Appendix ‘ A’ (Refers to IHQ‐MoD(N) letter No CPT(JCM)/3543/XII/12‐M dt Oct 2011) PROGRESS POINTS DISCUSSED DURING THE 12 TH MAIN MEETING OF NHQ JCM COUNCIL – 30 SEP 2011 Ser No Point No Point in Brief Comments 1. 6(4-M) (16 Jan 08) Regularization of USLs Regularization of balance USLs granted temporary status including nine in whose case orders were held in abeyance by HQ ENC. (Shri BS Reddy, INDWF) There are no provisions for regularisation of Ty status Casual employees who did not meet the laid down criteria as per Govt instructions issued in 1993 and subsequently in 2006 after Uma Devi Judgement. These were one time measure. It was pointed out by Staff side that there are DOPT instructions which permit regularisation of Ty status USLs which can be followed. The Chairman directed that the applicability of DOPT instructions in this case will be explored. The case may be re-examined in the light of these instructions if these do exist. The Point is closed. 2. 3(6-M) Exercise of Disciplinary Powers 3. 15 (6-M) Exercise of disciplinary powers with regard to IHQ Policy letter CPT (DV)/3118/Policy dated 26 Jun 08 not yet implemented till today. Shri GSJ Achuta Rao, AIDEF Over Time Wages as per Factories Act – 1948 Over Time Wages be paid in revised scales as per Section 59 of the Factories Act – 1948. Shri KK Balachandran., AIDEF MoD has undertaken a comprehensive review of appointing and disciplinary authorities in the three service HQs/ISOs. IHQ-MoD(N) will shortly be submitting its recommendations to MoD. In the meanwhile, instructions are being issued vide IHQ letter No CPT(DV)/3118/Policy dt 26 Jun 08 may be complied with. The Point is closed. Action: DCPS(D&V) Govt orders for payment of OTA on revised rates wef 01-01-06 have been issued vide MoD OM No 18(5)/2008-D(Civ II) dt 10 May 11. These orders have been promulgated to Command HQs for implementation. Funds have already been allocated to Command HQs for this purpose. 4. 1(7-M) Recruitment Rules Amendments Recruitment Rules amendments after 6 th CPC recommendations be done expeditiously after consultation with the Staff Side. Shri S M Veerappan, AIDEF The Point is closed. Action: DCP As decided in last Main meeting, a meeting with Staff side members on the issue was held on 20 May 11. Proposal for revision of RRs for 39 cadres has been initiated. Draft RRs of 22 cadres are under process with MoD/DOPT/UPSC. Draft RRs for remaining cadres are under preparation in consultation with Command/Staff side members. The Progress is to be monitored.
