Any person who unlawfully dumps solid waste as described in Section 025(3)(b) and in an<br />
amount less than one (1) cubic yard, but greater than (1) cubic foot, shall be, upon<br />
conviction, guilty of a misdemeanor, and shall be subject to a fine of not more than $1,000,<br />
or imprisonment in the county jail not to exceed ninety (90) days, or both. The court may<br />
also impose restitution as stated in Chapter 70.95 RCW, Solid Waste Management-<br />
Reduction and Recycling.<br />
Any person who unlawfully dumps solid waste as described in Section 025(3)(b) of these<br />
regulations and in an amount greater than (1) cubic yard, shall be, upon conviction, guilty<br />
of a gross misdemeanor, and shall be subject to a fine of not more than $5,000, or<br />
imprisonment in the county jail not to exceed one (1) year, or both. The court may also<br />
impose restitution as stated in Chapter 70.95 RCW, Solid Waste Management-Reduction<br />
and Recycling.<br />
Any person who fails, neglects, or refuses to obey an order of the <strong>Health</strong> Officer to correct<br />
a violation as set forth in Section 950(5)(g) above shall be, upon conviction, guilty of a<br />
misdemeanor and shall be subject to a fine of not more than $1,000, or imprisonment in the<br />
county jail not0 to exceed ninety (90) days, or both. The court may also impose<br />
restitution.<br />
Any person who fails, neglects, or refuses to comply with a written assurance of<br />
discontinuance pursuant to Section 950(5)(h) above shall be, upon conviction, guilty of a<br />
misdemeanor and shall be subject to a fine of not more than $1,000, or imprisonment in the<br />
county jail not to exceed ninety (90) days, or both. The court may also impose restitution.<br />
Any person who operates a solid waste facility or collection service without a permit shall<br />
be, upon conviction, guilty of a misdemeanor and shall be subject to a fine of not more<br />
than $1,000, or imprisonment in the county jail not to exceed ninety (90) days, or both.<br />
The court may also impose restitution.<br />
Any person who operates a solid waste facility or collection service after a permit has been<br />
suspended shall be, upon conviction, guilty of a misdemeanor and shall be subject to a fine<br />
of not more than $1,000, or imprisonment in the county jail not to exceed ninety (90) days,<br />
or both. The court may also impose restitution.<br />
(c) Noncompliance Fees. Pursuant to the most current <strong>Health</strong> <strong>District</strong> fee schedule adopted by the<br />
Board of <strong>Health</strong>, the <strong>Health</strong> <strong>District</strong> may assess an hourly noncompliance fee to a permittee or<br />
owner/operator of unpermitted facility for the following:<br />

<strong>Health</strong> <strong>District</strong> oversight and review required as a result of the <strong>Health</strong> Officer’s<br />
determination that a permitted facility is not in compliance with its permit and/or<br />
applicable regulations and has not met the compliance dates specified in a notice<br />
and order to correct violation; or<br />
Amendments to an existing <strong>Health</strong> <strong>District</strong> permit required as a result of the<br />
permitted facility not being in compliance with its permit and/or applicable<br />
regulations.<br />
Second and subsequent re-inspections conducted by the <strong>Health</strong> <strong>District</strong> in<br />
response to the permittee not complying with their permit or the permittee not<br />
