(ii) Investigate every application to determine whether the facilities meet all applicable laws and<br />

regulations, conform to the approved comprehensive solid waste management plan and/or the approved<br />

hazardous waste management plan, and comply with all zoning requirements; and<br />

(d) Once the department has received a complete application for review, it shall:<br />

(i) Ensure that the proposed site or facility conforms with all applicable laws and regulations<br />

including the minimum functional standards for solid waste handling;<br />

(ii) Ensure that the proposed site or facility conforms to the approved comprehensive solid waste<br />

management plan and/or the approved hazardous waste management plan; and<br />

(iii) Recommend for or against the issuance of each permit by the jurisdictional health department<br />

within forty-five days of receipt of a complete application.<br />

(e) Application procedures for statewide beneficial use exemptions and permit deferrals are<br />

contained in WAC 173-350-200 and 173-350-710(8), respectively.<br />

(2) Permit issuance.<br />

(a) When the jurisdictional health department has evaluated all pertinent information, it may issue or<br />

deny a permit. Every solid waste permit application shall be approved or disapproved within ninety days<br />

after its receipt by the jurisdictional health department. Every permit issued by a jurisdictional health<br />

department shall contain specific requirements necessary for the proper operation of the permitted site<br />

or facility.<br />

(b) Every permit issued shall be valid for a period not to exceed five years at the discretion of the<br />

jurisdictional health department.<br />

(c) Jurisdictional health departments shall file all issued permits with the appropriate regional office<br />

of the department no more than seven days after the date of issuance.<br />

(d) The department shall review the permit in accordance with RCW 70.95.185 and report its<br />

findings to the jurisdictional health department in writing within thirty days of permit issuance.<br />

(e) The jurisdictional health department is authorized to issue one permit for a location where<br />

multiple solid waste handling activities occur, provided all activities meet the applicable requirements of<br />

this chapter.<br />

(3) Permit renewals.<br />

(a) Prior to renewing a permit, the health department shall conduct a review as it deems necessary to<br />

ensure that the solid waste handling facility or facilities located on the site continue to:<br />

(i) Meet the solid waste handling standards of the department;<br />

(ii) Comply with applicable local regulations; and<br />

(iii) Conform to the approved solid waste management plan and/or the approved hazardous waste<br />

management plan.<br />

(b) A jurisdictional health department shall approve or deny a permit renewal within forty-five days<br />

of conducting its review.<br />

(c) Every permit renewal shall be valid for a period not to exceed five years at the discretion of the<br />

jurisdictional health department.<br />

(d) The department shall review the renewal in accordance with RCW 70.95.190 and report its<br />

findings to the jurisdictional health department in writing.<br />

(e) The jurisdictional board of health may establish reasonable fees for permits reviewed under this<br />

section. All permit fees collected by the health department shall be deposited in the treasury and to the<br />

account from which the health department's operating expenses are paid.<br />

(4) Permit modifications. Any significant change to the operation, design, capacity, performance or<br />

monitoring of a permitted facility may require a modification to the permit. The following procedures<br />

shall be followed by an owner or operator prior to making any change in facility operation, design,<br />

performance or monitoring:<br />

(a) The facility owner or operator shall consult with the jurisdictional health department regarding<br />

the need for a permit modification;<br />

(b) The jurisdictional health department shall determine whether the proposed modification is<br />

significant. Upon such a determination, the owner or operator shall make application for a permit<br />
