the street because they were wearing dark
clothes, reports said. He admitted having
“three or four” beers at a nearby bar
that night, court documents said. Breeding
avoided a Breathalyzer six times at the
scene by “blowing out of the corners of his
mouth, trying to skew results,” those documents
said.
Officers took him to Carolinas Medical
Center-University, where
he refused a blood test.
Breeding was released
from the Mecklenburg
Smith
County jail at 1:30 p.m.
Saturday on a $3,000
bond, the jail log said.
Smith was pronounced
dead at Carolinas Medical
Center seven hours
later, the police report said.
The police report said the incident is
still under investigation, but officials have
not said if they will bring more charges
against Breeding. Calls Wednesday afternoon
to the Mecklenburg County District
Attorney’s office were not answered.
Breeding said he had “absolutely no comment”
about the incident when reached
Wednesday afternoon.
Smith’s friends were angry that Breeding
could post bail and leave jail so quickly.
Many didn’t know he had already gotten
out of the jail.
“He’s out walking around, and she can’t
take a breath anymore?” Barrett said.
“Doesn’t seem like justice to me.”
Family and friends of Smith held a vigil
for the community college student Monday,
Jan. 18, at the wreck site.
They remembered her as their friend and
hoped her story could become a teaching
moment.
“She was taken all too soon from us,”
Barrett said. “She didn’t deserve this. But
we’re hoping to take something from all
of this. All of her friends are forming a
Standing Against Drunk Driving group
and are pledging to never drink and
drive. This tragedy doesn’t need to happen
again.”
Several friends created a Facebook.
com page called “RIP Shalenia Smith
Dec. 9, 1989- Jan. 16, 2010.” Friends
posted photos and videos of Smith and
tributes to her on the comment section.
The group had nearly 400 members
Wednesday.
“R.I.P Lenia, I will miss you so much ...
I can’t believe you’re gone. The memories
we had and shared will always be in my
heart & I will cherish forever. I love you,
Shalenia. Save me a spot in heaven. You
will never be forgotten,” one commenter
said.
Smith, of 13300 York Center Drive, was
a 2009 graduate of E.E. Waddell High
School and was studying to become a pediatrician,
friends said.
Funeral services are scheduled for Saturday,
Jan. 23, at Sherman Memorial Church
of God, 1401 Parkwood Ave., at 1 p.m. A
visitation begins at noon.
Breeding’s next court appearance is
scheduled for Feb. 24. q
