(a) General. At a minimum, the <strong>Health</strong> Officer shall perform annual inspections of all permitted<br />
solid waste facilities. Findings shall be noted and kept on file. A copy of the inspection report<br />
or annual summary shall be furnished to the site operator by the <strong>Health</strong> Officer.<br />
(b) Pre-Operational Inspection. Whenever plans and specifications are required by these<br />
regulations to be submitted to the <strong>Health</strong> Officer, the <strong>Health</strong> Officer may inspect the<br />
proposed solid waste disposal site, solid waste handling facility, or solid waste<br />
collection service prior to the start of the operations to verify compliance with approved<br />
plans and specifications.<br />
(c) Conditionally Exempt Facilities. The <strong>Health</strong> Officer shall conduct inspections at<br />
conditionally exempt solid waste facilities as provided for under 173-350 at such<br />
frequency as necessary to ensure that the facility is operating in accordance with all<br />
applicable conditions. Facilities that refuse to allow <strong>Health</strong> <strong>District</strong> inspection at<br />
reasonable times are no longer exempt from the requirement to obtain a solid waste<br />
handling permit. The <strong>Health</strong> <strong>District</strong> is authorized to charge a fee to recover its expense<br />
for inspections conducted at conditionally exempt solid waste handling facilities in<br />
accordance with its current Fee Schedule.<br />
(5) Violations<br />
(a) Violations of these regulations may be addressed through the remedies and penalties provided<br />
in this section.<br />
(b) Each violation of these regulations shall be a separate and distinct offense and in the case of a<br />
continuing violation, each day’s continuance shall be a separate and distinct violation.<br />
(c) The <strong>Health</strong> Officer may investigate alleged or apparent violations of these regulations. Upon<br />
request of the <strong>Health</strong> Officer, the person allegedly or apparently in violation of these regulations<br />
shall provide information identifying themselves.<br />
(d) A violation of a term or condition of a permit issued under this regulation is a violation of these<br />
regulations.<br />
(6) Notice and Order to Correct Violation<br />
(a) Issuance. Whenever the <strong>Health</strong> Officer determines that a violation of these regulations<br />
has occurred or is occurring, he/she may issue a written notice and order to correct<br />
violation to the property owner or to any person causing, allowing or participating in the<br />
violation.<br />
(b) Content. The notice and order to correct violation shall contain:<br />

The name and address of the property owner or other persons to whom the notice and order<br />
to correct violation is directed;<br />
The street address or description sufficient for identification of the building, structure,<br />
premises, or land upon or within which the violation has occurred or is occurring;<br />
