Planning Authority Reports
2. Summary
The application is for the construction of six animal shelters at 1260 Oldina
Road, Oldina.
The site is located within the Primary Industries zone. The application is
discretionary as it relies on assessment against the Performance Criteria in
relation to the setback standards.
3. Background
The subject property is located on Oldina Road within a rural area. Lowries
Road dissects the site through a southern portion of the site. The site has a
total area of 34.9 hectares. The site currently contains a dwelling house,
sheds, the six animal shelters and horses. Adjacent properties are
predominantly larger farms.
4. Statutory Requirements
The application is subject to the following statutory instruments:
Land Use Planning and Approvals Act 1993
Waratah Wynyard Planning Scheme 2000
5. Finances
Financial costs may arise in relation to any appeal against the determination of
the application by the Planning Authority.
6. Discussion
Application
The application is for the approval of six equine and livestock weather
shelters. The shelters have already been constructed on site without planning
approval.
Five of the shelters have dimensions of 7 metres by 7 metres and the
remaining shelter is six metres by 12 metres wide. The height of the shelters
is approximately three metres. The sides and facia of the shelters are a cream
colour and the roof is a blue colour.
Waratah-Wynyard Council – Ordinary Meeting Agenda – 19 January 2009 Page 10
Planning Authority Reports
Advertising
The application was advertised for a period of 14 days in accordance with the
provisions of the Land Use Planning and Approvals Act 1993. During this
time Council received three representations raising concerns with the proposal.
• Darren Scrivener, 1258 Oldina Road, Oldina
Issue Raised:
These shelters are an eyesore and take up too much valuable paddock space.
My main concern is being hit by flying sheets of roof iron in the heavy winds.
Planning Comment
The visual amenity of the area comprises a rural landscape typical of the
northwest. In such rural landscapes sheds and storage structures are a normal
visual element. A structural engineering certificate for the sheds was
submitted with the application, which states the sheds will comply with the
relevant standards when constructed in accordance with the engineering design
documents. The assessment required under the Building Approval stage of the
application will ensure that the structures are constructed in accordance with
the structural engineering certificate.
Wendy Abbott, 1258 Oldina Road, Oldina
Issue Raised:
The shelters in question are already insitu and take up a large area that
detracts from the beauty of the area and surrounding countryside. The colour
of the shelters detracts from the surrounds.
Planning Comment
See above comment.
Linden Keep, 1182 Oldina Road, Oldina
Issue Raised:
The plans show the sheds built 29 metres from my boundary. There has
already been a situation between myself and Maggie Boyd in regards to myself
shooting vermin up to my fence line.
Planning Comment
From the site plan it appears the shelters will be within 29 metres of the
boundary from 1258 Oldina Road and not 1182 Oldina Road. The issue of
shooting vermin is a domestic issue and not a planning one.
Waratah-Wynyard Council – Ordinary Meeting Agenda – 19 January 2009 Page 11
Planning Authority Reports
Assessment
The site is zoned Primary Industries under the Waratah-Wynyard Planning
Scheme 2000. The animal shelters will be used for sheltering horses and other
livestock on site from the weather. The use relates to the primary industries
use on site and therefore the appropriate use classification is the Resource
Development Use class. The Resource Development use class is a primary
use class within the Primary Industries Zone
Standards for development in the Primary Industries zone are provided in Part
9 of the Planning Scheme. As the application relies on assessment against the
Performance Criteria in relation to development standards relating to siting, it
requires discretionary approval under Section 57 of the Land Use Planning
and Approvals Act 1993 (LUPAA).
The following section provides an assessment against the relevant Planning
Scheme provisions.
9.0 PRIMARY INDUSTRIES ZONE
9.1 Values of the zone
9.1.1 This zone incorporates predominantly primary industry related
use or development of significant tracts of land from the coast
through to the southern extremities of the planning area. It
includes land used for farming, forestry, quarrying or mineral
extraction processing works and a range of non-urban uses
such as roads and rail networks, electricity distribution lines,
water supply utilities and the like on private land, State
Reserves, State Forests and Crown Land.
9.1.2 The values associated with those areas in the zone are specified
in Part 2 of the planning scheme
9.2 Intent of the zone
(a)
(b)
To protect and allow for the sustainable use and development
of the natural and non-natural resources on which agriculture,
aquaculture, forestry and mining depend; and
To allow a range of uses in ways and in locations that do not
affect the viability of use or development associated with the
primary uses of the zone.
Waratah-Wynyard Council – Ordinary Meeting Agenda – 19 January 2009 Page 12
Planning Authority Reports
The provision of the animal shelters on site relates to the primary use of the
site being for grazing of horses and other livestock. he proposal should not
affect the use of surrounding land for agricultural activities. Moreover,
visually the shelters shed will appear similar to many agricultural structures in
the vicinity.
The application is assessed as follows against Scheme criteria specific to the
application:
Relevant Standards for use or development in the Primary Industries Zone
9.4.1 Issue 11.0: - Design and Form
Objective: To design and sit rural buildings in a manner that protects rural
amenity and maintains appropriate rural character.
Acceptable Solution
11.1 Building that are not occupied by
sensitive uses and to be setback a
minimum of:-
(a) 30 metres from a road
boundary (unless a greater
setback from Category I, II or
III road is required in
accordance with Table 14.2.1
Issue 5.0:- Setbacks for
Buildings and Structures.);
and
(b) 10 metres from any other
boundary.
11.2 The maximum building height is
7.5 metres.
Performance Criteria
11.1 The required setbacks may be
varied where it can be
demonstrated that:
(a) the location of proposed
building or structures
compliments the setbacks of
existing buildings or
structures in the immediate
area; or
(b) the design and location of
proposed buildings or
structures compliments the
amenity and character of the
locality and is not visually
intrusive; or
(c) the design of the proposed
building or structures
minimises the earth works
associated with construction
and responds appropriately to
the particular size, shape,
contours or slope of the land.
11.2 Building height may be varied
where it is demonstrated that
buildings or structures are
designed and sited in a manner
that does not result in a high level
of contrast with the prevailing
landscape elements. Matters to
be considered include the shape,
Waratah-Wynyard Council – Ordinary Meeting Agenda – 19 January 2009 Page 13
Planning Authority Reports
height, bulk, materials and
colours of buildings and
structures, and their appearance
in relation to skylines, and to
existing and proposed vegetation.
The setbacks for five of the proposed shelters comply with the setback
requirements, however one of the shelters is within 23 metres of Oldina Road
and therefore relies on assessment against the Performance Criteria. The
location of the shelter within 30 metres of the boundary to Oldina Road is not
visually obtrusive in the area and will not detrimentally impact the amenity in
the area. The location of the shelter and its low height means that it wont have
any impacts in terms of overshadowing.
All the proposed shelters are less than 7.5 metres in height (only 3 metres) and
comply with the acceptable solution.
The proposal meets the performance criteria.
7. Risk
There is a risk the applicant or representors may appeal the determination of
the Planning Authority to the Resource Management and Planning Appeal
Tribunal.
IN FAVOUR
8. Conclusion
The application involves the construction of six animal shelters on site on a lot
within the Primary Industries Zone. The land is currently utilised for grazing
of horses and other livestock and a residential dwelling. The animal shelters
are related to the primary industries use on site.
The application is seeking a variation to the setback requirements for one of
the animal shelters. The application is considered to not affect the amenity of
the area, or affect the attainment of the zone or planning scheme objectives.
2. Summary
This report has been prepared to enable the timing of Ordinary Meetings to be
altered to allow for a pre-meeting meal, and to decide on two alternative
Ordinary Meeting locations in 2009.
For Council to be open and accountable to its community, consistency in the
meeting schedule is suggested as this allows residents to know with some
certainty when Council meetings are normally held.
3. Background
For the past year it has been normal practice for Council to conduct Ordinary
Council meetings on the third Monday of each month commencing at 5:30 pm.
Prior to this meetings were held on the third Monday of each month
commencing at 7:30pm.
4. Statutory Requirements
The Local Government (Meeting Procedure) Regulations 2005 states:
6. Times of meetings
(1) A meeting is not to start before 5 p.m. unless otherwise determined by
the council by absolute majority or by the council committee by simple
majority.
(2) After each ordinary election, a council and a council committee are to
review the times of commencement of meetings.
5. Finances
The conduct of any Council meeting has costs associated with it, additionally
there will be a cost associated with catering. It is envisioned that meals will be
served at the Council Chambers, Wynyard at approximately 5:15pm. The
meals will cater for Councillors and Staff formally attending the meeting.
Sandwiches would no longer be provided after the meeting.
6. Discussion
The Council may determine the most appropriate timing for ordinary
meetings. The only provision included within the Regulations is that an
ordinary meeting is to be conducted at least once per month. All meetings are
to commence after 5:00 pm unless determined otherwise by the Council by
absolute majority.
Waratah-Wynyard Council – Ordinary Meeting Agenda – 19 January 2009 Page 18
Council Reports
The proposed 6:00pm commencement time will allow for a meal to be served
immediately prior to an Ordinary meeting. It is also noted that Circular Head
Council holds its Ordinary meetings on the third Thursday of each month
commencing at 6:00pm following a meal.
7. Risk
No risks have been identified in relation to this matter.
8. Conclusion
The determination of the timing and alternative locations of meetings is
presented for consideration.
Respect Orders program.
The Community Respect Orders program is an early intervention diversionary
option based on a restorative justice approach, used by Tasmania Police, for
youth and young adults, whereby the offender performs reparation work in the
community under the supervision of Tasmania Police.
TVIN Visitor Experience Assistant Grant
The Wonders of Wynyard received a grant for $5,000 under the TVIN Visitor
Experience Assistance Grants. The grant will enable the WOW to implement a
more efficient on-line booking system. Acquisition of the Book Easy Booking
System will make the Wynyard Visitor Centre compatible with Tier 1 and Tier
3 Visitor Centres in Tasmania.
The project involves a training component for Centre staff. This will enable
the Centre to have a 24 hour, 7 days per week sales presence which is
important as it will ensure that the Veteran Car Exhibition can be marketed
and promoted more effectively to tour groups. With 34,000 visitors last
financial year, this system will maximise the Centre’s yield and provide an
industry standard booking service.
CHILDREN’S SERVICES
Parent interviews took place in December with approximately six families in
each room meeting with staff to discuss their children’s progress.
The annual Christmas party was held on the 17 th December with
approximately 60 families attending. There was plenty of entertainment
including a jumping castle, face painting, magician and balloon artist. Santa
arrived at around 7.00pm on the fire engine with treats for the children. This
is a wonderful social event for families to come together.
The children from the Little Goldie Street program participated in the
Christmas parade on Christmas Eve with most children and some family
members joining in. The children and staff walked in the parade dressed as
reindeers - a banner that the staff and children had worked on was carried with
the Centre’s name and details displayed.
Information Report
A report is being prepared for consideration by Council regarding the
establishment of an after school care program at the Yolla District High
School. Initial investigations of the site have identified a possible venue at the
school. The school has carried out surveys to determine interest from the
school community and is keen to provide this service on site.
The Education Department’s Child Care Unit has approached Children’s
Services to be involved in the trial of the proposed new processes for the
approval of four year olds in OSHC. The trial will commence in 2009.
TOURISM AND WONDERS OF WYNYARD EXHIBITION CENTRE
The permanent display depicting the Tommeginer people has been installed at
the Exhibition Centre. This permanent display has been placed in the WOW
to promote the community’s indigenous history to visitors and encourage them
to visit Freestone Cove and the fish traps.
Further information has been received from Stephen Hite from Burnie Sports
and Events regarding incorporating a tour of the WOW into the itinerary for
the cruise ship market. Mr. Hite advised that one of the on-shore operators is
interested in including the WOW on this seasons itinerary. Heritage Tours
will be making contact to organise the inclusion of the WOW for upcoming
cruise ship visits.
The final meeting of the Literacy/Arts program was held at Table Cape
Primary School in early December. This group has worked hard to improve
educational outcomes for local indigenous students over the past three years.
Projects have focussed on the Tommeginer people with several exhibitions
being held over this time.
Planning has commenced to offer the Community Recreation Leaders Award
in April 2009. The program is of an introductory nature and equips
participants to deliver a variety of recreational programs. Several Council
facilities will be used as training venues.
The Tasmanian Youth Forum was held in Launceston and was attended by the
Community Development Officer along with local youth representative Dillon
Roberts. The forum focussed on innovative projects/programs to address youth
homelessness in Tasmania.
Support was provided for the Carols by Candlelight evening in Gutteridge
Gardens at an alternative area due to work in progress on the stage and
surrounds. Lighting and seating were provided.
The Norfolk Pine on the corner of Arthur and Pelissier streets in Somerset was
selected to be illuminated as a Christmas tree. The tree has generated
considerable interest in the community. Unfortunately there wasn’t any follow
up from the media. Next year an official lighting up event will be organised to
increase media attention.
Work has commenced on documenting walkways/ pathways in Somerset and
Wynyard with a view to identifying extensions, links and circuits to improve
walker experiences. This project is proposed to be funded from financial
assistance package from the Commonwealth Government announced recently.
The Caring for our Country funding has been announced. A boardwalk for
Penguin tours at Doctors Rocks was approved along with environmental work
on Sisters Creek. Council will auspice the latter project with Cradle Coast
looking after the former one.
Waratah-Wynyard Council’s Learn to Swim program is well underway. The
program comprises two courses, to be held over four weeks. Each course runs
over a two week period, with an hourly lesson each weekday. The classes
being offered are Under 4’s, Water Orientation, Beginners and Basic Stoke
Development. Initial bookings have been very good. There are approximately
115 children currently enrolled.
