brief appearance before <strong>the</strong> Panel.<br />

The Panel believed that <strong>the</strong>re is a<br />

value to course work for this Member.<br />

Education and learn<strong>in</strong>g is always<br />

of benefit, regardless of one’s level of<br />

seniority and experience. The Panel<br />

believed it is necessary for <strong>the</strong> Member<br />

to fully appreciate <strong>the</strong> impact of<br />

his behaviour, and that course work<br />

is rehabilitative and <strong>in</strong>structive. The<br />

Panel acknowledged <strong>the</strong> boundary<br />

tra<strong>in</strong><strong>in</strong>g that <strong>the</strong> Member underwent<br />

<strong>in</strong> Arizona, but believed <strong>the</strong>re is added<br />

value <strong>in</strong> <strong>the</strong> Member attend<strong>in</strong>g <strong>the</strong><br />

“Applied Ethics <strong>in</strong> Pharmacy Practice”<br />

course offered at <strong>the</strong> University<br />

of Toronto. The Panel <strong>the</strong>refore<br />

ordered <strong>the</strong> successful completion<br />

of this course as a specified term,<br />

condition or limitation on <strong>the</strong> Member’s<br />

Certificate of Registration. This<br />

course will ensure that <strong>the</strong> Member<br />

thoroughly understands his ethical<br />

responsibilities as a pharmacist and<br />

his participation <strong>in</strong> a regulated health<br />

profession.<br />

The Panel accepted <strong>the</strong> $10,000<br />

costs recommendation and set <strong>the</strong><br />

deadl<strong>in</strong>e for payment <strong>in</strong> l<strong>in</strong>e with <strong>the</strong><br />

timel<strong>in</strong>e for schedul<strong>in</strong>g <strong>the</strong> reprimand.<br />

To address <strong>the</strong> Panel’s concerns<br />

about <strong>the</strong> suspension be<strong>in</strong>g able to<br />

be served without any effort on <strong>the</strong><br />

part of <strong>the</strong> Member, <strong>the</strong> Panel made<br />

it a requirement that <strong>the</strong> suspension<br />

period cannot be triggered until<br />

<strong>the</strong> Member receives <strong>the</strong> reprimand,<br />

physically attends <strong>in</strong> Ontario for <strong>the</strong><br />

course work, and pays <strong>the</strong> costs as<br />

ordered.<br />

Order<br />

1. A reprimand to be scheduled and<br />

received by <strong>the</strong> Member with<strong>in</strong> 60<br />

days of <strong>the</strong> Order, by teleconference<br />

or <strong>in</strong> person;<br />

2. Terms, conditions, and limitations<br />

on <strong>the</strong> Member’s Certificate of<br />

Registration, and <strong>in</strong> particular, that<br />

<strong>the</strong> Member complete successfully,<br />

at his own expense, with<strong>in</strong> 12<br />

months of <strong>the</strong> date of <strong>the</strong> Order,<br />

Applied Ethics <strong>in</strong> Pharmacy Practice,<br />

offered by Professor Zub<strong>in</strong><br />

Aust<strong>in</strong> at <strong>the</strong> Leslie Dan Faculty<br />

of Pharmacy at <strong>the</strong> University of<br />

Toronto;<br />

3. Costs to <strong>the</strong> College of $10,000;<br />

and<br />

4. A suspension of six months, with<br />

<strong>the</strong> suspension to commence only<br />

after <strong>the</strong> Member has complied<br />

with <strong>the</strong> rest of <strong>the</strong> Order and<br />

has declared his <strong>in</strong>tention to return<br />

to <strong>the</strong> practice of pharmacy <strong>in</strong><br />

Ontario.<br />

This Order was <strong>in</strong> effect as of February<br />

17, 2009, <strong>the</strong> date of <strong>the</strong> hear<strong>in</strong>g.<br />
