“three or four” beers at a nearby bar<br />
that night, court documents said. Breeding<br />
avoided a Breathalyzer six times at the<br />
scene by “blowing out of the corners of his<br />
mouth, trying to skew results,” those documents<br />
said.<br />
Officers took him to <strong>Carolina</strong>s Medical<br />
Center-<strong>University</strong>, where<br />
he refused a blood test.<br />
Breeding was released<br />
from the Mecklenburg<br />
Smith<br />
County jail at 1:30 p.m.<br />
Saturday on a $3,000<br />
bond, the jail log said.<br />
Smith was pronounced<br />
dead at <strong>Carolina</strong>s Medical<br />
Center seven hours<br />
later, the police report said.<br />
The police report said the incident is<br />
still under investigation, but officials have<br />
not said if they will bring more charges<br />
against Breeding. Calls Wednesday afternoon<br />
to the Mecklenburg County District<br />
Attorney’s office were not answered.<br />
Breeding said he had “absolutely no comment”<br />
about the incident when reached<br />
Wednesday afternoon.<br />
Smith’s friends were angry that Breeding<br />
could post bail and leave jail so quickly.<br />
Many didn’t know he had already gotten<br />
out of the jail.<br />
“He’s out walking around, and she can’t<br />
take a breath anymore?” Barrett said.<br />
“Doesn’t seem like justice to me.”<br />
Family and friends of Smith held a vigil<br />
for the community college student Monday,<br />
Jan. 18, at the wreck site.<br />
They remembered her as their friend and<br />
hoped her story could become a teaching<br />
moment.<br />
“She was taken all too soon from us,”<br />
Barrett said. “She didn’t deserve this. But<br />
we’re hoping to take something from all<br />
of this. All of her friends are forming a<br />
Standing Against Drunk Driving group<br />
and are pledging to never drink and<br />
drive. This tragedy doesn’t need to happen<br />
again.”<br />
Several friends created a Facebook.<br />
com page called “RIP Shalenia Smith<br />
Dec. 9, 1989- Jan. 16, 2010.” Friends<br />
posted photos and videos of Smith and<br />
tributes to her on the comment section.<br />
The group had nearly 400 members<br />
Wednesday.<br />

Smith, of 13300 York Center Drive, was<br />
a 2009 graduate of E.E. Waddell High<br />
School and was studying to become a pediatrician,<br />
friends said.<br />
Funeral services are scheduled for Saturday,<br />
Jan. 23, at Sherman Memorial Church<br />
of God, 1401 Parkwood Ave., at 1 p.m. A<br />
visitation begins at noon.<br />
Breeding’s next court appearance is<br />
