<strong>The</strong> Secretary of State for Transport, being a Minister designated for the purposes ofsection<br />
2(2) of the European Communities Act 1972(a) in relation to measures relating to the<br />
organisation of working time(b), in exercise of the powers conferred by that section hereby<br />
makes the following Regulations:<br />

1. <strong>The</strong>se Regulations may be cited as the Civil Aviation (Working Time) Regulations 2004<br />
<strong>and</strong> shall come into force on 13th April 2004.<br />
Scope<br />
2. <strong>The</strong>se Regulations apply to persons employed to act as crew members on board a civil<br />
aircraft flying for the purposes ofpublic transport.<br />
Interpretation<br />
3. In these Regulations-<br />
"the 1974 Act" means the Health <strong>and</strong> Safety at Work Act 1974(c);<br />
"block fiying time" means the time between an aircraft first moving from its parking place<br />
for the purpose oftaking off until it comes to rest on its designated parking position with<br />
all its engines stopped;<br />
"the CAA" means the Civil Aviation Authority;<br />
"cabin crew" means a person onboard a civil aircraft, other thanflight crew, who is carried<br />
for the purpose ofperforming in the interests ofthe safety ofthe passengers, duties that<br />
are assigned to him. for that purpose by the operator or the comm<strong>and</strong>er ofthat aircraft;<br />
"calendar year" means the period of 12 months beginning with 1st Januaxy in any year;<br />
"collective agreement" means a collective agreement within the meaning ofsection 178 of<br />
the Trade Union <strong>and</strong> Labour Relations (Consolidation) Act 1992(d) the trade union<br />
parties to which are independent trade unions within the meaning ofsection 5 ofthat Act;<br />
"the Commission" means the Health <strong>and</strong> Safety Commission referred to in section 10(2)<br />
ofthe 1974 Act;<br />
"crew member" means a person employed to act as a member of the cabin crew or flight<br />
crew on board a civil aircraft by an undertaking established in the United Kingdom;<br />
