<strong>SECTION</strong> <strong>49</strong> - <strong>SIGNS</strong><br />

Introduction - The Nature of Signs<br />

Characteristics of signs include the message, or meaning (eg a white cross at the roadside signifies a road<br />

fatality) size, colour, design, number, location and duration. The spatial impacts of the structural elements of<br />

signs on road safety and visual amenity can be quantified in terms of bulk and location. Determining the<br />

impacts of the message conveyed by a sign involves gauging how people “read” their outdoor environment.<br />

For example, identifying a site by its name is an expected and coherent message in the outdoor<br />

environment. Conversely, a sign notifying the monetary exchange rate in the outdoor environment makes as<br />

much “sense” as a “NO RIGHT TURN” sign in a stock exchange building. The issue therefore is not whether<br />

the message is “necessary”; but to what extent, with respect to permitted status, does the message interpret<br />

or add meaning to the environmental context of the <strong>Waikato</strong> <strong>District</strong>. Conversely, does the message detract<br />

or distract from, or confuse the coherent interpretation of the environmental context in which the message<br />

appears?<br />

The greatest impact of a sign on the environment occurs when the sign first appears. Duration lessens the<br />

prominence of signs. However, the effect of a permanent sign, visible from adjacent residences, can<br />

severely degrade the pleasantness of visual, social or cultural amenity for neighbours, even though<br />

distraction to regular passers-by from the sign may decrease as the duration of the sign lengthens.<br />

The Purpose of Signs<br />

The purpose of signs is to attract the attention of and provide information to road users and the general<br />

public. Information is conveyed for a number of reasons. These include: controlling traffic movements,<br />

warning of hazards, identifying properties, giving notice of forthcoming events, and informing about available<br />

goods and services.<br />

Adverse Effects of Signs on Environments<br />

Amenity standards vary throughout the <strong>Waikato</strong> <strong>District</strong>, and are created by the range and nature of land<br />

uses in an area. Different areas can accommodate the impacts of signs more readily than others. Town<br />

centres and industrial areas are less likely to be affected by a greater number and larger sizes of signs than<br />

are residential and rural areas. The visual amenity of residential and rural areas is highly sensitive to the<br />

adverse effects of signs. Also community consultation provides evidence that local communities have a<br />

greater tolerance for commercial off-site signs that promote local business, and perceive large commercial<br />

hoardings not related to local business to have the greatest adverse effects on visual amenity in terms of<br />

structure and message.<br />

The sensitivity of road environments requires signage for safety reasons in some places, and directional or<br />

general information in others. Traffic signs, warning signs, and street or road identification signs maintain<br />

and enhance road user safety. The roading hierarchy in the <strong>District</strong> Plan ranks the functions of roads. This<br />

hierarchy also signals the social and economic significance of the routes and creates the opportunity for and<br />

the value of signs directed at the travelling public.<br />

Signs that comply with standards are permitted. However, a resource consent may be required in order that<br />

community safety, values and visual amenity cannot be compromised by signs that:<br />

• have complicated, inappropriate, confusing, ambiguous or illegible messages; or<br />

• are poorly constructed or maintained; or<br />

• are too big in relation to the surrounding scale of buildings and structures; or<br />

• have distracting or confusing lighting; or<br />

• have moving parts that can cause injury; or<br />

• are located inappropriately; or<br />

• degrade existing natural or cultural features, or character of the site or locality.<br />

These adverse effects of signs need to be addressed.<br />

<strong>49</strong>.0 ISSUE<br />

<strong>49</strong>.0.1 Signs provide important information but they can also adversely affect the safety of people,<br />

including road users, visual amenity of different areas within the <strong>Waikato</strong> <strong>District</strong>, and cultural<br />

values of people and communities in the <strong>Waikato</strong> <strong>District</strong>.<br />

<strong>49</strong>.1 OBJECTIVE<br />

<strong>49</strong>.1.1 Signs should provide information that communicates a message to the community while<br />

avoiding, remedying or mitigating adverse effects on communities and road safety, visual<br />

amenity of different areas within the <strong>Waikato</strong> <strong>District</strong> and the cultural values of people and<br />

communities within the <strong>Waikato</strong> <strong>District</strong>, or surrounding areas.<br />

<strong>49</strong>.2 POLICIES<br />

Safety<br />

<strong>49</strong>.2.1 To provide for signs where they are an important factor in promoting the safety of the<br />

community and road users.<br />

<strong>49</strong>.2.2 To ensure the message of signs does not confuse road users or encourage them to make<br />

impulsive manoeuvres.<br />

<strong>49</strong>.2.3 To ensure that signs, other than traffic signs, are provided for in a manner that facilitates<br />

community and road safety.<br />

Amenity<br />

<strong>49</strong>.2.4 To ensure that the number, size and location of signs are compatible with the level of sensitivity<br />

of different areas to the adverse effects of signs, including visual clutter.<br />

<strong>49</strong>.2.5 To encourage a high standard of sign presentation, construction and maintenance.<br />

<strong>49</strong>.2.6 To ensure that signs, other than traffic signs, are provided for in a manner that maintains<br />

landscape and visual amenity, and cultural values while avoiding signs that are incongruous or<br />

out of character with their neighbourhood.<br />

Conspicuity<br />

<strong>49</strong>.2.7 To ensure that signs are prominently visible, clear, concise and easily read and understood by<br />

road users.<br />

<strong>49</strong>.3 REASONS FOR POLICIES<br />

<strong>49</strong>.3.1 Policies recognise that signs provide information that promotes public safety and enables social,<br />

cultural and economic wellbeing. The potential adverse effects of signs on traffic safety are of<br />

particular concern to <strong>Council</strong>. Providing information through signs offers an opportunity for the<br />

community and businesses to notify their location, activities and services.<br />

<strong>49</strong>.3.2 The policies recognise that characteristics of signs need to be managed because different areas<br />

have different levels of sensitivity to potential adverse effects of signs. Signs which mimic traffic<br />

signs, contain a message which is out of context with its siting, or are poorly located can distract<br />

or confuse road users, obstruct visibility of other traffic, present a physical obstruction to traffic<br />

or detract from amenity values.<br />

<strong>49</strong>.4 METHODS<br />

<strong>49</strong>.4.1 Implement and enforce rules with respect to number, size, location, placement, materials,<br />

content and appearance.<br />

(a) "Advertising Signs and Road Safety: Design and Location Guidelines” (1993) Land<br />

Transport Safety Authority and Transit New Zealand;<br />

(b) Design Guide containing a summary of the most significant road safety issues and rules,<br />

principles for optimal designs for signs compatible with maintaining and enhancing the<br />

amenity of commercial areas and a regularly updated map of crash sites in the district in 70<br />

km/hr or greater areas;<br />

(c) Codes of practice developed by road controlling authorities, sign writing and associated<br />

professions and industries; and<br />

(d) Protocols between <strong>Council</strong> and user groups.<br />

<strong>49</strong>.4.4 Facilitate aggregated signs at the entrance to towns and townships.<br />

sites of natural, cultural and historical interest as resources are available through the Annual<br />

<strong>49</strong>.5 RULES<br />

<strong>49</strong>.5.1 Unless specified elsewhere in the rules, applications for controlled activities will not be notified.<br />

<strong>49</strong>.5.2 Unless specified elsewhere in the rules on Signs, rules in the underlying zone apply to signs in<br />

the adjoining reserves, including roads.<br />

<strong>49</strong>.5.3 For the purposes of the rules in Section <strong>49</strong> the use of the term Residential Zones shall include<br />

the Rural Residential, Urban Pa, Residential Zone, Rural Residential Areas and Mixed Areas of<br />

the Hopuhopu Zone, and a Scheduled Deferred Residential Area in the Rural Zone.<br />

<strong>49</strong>.5.4 The use of the term Rural Zones shall include the Rural Pa Zone and the Rural Areas of the<br />

Hopuhopu Zone.<br />

Note: (i) Signs erected either on a road or on private property require the permission of either the<br />

road controlling authority or the property owner, whichever applies.<br />

and require a building consent. However, a requirement to comply with building standards<br />

<strong>49</strong>.5.5.1 A traffic sign is permitted and exempt from complying with any conditions for<br />

a permitted activity.<br />

<strong>49</strong>.5.5.2 A sign warning of a hazard or hazards, including power lines crossing<br />

navigable channels, is permitted notwithstanding all rules, if the activity<br />

complies with the current relevant statutory regulations.<br />

i) a clearance of 2.4 metres above any footpath; and<br />

ii) a clearance distance of at least 450mm inwards from the kerb where a sign is attached to the underside of the verandah.<br />

to ensure safe and convenient access for pedestrians from the roadway onto the kerb side area of the pavement or trafficable<br />

v) be removed during night hours from the road where the sign is not illuminated adequately from either street lighting or the<br />

Except for traffic signs, a sign of a road controlling or safety authority that does not<br />

comply with conditions for a permitted activity, including commercial signs, international<br />

symbols, and advertising of road construction companies.<br />

Standards and terms shall be:<br />

(a)<br />

a sign directing to an activity providing for more than 200 vehicles<br />

per day as an annual average; or<br />

(b)<br />

commercial advertising associated with roading contracts.<br />

Signs of local authorities in lay-bys.<br />

A sign in a layby, that is an area abutting or adjoining a trafficable<br />

roadway, identifying the location of local activities shall:<br />

A sign visible from a regional or district arterial, or collector road in the Rural Zone<br />

(excluding the Landscape, Ridgeline Protection and Coastal Policy Areas) shall:<br />

1 comply with the separation distances in Rule <strong>49</strong>.5.6.4; and<br />

2 have a maximum sign area of 18m 2 ; and<br />

<strong>49</strong>.5.8 Controlled and Discretionary Resource Consent – Assessment Matters<br />

In considering whether or not to grant consent or impose conditions, the <strong>Council</strong> shall have<br />

regard to the following assessment matters:<br />

Safety<br />

(a) The effect of altering the conditions that apply for permitted activities on road or community<br />

safety and amenity values.<br />

(b)<br />

(c)<br />

The degree of the relationship between the message on the sign and driving related tasks,<br />

the nature of the environment including the cultural significance of the site, and the land<br />

use activities in the vicinity.<br />

In relation to general traffic safety, all of the following matters will be considered:<br />

1 The extent to which the sign may provide for improved safety than would a sign<br />

complying with the conditions for permitted activities.<br />

2 The extent to which the sign may obstruct driving sight distances, traffic signs or<br />

signals, or unnecessarily intrude into a road user’s field of view.<br />

3 The extent to which the message on the sign distracts the attention of the road user by<br />

stimulating curiosity or confusion.<br />

4 The potential adverse effects of the sign on road users’ concentration under all<br />

possible weather conditions.<br />

Amenity<br />

(d) The extent to which the sign will have any adverse effects on the level of service provided<br />

by the road and the visual amenity of the locality.<br />

(e)<br />

In relation to the visual amenities of the locality all of the following matters will be<br />

considered:<br />

1 The extent to which the sign may provide for better visual amenity than would a sign<br />

complying with the conditions for permitted activities.<br />

2 The visual impact of the sign and its potential to adversely affect the amenities of the<br />

locality.<br />

3 The potential of the structural component of the sign to adversely affect public health<br />

and safety, or to reduce public convenience.<br />

4 The degree of sensitivity of the receiving environment to the visual, social or cultural<br />

effects of signs.<br />

(f)<br />

Any likely cumulative effects of allowing the sign to be erected<br />

Conspicuity<br />

(g) The extent to which any sign resembles a traffic sign or signal, or may make a traffic sign<br />

or signal less conspicuous, with respect to colour or shape, when considered from all<br />

possible driving angles. This includes signs which:<br />

1 Resemble the shape or colour of a traffic sign or signal; or<br />

2 May otherwise confuse motorists when in the vicinity of an intersection or other<br />

potential traffic hazard; or<br />

3 That could reduce the clarity or effectiveness of a traffic sign or signal; or<br />

4 Invite road users to turn, but are sited in such proximity to the vehicle entrance that<br />

there is not time to signal, slow down and turn safely; or<br />

5 Contain reflectors and therefore have the potential to be confused with traffic signs or<br />

signals at night.<br />

<strong>49</strong>.5.9 Reasons for Rules<br />

(a)<br />

Rules are to ensure minimum performance standards to achieve the following prioritised<br />

outcomes:<br />

1 Road safety<br />

2 Information to assist road users<br />

3 Protection or enhancement of visual and other amenity values of the community, and<br />

4 Enabling the erection of signs, where adverse effects can be avoided, remedied or<br />

mitigated.<br />

(b)<br />

Thus rules:<br />

1 Protect the conspicuity of traffic signs<br />

2 Permit signs that identify a site<br />

3 Enable other signs to be erected as permitted activities, where they comply with<br />

performance standards<br />

4 Enable advance warning signs that do not comply with rules for permitted status to be<br />

controlled activities<br />

5 Establish an integrated approach to the authorisation of signs.<br />

The implementation of the policies and methods relating to signs will result in:<br />
