phase of the development and that all
deliveries to the development are to be made via the Goldie Street frontage.
Business & Civic Zone
The subject site is located within the Business & Civic Zone and the
application seeks approval for a Business & Civic development. Relevant to
this proposal, Clause 2.2.3 of the Planning Scheme establishes the Values of
the Business & Civic Zone as:
The capacity to provide a range of commercial functions of both local and
regional significance;
The capacity to provide a mix of commercial, business, public and community
facilities and activities in locations easily accessed and where the impact on
adjoining activities can be managed; and
A focus for commercial, tourism and public investment.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 15
Planning Authority Reports
The proposed hydrotherapy pool provides an opportunity to encourage
investment within the Waratah-Wynyard municipal area and to generate
employment during construction and operation of the facility. The site
proposed for the pool is within the Business and Civic zone, close to the
Central Business District of the town of Wynyard.
Under clause 8.3.1 of the Waratah Wynyard Planning Scheme 2000, the
Business & Civic development is a primary use class within the Business &
Civic Zone.
The intent of the Business & Civic Zone is:
(a)
(b)
To provide for a range of business and civic uses in
concentrated areas; and
To allow a range of other uses in ways and locations that do
not affect the viability and operation of use or development
associated with the primary uses of the zone.
The proposal is for a primary use within the zone and is located within an
existing business & civic area. The proposal is not considered to affect the
viability or operation of other primary use class activities within the area. The
proposed hydrotherapy pool is consistent with the intent of the Business &
Civic Zone.
The following section provides an assessment of the proposal against the
relevant issues identified in Part 7.0 of the Planning Scheme.
Issue 1.0 Delivery of Goods
The acceptable solution for issue 1.0 is:
Where delivery of goods is required, arrangements for parking,
manoeuvring, loading and unloading of delivery vehicles are not to
interfere with pedestrian or vehicle movements on roads, within on-site
parking areas and at public entrances to buildings.
There are no performance criteria.
The application states that there will be no requirement for delivery vehicle
access and that maintenance personnel enter the premises plant room from the
rear right of way.
The issue of the right of way has been raised in representation to Council and
as it is considered appropriate that the permit be conditioned to limit use of
this access as the applicant clearly flags in the application that there will be
limited impact from deliveries.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 16
Planning Authority Reports
The proposal is therefore considered to be consistent with the acceptable
solution for delivery of goods under the Planning Scheme.
Issue 2.0 Building Appearance and Street Character
Within the Waratah Wynyard Planning Scheme 2000, the objective is:
‘To ensure that building appearance from public streets is visually
compatible with surrounding development and maintains pedestrian
amenity’.
It is proposed that the building to enclose the hydrotherapy pool will be a
single storey building – 5 metres high at the highest point – and is to be built
to the north, south and western boundaries. The proposal is within the
Business & Civic Zone and the surrounding area has a number of buildings of
similar appearance and size to that proposed and therefore is in keeping with
the surrounding buildings on Goldie Street. The exception is the residential
dwelling to the west of the proposed development is set back approximately 4
metres from the street boundary.
The application also details an awning similar to that of the abutting eastern
veranda appearance.
The proposal is therefore considered to be consistent with the acceptable
solution for building appearance and street character under the Planning
Scheme.
Issue 3.0 Infrastructure Provision
The objective is:
To ensure that the cost of providing infrastructure to new development
is not borne by the community.
The Council’s Director Engineering Services requires a condition of approval
that all costs associated with the development are be at the developer’s
expense.
Issue 5.0 Amenity of existing residential development
The objective is:
To ensure that use and development protects the amenity of residential
use or development abutting the Business and Civic Zone.
This Planning Scheme standard is not applicable to the neighbouring
residential use as both properties are within the Business and Civic Zone.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 17
Planning Authority Reports
The residential use does not abut the Business and Civic Zone and hence is not
afforded the protection provided in this Scheme standard in respect to the
interface between the Business and Civic and Residential Zones. Nevertheless
standard conditions of the permit will ensure that no environmental nuisance
or harm is created as a result of the development.
Issue 6.0 Amenity of existing non residential use or development
The objective is:
To ensure that new use or development does not adversely impact on
the operation of existing non residential use or development on
adjoining sites.
The nature of the proposal does not involve any processes or activities that
would lead to adverse impacts on the operation of existing non residential use
or developments on adjoining sites.
Issue 7.0 Subdivision
Not applicable
Issue 7.0 Pedestrian Movement
17.0 Car Parking and Access Schedule
The intent of this Schedule it to:
Ensure adequate parking is provided for all use or development;
Ensure that parked vehicles do not obstruct the passage of other
vehicles, pedestrians or cyclists or create traffic hazards; and
Minimise detrimental impacts of vehicle parking and access and
driveway needs on the amenity of the use or development, streetscape
Table 17.1 Issue 1.0:- Car Parking Provision
Objective: To provide sufficient conveniently located and accessible parking for
people utilising or servicing a use or development.
Acceptable Solution
1.1 The number of car parking spaces
to be provided on the
development site for a use or
accordance with the requirements
of Figure 17.1.
Performance Criteria
1.1 The number of car parking spaces
required to meet the needs of the
use or development is to be
determined by assessing:
(a)
the number and size of
vehicles associated with the
proposed use or
development;
(b)
the provision or availability
of existing on-street car
parking easily accessible by
customers or visitors;
(c) the location and nature of
other uses or developments
in the vicinity;
(d) the effect of slope or other
site constraints in reducing
parking opportunities;
(e) any street network
hierarchy adopted by
Council and objectives for
the hierarchy;
(f) the possible demand for
car parking spaces from
adjoining properties;
(g) the need for overflow
parking; and
(h) availability of public
transport within a reasonable
distance of the site.
Acceptable Solution
1.2 In the Business and Civic Zone,
Council may accept a cash
payment in lieu of all or part of
the car parking space
requirement as determined under
Clause 1.1. Where Council
accepts such payment, it is to
provide parking for those spaces
in a location suitable for users of
the use or development.
1.3 The value of cash in lieu be
provided is to be determined in
accordance with Figure 17.4.
Performance Criteria
1.2 No performance criteria.
1.3 No performance criteria.
On the same title, a previous Planning Permit (DA31/2006) for a retail outlet
required five car parking spaces, made up of three (3) for the proposed retail
business, and two (2) for the existing residential dwelling. There was a
shortfall of two (2) car parking spaces for the business use. A cash in lieu
contribution was required for the entire business car parking unable to be
provided on site. This equated to a total of $1,920 cash in lieu requirement.
Application of Figure 17.4 -Calculation of Value of Cash in Lieu for
the 2 car spaces unable to be provided is as follows:
Area of car parking spaces not provided = 28.8m 2 , divided by land area
600m 2 X $40,000 (unimproved capital value of land) = $1,920 cash in
lieu requirement.
Relevant to the current Development application, the Planning Scheme Figure
17.1 Car Parking Spaces states that in the Business and Civic zone one (1) car
parking space is required per 30m 2 of gross floor area. The proposal before
Council has an approximate retail floor area of 211m 2 . The minimum number
of car parking spaces required if calculated on a floor area basis would be
seven (7).
The submitted plans make no provision for on site car parking relative to the
proposed business use. The developer, in the submitted information, outlines
a view that a lesser car parking requirement should apply and identifies that
additional car parking would be available on the street in lieu of the current
driveway to the property.
The lesser parking requirement is not accepted as the Scheme clearly provides
that the measure is whichever is the greater of a gross floor area or a
calculation based on the type of use.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 20
Planning Authority Reports
In this case the floor area is the greater. The comment on the increased
availability of on street parking is accepted however, the cost of providing this
should be covered by the cash in lieu contribution of the developer.
The five (5) car parking spaces provided on site are for the existing retail
outlet (3) and the existing residential dwelling (2). The site is unable to make
provision for the seven (7) car parking spaces required for the proposed
development. It is considered acceptable that the developer be required to
make a cash in lieu contribution for all business car parking unable to be
provided on site.
A condition of approval is provided with this permit that prior to the
commencement of the use the applicant is to pay to Council cash in lieu for car
parking spaces not provided on site to the sum of $5,154. Calculation of
Value of Cash in Lieu for the seven (7) retail spaces unable to be provided is
as follows: Area of car parking spaces not provided = 100m 2 , divided by land
area 776m 2 X $40,000 (unimproved capital value of land) = $5,154 cash in
lieu requirement.
19.0 Signs
The development application details a sign – 1 metre high by 2 metres wide
(2.0 square metres) – that is to be mounted above the awning on the building’s
front façade facing Goldie Street. The sign is to state the business name,
business nature and contact phone number, and is to be constructed from
Colour Bond sheet metal in blue and white tones. The sign will not be
illuminated either internally or externally.
The following conditions form part of the permit:
No advertising signs other than those indicated in the development
proposal are to be erected without the approval of the Director
Development Services.
No part of the sign hereby permitted is be internally or externally
illuminated.
7. Risk
The applicant or the representor may appeal the Planning Authority’s decision
to the Resource Management and Planning Appeal Tribunal.
8. Conclusion
The proposed hydrotherapy pool is consistent with the Waratah Wynyard
Planning Scheme 2000. The proposal is for a primary use within the existing
Business & Civic Zone. The conditions provided within the permit will ensure
that the hydrotherapy pool does not pose a detrimental impact upon the
amenity of surrounding land.
The proposal is consistent with the values of the Business & Civic Zone,
including providing a range of commercial functions of both local and regional
significance. The proposed hydrotherapy pool is recommended for approval
subject to the conditions provided with this permit.
1. Recommendation
That the Planning Authority refuse the application for a minor
amendment to SD1637 which would have allowed Lots 25 to 30
to be brought forward to Stage 3 of the subdivision and also
removed the requirement to drain the farm dam on the balance
land as the application does not demonstrate compliance with
Section 56 (2)(b) and (c) of the Land Use Planning and
Approvals Act 1993.
2. Summary
Introduction
This item was listed on the Planning Authority agenda for its meeting on 19
March 2007. Correspondence received from the applicant Mr Mackenzie on
the 19 March 2007 which requested that a decision on the minor amendment
application be deferred to allow additional information to be provided. The
Planning Authority determined:
That Council defer consideration of the minor amendment
application for SD1637 until the next meeting of Council, scheduled
for 16 April 2007, at which time Council is to formally determine the
matter.
The Planning Authority’s decision was communicated to Mr Mackenzie in
writing dated 21 March 2007. The Director Development Services attended
an on-site meeting with Mr Mackenzie and his Consultant Engineer on 23
March 2007.
At the time of finalising the agenda for this meeting no new additional
information has been provided which would cause an alternative
recommendation to be provided.
Planning Authority Reports
The report from the agenda of 19 March 2007 is reproduced below in its
entirety.
Application is made to amend Planning Permit SD1637 to include proposed
lots 25 to 30 in Stage three of the staged subdivision. These lots are currently
part of Stage four of the development. An issue which impacts on this
adjustment of proposed lots between stages is the requirement in the original
permit for the draining of a farm dam prior to development of stage four. The
developer also seeks to have the dam remain on the property and has
submitted documentation in support of the application.
3. Background
An application to subdivide the property was processed in 2001 to allow for 36
lots to be developed in four Stages. Stages one and two have been completed
and are now sealed. This land is being progressively taken up for residential
development.
The developer is currently progressing Stage three of the subdivision and
seeks a minor amendment to include lots from Stage four that are adjacent to
the roadway being constructed, in Stage three, namely lots 25 to 30 inclusive.
The developer also seeks to amend the permit to have a farm dam on the
balance land remain and has submitted documentation that encourages the
Planning Authority to permit such minor amendments.
The original subdivision has previously been the subject of a minor
amendment to alter the original conditions of the permit. This amendment
related to the provision of above ground power supplies altering the condition
of permit to provide undergrounding of the power supply. The deliberations
of the Planning Authority on that matter are relevant to the assessment of this
application.
4. Statutory and Strategic Requirements
Statutory Requirements
• Waratah-Wynyard Planning Scheme 2000, (Scheme)
• Land Use Planning and Approvals Act 1993 (LUPAA)
5. Finances
There are no readily identifiable financial impacts to Council’s determination
of the application under LUPAA as no avenue of appeal exists under this
legislation.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 27
Planning Authority Reports
6. Discussion
This matter is of concern given the original requirements of the permit and the
intent of the Planning Authority under the previous Planning Scheme to allow
a residential enclave in the rural setting.
Further information was sought from the developer to enable the Planning
Authority to address the requirements of LUPAA as set out under Section 56
(2) as follows:
56. Minor amendments of permits
(1) The owner of land, or a person with the consent of the owner, may
request the planning authority in writing to amend a permit which applies to
that land.
(2) The planning authority may amend the permit if it is satisfied that the
amendment –
(a) does not change the effect of any condition required by the
Appeal Tribunal; and
(b) will not cause an increase in detriment to any person; and
(c) does not change the use or development for which the
permit was issued other than a minor change to the description
of the use or development.
(3) If the planning authority amends a permit, it must, by notice in writing
served on –
(a) the person who requested the permit to be amended; and
(b) if that person is not the owner of the land, the owner; and
(c) in the case of a permit granted under section 57, the owner
or occupier of any property which adjoins the land; and
(d) any person who made a representation under section 57(5)
in relation to the application for the permit –
notify those persons of the amendments made to the permit.
(4) If the planning authority amends a permit containing a condition or
restriction which the Board of Environmental Management and Pollution
Control has required under section 25(5) of the Environmental Management
and Pollution Control Act 1994, the planning authority must, by notice in
writing served on the Board, notify it of the amendments made to the permit.
Planning Authority Reports
The developer, following initial assessment of the proposal by Council staff
with input from DPIW officer Mr Martin Huzzey, has submitted supporting
documentation from Tasmanian Fire Services, Mr Malcolm Densley and Mr
Chris Bartlett. The issues of concern identified when assessing the application
against the requirements of LUPAA and the responses provided by the
developer in the supporting information are set out below:
Issues relevant to LUPAA
requirements under Section 56.
Minor amendments of permits
(c) does not change the use or
development for which the permit was
issued other than a minor change to
the description of the use or
development
Comment
The proposed inclusion of lots 25 to
30 into Stage three does not represent
a significant departure from the
original permit in itself however when
coupled with the retention of the farm
dam raises concerns as these lots abut
the dam.
The retention of the dam on Lot 36
does represent a significant departure
from the original approval. Any
draining works require a permit from
DPIW and would include conditions
to rehabilitate the land. Thus Lot 36
under the original permit would have
resulted in a usable lot of
approximately 3 Hectares absent the
need to maintain the 10 Megalitre,
(Ref Densley Report) farm dam. To
allow the 10 Megalitre dam to remain
and significantly restrict the useable
land on lot 36 is not viewed as a
minor alteration to the original
approval.
The effect on lot 36 if the developer’s
arguments are accepted, in respect to
waterway values is to severely restrict
the development potential of the lot
due to setbacks required under the
Scheme with particular reference to
the Wetlands and Waterways
Schedule.
This schedule provides a 30-metre
setback requirement for works under
the Acceptable Solution. It is
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 29
Planning Authority Reports
(b) will not cause an increase in
detriment to any person;
arguable that any approved lot should
be able to be developed under the
Acceptable Solution of the Scheme
and not be forced to automatically
rely on the Performance Criteria to
gain a development approval. Clearly
a subsequent owner of the lot will be
impacted on in this manner if the dam
remains on the lot.
The comments from DPIW with
regard to the upgrading of Dam
hazard rating and the transfer of that
inherent risk to the property owner
clearly provide that there is an
increase in detriment to a person, be
that the current or future owners of
Lot 36. Clearly the ongoing cost of
maintaining the dam in an appropriate
manner versus the nil cost other than
a one-off removal cost, (developers
cost) demonstrates a detriment.
The report identifies that the dam
would change in nature from a farm
dam to an aesthetic water body within
a residential setting.
This raises issues such as potential for
unauthorised access by children,
environmental issues such as nuisance
from waterfowl and insect breeding
and potential for pollution of the dam
from drainage of the residential
surrounds.
The report clearly identifies that the
body of water is a farm dam and
should any threatened species be
found in the removal process
appropriate conditioning of the permit
would ensure correct relocation of the
species.
The unsaid progression of allowing
the dam to remain is that the
remaining lots in the future stage four
include lots below the dam wall. It is
clearly arguable that the owners,
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 30
Planning Authority Reports
whether current or future, of these lots
can potentially suffer a detriment
should the dam remain.
Developer’s
supporting
documentation
Report by Mr M Densley 25 August
2007
Comment
The report was referred to DPIW for
comment. Mr Huzzey in his response
does not fully concur with the report
and the conclusions drawn. The
response includes comment on the
elevation of the hazard rating for the
dam and highlights the risks
associated with leaving the dam
insitu.
The report by Mr Densley comments
on building envelopes on the lots
below the dam, however these
building envelopes were not put on
the lots to safeguard against dam
collapse as the original approval
called for the removal of the hazard.
The envelopes are a function of
suitable building sites for founding
and on-site disposal of effluent. The
envelopes do not preclude the owners
from developing the lot in the normal
manner of residential living. As a
result significant assets may well be at
risk should a future problem occur
with the dam.
Tasmania Fire Service
The support of the Tasmanian Fire
Service in seeking the retention of the
Dam identifies an impost on the
eventual owner of the lot in respect to
access to water and a requirement for
a suitable access point to draw off
water.
It does not identify that the water
supply is the only available drawing
point for water in the event of a fire in
the area. Indeed the fire vehicles
would have to travel over Camp
Creek to proceed to the subdivided
lots. The bridge over the creek would
seem to make an ideal draw point for
water.
Mr Chris Bartlett
It is not considered that matters raised
by Tasmania Fire Service negate the
matters under LUPAA to be
considered by the Planning Authority.
The matters raised by Mr Bartlett are
in the main a restating of issues raised
by Mr Densley and Tasmania Fire
Service.
Mr Bartlett does encourage Council to
retain the Dam on threatened species
grounds and raises case law, which he
argues may make draining the dam
unlawful.
The issue of removal of any
threatened species found under permit
conditions from DPIW is included in
advice from DPIW.
Should draining the dam be unlawful
as encouraged by Mr Bartlett and
absent any amendment by the
Planning Authority then the
threatened species argument would
preclude any development of Stage
four of the subdivision.
In such a case the threatened species
legislation should preclude DPIW
from issuing a permit for draining the
dam and, as sealing this Stage four
includes draining the dam, this would
appear to be counterproductive to the
developers’ plans.
There has been no evidence of an
active ecosystem including threatened
species, platypus, wild fowl and
vegetation. The submitted
photographs depict a rather barren
farm dam.
Planning Authority Reports
Mr Bartlett does not address the tests
provided in LUPAA for processing a
minor amendment other than agreeing
with the other supporting
documentation and stating his opinion
that there is no detriment or change to
the use or development for which the
original permit was issued.
The matter of a minor amendment to this subdivision has been previously
worked though by the Planning Authority in respect to power supply to the
subdivision and it is relevant to revisit advice received in respect to that issue.
Previous legal advice provided by Mr Brian Stace states that there is no appeal
right under LUPAA should the Planning Authority determine not to approve
the application for a minor amendment. The Resource Planning and Appeal
Tribunal confirmed this position.
Further advice on this matter was received from Mr Stace, to the effect that the
tests provided under LUPAA in respect to minor amendments were
cumulative in nature under Section 56 (2) (a to c). The Planning Authority
needs to be satisfied that what is proposed passes all the tests and even then
has a discretion, as the Section allows that the Planning Authority ‘may
amend’. That is the Planning Authority has a choice, a discretion, to approve
or refuse.
The minor amendment process effectively prevents an applicant obtaining an
approval and through a series of minor amendments effectively altering the
original approval to one which is more suitable to the applicant.
In the case of the power line issue the applicant was eventually required to pay
for Council to engage a valuer to determine if a detriment would result from
an approval.
An appraisal of the information at hand is sufficient to raise sufficient doubt as
to whether a detriment would be suffered by any person including the
subdivider.
The matter of the remaining lots in Stage four of the subdivision is also
pertinent to any alteration of the permit conditions. Lots 31 and 32 are directly
below the dam wall and may well be impacted in the future should the dam not
be maintained. Should Council allow the amendment the effect will be to
allow residential development below the dam wall as there is no impediment
to the developer continuing on to complete the subdivision.
Planning Authority Reports
7. Risk
There is no identified risk in refusing the application for an amendment as
there is no avenue of appeal open under LUPAA. The developer may
continue to challenge such a refusal however may well put in jeopardy the
future of Stage four of the subdivision through such a process.
8. Conclusion
The assessment of the application has raised sufficient doubt as to compliance
with the cumulative tests provided in LUPAA for consideration by the
Planning Authority and accordingly the minor amendment application should
be refused.
1. Recommendation
That Council:
(a)
(b)
receive the report commissioned by the Local Government
Association of Tasmania (LGAT) titled ‘A Review of the
Financial Sustainability of Local Government in Tasmania’.
endorse the establishment of a LGAT Steering Committee to
review the recommendation included within the report.
2. Summary
This report has been prepared to allow Council to formally receive the report
prepared for LGAT by Access Economic titled ‘A Review of the Financial
Sustainability of Local Government in Tasmania’.
3. Background
Access Economics was commissioned by LGAT to undertake the study. The
study follows similar studies undertaken by Access Economics in New South
Wales, South Australia and Western Australia.
The Australian Local Government Association also commissioned a report
from PricewaterhouseCoopers which considered the overall financial
sustainability of councils across the country. This report was launched at the
2006 ALGA General Assembly.
The review of financial sustainability of Tasmanian Councils was released on
21 March 2007 (refer separate attachment). This independent study provides a
snapshot of councils’ current situation regarding issues that are impacting on
their financial sustainability and details a suite of initiatives that will assist in
improving their long-term sustainability.
Objective
6.2
Objective
6.5
Develop, commit and implement a strategic asset development
plan that is financially responsible and meets community needs.
Be recognised as a leader in the provision of local governance to
the community.
Statutory Requirements
There are no specific statutory requirements to be considered in relation to this
particular matter.
5. Finances
The implementation of recommendations from the financial sustainability
report may have significant impacts for Council in the short, medium and
longer term.
Access Economics have recommended a series of actions for Tasmanian local
government to consider and LGAT plans to move quickly to establish a
Steering Committee, comprising elected members and officials, to work
through these recommendations and develop a program of action to implement
those that are supported.
6. Discussion
The report outlines the major financial stressors on councils, highlighting the
infrastructure backlog and the provision of increasing services to the
community as the key challenges facing councils.
The report identifies the following:
That one in five Tasmanian Councils may be financially unstainable. Based
upon the best information we can muster at this stage, we categorise the
current finances (and financial policies) of six Tasmanian Councils (or 20%),
which serves 8% of the State’s population, as ‘unsustainable’. This does not
mean these Councils are in imminent danger of defaulting on their debt
service obligations or that their financial viability is being called into
question. Rather, what is being flagged is that – if the long-term finances of
such Councils are to be put onto a sustainable footing – substantial or
disruptive revenue (or expenditure) adjustments appear inevitable.’
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 38
Council Reports
The report states that ‘rather than singling out particular Councils, to our
mind of more importance is the macro perspective provided by our
assessments as to the condition of local government as a whole.
Councils ‘feeling the pinch’ are most likely to be those, as characterised by
PricewaterhouseCoopers in its recent National Financial Sustainability Study
of local government for ALGA, that exhibit:
• Minimal (or negative) revenue growth;
• For a small proportion of Councils, limited access to rate revenue due
to relatively small populations reducing the size of the rates income
stream coupled with constraints on the size of annual rates increases;
• Limited access to the strong financial and asset management skills
which are critical to identifying sustainability problems, optimising
renewals expenditure and improving revenue streams;
• Expanding service provision due to rising community demands,
coupled with a related tendency by some Councils to step in to provide
a non-traditional service; and
• A tendency to run operating deficits creating a need to defer or
underspend on renewal of infrastructure, particularly community
infrastructure.
Particular areas identified for improvement are:
• Establishing internal structures that provide for independent review of
processes and decision-making to assist councillors meet their
accountability to ratepayers and the community, including with an
audit committee overseeing and advising on matters of accountability
and internal control;
• Embedding spending and revenue decisions in a multi-year framework,
and against the background of long-term financial rules; and
• Improving coherence and uniformity in external financial reporting.
It is also recommended that Tasmanian Councils develop appropriate longterm
spending, asset management, revenue and borrowing strategies to
overcome their infrastructure and services challenges within sustainable
financial limits.
At the very least, each Council should develop a rolling 10-year financial plan
to:
• Rehabilitate infrastructure that is already dilapidated;
• Renew infrastructure when it degrades below an acceptable standard
in future;
• Expand the total infrastructure stock by enough to adequately cater for
residential and business growth;
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 39
Council Reports
• Develop services in line with population growth and changing
community needs;
• Generate additional resources from revenue measures, operational
savings, reordering of spending priorities, infrastructure enhancement
deferrals, asset leases or disposals and extra borrowings that would be
sufficient to fund such a program; and
• Ensure that the outcome complies with sustainable financial targets
(e.g. the recommended minimum operating surplus ratio and maximum
annual renewals gap ratio) during this period.
7. Risk
A number of longer-term risks have been identified within the report generally
for local government in Tasmania. Waratah-Wynyard Council will need to
closely consider the recommendations from the report over time and develop
strategies to ensure its continued financial sustainability.
8. Conclusion
The report is presented for noting by Council at this time.
3. Background
Following completion of the initial renovation of the Railway Institute Hall in
Wynyard, it was considered that there was no need for the steering committee
that was appointed to oversee the upgrade works to continue and that the
facility would be managed by Council staff.
In late 2006 Council sought the views of the Community Centre Management
Special Committee’s on the merit of expanding their role to also include the
Railway Institute Hall.
Following advice received from the Committee that it generally supported the
inclusion of the Railway Institute Hall into their responsibilities in March 2007
it is now necessary to formally review the Delegation of Authority and
84/07 REVIEW OF COUNCIL POLICY – FINANCIAL ASSISTANCE TO
STATE AND NATIONAL REPRESENTATIVES POLICY
To:
Council
Reporting Officer: Executive Officer - Policy
Responsible Manager: Director Corporate Services
File Reference: 001.38
Council Meeting Date: 16 April 2007
1. Recommendation
That Council confirm the amended Financial Assistance to State and
National Representatives Policy and note that it is scheduled for
review in July 2011 unless interim circumstances necessitate an earlier
review.
2. Summary
This purpose of this report is to allow Council the opportunity to review its
Financial Assistance to State and National Representatives Policy originally
adopted on 19 May 2003 and subsequently reviewed and amended on 18 July
2005.
The current policy allows Council the discretion to approve a donation of
approximately 10% of costs, or up to $500 in cash or ‘in-kind’, to eligible
persons or organisations representing Australia at World Championship
sporting level or an event of similar status in a non-sporting pursuit.
3. Background
At its meeting held on 19 March 2007 Council resolved as follows:
“That Council’s current policy for financial assistance to State and
National Representatives be reviewed and a report presented to
Council for consideration.”
This report has been drafted in response to Council’s resolution.
4. Statutory and Strategic Requirements
Strategic Plan Reference
Council’s Strategic Plan 2004-2009 includes the following objectives:
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 52
Council Reports
Objective
6.3
Objective
6.6
Ensure that Council service delivery is reviewed, maintained and
enhanced to reflect community expectations.
Provide open, consistent, timely and accountable leadership in
decision-making.
Statutory Requirements
The Local Government Act 1993 provides:
Grants and benefits
77. (1) A council may make a grant or provide a benefit that is not a
legal entitlement to any person, other than a councillor, for any
purpose it considers appropriate.
(2) The details of any grant made or benefit provided are to be
included in the annual report of the council.
5. Finances
Any donations made under this policy are usually funded through Council’s
Community Assistance Small Grants Scheme. The most recent donation was
for an amount of $500 to junior futsal player Dayna Pine as a result on an
application considered by Council at its 19 March 2007 meeting.
Four other donations of $500 each have been made to Australian sporting
representatives during the current financial year.
6. Discussion
In accordance with Council’s resolution, the current policy has being reviewed
and consideration given to whether or not any amendments may be required.
The policy review indicated that it has generally worked quite well in practice,
providing Council with the opportunity to deal with applications for financial
assistance on a consistent and equitable basis.
The only major suggested alteration to the policy is the inclusion of a
provision that evidence be provided to Council that a person who appears to
meet the selection criteria for financial assistance by Council will be
participating in an event or pursuit that is ratified or sanctioned by the
generally recognised national peak body for that sporting, cultural, recreational
or similar pursuit.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 53
Council Reports
Therefore it is suggested that the following paragraph be added to Section 4.0
of the policy document:
“Following receipt of an application which appears to meet the selection
criteria for consideration of financial assistance by Council, the General
Manager shall ascertain, and include in the report to be considered by
Council, whether or not the sporting, cultural, recreational or similar
pursuit in which the applicant will be participating is ratified or
sanctioned by the generally recognised national peak body for that
sporting, cultural, recreational or similar pursuit.”
It is expected that Council staff will conduct the necessary research. In most
cases the level of research required should be relatively simple.
It is not considered necessary, at this time, to increase the maximum amount of
assistance which may be donated by Council. The policy currently allows
Council the discretion to approve a donation of approximately 10% of costs, or
up to $500 in cash or ‘in-kind’. Of course, Council always retains the
discretion to donate a lesser amount if it so resolves.
The only other alterations to the current policy are minor typographical
changes and do not affect the overall intent of the policy.
As a further review of the policy in the short term is unlikely, a future review
date of July 2011 is recommended.
7. Risk
As a matter of procedure, the ongoing development and review of Council
policies takes into consideration, the potential effects upon, or alterations to,
Council’s risk levels, financial or otherwise.
There are no obvious material changes to Council’s levels of risk which may
arise as a result of the adoption by Council of an amended Financial
Assistance to State and National Representatives Policy.
8. Conclusion
This report is presented for Council consideration.
Council from persons chosen to represent either Tasmania or Australia in
sporting, cultural, recreational or similar pursuits.
Council has the discretion to approve a donation of approximately 10% of
costs or up to $500 in cash or ‘in-kind’ to persons or organisations
85/07 LIGHTHOUSE ROAD - REQUEST FROM AUSTRALIAN MARITIME
SAFETY AUTHORITY FOR APPROVAL TO INSTALL GATE
Reporting Officer: Director Engineering Services
File Reference: RS155 & 7433263
Council Meeting Date: 16 April 2007
1. Recommendation
The Council approve the installation of a gate on Lighthouse Road to
limit vehicular access to the Table Cape Lighthouse during the period
dusk to dawn, subject to AMSA formally agreeing to the conditions
imposed by Council as outlined in this report, and further seek
approval from the Department of Infrastructure Energy and Resources
for the installation of the gate.
2. Summary
The Australian Maritime Safety Authority (AMSA) wrote to Council seeking
approval for the installation of a gate across Lighthouse Road, Table Cape, to
prevent vehicular access to the Lighthouse after dark. This action was
proposed by AMSA as a means to reduce the incidence of vandalism at the
Lighthouse facility.
Council determined to exercise its powers under Section 31 of the Local
Government (Highways) Act 1982 at its 19 February 2007 meeting and public
notices advising of Council’s intent to permit the installation of an obstruction
in the Lighthouse Road reservation to limit vehicular access to the Table Cape
Lighthouse, were placed in the Advocate newspaper.
One submission was received and it indicated support for the proposal.
It is recommended to Council that it proceed with the formal process to permit
a gate to be installed across Lighthouse Road to restrict vehicular access to the
Table Cape Lighthouse during the period dusk to dawn each night, subject to
AMSA committing to fund the costs associated with erecting the gate, the cost
to close and open the gate each day and agreeing to comply with the
conditions outlined in this report.
Council Reports
3. Background
At its 15 January 2007 meeting Council considered a report regarding a
request from AMSA in which permission was sought to install a gate across
Lighthouse Road to restrict access to the Table Cape Lighthouse during the
period between dusk and dawn.
This item was deferred to permit Councillors to inspect the proposed location
of the gate and the site visit occurred 29 January 2007.
This matter was further considered at the 19 February 2007 meeting of
Council, with the following determination:
1. The Council advise the Australian Maritime Safety Authority that
it supports, in principle, the Authority’s request for approval to
install a gate on Lighthouse Road to limit vehicular access after
dark.
2. That Council determines to proceed with advertising its intent to
permit an obstruction to be placed on Lighthouse Road, pursuant
to the provisions of Section 31 Local Government (Highways) Act
1982 and submissions on the proposal sought, subject to AMSA
committing to fund all costs associated with the process.
3. That upon completion of the submission process Council will
consider a further report in respect to the submissions received
and determine it’s formal position on the installation of the
obstruction at that time.
A copy of the Council’s determination and the accompanying report was
forwarded to AMSA for information and the obligations associated with any
approval given for the installation of a gate advised to that Authority.
A public notice was placed in the Advocate newspaper on 24 February 2007
and 3 March 2007 advising of Council’s intent to permit an obstruction to be
placed across Lighthouse Road and interested persons were invited to lodge a
submission on the proposal. A small display containing the same information
as the public notice was also erected in the foyer of the Council offices.
The submission period closed 27 March 2007.
The abutting landowner who would be affected by the installation of the gate
was also advised by letter of the proposal at hand.
This report informs Council of the outcome from the consultation process in
respect to the proposal to erect a gate across Lighthouse Road, Table Cape.
4. Statutory and Strategic Requirements
Strategic Plan Reference
Objective 6.6
Provide open, consistent, timely and accountable leadership
in decision-making.
Statutory Requirements
The Local Government (Highways) Act 1982 provides for a corporation to
place, or permit to be placed, an obstruction on a road for the purposes of
prohibiting or restricting traffic.
Section 31 of the Act describes the process to be followed should the
corporation wish to exercise this power.
31. Obstructions For Prohibition Or Restriction Of Vehicular Traffic
1. A corporation may, with the approval of the Transport
Commission, construct or place obstructions in a local highway
for the purpose of preventing or restricting the movement of
vehicular traffic.
2. Before making an application under this section for the approval
of the Transport Commission, the corporation shall cause a notice
to be published twice in separate issues of a local newspaper
circulating in the municipality of its intention to make the
application, specifying the situation and nature of the obstruction
and stating that written representations may be made to the
corporation with respect to the matter before such day as is
specified in the notice, being a day not earlier than 28 days after
its first publication.
3. The Transport Commission shall not give its approval under this
section in respect of an obstruction unless there has been
submitted to the Commission a copy of the notice published
under subsection (2), together with evidence that it has been
published as required by that subsection and copies of any
representations made to the corporation in accordance with the
notice and its comments on those representations.
4. The Transport Commission may give its approval under this
section for a corporation to install a road hump in –
(a)
a local highway leading to or from a car park; or
a local highway which is in a residential area.
5. A road hump installed pursuant to an authority given by the
Transport Commission under subsection (4) shall –
(a)
(b)
be of a design approved by the Transport
Commission;
be installed in a manner approved by the Transport
Commission; and
(c) be installed in a specific location on the local
highway referred to in subsection (4) that is
approved by the Commission.
6. No action, liability, claim, or demand lies or shall be allowed by
or in favour of any person against the Transport Commission, a
corporation, or any person involved in the installation of a road
hump in a local highway in respect of any damage done to a
vehicle or injury to a person or animal by reason of the
installation of the road hump in the local highway if the road
hump –
(a)
(b)
was installed pursuant to this section; and
was installed after the commencement of the
Traffic Amendment Act (No. 2) 1987.
7. In this section –
"road hump" has the meaning assigned to that expression by
section 49A of the Traffic Act 1925 .
5. Finances
The process to be followed under the Local Government (Highways) Act 1982
required advertising to be carried out and this had a direct cost implication to
Council. The cost of advertising will be recovered from AMSA as part of any
approval for the erection of the proposed gate.
All costs associated with the supply, erection and maintenance of the gate
would be borne by AMSA, as would all costs associated with locking and
unlocking of the gate.
Council Reports
6. Discussion
The consultation process resulted in one submission being received on the
proposal to install a gate across Lighthouse Road as a means of restricting
vehicular access to the Lighthouse site between dusk and dawn each day.
A copy of the submission from Van Diemen Quality Bulbs is attached and it
was advised that the Company has no objection to the proposal.
No further correspondence has been received from AMSA on this matter since
Council’s decision of 19 February 2007 was communicated to them. It is
suggested that the organisation has no objection to the conditions that would
be imposed were Council to permit a gate to be erected.
There being no objections to the proposal it is suggested to Council that it
determine to proceed with implementing the provisions of Section 31 Local
Government (Highways) Act 1982 to formalise the installation of the proposed
gate on Lighthouse Road.
Were Council to make a positive determination in this regard the next step in
the process would be to formally write to the Department of Infrastructure
Energy and Resources and seek their approval for the installation of the gate.
In addition formal advice would be sought from AMSA seeking their
compliance with the requirements and conditions associated with Council’s
approval for the gate. These are reproduced below for information.
• AMSA to be responsible for all costs associated with the formal procedure
to erect an obstruction on Lighthouse Road.
• The gate is to be constructed and installed to the satisfaction of the
Director Engineering Services. This is to include advance warning signs to
advise of the gate and signage on the gate to prevent collisions with the gate.
• AMSA to be responsible for all costs associated with the supply,
installation and maintenance of the gate.
• AMSA to be responsible for locking the gate between dusk and dawn of
each night and shall supply the lock for the gate and provide keys to the
neighbouring landholder, Council and Emergency Services.
• Appropriate signage to be erected on the gate, advising of the periods the
gate is locked and contact details in the event of an emergency.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 62
Council Reports
An additional condition to be imposed on AMSA would be as follows:
• Council at its discretion can determine to ‘re-open’ the access at any time
in the future by providing AMSA with 30 days notice of its intention. AMSA
to be responsible for removing the gate if requested by Council.
7. Risk
Were a gate to be installed across Lighthouse Road and access restricted
during the night, there may be some members of the public who would feel
aggrieved at this occurring.
A consultation process has been undertaken and no objections to the proposal
to install the gate were received by the close of the submission period.
The installation of the gate may assist in reducing the incidence of vandalism
at the Lighthouse and prevent possible damage to essential navigation
equipment.
8. Conclusion
This report is presented to Council for consideration.
86/07 ROAD SAFETY IMPROVEMENT OPTIONS – INTERSECTION OF
JACKSON STREET AND DODGIN STREET, WYNYARD
To:
Council
Reporting Officer: Director Engineering Services
File Reference: RS155 & 7433263
Council Meeting Date: 16 April 2007
1. Recommendation
The Council instruct staff to arrange for the installation of rumble bar
traffic islands in the northern and southern intersections of Jackson
Street and Dodgin Street, Wynyard and approve the relocation of the
existing pedestrian refuge in Dodgin Street some 12 metres to the west
of the current location.
2. Summary
This report considers a number of possible measures to achieve a reduction in
accidents at the intersection of Jackson Street and Dodgin Street, Wynyard.
The installation of rumble bar traffic islands in the Jackson Street intersections
with Dodgin Street will assist in controlling traffic manoeuvres. Relocation of
the existing pedestrian refuge some 12 metres to the west of its current
location will improve sight lines and continue to provide a crossing
opportunity for pedestrians at this location.
3. Background
At its 20 November 2006 meeting, Council considered a report with a proposal
by the Department of Infrastructure Energy and Resources to submit a Black
Spot Application, on behalf of Council, for the installation of a roundabout at
the intersection of Jackson Street and Dodgin Street.
On that matter Council determined:
“That Council determines to advise the Department of Infrastructure, Energy
and Resources that it does not support the lodgement of a Black Spot Funding
submission for the construction of a roundabout at the intersection of Jackson
Street and Dodgin Street, Wynyard however, it will look to identify alternative
options.”
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 64
Council Reports
Further on this matter Council also determined:
“That Council staff liaise with the DIER to identify alternative options to
address the traffic concerns raised.”
At the March 2007 meeting of Council a correspondence report was presented
in regard to traffic management issues raised in letters from the Wynyard
Senior Citizens Club and North West Regional Advisory Committee (RACT).
There was significant debate on the nature of possible traffic management
improvements at the intersection however, ultimately there was no decision
made in respect to the report presented and as such the November 2006
determination of Council remains the current position.
Council staff had discussions with officers from the Department of
Infrastructure Energy and Resource on possible options to address traffic
safety concerns at the intersection of Dodgin Street and Jackson Street and this
report discussed possible improvement options for Council to consider.
4. Statutory and Strategic Requirements
Strategic Plan Reference
Objective
6.6
Provide open, consistent, timely and accountable leadership in
decision-making.
Statutory Requirements
The installation of signage, construction of new traffic control devices or the
alteration of existing devices requires the approval of DIER.
Were Council to consider implementing one, or a combination of the measures
identified in this report, a formal request for approval to undertake the works
would be forwarded to DIER.
5. Finances
A number of minor works are proposed within this report. The estimated cost
of each action is as follows:
Install rumble bar islands (2 number) $ 800
Remove pedestrian refuge $ 500
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 65
Council Reports
Relocate pedestrian refuge to the west $2,800
Additional signage $ 300
The operational budget for Wynyard Sealed Roads would fund improvement
works if implemented.
6. Discussion
There has been a history of vehicular accidents at the intersection of Jackson
Street and Dodgin Street, Wynyard. Based upon information provided by
DIER there have been four (4) casualty accidents and eighteen (18) property
accidents reported during the past 5 years.
DIER assessed the recorded accidents for trends in the nature of the accidents
occurring with the following observations made.
The two main collision types were:
• Single vehicle collisions with the pedestrian refuge on Dodgin Street,
western side of intersection. Either due to through traffic or right
turning traffic from the northern leg of the Jackson Street intersection.
• Two vehicle collisions where one driver has failed to give way to
another. Reasons include possible sightline obstruction by the
pedestrian refuge for vehicles travelling west on Dodgin Street and
attempting to undertake a right turn manoeuvre into Jackson Street and
colliding with east bound traffic on Dodgin Street. Failure of vehicles
exiting Jackson Street to give way to through traffic, possibly due to
inattention.
To address the possible reasons for the types of accidents occurring the
following improvement options are suggested:
• Construct rumble bar islands in the Jackson Street intersections.
Rumble bar islands provide a means of controlling turn manoeuvrers at
an intersection. They encourage drivers to enter and exit in a
controlled manner and inhibit the ability of drivers to cut corners thus
removing a potential source of traffic conflict.
The islands also assist in reinforcing to the driver that they are on the
minor road and must give way to through traffic.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 66
Council Reports
• Install signage
Improved intersection warning signage may assist in making drivers
more aware of the intersection however, it is suggested that structural
measures may provide more benefit in this instance.
• Remove the pedestrian refuge
The pedestrian refuge, in its current location, would appear to create
sightline issues for some motorists and inattentive drivers have collided
with the refuge.
Removal of the pedestrian refuge would address such issues.
It is apparent however, that members of the community, mainly older
persons, use the refuge, however the frequency of use is quite sporadic.
The refuge would provide some comfort to persons with limited
mobility in crossing the wide expanse of Dodgin Street.
Removal of the refuge may impact on the safety of older pedestrians
crossing at that location.
• Relocate the pedestrian refuge
The current location for the pedestrian refuge has a number of
limitations.
Relocation of the refuge some 10 to 12 metres to the west of Jackson
Street would remove the structure from the area of conflict for right
turning traffic out of Jackson Street and open up the sightlines in the
immediate vicinity of the intersection.
Conflict between the refuge and through traffic may still be an issue in
the new location.
To accommodate the refuge, the bus stop on the northern side of
Dodgin Street would need to be shortened. This would not impact of
the operation of the bus stop.
Whichever works are carried out in the vicinity of the Dodgin Street and
Jackson Street intersection there are a number of factors that would need to be
considered:
• Dodgin Street has been identified as the “bypass route “ for larger
vehicles so as to avoid the Wynyard CBD.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 67
Council Reports
• Impact on pedestrians should the pedestrian refuge be removed or
relocated.
• The intersection in question is used by Metro Buses, passenger buses
and coaches accessing the Visitor Information Centre, delivery vehicles
and the like. Traffic management measures would need to consider the
manoeuvrability limitations for such vehicles.
• Approval from the Department of Infrastructure Energy and Resources
would be required for works on the pedestrian refuge and installation
of the rumble bar islands.
7. Risk
The Department of Infrastructure Energy and Resources have identified the
intersection of Dodgin Street and Jackson Street as being a potential Black
Spot Program project due to the recorded accident history at the intersection.
In consultation with DIER, possible options to reduce the incidence of
accidents have been identified and are detailed in this report.
There would be an expectation in the community, now that such a review has
been undertaken, that some improvement works are carried out to address the
community concern with this intersection.
In the event that no works are carried out it is quite probable that Council may
be criticised for not addressing the issue.
8. Conclusion
A number of options have been presented in this report that will aid in
reducing the potential for accidents at the intersection of Jackson Street and
Dodgin Street, Wynyard.
It is recommended to Council that rumble bar islands be installed in the
northern and southern intersection of Jackson Street with Dodgin Street and
that the pedestrian refuge be relocated some 12 metres to the west of its
current location to improve sightlines and reduce the potential for conflict with
right turning traffic from Jackson Street.
Approval from the Department of Infrastructure Energy and Resources would
be necessary for the works as proposed.
WEED MANAGEMENT
Gorse
Two projects for Gorse will soon be underway in the municipality. Council
received a small amount of money from the Cradle Coast NRM ‘Local
Government Incentive’ grants late last year. It was decided that this would
offered to landowners who had reasonably small, infestations of Gorse. The
justification being to try and clean up the outlying areas, leaving the two main
areas of Table Cape and Waratah to be tackled where more funding becomes
available.
Cradle Coast NRM have implemented a Gorse control project in other
municipalities along the Coast, and will now offer this to property owners in
Waratah-Wynyard. This is a much larger grant program, which will mean
work can begin on some of the larger infestations.
If must be noted that both these grants are not a ‘handout’ to the landowner.
Anyone wishing to take advantage of this money, must sign a contract to
agree that once a contractor has been employed to carry out the initial works,
they (the landowner) will maintain the area for at least three years.
Crack Willow
Work is continuing by Council contractors to treat mature Crack Willow trees,
and re-growth from stumps. Residents are advised to contact Council if they
have any Crack Willow on their property so they can be treated under this
program. This project is working toward the eradication of Crack Willow in
this municipality, not just control of the plant, so any remaining plants within
a catchment have potential to re-infest ‘clean’ sites, and need to be treated as
soon as possible.
Cradle Coast NRM / Landcare Field Day
A successful Field Day was held on Wednesday 21 st March for landowners
and NRM staff to view a number of projects in the Waratah-Wynyard, and
Burnie, areas relating to waterways and aquatic weeds.
Some of the projects looked at and discussed were;
Waratah-Wynyard Council and Wynyard Landcare’s efforts in
poisoning/removing Crack Willow, and revegetating the riparian zones,
Burnie City Council’s catchment management project (funded by Natural
Heritage Trust) which has now re-fenced the waterways and tributaries in the
catchment which supplies the city’s water,
The experiments by Elliott Catchment Management Group to control Glyceria
maxima (also known as Poa aquatica) in wetlands and creeks,
The effects of poor land management practices on the Giant Freshwater
Lobster and its habitat,
A tour of the Burnie Water Treatment Plant.
Pampas Grass
Work will soon begin on spraying Pampas Grass at all recorded sites. Cradle
Coast NRM has provided funding to all municipalities to employ contractors
to carry out this work. Prior to this funding Council had followed up with
property owners to ensure that Pampas Grass plants were controlled, and have
routinely carried out spraying operations on Council owned land.
This funding will assist greatly with the eradication of Pampas Grass in this
municipality. Residents are asked to contact Council should they find any
new infestations.
ENGINEERING SERVICES
A. WORKS MANAGERS REPORT
March has seen the completion of the majority of the capital works
program for 2006/2007. The re-construction and sealing projects
urban and rural have been completed, including reseal programs and
line marking. Takone Road reconstruction, which was a major project
for Transport & General Services staff, was completed within the
allotted time frame and budget. Bridge replacements have also been
finalised, with Flowerdale River Meunna Road Bridge having just been
reopened to traffic.
Council’s subdivision at Sister Beach is progressing well with the
majority of civil works having been completed. Aurora and Telstra
services are still to be installed and completion of pavement gravel,
sealing, footpaths, driveways and nature strips should occur over the
next few weeks.
Goldie Street CBD improvements between Saunders and Jackson
Streets are almost completed. The footpath on the southern side has
been finished along with the landscaped areas. Asphalting works
should take place during May, and with the majority of works being
done at night-time, this should keep disruption to the business
operators to a minimum.
Drainage improvements to the Sister Beach stormwater system are
making a marked improvement within the area. Current works are
taking place along both sides of Irby Boulevard and materials have
been ordered for Stage III of this project.
The Roadside vegetation-mowing program has almost been completed
on the road network, with Meunna Road verges still to be mowed.
The Roads to Recovery program will commence again in early April
and run through to June. There is still 11 kilometres of road to be
completed, which will require approximately 13,300 tonnes of FCR
(Scalps) to be carted and spread on the various projects.
88/07 RESIDENT REQUEST - SEALING OF ACCESS ROAD TO
SOMERSET TENNIS CLUB
Correspondence has been received from Mr A Dunham, requesting that
Council consider the sealing of the gravel access road that commences at the
Esplanade and provides access to the Somerset Tennis Club and foreshore
area.
The writers concerns with the current situation are as follows:
• Vehicles driving at inappropriate speeds
• Hoon behaviour
• Dust
Mr Dunham considers that upgrading of the gravel access road would address
the issues raised.
OFFICERS COMMENTS
The gravel access road provides vehicular access to the Somerset Tennis
Courts and the foreshore area beyond.
Recently some 20m of the access road and intersection were surfaced with
asphalt to address dust issues and reduce the transfer of gravel to the
Esplanade Road surface.
The volume of traffic using the access road will vary according to the level of
activity at the tennis courts and foreshore area. The level of maintenance
required to maintain the road in good order is not excessive.
Waratah-Wynyard Council – Ordinary Meeting Minutes – 16 April 2007 Page 96
Correspondence
Poor driver behaviour would appear to be one of the main reasons for
requesting that the road be upgraded and in many respects this is an education
and enforcement issue rather than a road standard issue.
The estimated cost of upgrading the access road some 250m to the Tennis
Courts, to a sealed road standard of 5 metre seal width is $30,000.
The upgrading of this road is not identified on the current forward capital
works program.
89/07 REQUEST FOR FINANCIAL ASSISTANCE – 2007 TOUR OF
TASMANIA ROAD CYCLING CLASSIC (103.01)
Correspondence has been received from Caribou Publications Pty Ltd, the
organisers of the 2007 Tour of Tasmania Road Cycling Classic, requesting
that Council give consideration to making a contribution of $3,000 toward the
event.
The 2007 Tour of Tasmania Road Cycling Classic forms part of the 12 th
Tattersalls Cycling Series and it is proposed that Wynyard host the finish of
the Tour’s sixth stage from Burnie on Thursday 4 October.
Further details of the request, together with general information about the
event, are included in the enclosure document.
OFFICERS COMMENTS
In the event that Council resolves to financially support this event, then a
budgetary provision will need to be made by Council when considering its
2007-2008 Annual Plan and Budget.
It is not known if holding the stage finish in Wynyard is dependent upon
Council financially supporting the Tour. It could be argued that the potential
benefits to the Waratah-Wynyard municipal area in return for the $3,000
sponsorship may be limited. It is suggested that Council decline the
sponsorship offer.
Alternatively, Council may resolve to support the event financially.
There is little detail, at this time, in relation to the traffic management
requirements of the organisers. Irrespective of whether or not Council
resolves to support the event financially, Council staff may need to hold
discussions with the event organisers in relation to traffic management issues
and any non-financial assistance that may be required of Council.
EMERGENCY MANAGEMENT COORDINATOR AND DEPUTY
MUNICIPAL EMERGENCY MANAGEMENT COORDINATOR
(502.02)
At its meeting held on 19 March 2007, Council resolved as follows:
Mr Fagg and Mr Lawes have been appointed under the transitional provisions
of section 23 of the new Emergency Management Act 2006, formal
91/07 CAMPERVAN AND MOTORHOME CLUB OF AUSTRALIA – RV
FRIENDLY TOWN SCHEME
CR CHALK declared an interest in this agenda item and left the meeting at
9:15 PM.
The Mayor has been approached by the Campervan and Motorhome Club of
Australia (CMCA) requesting consideration of Wynyard becoming a RV
Friendly Town.
The RV Friendly Town Scheme is a new CMCA initiative aimed at assisting
mobile travellers as they travel throughout Australia.
An RV Friendly Town is one that has met a set of guidelines to ensure they
provide a certain amount of amenities, and a certain level of services for these
travellers. A town qualifies to for participating in the Scheme providing it
meets the following:
• Provision of short term and/or long-term parking.
• Access to a general shopping area.
• Access to a Dump Point.
• Access to potable water.
• Appropriate parking within the town centre.
• Access to medical facilities and pharmacies.
• Motor vehicle service centre.
• Tourist Information Centre.
As well as the above the CMCA also look at the general attitude of the council
and business people.
OFFICERS COMMENT
The cost to Council for participating in the RV Friendly Town Scheme is $220
per set of signs (2 per set). These signs need to be erected at Council’s
expense 1 – 2 kilometres from the town entrance.
Council may also choose to submit articles to the CMCA publication titled
‘The Wanderer’ and also purchase advertising space.
