1. Recommendation<br />

That the Planning Authority approve the proposed Hydrotherapy<br />

Centre to be constructed at 45 Goldie Street, <strong>Wynyard</strong>, subject to the<br />

following conditions:<br />

1. The development as shown on the endorsed plan(s) is not to be<br />

altered or modified for any reason without the consent of the<br />

Director of Development Services.<br />

2. The premises is only to be open for the use hereby permitted<br />

between the following hours:<br />

Monday to Friday - 6:00 a.m. to 9:00 p.m.<br />

inclusive<br />

Saturday - 6:00 a.m. to 9:00 p.m. inclusive<br />

Sundays and Public Holidays - 6:00 a.m. to 9:00<br />

p.m. inclusive<br />

3. Prior to the commencement of the use the applicant is to pay to<br />

<strong>Council</strong> cash in lieu for car parking spaces not provided on site<br />

to the sum of $5,154. Calculation of Value of Cash in Lieu for<br />

the seven (7) retail spaces unable to be provided is as follows:<br />

Area of car parking spaces not provided = 100m 2 , divided by<br />

land area 776m 2 X $40,000 (unimproved capital value of land) =<br />

$5,154 cash in lieu requirement.<br />

4. At no time is the right of way marked as C, D, E & F on the title<br />

known as CT149065/1, and the right of way on the title known as<br />

CT55948/2 to be obstructed by the parking of cars (except for<br />

vehicles associated with plant maintenance operations) or<br />

storage of materials either during or after the construction phase<br />

of the development.<br />

5. All deliveries to the development are to be made via the Goldie<br />

Street frontage of the premises.<br />

6. No advertising signs other than those indicated in the<br />

development proposal are to be erected without the approval of<br />

the Director Development Services.<br />

7. No part of the sign hereby permitted is to be internally or<br />

externally illuminated.<br />

8. The use of this development is not to result in the generation of<br />

environmental harm or nuisance as defined in the Environmental<br />

Management and Pollution Control Act 1994.<br />

9. Erosion and sediment controls are to be installed for the duration<br />

of the construction phase so as to limit the loss of soils and other<br />

debris from the site.<br />

10. No material is to be deposited on the road.<br />

11. No damage is to be caused to the road, footpath or other facility.<br />

12. No materials, machinery or operational construction are to be<br />

located on the road, footpath, nature strip or road reservation.<br />

13. The footings of the development are to be constructed such that<br />

no additional loading is placed upon the <strong>Council</strong> stormwater<br />

drainage line that traverses the property. The developer is to<br />

ensure that access remains to inspection openings in the<br />

drainage line and be responsible for ensuring that the drainage<br />

line is maintained in a clear state so that normal stormwater<br />

flows are unimpeded. The footing and access design system is to<br />

be to the satisfaction of <strong>Council</strong>’s Director Engineering Services.<br />

14. The developer is to be responsible for the cost of connection of<br />

the development to the <strong>Council</strong> sewerage network.<br />

15. All costs associated with the proposed development are to be met<br />

by the Developer.<br />

2. Summary<br />

The proposal is for the construction of a Hydrotherapy Centre on land zoned<br />

as Business & Civic at 45 Goldie Street, <strong>Wynyard</strong>. The proposal involves the<br />

construction of a building to house a heated swimming pool, change rooms,<br />

spa, sauna, and a physiotherapist/masseuse consultant’s room.<br />

The application is discretionary under clause 3.3.3(a) of the <strong>Waratah</strong>-<strong>Wynyard</strong><br />

Planning Scheme 2000 as although it constitutes a primary use class within the<br />

Business & Civic Zone, it partly relies on performance criteria within the Car<br />

Parking Schedule.<br />

3. Background<br />

This report assesses the proposal against the <strong>Waratah</strong>-<strong>Wynyard</strong> Planning<br />

Scheme 2000, State Policies and other relevant legislation and takes into<br />

account representations received during the public notification period.<br />

The subject property is located within the Central Business District of the<br />

town of <strong>Wynyard</strong>. The site for the proposed hydrotherapy pool comprises flat<br />

land that currently supports a residential dwelling (89m 2 ), a garage (32m 2 ),<br />

and a retail outlet (249m 2 ). The title is within proximity to existing<br />

commercially developed sites and is also close to residentially zoned and<br />

developed land. Access to the site includes street frontage to Goldie Street<br />

and a right of way access from Inglis Street.<br />

4. Statutory Requirements<br />

The application is subject to the following statutory instruments:<br />

• Land Use Planning and Approvals Act 1993<br />

• <strong>Waratah</strong> <strong>Wynyard</strong> Planning Scheme 2000<br />

5. Finances<br />

There are no financial implications arising for <strong>Council</strong> as a result of this<br />

development. If an appeal were lodged in relation to this application <strong>Council</strong><br />

would incur costs associated with defending its position.<br />

6. Discussion<br />

Application<br />

The proposal is for the construction of a Hydrotherapy Centre to include a<br />

hydrotherapy pool on land zoned as Business & Civic at 45 Goldie Street,<br />

<strong>Wynyard</strong>. The proposal involves the construction of a building to house a<br />

heated hydrotherapy pool, change rooms, spa, sauna, and a<br />

physiotherapist/masseuse consultant’s room. As well as the therapeutic<br />

services, the business will provide water safety education, private swimming<br />

instruction and water aerobic classes.<br />

As the closest facility of this nature is located 20 kilometres away in Burnie<br />

the hydrotherapy pool will provide local access for elderly and convalescing<br />

members of the <strong>Wynyard</strong> community. Furthermore, the business will benefit<br />

the wider community through providing employment during and after the<br />

construction phase of the proposal.<br />

The subject title proposed for development currently supports a residence<br />

(89m 2 ), a garage (32m 2 ), and a retail outlet (249m 2 ). The proposed building<br />

will cover a total area of 211 square metres.<br />

The proposal was advertised for a period of two weeks in accordance with the<br />

provisions of the Land Use Planning and Approvals Act, 1993. During this<br />

time <strong>Council</strong> received two (2) representations. The first was from Kylie<br />

Anderson of 47 Goldie Street, <strong>Wynyard</strong>, and the second from Richard K.<br />

Ruddle of Solicitors Kay & Ruddle on behalf of E & JG Duyst, owners of 8A<br />

& 8B Inglis Street.<br />

Issue Raised:<br />

The height of the eastern wall is to be raised to allow for windows and this<br />

will increase the existing problem of natural light to my property.<br />

Planning Comment:<br />

The titles for both the proposed development and the representor’s property<br />

are within the Business & Civic Zone. The proposal is consistent with the<br />

provisions of the zone and the residential use is not afforded a protection from<br />

overshadowing under the zone.<br />

Issue Raised:<br />

The western wall is to be 3.2 metres in height right to the footpath boundary.<br />

This will make it difficult for exiting my driveway, as visibility will be greatly<br />

reduced. With the medical centre opposite there are a lot of people who pass<br />

my property in gophers, prams, and wheelchairs etc.<br />

Planning Comment:<br />

The proposal is for a primary use within the Business & Civic Zone and is<br />

located within an existing Business & Civic area. Within the Business &<br />

Civic Zone, the Planning Scheme allows for structures to be built to<br />

boundaries, and is generally the case for a large percentage of commercial<br />

buildings. The proposal meets the Acceptable Solutions for development<br />

within the Business & Civic Zone. Consequently, the above issue is<br />

considered to be within the scope of standard driver safety and awareness as<br />

would be the normal case for vehicles manoeuvring in the Business and Civic<br />

Zone.<br />

Issue Raised:<br />

The increased parking in an already problem area is also a major concern<br />

because people park in no parking area making it impossible to access my<br />

driveway. A lot of the parking is taken up by medical centre staff and the<br />

business submitting the proposal.<br />

Planning Comment:<br />

A condition of permit stipulates:<br />

‘Prior to the commencement of the use the applicant is to pay to <strong>Council</strong> cash<br />

in lieu for car parking spaces not provided on site to the sum of $5,154.<br />

Calculation of Value of Cash in Lieu for the seven (7) retail spaces unable to<br />

be provided is as follows: Area of car parking spaces not provided = 100m 2 ,<br />

divided by land area 776m 2 X $40,000 (unimproved capital value of land) =<br />

$5,154 cash in lieu requirement.’<br />

This payment under the Car parking and Access Schedule of the Scheme is to<br />

“provide parking for those spaces in a location suitable for users of the use or<br />

development”. The developer has identified that additional street car parking<br />

may become available where there is currently an access driveway to the<br />

premises. The payment should be used to augment and control parking in this<br />

area to assist with the issues raised in the representation.<br />

Duyst - owners of 8A & 8B Inglis Street.<br />

Issue Raised:<br />

The right of way (ROW) over 8A & 8B Inglis Street is not currently used for<br />

the parking of vehicles, nor as a storage area. There is permanent parking at<br />

the rear of these premises, not on any part of the right of way. The owners of<br />

8A & 8B Inglis Street are concerned that the proposed plans do not appear to<br />

provide for any permanent parking at the rear of the developers property at 45<br />

Goldie Street, and consequently fear that the right of way area marked CDEF<br />

on the title known as CT149065/1 may be in constant use as permanent and<br />

semi-permanent parking space for the developer, especially during the<br />

construction phase with the delivery of building materials and equipment, and<br />

that the right of way will be in constant use during this period by tradesmen<br />

and subsequently by customers, who may be tempted to park more or less<br />

permanently on the right of way itself.<br />

Planning Comment:<br />

A condition of permit will stipulate that at no time is the right of way marked<br />

as C, D, E & F on the title known as CT149065/1, and the right of way on the<br />

title known as CT55948/2 to be obstructed by the parking of cars (except for<br />

vehicles associated with plant maintenance operations) or storage of materials<br />

either during or after the construction phase of the development and that all<br />

deliveries to the development are to be made via the Goldie Street frontage.<br />

Business & Civic Zone<br />

The subject site is located within the Business & Civic Zone and the<br />

application seeks approval for a Business & Civic development. Relevant to<br />

this proposal, Clause 2.2.3 of the Planning Scheme establishes the Values of<br />

the Business & Civic Zone as:<br />

The capacity to provide a range of commercial functions of both local and<br />

regional significance;<br />

The capacity to provide a mix of commercial, business, public and community<br />

facilities and activities in locations easily accessed and where the impact on<br />

adjoining activities can be managed; and<br />

A focus for commercial, tourism and public investment.<br />

The proposed hydrotherapy pool provides an opportunity to encourage<br />

investment within the <strong>Waratah</strong>-<strong>Wynyard</strong> municipal area and to generate<br />

employment during construction and operation of the facility. The site<br />

proposed for the pool is within the Business and Civic zone, close to the<br />

Central Business District of the town of <strong>Wynyard</strong>.<br />

Under clause 8.3.1 of the <strong>Waratah</strong> <strong>Wynyard</strong> Planning Scheme 2000, the<br />

Business & Civic development is a primary use class within the Business &<br />

Civic Zone.<br />

The intent of the Business & Civic Zone is:<br />

(a)<br />

(b)<br />

To provide for a range of business and civic uses in<br />

concentrated areas; and<br />

To allow a range of other uses in ways and locations that do<br />

not affect the viability and operation of use or development<br />

associated with the primary uses of the zone.<br />

The proposal is for a primary use within the zone and is located within an<br />

existing business & civic area. The proposal is not considered to affect the<br />

viability or operation of other primary use class activities within the area. The<br />

proposed hydrotherapy pool is consistent with the intent of the Business &<br />

Civic Zone.<br />

The following section provides an assessment of the proposal against the<br />

relevant issues identified in Part 7.0 of the Planning Scheme.<br />

Issue 1.0 Delivery of Goods<br />

The acceptable solution for issue 1.0 is:<br />

Where delivery of goods is required, arrangements for parking,<br />

manoeuvring, loading and unloading of delivery vehicles are not to<br />

interfere with pedestrian or vehicle movements on roads, within on-site<br />

parking areas and at public entrances to buildings.<br />

There are no performance criteria.<br />

The application states that there will be no requirement for delivery vehicle<br />

access and that maintenance personnel enter the premises plant room from the<br />

rear right of way.<br />

The issue of the right of way has been raised in representation to <strong>Council</strong> and<br />

as it is considered appropriate that the permit be conditioned to limit use of<br />

this access as the applicant clearly flags in the application that there will be<br />

limited impact from deliveries.<br />

The proposal is therefore considered to be consistent with the acceptable<br />

solution for delivery of goods under the Planning Scheme.<br />

Issue 2.0 Building Appearance and Street Character<br />

Within the <strong>Waratah</strong> <strong>Wynyard</strong> Planning Scheme 2000, the objective is:<br />

‘To ensure that building appearance from public streets is visually<br />

compatible with surrounding development and maintains pedestrian<br />

amenity’.<br />

It is proposed that the building to enclose the hydrotherapy pool will be a<br />

single storey building – 5 metres high at the highest point – and is to be built<br />

to the north, south and western boundaries. The proposal is within the<br />

Business & Civic Zone and the surrounding area has a number of buildings of<br />

similar appearance and size to that proposed and therefore is in keeping with<br />

the surrounding buildings on Goldie Street. The exception is the residential<br />

dwelling to the west of the proposed development is set back approximately 4<br />

metres from the street boundary.<br />

The application also details an awning similar to that of the abutting eastern<br />

veranda appearance.<br />

The proposal is therefore considered to be consistent with the acceptable<br />

solution for building appearance and street character under the Planning<br />

Scheme.<br />

Issue 3.0 Infrastructure Provision<br />

The objective is:<br />

To ensure that the cost of providing infrastructure to new development<br />

is not borne by the community.<br />

The <strong>Council</strong>’s Director Engineering Services requires a condition of approval<br />

that all costs associated with the development are be at the developer’s<br />

expense.<br />

Issue 5.0 Amenity of existing residential development<br />

The objective is:<br />

To ensure that use and development protects the amenity of residential<br />

use or development abutting the Business and Civic Zone.<br />

This Planning Scheme standard is not applicable to the neighbouring<br />

residential use as both properties are within the Business and Civic Zone.<br />

The residential use does not abut the Business and Civic Zone and hence is not<br />

afforded the protection provided in this Scheme standard in respect to the<br />

interface between the Business and Civic and Residential Zones. Nevertheless<br />

standard conditions of the permit will ensure that no environmental nuisance<br />

or harm is created as a result of the development.<br />

Issue 6.0 Amenity of existing non residential use or development<br />

The objective is:<br />

To ensure that new use or development does not adversely impact on<br />

the operation of existing non residential use or development on<br />

adjoining sites.<br />

The nature of the proposal does not involve any processes or activities that<br />

would lead to adverse impacts on the operation of existing non residential use<br />

or developments on adjoining sites.<br />

Issue 7.0 Subdivision<br />

Issue 7.0 Pedestrian Movement<br />

The operation of the proposed Hydrotherapy Pool will not obstruct pedestrian<br />

movement along the Goldie Street footpath.<br />

No sites of cultural significance including Aboriginal heritage are within the<br />

land area proposed for Hydrotherapy Pool.<br />

The intent of this Schedule it to:<br />

Ensure adequate parking is provided for all use or development;<br />

Ensure that parked vehicles do not obstruct the passage of other<br />

vehicles, pedestrians or cyclists or create traffic hazards; and<br />

Minimise detrimental impacts of vehicle parking and access and<br />

driveway needs on the amenity of the use or development, streetscape<br />

required five car parking spaces, made up of three (3) for the proposed retail<br />

business, and two (2) for the existing residential dwelling. There was a<br />

shortfall of two (2) car parking spaces for the business use. A cash in lieu<br />

contribution was required for the entire business car parking unable to be<br />

provided on site. This equated to a total of $1,920 cash in lieu requirement.<br />

Application of Figure 17.4 -Calculation of Value of Cash in Lieu for<br />

the 2 car spaces unable to be provided is as follows:<br />

Area of car parking spaces not provided = 28.8m 2 , divided by land area<br />

600m 2 X $40,000 (unimproved capital value of land) = $1,920 cash in<br />

lieu requirement.<br />

Relevant to the current Development application, the Planning Scheme Figure<br />

17.1 Car Parking Spaces states that in the Business and Civic zone one (1) car<br />

parking space is required per 30m 2 of gross floor area. The proposal before<br />

<strong>Council</strong> has an approximate retail floor area of 211m 2 . The minimum number<br />

of car parking spaces required if calculated on a floor area basis would be<br />

seven (7).<br />

The submitted plans make no provision for on site car parking relative to the<br />

proposed business use. The developer, in the submitted information, outlines<br />

a view that a lesser car parking requirement should apply and identifies that<br />

additional car parking would be available on the street in lieu of the current<br />

driveway to the property.<br />

The lesser parking requirement is not accepted as the Scheme clearly provides<br />

that the measure is whichever is the greater of a gross floor area or a<br />

calculation based on the type of use.<br />

In this case the floor area is the greater. The comment on the increased<br />

availability of on street parking is accepted however, the cost of providing this<br />

should be covered by the cash in lieu contribution of the developer.<br />

The five (5) car parking spaces provided on site are for the existing retail<br />

outlet (3) and the existing residential dwelling (2). The site is unable to make<br />

provision for the seven (7) car parking spaces required for the proposed<br />

development. It is considered acceptable that the developer be required to<br />

make a cash in lieu contribution for all business car parking unable to be<br />

provided on site.<br />

A condition of approval is provided with this permit that prior to the<br />

commencement of the use the applicant is to pay to <strong>Council</strong> cash in lieu for car<br />

parking spaces not provided on site to the sum of $5,154. Calculation of<br />

Value of Cash in Lieu for the seven (7) retail spaces unable to be provided is<br />

as follows: Area of car parking spaces not provided = 100m 2 , divided by land<br />

area 776m 2 X $40,000 (unimproved capital value of land) = $5,154 cash in<br />

lieu requirement.<br />

19.0 Signs<br />

The development application details a sign – 1 metre high by 2 metres wide<br />

(2.0 square metres) – that is to be mounted above the awning on the building’s<br />

front façade facing Goldie Street. The sign is to state the business name,<br />

business nature and contact phone number, and is to be constructed from<br />

Colour Bond sheet metal in blue and white tones. The sign will not be<br />

illuminated either internally or externally.<br />

The following conditions form part of the permit:<br />

No advertising signs other than those indicated in the development<br />

proposal are to be erected without the approval of the Director<br />

Development Services.<br />

No part of the sign hereby permitted is be internally or externally<br />

7. Risk<br />

The applicant or the representor may appeal the Planning Authority’s decision<br />

The proposed hydrotherapy pool is consistent with the <strong>Waratah</strong> <strong>Wynyard</strong><br />

Planning Scheme 2000. The proposal is for a primary use within the existing<br />

Business & Civic Zone. The conditions provided within the permit will ensure<br />

that the hydrotherapy pool does not pose a detrimental impact upon the<br />

amenity of surrounding land.<br />

The proposal is consistent with the values of the Business & Civic Zone,<br />

including providing a range of commercial functions of both local and regional<br />

significance. The proposed hydrotherapy pool is recommended for approval<br />

subject to the conditions provided with this permit.<br />

application be deferred to allow additional information to be provided. The<br />

Planning Authority determined:<br />

The Planning Authority’s decision was communicated to Mr Mackenzie in<br />

writing dated 21 March <strong>2007</strong>. The Director Development Services attended<br />

an on-site meeting with Mr Mackenzie and his Consultant Engineer on 23<br />

March <strong>2007</strong>.<br />

At the time of finalising the agenda for this meeting no new additional<br />

information has been provided which would cause an alternative<br />

The report from the agenda of 19 March <strong>2007</strong> is reproduced below in its<br />

entirety.<br />

Application is made to amend Planning Permit SD<strong>16</strong>37 to include proposed<br />

lots 25 to 30 in Stage three of the staged subdivision. These lots are currently<br />

part of Stage four of the development. An issue which impacts on this<br />

adjustment of proposed lots between stages is the requirement in the original<br />

permit for the draining of a farm dam prior to development of stage four. The<br />

developer also seeks to have the dam remain on the property and has<br />

submitted documentation in support of the application.<br />

3. Background<br />

An application to subdivide the property was processed in 2001 to allow for 36<br />

lots to be developed in four Stages. Stages one and two have been completed<br />

and are now sealed. This land is being progressively taken up for residential<br />

development.<br />

The developer is currently progressing Stage three of the subdivision and<br />

seeks a minor amendment to include lots from Stage four that are adjacent to<br />

the roadway being constructed, in Stage three, namely lots 25 to 30 inclusive.<br />

The developer also seeks to amend the permit to have a farm dam on the<br />

balance land remain and has submitted documentation that encourages the<br />

Planning Authority to permit such minor amendments.<br />

The original subdivision has previously been the subject of a minor<br />

amendment to alter the original conditions of the permit. This amendment<br />

related to the provision of above ground power supplies altering the condition<br />

of permit to provide undergrounding of the power supply. The deliberations<br />

of the Planning Authority on that matter are relevant to the assessment of this<br />

application.<br />

of the application under LUPAA as no avenue of appeal exists under this<br />

6. Discussion<br />

This matter is of concern given the original requirements of the permit and the<br />

intent of the Planning Authority under the previous Planning Scheme to allow<br />

a residential enclave in the rural setting.<br />

Further information was sought from the developer to enable the Planning<br />

Authority to address the requirements of LUPAA as set out under Section 56<br />

(2) as follows:<br />

56. Minor amendments of permits<br />

(1) The owner of land, or a person with the consent of the owner, may<br />

request the planning authority in writing to amend a permit which applies to<br />

that land.<br />

(2) The planning authority may amend the permit if it is satisfied that the<br />

amendment –<br />

(a) does not change the effect of any condition required by the<br />

Appeal Tribunal; and<br />

(b) will not cause an increase in detriment to any person; and<br />

(c) does not change the use or development for which the<br />

permit was issued other than a minor change to the description<br />

of the use or development.<br />

(3) If the planning authority amends a permit, it must, by notice in writing<br />

served on –<br />

(a) the person who requested the permit to be amended; and<br />

(b) if that person is not the owner of the land, the owner; and<br />

(c) in the case of a permit granted under section 57, the owner<br />

or occupier of any property which adjoins the land; and<br />

(d) any person who made a representation under section 57(5)<br />

in relation to the application for the permit –<br />

notify those persons of the amendments made to the permit.<br />

(4) If the planning authority amends a permit containing a condition or<br />

restriction which the Board of Environmental Management and Pollution<br />

Control has required under section 25(5) of the Environmental Management<br />

and Pollution Control Act 1994, the planning authority must, by notice in<br />

writing served on the Board, notify it of the amendments made to the permit.<br />

The developer, following initial assessment of the proposal by <strong>Council</strong> staff<br />

with input from DPIW officer Mr Martin Huzzey, has submitted supporting<br />

documentation from Tasmanian Fire Services, Mr Malcolm Densley and Mr<br />

Chris Bartlett. The issues of concern identified when assessing the application<br />

against the requirements of LUPAA and the responses provided by the<br />

developer in the supporting information are set out below:<br />

The proposed inclusion of lots 25 to<br />

30 into Stage three does not represent<br />

a significant departure from the<br />

original permit in itself however when<br />

coupled with the retention of the farm<br />

dam raises concerns as these lots abut<br />

the dam.<br />

The retention of the dam on Lot 36<br />

does represent a significant departure<br />

from the original approval. Any<br />

draining works require a permit from<br />

DPIW and would include conditions<br />

to rehabilitate the land. Thus Lot 36<br />

under the original permit would have<br />

resulted in a usable lot of<br />

approximately 3 Hectares absent the<br />

need to maintain the 10 Megalitre,<br />

(Ref Densley Report) farm dam. To<br />

allow the 10 Megalitre dam to remain<br />

and significantly restrict the useable<br />

land on lot 36 is not viewed as a<br />

minor alteration to the original<br />

approval.<br />

The effect on lot 36 if the developer’s<br />

arguments are accepted, in respect to<br />

waterway values is to severely restrict<br />

the development potential of the lot<br />

due to setbacks required under the<br />

Scheme with particular reference to<br />

the Wetlands and Waterways<br />

Schedule.<br />

This schedule provides a 30-metre<br />

setback requirement for works under<br />

the Acceptable Solution. It is<br />

(b) will not cause an increase in<br />

detriment to any person;<br />

arguable that any approved lot should<br />

be able to be developed under the<br />

Acceptable Solution of the Scheme<br />

and not be forced to automatically<br />

rely on the Performance Criteria to<br />

gain a development approval. Clearly<br />

a subsequent owner of the lot will be<br />

impacted on in this manner if the dam<br />

remains on the lot.<br />

The comments from DPIW with<br />

regard to the upgrading of Dam<br />

hazard rating and the transfer of that<br />

inherent risk to the property owner<br />

clearly provide that there is an<br />

increase in detriment to a person, be<br />

that the current or future owners of<br />

Lot 36. Clearly the ongoing cost of<br />

maintaining the dam in an appropriate<br />

manner versus the nil cost other than<br />

a one-off removal cost, (developers<br />

cost) demonstrates a detriment.<br />

The report identifies that the dam<br />

would change in nature from a farm<br />

dam to an aesthetic water body within<br />

a residential setting.<br />

This raises issues such as potential for<br />

unauthorised access by children,<br />

environmental issues such as nuisance<br />

from waterfowl and insect breeding<br />

and potential for pollution of the dam<br />

from drainage of the residential<br />

surrounds.<br />

The report clearly identifies that the<br />

body of water is a farm dam and<br />

should any threatened species be<br />

found in the removal process<br />

appropriate conditioning of the permit<br />

would ensure correct relocation of the<br />

species.<br />

The unsaid progression of allowing<br />

the dam to remain is that the<br />

remaining lots in the future stage four<br />

include lots below the dam wall. It is<br />

clearly arguable that the owners,<br />

The report by Mr Densley comments<br />

on building envelopes on the lots<br />

below the dam, however these<br />

building envelopes were not put on<br />

the lots to safeguard against dam<br />

collapse as the original approval<br />

called for the removal of the hazard.<br />

The envelopes are a function of<br />

suitable building sites for founding<br />

and on-site disposal of effluent. The<br />

envelopes do not preclude the owners<br />

from developing the lot in the normal<br />

manner of residential living. As a<br />

result significant assets may well be at<br />

risk should a future problem occur<br />

with the dam.<br />

Tasmania Fire Service<br />

The support of the Tasmanian Fire<br />

Service in seeking the retention of the<br />

Dam identifies an impost on the<br />

eventual owner of the lot in respect to<br />

access to water and a requirement for<br />

a suitable access point to draw off<br />

water.<br />

It does not identify that the water<br />

supply is the only available drawing<br />

point for water in the event of a fire in<br />

the area. Indeed the fire vehicles<br />

would have to travel over Camp<br />

Creek to proceed to the subdivided<br />

lots. The bridge over the creek would<br />

seem to make an ideal draw point for<br />

water.<br />

Mr Chris Bartlett<br />

It is not considered that matters raised<br />

by Tasmania Fire Service negate the<br />

matters under LUPAA to be<br />

considered by the Planning Authority.<br />

The matters raised by Mr Bartlett are<br />

in the main a restating of issues raised<br />

by Mr Densley and Tasmania Fire<br />

Service.<br />

Mr Bartlett does encourage <strong>Council</strong> to<br />

retain the Dam on threatened species<br />

grounds and raises case law, which he<br />

argues may make draining the dam<br />

unlawful.<br />

The issue of removal of any<br />

threatened species found under permit<br />

conditions from DPIW is included in<br />

advice from DPIW.<br />

Should draining the dam be unlawful<br />

as encouraged by Mr Bartlett and<br />

absent any amendment by the<br />

Planning Authority then the<br />

threatened species argument would<br />

preclude any development of Stage<br />

four of the subdivision.<br />

In such a case the threatened species<br />

legislation should preclude DPIW<br />

from issuing a permit for draining the<br />

dam and, as sealing this Stage four<br />

includes draining the dam, this would<br />

appear to be counterproductive to the<br />

developers’ plans.<br />

There has been no evidence of an<br />

active ecosystem including threatened<br />

species, platypus, wild fowl and<br />

vegetation. The submitted<br />

photographs depict a rather barren<br />

farm dam.<br />

Mr Bartlett does not address the tests<br />

provided in LUPAA for processing a<br />

minor amendment other than agreeing<br />

with the other supporting<br />

documentation and stating his opinion<br />

that there is no detriment or change to<br />

the use or development for which the<br />

original permit was issued.<br />

The matter of a minor amendment to this subdivision has been previously<br />

worked though by the Planning Authority in respect to power supply to the<br />

subdivision and it is relevant to revisit advice received in respect to that issue.<br />

Previous legal advice provided by Mr Brian Stace states that there is no appeal<br />

right under LUPAA should the Planning Authority determine not to approve<br />

the application for a minor amendment. The Resource Planning and Appeal<br />

Tribunal confirmed this position.<br />

Further advice on this matter was received from Mr Stace, to the effect that the<br />

tests provided under LUPAA in respect to minor amendments were<br />

cumulative in nature under Section 56 (2) (a to c). The Planning Authority<br />

needs to be satisfied that what is proposed passes all the tests and even then<br />

has a discretion, as the Section allows that the Planning Authority ‘may<br />

amend’. That is the Planning Authority has a choice, a discretion, to approve<br />

or refuse.<br />

The minor amendment process effectively prevents an applicant obtaining an<br />

approval and through a series of minor amendments effectively altering the<br />

original approval to one which is more suitable to the applicant.<br />

In the case of the power line issue the applicant was eventually required to pay<br />

for <strong>Council</strong> to engage a valuer to determine if a detriment would result from<br />

an approval.<br />

An appraisal of the information at hand is sufficient to raise sufficient doubt as<br />

to whether a detriment would be suffered by any person including the<br />

subdivider.<br />

The matter of the remaining lots in Stage four of the subdivision is also<br />

pertinent to any alteration of the permit conditions. Lots 31 and 32 are directly<br />

below the dam wall and may well be impacted in the future should the dam not<br />

be maintained. Should <strong>Council</strong> allow the amendment the effect will be to<br />

allow residential development below the dam wall as there is no impediment<br />

to the developer continuing on to complete the subdivision.<br />

7. Risk<br />

There is no identified risk in refusing the application for an amendment as<br />

there is no avenue of appeal open under LUPAA. The developer may<br />

continue to challenge such a refusal however may well put in jeopardy the<br />

future of Stage four of the subdivision through such a process.<br />

8. Conclusion<br />

The assessment of the application has raised sufficient doubt as to compliance<br />

with the cumulative tests provided in LUPAA for consideration by the<br />

Planning Authority and accordingly the minor amendment application should<br />

be refused.<br />

2. Summary<br />

This report has been prepared to allow <strong>Council</strong> to formally receive the report<br />

prepared for LGAT by Access Economic titled ‘A Review of the Financial<br />

Sustainability of Local Government in Tasmania’.<br />

3. Background<br />

Access Economics was commissioned by LGAT to undertake the study. The<br />

study follows similar studies undertaken by Access Economics in New South<br />

Wales, South Australia and Western Australia.<br />

The Australian Local Government Association also commissioned a report<br />

from PricewaterhouseCoopers which considered the overall financial<br />

sustainability of councils across the country. This report was launched at the<br />

2006 ALGA General Assembly.<br />

The review of financial sustainability of Tasmanian <strong>Council</strong>s was released on<br />

21 March <strong>2007</strong> (refer separate attachment). This independent study provides a<br />

snapshot of councils’ current situation regarding issues that are impacting on<br />

their financial sustainability and details a suite of initiatives that will assist in<br />

improving their long-term sustainability.<br />

5. Finances<br />

The implementation of recommendations from the financial sustainability<br />

report may have significant impacts for <strong>Council</strong> in the short, medium and<br />

longer term.<br />

Access Economics have recommended a series of actions for Tasmanian local<br />

government to consider and LGAT plans to move quickly to establish a<br />

Steering Committee, comprising elected members and officials, to work<br />

through these recommendations and develop a program of action to implement<br />

those that are supported.<br />

6. Discussion<br />

The report outlines the major financial stressors on councils, highlighting the<br />

infrastructure backlog and the provision of increasing services to the<br />

community as the key challenges facing councils.<br />

The report identifies the following:<br />

That one in five Tasmanian <strong>Council</strong>s may be financially unstainable. Based<br />

upon the best information we can muster at this stage, we categorise the<br />

current finances (and financial policies) of six Tasmanian <strong>Council</strong>s (or 20%),<br />

which serves 8% of the State’s population, as ‘unsustainable’. This does not<br />

mean these <strong>Council</strong>s are in imminent danger of defaulting on their debt<br />

service obligations or that their financial viability is being called into<br />

question. Rather, what is being flagged is that – if the long-term finances of<br />

such <strong>Council</strong>s are to be put onto a sustainable footing – substantial or<br />

disruptive revenue (or expenditure) adjustments appear inevitable.’<br />

The report states that ‘rather than singling out particular <strong>Council</strong>s, to our<br />

mind of more importance is the macro perspective provided by our<br />

assessments as to the condition of local government as a whole.<br />

<strong>Council</strong>s ‘feeling the pinch’ are most likely to be those, as characterised by<br />

PricewaterhouseCoopers in its recent National Financial Sustainability Study<br />

of local government for ALGA, that exhibit:<br />

• Minimal (or negative) revenue growth;<br />

• For a small proportion of <strong>Council</strong>s, limited access to rate revenue due<br />

to relatively small populations reducing the size of the rates income<br />

stream coupled with constraints on the size of annual rates increases;<br />

• Limited access to the strong financial and asset management skills<br />

which are critical to identifying sustainability problems, optimising<br />

renewals expenditure and improving revenue streams;<br />

• Expanding service provision due to rising community demands,<br />

coupled with a related tendency by some <strong>Council</strong>s to step in to provide<br />

a non-traditional service; and<br />

• A tendency to run operating deficits creating a need to defer or<br />

underspend on renewal of infrastructure, particularly community<br />

infrastructure.<br />

Particular areas identified for improvement are:<br />

• Establishing internal structures that provide for independent review of<br />

processes and decision-making to assist councillors meet their<br />

accountability to ratepayers and the community, including with an<br />

audit committee overseeing and advising on matters of accountability<br />

and internal control;<br />

• Embedding spending and revenue decisions in a multi-year framework,<br />

and against the background of long-term financial rules; and<br />

• Improving coherence and uniformity in external financial reporting.<br />

It is also recommended that Tasmanian <strong>Council</strong>s develop appropriate longterm<br />

spending, asset management, revenue and borrowing strategies to<br />

overcome their infrastructure and services challenges within sustainable<br />

financial limits.<br />

At the very least, each <strong>Council</strong> should develop a rolling 10-year financial plan<br />

to:<br />

• Rehabilitate infrastructure that is already dilapidated;<br />

• Renew infrastructure when it degrades below an acceptable standard<br />

in future;<br />

• Expand the total infrastructure stock by enough to adequately cater for<br />

residential and business growth;<br />

savings, reordering of spending priorities, infrastructure enhancement<br />

deferrals, asset leases or disposals and extra borrowings that would be<br />

sufficient to fund such a program; and<br />

• Ensure that the outcome complies with sustainable financial targets<br />

(e.g. the recommended minimum operating surplus ratio and maximum<br />

annual renewals gap ratio) during this period.<br />

7. Risk<br />

A number of longer-term risks have been identified within the report generally<br />

for local government in Tasmania. <strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong> will need to<br />

closely consider the recommendations from the report over time and develop<br />

strategies to ensure its continued financial sustainability.<br />

1. Recommendation<br />

That <strong>Council</strong> note the information and authorises the affixing of the<br />

Common Seal to all associated sale contracts.<br />

2. Summary<br />

This report has been prepared to advise <strong>Council</strong> of the outcome of the auction<br />

held on 31 March <strong>2007</strong> to sell properties at <strong>Waratah</strong> due to the accumulation<br />

of unpaid rates.<br />

3. Background<br />

At the <strong>Council</strong> meeting on 19 March <strong>2007</strong> <strong>Council</strong> endorsed the sale of lots at<br />

<strong>Waratah</strong> for unpaid rates. There were seventeen (17) lots to be sold by public<br />

auction and seven (7) were approved for the General Manager to negotiate by<br />

private treaty.<br />

Since that time three of the private treaty sales have been agreed to, the others<br />

are still under negotiation.<br />

The Local Government Act 1993 regulates the procedure to be followed in the<br />

139. Application of money from sale<br />

(1) Any money received on the sale of land is to be applied as follows:<br />

(a) firstly – in paying the costs of the sale and any other costs incurred<br />

in proceeding under this division;<br />

(b) secondly – in discharging any liabilities to the council in respect of<br />

the land;<br />

(c) thirdly – in discharging any liability to the Crown for rates or taxes<br />

in respect of the land;<br />

(d) fourthly – in discharging any liabilities secured by registered<br />

mortgages, encumbrances or charges;<br />

(e) fifthly – in discharging any other mortgages, encumbrances and<br />

charges of which the council has notice;<br />

(f) sixthly – in payment to the previous owner of the land if that person<br />

becomes known within 12 months of the sale/<br />

139A. Register of money<br />

(1) The general manager is to keep a register of any money remaining<br />

after payments and discharges are made under section 139.<br />

(2) The register is to include details of the previous owner of the land.<br />

(3) The general manager is to cause prescribed details of the register<br />

in respect of prescribed amounts to be published at least once a<br />

year in a daily newspaper circulating in the municipal area.<br />

(4) Any money received by a council from the sale of land that is not<br />

claimed by the owner of the land within 3 years of the sale vests in<br />

the council.<br />

5. Finances<br />

The amount received from the sale of the land, in all but one case allowed<br />

<strong>Council</strong> to recoup all the outstanding rates and expenses.<br />

The gross amount received from the auction and sale by private treaty sales<br />

amounts to $186,150. Following the completion of the formal transfers and<br />

the clearance of all liabilities there will be a reasonable surplus achieved.<br />

<strong>Council</strong> will need to comply with the requirements of section 139A of the Act<br />

in relation to this surplus.<br />

2. Summary<br />

This report covers the administrative arrangements needed to give effect to the<br />

<strong>Council</strong>’s decision at the last ordinary meeting to combine the interests of the<br />

<strong>Wynyard</strong> Community Centre Special Committee and the Railway Institute<br />

Hall Steering Committee into a Special Committee to be known as the<br />

Community Centre/Railway Institute Hall Management Committee.<br />

3. Background<br />

Following completion of the initial renovation of the Railway Institute Hall in<br />

<strong>Wynyard</strong>, it was considered that there was no need for the steering committee<br />

that was appointed to oversee the upgrade works to continue and that the<br />

facility would be managed by <strong>Council</strong> staff.<br />

In late 2006 <strong>Council</strong> sought the views of the Community Centre Management<br />

Special Committee’s on the merit of expanding their role to also include the<br />

Railway Institute Hall.<br />

Following advice received from the Committee that it generally supported the<br />

inclusion of the Railway Institute Hall into their responsibilities in March <strong>2007</strong><br />

it is now necessary to formally review the Delegation of Authority and<br />

Operating Procedures for the restructured Committee.<br />

as it thinks fit, special committees.<br />

(2) A special committee consists of such persons appointed by the<br />

council as the council thinks appropriate.<br />

(3) The council is to determine the procedures relating to meetings of a<br />

special committee.<br />

5. Finances<br />

The combination of the activities of two former committees into a new Special<br />

Committee entity is not likely to have any significant financial implications for<br />

<strong>Council</strong>.<br />

6. Discussion<br />

The <strong>Council</strong> has made the decision to combine the management of the<br />

<strong>Wynyard</strong> Community Centre and Railway Institute Hall and vest this role in a<br />

single Special Committee.<br />

The following section outlines the Schedule of Delegation and Operating<br />

Procedures proposed to apply to the Committee:<br />

Pursuant to Section 24 of the Local Government Act 1993 the <strong>Waratah</strong>-<br />

<strong>Wynyard</strong> <strong>Council</strong> hereby establishes a Special Committee as detailed in<br />

Schedule 1 and 2 below.<br />

SCHEDULE 1<br />

1. The name of the Special Committee shall be the:<br />

Community Centre/Railway Institute Hall Management Committee<br />

SCHEDULE 2<br />

1.<br />

Objectives of the Committee<br />

1.1. To manage the <strong>Wynyard</strong> Community Centre (including the<br />

surrounding buildings) and the Railway Institute Hall on behalf of<br />

<strong>Council</strong>.<br />

2.<br />

The Committee Structure<br />

2.1 The Committee shall consist of six (6) members at any one time.<br />

2.2 The Committee shall appoint a Chairperson at the Annual General<br />

Meeting.<br />

2.3 The Committee will be made up of the following:<br />

• 1 <strong>Council</strong>lor of <strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong><br />

• 1 representative from St. John Ambulance<br />

• 1 representative from the <strong>Wynyard</strong> Children’s Services<br />

• Community Development Officer of <strong>Waratah</strong>-<strong>Wynyard</strong><br />

Term of the Committee<br />

3.1 The Committee members representing St John Ambulance, <strong>Wynyard</strong><br />

Children’s Services and major user groups are to be appointed by their<br />

respective organisations biennially.<br />

3.2 <strong>Council</strong>lor representation will be confirmed following the conduct of<br />

the biennial local government elections.<br />

3.3 The position of the Community Representative will become vacant<br />

biennially and expressions of interest for appointment to the<br />

Committee will be advertised prior to the Annual General Meeting.<br />

The General Manager will select the appointee utilising a predetermined<br />

merit selection process.<br />

3.4 <strong>Council</strong> will confirm the representatives appointed to the Committee at<br />

its first available meeting following the conduct of the Annual General<br />

Meeting of the Committee.<br />

4.<br />

Functions of the Committee<br />

4.1 To manage the development and maintenance of the <strong>Wynyard</strong><br />

Community Centre and Railway Institute Hall to achieve relevant aims<br />

and targets of the Strategic, Operational and Business Plans of the<br />

<strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong>.<br />

5.<br />

Restrictions on Committee Powers<br />

5.1 The Committee does not have the power to:<br />

- Impose taxes, rates or charges<br />

- Rebate rates or charges<br />

- Make grants<br />

- Borrow money<br />

- Make a rate<br />

- Make a By-law<br />

- Execute a Deed<br />

- Sign a contract<br />

- Institute a legal proceeding<br />

- Call for tenders.<br />

- Provide direction to staff<br />

- Advertise for and/or appoint an employee or servant<br />

- Conduct business and activities other than in accordance with<br />

<strong>Council</strong>’s Risk Management and Occupational Health and Safety<br />

policies and practices.<br />

6. Committee Meeting Procedures<br />

6.1 The Committee meetings shall be conducted in accordance with the<br />

requirements of the Local Government (Meeting Procedures)<br />

Regulations 2005.<br />

6.2 Quorum:<br />

A Quorum of the Committee shall be a majority of members being<br />

present. (i.e. 6-member committee 4 need to be in attendance)<br />

6.3 Records of the meetings are to be kept by the Community Development<br />

Officer (CDO):<br />

The CDO will ensure that detailed minutes of each meeting is kept<br />

which include at a minimum the following:<br />

- The names of those present,<br />

- an accurate record of any motion indicating the mover<br />

and seconder and including the word 'Carried' or 'Lost'<br />

after each motion,<br />

- the time, date and place of each meeting.<br />

6.4 The minutes of each meeting shall be: -<br />

6.4.1 sent to <strong>Council</strong> for adoption of any recommendations contained<br />

therein, and<br />

6.4.2 confirmed at the subsequent meeting of that Committee.<br />

6.5 Appointment of Acting Chairperson:<br />

If the elected Chairperson is not available for a meeting an Acting<br />

Chairperson shall be chosen from those present at the meeting.<br />

6.6 Frequency of Meetings:<br />

Meetings of the Committee must be held at least five times per year.<br />

6.7 Committee minutes to be provided to <strong>Council</strong>:<br />

The minutes of each Committee Meeting shall be provided to <strong>Council</strong><br />

within fourteen (14) days following the conclusion of the meeting.<br />

6.8 Notice of Meetings:<br />

6.8.1 Notice of each Committee meeting shall be given to each<br />

Committee member at least seven (7) days in advance unless it<br />

is impractical to do so because an urgent matter requires a<br />

meeting be held at shorter notice.<br />

6.8.2 Notice of the Annual General Meeting of the Special<br />

Committee shall be published in a newspaper generally<br />

circulating in the <strong>Waratah</strong>-<strong>Wynyard</strong> municipal area at least<br />

fourteen (14) days prior to such Annual General Meeting.<br />

6.9 The Committee shall hold an Annual General Meeting by the 30th of<br />

November in each year.<br />

7. Insurance<br />

7.1 Management Committee Members and Voluntary Workers:<br />

Where requested, <strong>Council</strong>'s personal accident and public liability<br />

insurance may be extended to cover Committee members and/or<br />

nominated voluntary workers attending meetings and other activities<br />

such as working bees which have the prior approval of the Committee.<br />

8.<br />

Alteration to Delegation and Rules of Procedure<br />

8.1 This delegation and rules of procedure may be amended at any time by<br />

<strong>Council</strong>.<br />

9. Definitions<br />

“Committee” means the Committee as stipulated in Schedule 1 of this<br />

document.<br />

“<strong>Council</strong>” means the <strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong>.<br />

“General Manager” means the General Manager of the <strong>Waratah</strong>-<br />

<strong>Wynyard</strong> <strong>Council</strong> as appointed from time to time, or a person acting in<br />

that position.<br />

“CDO” means the Community Development Officer of the <strong>Waratah</strong>-<br />

<strong>Wynyard</strong> <strong>Council</strong>, or a person acting in that position.<br />

7. Risk<br />

There are no significant risk issues identified with formation of the Special<br />

Committee as proposed in this report.<br />

That <strong>Council</strong> confirm the amended Financial Assistance to State and<br />

National Representatives Policy and note that it is scheduled for<br />

review in July 2011 unless interim circumstances necessitate an earlier<br />

review.<br />

2. Summary<br />

This purpose of this report is to allow <strong>Council</strong> the opportunity to review its<br />

Financial Assistance to State and National Representatives Policy originally<br />

adopted on 19 May 2003 and subsequently reviewed and amended on 18 July<br />

2005.<br />

The current policy allows <strong>Council</strong> the discretion to approve a donation of<br />

approximately 10% of costs, or up to $500 in cash or ‘in-kind’, to eligible<br />

persons or organisations representing Australia at World Championship<br />

sporting level or an event of similar status in a non-sporting pursuit.<br />

3. Background<br />

At its meeting held on 19 March <strong>2007</strong> <strong>Council</strong> resolved as follows:<br />

“That <strong>Council</strong>’s current policy for financial assistance to State and<br />

National Representatives be reviewed and a report presented to<br />

<strong>Council</strong> for consideration.”<br />

This report has been drafted in response to <strong>Council</strong>’s resolution.<br />

77. (1) A council may make a grant or provide a benefit that is not a<br />

legal entitlement to any person, other than a councillor, for any<br />

purpose it considers appropriate.<br />

(2) The details of any grant made or benefit provided are to be<br />

included in the annual report of the council.<br />

5. Finances<br />

Any donations made under this policy are usually funded through <strong>Council</strong>’s<br />

Community Assistance Small Grants Scheme. The most recent donation was<br />

for an amount of $500 to junior futsal player Dayna Pine as a result on an<br />

application considered by <strong>Council</strong> at its 19 March <strong>2007</strong> meeting.<br />

Four other donations of $500 each have been made to Australian sporting<br />

representatives during the current financial year.<br />

6. Discussion<br />

In accordance with <strong>Council</strong>’s resolution, the current policy has being reviewed<br />

and consideration given to whether or not any amendments may be required.<br />

The policy review indicated that it has generally worked quite well in practice,<br />

providing <strong>Council</strong> with the opportunity to deal with applications for financial<br />

assistance on a consistent and equitable basis.<br />

The only major suggested alteration to the policy is the inclusion of a<br />

provision that evidence be provided to <strong>Council</strong> that a person who appears to<br />

meet the selection criteria for financial assistance by <strong>Council</strong> will be<br />

participating in an event or pursuit that is ratified or sanctioned by the<br />

generally recognised national peak body for that sporting, cultural, recreational<br />

or similar pursuit.<br />

Therefore it is suggested that the following paragraph be added to Section 4.0<br />

of the policy document:<br />

“Following receipt of an application which appears to meet the selection<br />

criteria for consideration of financial assistance by <strong>Council</strong>, the General<br />

Manager shall ascertain, and include in the report to be considered by<br />

<strong>Council</strong>, whether or not the sporting, cultural, recreational or similar<br />

pursuit in which the applicant will be participating is ratified or<br />

sanctioned by the generally recognised national peak body for that<br />

sporting, cultural, recreational or similar pursuit.”<br />

It is expected that <strong>Council</strong> staff will conduct the necessary research. In most<br />

cases the level of research required should be relatively simple.<br />

It is not considered necessary, at this time, to increase the maximum amount of<br />

assistance which may be donated by <strong>Council</strong>. The policy currently allows<br />

<strong>Council</strong> the discretion to approve a donation of approximately 10% of costs, or<br />

up to $500 in cash or ‘in-kind’. Of course, <strong>Council</strong> always retains the<br />

discretion to donate a lesser amount if it so resolves.<br />

The only other alterations to the current policy are minor typographical<br />

changes and do not affect the overall intent of the policy.<br />

As a further review of the policy in the short term is unlikely, a future review<br />

date of July 2011 is recommended.<br />

7. Risk<br />

As a matter of procedure, the ongoing development and review of <strong>Council</strong><br />

policies takes into consideration, the potential effects upon, or alterations to,<br />

<strong>Council</strong>’s risk levels, financial or otherwise.<br />

There are no obvious material changes to <strong>Council</strong>’s levels of risk which may<br />

arise as a result of the adoption by <strong>Council</strong> of an amended Financial<br />

Assistance to State and National Representatives Policy.<br />

1.0 Purpose<br />

This Policy sets out <strong>Council</strong>’s position in relation to requests for financial<br />

assistance from, or on behalf of, persons chosen to represent Tasmania or<br />

Australia in sporting, cultural, recreational or similar pursuits.<br />

The objective of this policy is to ensure that all applications for financial<br />

assistance from State and National representatives are dealt with on a<br />

consistent basis.<br />

This Policy applies to all applications for financial assistance received by<br />

<strong>Council</strong> from persons chosen to represent either Tasmania or Australia in<br />

sporting, cultural, recreational or similar pursuits.<br />

<strong>Council</strong> has the discretion to approve a donation of approximately 10% of<br />

costs or up to $500 in cash or ‘in-kind’ to persons or organisations<br />

representing Australia at World Championship sporting level or an event of<br />

similar status in a non-sporting pursuit. The applicant(s) must normally reside<br />

in the <strong>Waratah</strong>-<strong>Wynyard</strong> municipal area or be recognised as having a close<br />

connection to the municipal area. All applications must be received in writing.<br />

Requests for assistance would normally be listed on the agenda for the first<br />

available Ordinary Meeting of <strong>Council</strong> after receipt to enable timely <strong>Council</strong><br />

consideration of applications.<br />

Following receipt of an application which appears to meet the selection<br />

criteria for consideration of financial assistance by <strong>Council</strong>, the General<br />

Manager shall ascertain, and include in the report to be considered by<br />

<strong>Council</strong>, whether or not the sporting, cultural, recreational or similar<br />

pursuit in which the applicant will be participating is ratified or<br />

sanctioned by the generally recognised national peak body for that<br />

sporting, cultural, recreational or similar pursuit.<br />

organisations representing the State of Tasmania in any national sporting<br />

The General Manager shall, following the receipt of written applications for<br />

assistance from State representatives, advise them in writing of this policy<br />

without the necessity for the applications to receive formal consideration by<br />

<strong>Council</strong>.<br />

1. Recommendation<br />

The <strong>Council</strong> approve the installation of a gate on Lighthouse Road to<br />

limit vehicular access to the Table Cape Lighthouse during the period<br />

dusk to dawn, subject to AMSA formally agreeing to the conditions<br />

imposed by <strong>Council</strong> as outlined in this report, and further seek<br />

approval from the Department of Infrastructure Energy and Resources<br />

for the installation of the gate.<br />

2. Summary<br />

The Australian Maritime Safety Authority (AMSA) wrote to <strong>Council</strong> seeking<br />

approval for the installation of a gate across Lighthouse Road, Table Cape, to<br />

prevent vehicular access to the Lighthouse after dark. This action was<br />

proposed by AMSA as a means to reduce the incidence of vandalism at the<br />

Lighthouse facility.<br />

<strong>Council</strong> determined to exercise its powers under Section 31 of the Local<br />

Government (Highways) Act 1982 at its 19 February <strong>2007</strong> meeting and public<br />

notices advising of <strong>Council</strong>’s intent to permit the installation of an obstruction<br />

in the Lighthouse Road reservation to limit vehicular access to the Table Cape<br />

Lighthouse, were placed in the Advocate newspaper.<br />

One submission was received and it indicated support for the proposal.<br />

It is recommended to <strong>Council</strong> that it proceed with the formal process to permit<br />

a gate to be installed across Lighthouse Road to restrict vehicular access to the<br />

Table Cape Lighthouse during the period dusk to dawn each night, subject to<br />

AMSA committing to fund the costs associated with erecting the gate, the cost<br />

to close and open the gate each day and agreeing to comply with the<br />

conditions outlined in this report.<br />

3. Background<br />

At its 15 January <strong>2007</strong> meeting <strong>Council</strong> considered a report regarding a<br />

request from AMSA in which permission was sought to install a gate across<br />

Lighthouse Road to restrict access to the Table Cape Lighthouse during the<br />

period between dusk and dawn.<br />

This item was deferred to permit <strong>Council</strong>lors to inspect the proposed location<br />

of the gate and the site visit occurred 29 January <strong>2007</strong>.<br />

This matter was further considered at the 19 February <strong>2007</strong> meeting of<br />

<strong>Council</strong>, with the following determination:<br />

1. The <strong>Council</strong> advise the Australian Maritime Safety Authority that<br />

it supports, in principle, the Authority’s request for approval to<br />

install a gate on Lighthouse Road to limit vehicular access after<br />

dark.<br />

2. That <strong>Council</strong> determines to proceed with advertising its intent to<br />

permit an obstruction to be placed on Lighthouse Road, pursuant<br />

to the provisions of Section 31 Local Government (Highways) Act<br />

1982 and submissions on the proposal sought, subject to AMSA<br />

committing to fund all costs associated with the process.<br />

3. That upon completion of the submission process <strong>Council</strong> will<br />

consider a further report in respect to the submissions received<br />

and determine it’s formal position on the installation of the<br />

obstruction at that time.<br />

A copy of the <strong>Council</strong>’s determination and the accompanying report was<br />

forwarded to AMSA for information and the obligations associated with any<br />

approval given for the installation of a gate advised to that Authority.<br />

A public notice was placed in the Advocate newspaper on 24 February <strong>2007</strong><br />

and 3 March <strong>2007</strong> advising of <strong>Council</strong>’s intent to permit an obstruction to be<br />

placed across Lighthouse Road and interested persons were invited to lodge a<br />

submission on the proposal. A small display containing the same information<br />

as the public notice was also erected in the foyer of the <strong>Council</strong> offices.<br />

The submission period closed 27 March <strong>2007</strong>.<br />

The abutting landowner who would be affected by the installation of the gate<br />

was also advised by letter of the proposal at hand.<br />

This report informs <strong>Council</strong> of the outcome from the consultation process in<br />

respect to the proposal to erect a gate across Lighthouse Road, Table Cape.<br />

Statutory Requirements<br />

The Local Government (Highways) Act 1982 provides for a corporation to<br />

place, or permit to be placed, an obstruction on a road for the purposes of<br />

prohibiting or restricting traffic.<br />

Section 31 of the Act describes the process to be followed should the<br />

corporation wish to exercise this power.<br />

31. Obstructions For Prohibition Or Restriction Of Vehicular Traffic<br />

1. A corporation may, with the approval of the Transport<br />

Commission, construct or place obstructions in a local highway<br />

for the purpose of preventing or restricting the movement of<br />

vehicular traffic.<br />

2. Before making an application under this section for the approval<br />

of the Transport Commission, the corporation shall cause a notice<br />

to be published twice in separate issues of a local newspaper<br />

circulating in the municipality of its intention to make the<br />

application, specifying the situation and nature of the obstruction<br />

and stating that written representations may be made to the<br />

corporation with respect to the matter before such day as is<br />

specified in the notice, being a day not earlier than 28 days after<br />

its first publication.<br />

3. The Transport Commission shall not give its approval under this<br />

section in respect of an obstruction unless there has been<br />

submitted to the Commission a copy of the notice published<br />

under subsection (2), together with evidence that it has been<br />

published as required by that subsection and copies of any<br />

representations made to the corporation in accordance with the<br />

notice and its comments on those representations.<br />

4. The Transport Commission may give its approval under this<br />

section for a corporation to install a road hump in –<br />

(a)<br />

a local highway leading to or from a car park; or<br />

5. A road hump installed pursuant to an authority given by the<br />

Transport Commission under subsection (4) shall –<br />

(a)<br />

be of a design approved by the Transport<br />

Commission;<br />

be installed in a manner approved by the Transport<br />

Commission; and<br />

(c) be installed in a specific location on the local<br />

highway referred to in subsection (4) that is<br />

approved by the Commission.<br />

6. No action, liability, claim, or demand lies or shall be allowed by<br />

or in favour of any person against the Transport Commission, a<br />

corporation, or any person involved in the installation of a road<br />

hump in a local highway in respect of any damage done to a<br />

vehicle or injury to a person or animal by reason of the<br />

installation of the road hump in the local highway if the road<br />

hump –<br />

(a)<br />

(b)<br />

was installed pursuant to this section; and<br />

was installed after the commencement of the<br />

Traffic Amendment Act (No. 2) 1987.<br />

7. In this section –<br />

"road hump" has the meaning assigned to that expression by<br />

section 49A of the Traffic Act 1925 .<br />

5. Finances<br />

The process to be followed under the Local Government (Highways) Act 1982<br />

required advertising to be carried out and this had a direct cost implication to<br />

<strong>Council</strong>. The cost of advertising will be recovered from AMSA as part of any<br />

approval for the erection of the proposed gate.<br />

All costs associated with the supply, erection and maintenance of the gate<br />

would be borne by AMSA, as would all costs associated with locking and<br />

unlocking of the gate.<br />

6. Discussion<br />

The consultation process resulted in one submission being received on the<br />

proposal to install a gate across Lighthouse Road as a means of restricting<br />

vehicular access to the Lighthouse site between dusk and dawn each day.<br />

A copy of the submission from Van Diemen Quality Bulbs is attached and it<br />

was advised that the Company has no objection to the proposal.<br />

No further correspondence has been received from AMSA on this matter since<br />

<strong>Council</strong>’s decision of 19 February <strong>2007</strong> was communicated to them. It is<br />

suggested that the organisation has no objection to the conditions that would<br />

be imposed were <strong>Council</strong> to permit a gate to be erected.<br />

There being no objections to the proposal it is suggested to <strong>Council</strong> that it<br />

determine to proceed with implementing the provisions of Section 31 Local<br />

Government (Highways) Act 1982 to formalise the installation of the proposed<br />

gate on Lighthouse Road.<br />

Were <strong>Council</strong> to make a positive determination in this regard the next step in<br />

the process would be to formally write to the Department of Infrastructure<br />

Energy and Resources and seek their approval for the installation of the gate.<br />

In addition formal advice would be sought from AMSA seeking their<br />

compliance with the requirements and conditions associated with <strong>Council</strong>’s<br />

approval for the gate. These are reproduced below for information.<br />

• AMSA to be responsible for all costs associated with the formal procedure<br />

to erect an obstruction on Lighthouse Road.<br />

• The gate is to be constructed and installed to the satisfaction of the<br />

Director Engineering Services. This is to include advance warning signs to<br />

advise of the gate and signage on the gate to prevent collisions with the gate.<br />

• AMSA to be responsible for all costs associated with the supply,<br />

installation and maintenance of the gate.<br />

• AMSA to be responsible for locking the gate between dusk and dawn of<br />

each night and shall supply the lock for the gate and provide keys to the<br />

neighbouring landholder, <strong>Council</strong> and Emergency Services.<br />

• Appropriate signage to be erected on the gate, advising of the periods the<br />

gate is locked and contact details in the event of an emergency.<br />

An additional condition to be imposed on AMSA would be as follows:<br />

• <strong>Council</strong> at its discretion can determine to ‘re-open’ the access at any time<br />

in the future by providing AMSA with 30 days notice of its intention. AMSA<br />

to be responsible for removing the gate if requested by <strong>Council</strong>.<br />

7. Risk<br />

Were a gate to be installed across Lighthouse Road and access restricted<br />

during the night, there may be some members of the public who would feel<br />

aggrieved at this occurring.<br />

A consultation process has been undertaken and no objections to the proposal<br />

to install the gate were received by the close of the submission period.<br />

The installation of the gate may assist in reducing the incidence of vandalism<br />

at the Lighthouse and prevent possible damage to essential navigation<br />

equipment.<br />

8. Conclusion<br />

This report is presented to <strong>Council</strong> for consideration.<br />

The <strong>Council</strong> instruct staff to arrange for the installation of rumble bar<br />

traffic islands in the northern and southern intersections of Jackson<br />

Street and Dodgin Street, <strong>Wynyard</strong> and approve the relocation of the<br />

existing pedestrian refuge in Dodgin Street some 12 metres to the west<br />

of the current location.<br />

2. Summary<br />

This report considers a number of possible measures to achieve a reduction in<br />

accidents at the intersection of Jackson Street and Dodgin Street, <strong>Wynyard</strong>.<br />

The installation of rumble bar traffic islands in the Jackson Street intersections<br />

with Dodgin Street will assist in controlling traffic manoeuvres. Relocation of<br />

the existing pedestrian refuge some 12 metres to the west of its current<br />

location will improve sight lines and continue to provide a crossing<br />

opportunity for pedestrians at this location.<br />

3. Background<br />

At its 20 November 2006 meeting, <strong>Council</strong> considered a report with a proposal<br />

by the Department of Infrastructure Energy and Resources to submit a Black<br />

Spot Application, on behalf of <strong>Council</strong>, for the installation of a roundabout at<br />

the intersection of Jackson Street and Dodgin Street.<br />

On that matter <strong>Council</strong> determined:<br />

“That <strong>Council</strong> determines to advise the Department of Infrastructure, Energy<br />

and Resources that it does not support the lodgement of a Black Spot Funding<br />

submission for the construction of a roundabout at the intersection of Jackson<br />

Street and Dodgin Street, <strong>Wynyard</strong> however, it will look to identify alternative<br />

options.”<br />

Further on this matter <strong>Council</strong> also determined:<br />

“That <strong>Council</strong> staff liaise with the DIER to identify alternative options to<br />

address the traffic concerns raised.”<br />

At the March <strong>2007</strong> meeting of <strong>Council</strong> a correspondence report was presented<br />

in regard to traffic management issues raised in letters from the <strong>Wynyard</strong><br />

Senior Citizens Club and North West Regional Advisory Committee (RACT).<br />

There was significant debate on the nature of possible traffic management<br />

improvements at the intersection however, ultimately there was no decision<br />

made in respect to the report presented and as such the November 2006<br />

determination of <strong>Council</strong> remains the current position.<br />

<strong>Council</strong> staff had discussions with officers from the Department of<br />

Infrastructure Energy and Resource on possible options to address traffic<br />

safety concerns at the intersection of Dodgin Street and Jackson Street and this<br />

report discussed possible improvement options for <strong>Council</strong> to consider.<br />

A number of minor works are proposed within this report. The estimated cost<br />

The operational budget for <strong>Wynyard</strong> Sealed Roads would fund improvement<br />

works if implemented.<br />

6. Discussion<br />

There has been a history of vehicular accidents at the intersection of Jackson<br />

Street and Dodgin Street, <strong>Wynyard</strong>. Based upon information provided by<br />

DIER there have been four (4) casualty accidents and eighteen (18) property<br />

accidents reported during the past 5 years.<br />

DIER assessed the recorded accidents for trends in the nature of the accidents<br />

occurring with the following observations made.<br />

The two main collision types were:<br />

• Single vehicle collisions with the pedestrian refuge on Dodgin Street,<br />

western side of intersection. Either due to through traffic or right<br />

turning traffic from the northern leg of the Jackson Street intersection.<br />

• Two vehicle collisions where one driver has failed to give way to<br />

another. Reasons include possible sightline obstruction by the<br />

pedestrian refuge for vehicles travelling west on Dodgin Street and<br />

attempting to undertake a right turn manoeuvre into Jackson Street and<br />

colliding with east bound traffic on Dodgin Street. Failure of vehicles<br />

exiting Jackson Street to give way to through traffic, possibly due to<br />

inattention.<br />

To address the possible reasons for the types of accidents occurring the<br />

following improvement options are suggested:<br />

• Construct rumble bar islands in the Jackson Street intersections.<br />

Rumble bar islands provide a means of controlling turn manoeuvrers at<br />

an intersection. They encourage drivers to enter and exit in a<br />

controlled manner and inhibit the ability of drivers to cut corners thus<br />

removing a potential source of traffic conflict.<br />

The islands also assist in reinforcing to the driver that they are on the<br />

minor road and must give way to through traffic.<br />

Improved intersection warning signage may assist in making drivers<br />

more aware of the intersection however, it is suggested that structural<br />

measures may provide more benefit in this instance.<br />

• Remove the pedestrian refuge<br />

The pedestrian refuge, in its current location, would appear to create<br />

sightline issues for some motorists and inattentive drivers have collided<br />

with the refuge.<br />

Removal of the pedestrian refuge would address such issues.<br />

It is apparent however, that members of the community, mainly older<br />

persons, use the refuge, however the frequency of use is quite sporadic.<br />

The refuge would provide some comfort to persons with limited<br />

mobility in crossing the wide expanse of Dodgin Street.<br />

Removal of the refuge may impact on the safety of older pedestrians<br />

crossing at that location.<br />

• Relocate the pedestrian refuge<br />

The current location for the pedestrian refuge has a number of<br />

limitations.<br />

Relocation of the refuge some 10 to 12 metres to the west of Jackson<br />

Street would remove the structure from the area of conflict for right<br />

turning traffic out of Jackson Street and open up the sightlines in the<br />

immediate vicinity of the intersection.<br />

Conflict between the refuge and through traffic may still be an issue in<br />

the new location.<br />

To accommodate the refuge, the bus stop on the northern side of<br />

Dodgin Street would need to be shortened. This would not impact of<br />

the operation of the bus stop.<br />

Whichever works are carried out in the vicinity of the Dodgin Street and<br />

Jackson Street intersection there are a number of factors that would need to be<br />

considered:<br />

• Dodgin Street has been identified as the “bypass route “ for larger<br />

vehicles so as to avoid the <strong>Wynyard</strong> CBD.<br />

• Impact on pedestrians should the pedestrian refuge be removed or<br />

relocated.<br />

• The intersection in question is used by Metro Buses, passenger buses<br />

and coaches accessing the Visitor Information Centre, delivery vehicles<br />

and the like. Traffic management measures would need to consider the<br />

manoeuvrability limitations for such vehicles.<br />

• Approval from the Department of Infrastructure Energy and Resources<br />

would be required for works on the pedestrian refuge and installation<br />

of the rumble bar islands.<br />

7. Risk<br />

The Department of Infrastructure Energy and Resources have identified the<br />

intersection of Dodgin Street and Jackson Street as being a potential Black<br />

Spot Program project due to the recorded accident history at the intersection.<br />

In consultation with DIER, possible options to reduce the incidence of<br />

accidents have been identified and are detailed in this report.<br />

There would be an expectation in the community, now that such a review has<br />

been undertaken, that some improvement works are carried out to address the<br />

community concern with this intersection.<br />

In the event that no works are carried out it is quite probable that <strong>Council</strong> may<br />

be criticised for not addressing the issue.<br />

8. Conclusion<br />

A number of options have been presented in this report that will aid in<br />

reducing the potential for accidents at the intersection of Jackson Street and<br />

Dodgin Street, <strong>Wynyard</strong>.<br />

It is recommended to <strong>Council</strong> that rumble bar islands be installed in the<br />

northern and southern intersection of Jackson Street with Dodgin Street and<br />

that the pedestrian refuge be relocated some 12 metres to the west of its<br />

current location to improve sightlines and reduce the potential for conflict with<br />

right turning traffic from Jackson Street.<br />

Approval from the Department of Infrastructure Energy and Resources would<br />

be necessary for the works as proposed.<br />

This report is presented to <strong>Council</strong> for consideration.<br />

WEED MANAGEMENT<br />

Gorse<br />

Two projects for Gorse will soon be underway in the municipality. <strong>Council</strong><br />

received a small amount of money from the Cradle Coast NRM ‘Local<br />

Government Incentive’ grants late last year. It was decided that this would<br />

offered to landowners who had reasonably small, infestations of Gorse. The<br />

justification being to try and clean up the outlying areas, leaving the two main<br />

areas of Table Cape and <strong>Waratah</strong> to be tackled where more funding becomes<br />

available.<br />

Cradle Coast NRM have implemented a Gorse control project in other<br />

municipalities along the Coast, and will now offer this to property owners in<br />

<strong>Waratah</strong>-<strong>Wynyard</strong>. This is a much larger grant program, which will mean<br />

work can begin on some of the larger infestations.<br />

If must be noted that both these grants are not a ‘handout’ to the landowner.<br />

Anyone wishing to take advantage of this money, must sign a contract to<br />

agree that once a contractor has been employed to carry out the initial works,<br />

they (the landowner) will maintain the area for at least three years.<br />

Crack Willow<br />

Work is continuing by <strong>Council</strong> contractors to treat mature Crack Willow trees,<br />

and re-growth from stumps. Residents are advised to contact <strong>Council</strong> if they<br />

have any Crack Willow on their property so they can be treated under this<br />

program. This project is working toward the eradication of Crack Willow in<br />

this municipality, not just control of the plant, so any remaining plants within<br />

a catchment have potential to re-infest ‘clean’ sites, and need to be treated as<br />

soon as possible.<br />

Cradle Coast NRM / Landcare Field Day<br />

A successful Field Day was held on Wednesday 21 st March for landowners<br />

and NRM staff to view a number of projects in the <strong>Waratah</strong>-<strong>Wynyard</strong>, and<br />

Burnie, areas relating to waterways and aquatic weeds.<br />

Some of the projects looked at and discussed were;<br />

<strong>Waratah</strong>-<strong>Wynyard</strong> <strong>Council</strong> and <strong>Wynyard</strong> Landcare’s efforts in<br />

poisoning/removing Crack Willow, and revegetating the riparian zones,<br />

Burnie City <strong>Council</strong>’s catchment management project (funded by Natural<br />

Heritage Trust) which has now re-fenced the waterways and tributaries in the<br />

catchment which supplies the city’s water,<br />

The experiments by Elliott Catchment Management Group to control Glyceria<br />

maxima (also known as Poa aquatica) in wetlands and creeks,<br />

The effects of poor land management practices on the Giant Freshwater<br />

Lobster and its habitat,<br />

A tour of the Burnie Water Treatment Plant.<br />

Pampas Grass<br />

Work will soon begin on spraying Pampas Grass at all recorded sites. Cradle<br />

Coast NRM has provided funding to all municipalities to employ contractors<br />

to carry out this work. Prior to this funding <strong>Council</strong> had followed up with<br />

property owners to ensure that Pampas Grass plants were controlled, and have<br />

routinely carried out spraying operations on <strong>Council</strong> owned land.<br />

This funding will assist greatly with the eradication of Pampas Grass in this<br />

municipality. Residents are asked to contact <strong>Council</strong> should they find any<br />

new infestations.<br />

ACTIVE PLANNING APPEALS<br />

CURRENT ENFORCEMENT ACTION UNDER SECTION 64 OF<br />

LUPAA<br />

1. Section 64 application - 712 Reservoir Drive, <strong>Wynyard</strong> for Illegal<br />

buildings, illegal landfill and illegal works to the embankment and<br />

bed of Camp Creek.<br />

An appeal hearing was part heard on 12 <strong>April</strong> 2006. The Tribunal part<br />

heard the appeal and held the matter over to allow the parties to<br />

explore a consent agreement. <strong>Council</strong>’s solicitor has advised that the<br />

consent agreement on this matter has not been resolved and the matter<br />

is to be again placed before the Tribunal.<br />

2. Section 64 application and EPN - Pages Road, illegal landfill.<br />

<strong>Council</strong>’s solicitor has advised on 7 September 2006 that the matter is<br />

being progressed to a consent agreement with the other party expected<br />

to sign off on the agreement. The Tribunal are currently processing the<br />

consent agreement.<br />

3. Section 64 application - Cardigan Street, Somerset, CT 198768/1,<br />

illegal landfill.<br />

<strong>Council</strong> are progressing a Sec 64 action in relation to illegal landfill on<br />

this residential title.<br />

<strong>Council</strong>’s solicitor has advised the matter is being progressed by the<br />

Tribunal with parties negotiating a consent agreement. It is expected<br />

that remedial works will be carried out in the next few months.<br />

ENGINEERING SERVICES<br />

A. WORKS MANAGERS REPORT<br />

March has seen the completion of the majority of the capital works<br />

program for 2006/<strong>2007</strong>. The re-construction and sealing projects<br />

urban and rural have been completed, including reseal programs and<br />

line marking. Takone Road reconstruction, which was a major project<br />

for Transport & General Services staff, was completed within the<br />

allotted time frame and budget. Bridge replacements have also been<br />

finalised, with Flowerdale River Meunna Road Bridge having just been<br />

reopened to traffic.<br />

<strong>Council</strong>’s subdivision at Sister Beach is progressing well with the<br />

majority of civil works having been completed. Aurora and Telstra<br />

services are still to be installed and completion of pavement gravel,<br />

sealing, footpaths, driveways and nature strips should occur over the<br />

next few weeks.<br />

Goldie Street CBD improvements between Saunders and Jackson<br />

Streets are almost completed. The footpath on the southern side has<br />

been finished along with the landscaped areas. Asphalting works<br />

should take place during May, and with the majority of works being<br />

done at night-time, this should keep disruption to the business<br />

operators to a minimum.<br />

Drainage improvements to the Sister Beach stormwater system are<br />

making a marked improvement within the area. Current works are<br />

taking place along both sides of Irby Boulevard and materials have<br />

been ordered for Stage III of this project.<br />

The Roadside vegetation-mowing program has almost been completed<br />

on the road network, with Meunna Road verges still to be mowed.<br />

The Roads to Recovery program will commence again in early <strong>April</strong><br />

and run through to June. There is still 11 kilometres of road to be<br />

completed, which will require approximately 13,300 tonnes of FCR<br />

(Scalps) to be carted and spread on the various projects.<br />

Correspondence has been received from Mr A Dunham, requesting that<br />

<strong>Council</strong> consider the sealing of the gravel access road that commences at the<br />

Esplanade and provides access to the Somerset Tennis Club and foreshore<br />

area.<br />

The writers concerns with the current situation are as follows:<br />

• Vehicles driving at inappropriate speeds<br />

• Hoon behaviour<br />

• Dust<br />

Mr Dunham considers that upgrading of the gravel access road would address<br />

the issues raised.<br />

OFFICERS COMMENTS<br />

The gravel access road provides vehicular access to the Somerset Tennis<br />

Courts and the foreshore area beyond.<br />

Recently some 20m of the access road and intersection were surfaced with<br />

asphalt to address dust issues and reduce the transfer of gravel to the<br />

Esplanade Road surface.<br />

The volume of traffic using the access road will vary according to the level of<br />

activity at the tennis courts and foreshore area. The level of maintenance<br />

required to maintain the road in good order is not excessive.<br />

Poor driver behaviour would appear to be one of the main reasons for<br />

requesting that the road be upgraded and in many respects this is an education<br />

and enforcement issue rather than a road standard issue.<br />

The estimated cost of upgrading the access road some 250m to the Tennis<br />

Courts, to a sealed road standard of 5 metre seal width is $30,000.<br />

The upgrading of this road is not identified on the current forward capital<br />

works program.<br />

Correspondence has been received from Caribou Publications Pty Ltd, the<br />

organisers of the <strong>2007</strong> Tour of Tasmania Road Cycling Classic, requesting<br />

that <strong>Council</strong> give consideration to making a contribution of $3,000 toward the<br />

event.<br />

The <strong>2007</strong> Tour of Tasmania Road Cycling Classic forms part of the 12 th<br />

Tattersalls Cycling Series and it is proposed that <strong>Wynyard</strong> host the finish of<br />

the Tour’s sixth stage from Burnie on Thursday 4 October.<br />

Further details of the request, together with general information about the<br />

event, are included in the enclosure document.<br />

OFFICERS COMMENTS<br />

In the event that <strong>Council</strong> resolves to financially support this event, then a<br />

budgetary provision will need to be made by <strong>Council</strong> when considering its<br />

<strong>2007</strong>-2008 Annual Plan and Budget.<br />

It is not known if holding the stage finish in <strong>Wynyard</strong> is dependent upon<br />

<strong>Council</strong> financially supporting the Tour. It could be argued that the potential<br />

benefits to the <strong>Waratah</strong>-<strong>Wynyard</strong> municipal area in return for the $3,000<br />

sponsorship may be limited. It is suggested that <strong>Council</strong> decline the<br />

sponsorship offer.<br />

Alternatively, <strong>Council</strong> may resolve to support the event financially.<br />

There is little detail, at this time, in relation to the traffic management<br />

requirements of the organisers. Irrespective of whether or not <strong>Council</strong><br />

resolves to support the event financially, <strong>Council</strong> staff may need to hold<br />

discussions with the event organisers in relation to traffic management issues<br />

and any non-financial assistance that may be required of <strong>Council</strong>.<br />

At its meeting held on 19 March <strong>2007</strong>, <strong>Council</strong> resolved as follows:<br />

“That <strong>Council</strong> advise the Minister for Police and Emergency<br />

Management that they wish to nominate Mr Chris Fagg for the<br />

position of Municipal Emergency Management Coordinator for the<br />

<strong>Waratah</strong>-<strong>Wynyard</strong> municipal area and Mr Frank Lawes for the<br />

position of Deputy Municipal Emergency Management Coordinator for<br />

the <strong>Waratah</strong>-<strong>Wynyard</strong> municipal area both nominations being made in<br />

accordance with section 23(2) of the Emergency Management Act<br />

2006.”<br />

Correspondence has subsequently been received from the Director of the State<br />

Emergency Service acknowledging <strong>Council</strong>’s decision and advising that, as<br />

Mr Fagg and Mr Lawes have been appointed under the transitional provisions<br />

of section 23 of the new Emergency Management Act 2006, formal<br />

reappointment by the Minister is not necessary at this time.<br />

The Director advised that <strong>Council</strong> will be asked to review the appointments<br />

following the expiration of a two-year period and he requested that his<br />

correspondence to formally advised to <strong>Council</strong>.<br />

A copy of the correspondence is included in the enclosure document.<br />

The correspondence provides formal acknowledgment of the appointments of<br />

Mr Fagg and Mr Lawes to the positions of Municipal Emergency Management<br />

91/07 CAMPERVAN AND MOTORHOME CLUB OF AUSTRALIA – RV<br />

FRIENDLY TOWN SCHEME<br />

CR CHALK declared an interest in this agenda item and left the meeting at<br />

9:15 PM.<br />

The Mayor has been approached by the Campervan and Motorhome Club of<br />

Australia (CMCA) requesting consideration of <strong>Wynyard</strong> becoming a RV<br />

Friendly Town.<br />

The RV Friendly Town Scheme is a new CMCA initiative aimed at assisting<br />

mobile travellers as they travel throughout Australia.<br />

An RV Friendly Town is one that has met a set of guidelines to ensure they<br />

provide a certain amount of amenities, and a certain level of services for these<br />

travellers. A town qualifies to for participating in the Scheme providing it<br />

meets the following:<br />

• Provision of short term and/or long-term parking.<br />

• Access to a general shopping area.<br />

• Access to a Dump Point.<br />

• Access to potable water.<br />

• Appropriate parking within the town centre.<br />

• Access to medical facilities and pharmacies.<br />

• Motor vehicle service centre.<br />

• Tourist Information Centre.<br />

As well as the above the CMCA also look at the general attitude of the council<br />

and business people.<br />

OFFICERS COMMENT<br />

The cost to <strong>Council</strong> for participating in the RV Friendly Town Scheme is $220<br />

per set of signs (2 per set). These signs need to be erected at <strong>Council</strong>’s<br />

expense 1 – 2 kilometres from the town entrance.<br />

<strong>Council</strong> may also choose to submit articles to the CMCA publication titled<br />

‘The Wanderer’ and also purchase advertising space.<br />
