Housework, a devalued framework <strong>in</strong>ternally<br />

and externally<br />

The head of research <strong>in</strong> <strong>the</strong> M<strong>in</strong>istry of Labour adds a new dimension to <strong>the</strong> issue of<br />

domestic regulations <strong>in</strong> <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> <strong>in</strong> say<strong>in</strong>g: “Comparatively speak<strong>in</strong>g, we<br />

are a very young country. Our social organization and most of our <strong>in</strong>ternal regulations are<br />

modelled on outside experiences. When it comes to domestics <strong>in</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong>,<br />

our biggest drawback is <strong>the</strong> fact that foreign female domestic workers are considered<br />

unskilled labour, a category adopted from <strong>in</strong>ternational practices. Until very recently, <strong>the</strong><br />

<strong>in</strong>ternational literature on migration did not account for <strong>women</strong> as im<strong>migrant</strong>s.<br />

“In <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong>, we follow trends but we do not set <strong>the</strong>m. If <strong>the</strong> status<br />

of domestics develops worldwide, we will be bound to follow. It may take longer here,<br />

because our society is very new to modernization and human rights issues. However, we<br />

are chang<strong>in</strong>g. I personally th<strong>in</strong>k once <strong>the</strong> concept of domestic work becomes valued<br />

worldwide, <strong>the</strong> status of domestics <strong>in</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> will also improve” (Rashid<br />

Mohamad, 2001).<br />

No b<strong>in</strong>d<strong>in</strong>g contract<br />

Contracts that foreign female domestic worker hold sometimes from <strong>the</strong> recruit<strong>in</strong>g<br />

agencies are nei<strong>the</strong>r official nor b<strong>in</strong>d<strong>in</strong>g to <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> Government. Dr.<br />

Mohamed Al Rukun, president of <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong>’ la wyers’ association,<br />

expla<strong>in</strong>s: “These contracts cannot be adopted by <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> officials, <strong>the</strong><br />

migration officers or any official agency” 24 . In order to have a contract that is <strong>in</strong>ternally<br />

b<strong>in</strong>d<strong>in</strong>g, all parties have to be under <strong>the</strong> <strong>in</strong>ternal control of <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong>. S<strong>in</strong>ce<br />

<strong>the</strong>se contracts <strong>in</strong>volve <strong>the</strong> Government of <strong>the</strong> foreign female domestic worker’s orig<strong>in</strong>al<br />

country, <strong>the</strong>y cannot be adopted <strong>in</strong>ternally unless <strong>the</strong>re is a special form of bilateral<br />

agreement or understand<strong>in</strong>g. To <strong>the</strong> best of my knowledge, however, <strong>the</strong>se agreements still<br />

do not exist <strong>in</strong> <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> <strong>in</strong> relation to foreign female domestic workers.”<br />

Prospect of a b<strong>in</strong>d<strong>in</strong>g contract<br />

<strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> officials are <strong>in</strong> <strong>the</strong> process of prepar<strong>in</strong>g a contract to be b<strong>in</strong>d<strong>in</strong>g<br />

<strong>in</strong>ternally. This contract, as an official figure <strong>in</strong> <strong>the</strong> Dubai immigration office 25 confirmed,<br />

is basically aimed at protect<strong>in</strong>g both <strong>the</strong> employer and <strong>the</strong> employee, and at controll<strong>in</strong>g bad<br />

practices at all levels, especially recruit<strong>in</strong>g agencies <strong>in</strong> <strong>the</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong> (Salem<br />

Said, 2001). It will state all conditions under which a domestic has to work, <strong>in</strong>clud<strong>in</strong>g<br />

payment, benefits, etc. It might be similar to <strong>the</strong> one provided by send<strong>in</strong>g countries, with<br />

<strong>the</strong> exception of <strong>the</strong> day-off. A m<strong>in</strong>imum salary of Dhs400 to Dhs500 is to be specified<br />

along with o<strong>the</strong>r terms b<strong>in</strong>d<strong>in</strong>g employer and employee.<br />

The head of <strong>the</strong> office, Mr. Said B<strong>in</strong> Belaila believes <strong>the</strong> issue of foreign female<br />

domestic worker will not be controlled until <strong>migrant</strong> domestics are considered as o<strong>the</strong>r<br />

workers <strong>in</strong> <strong>United</strong> <strong>Arab</strong> <strong>Emirates</strong>, and are <strong>in</strong>cluded under <strong>the</strong> country’s labour laws.<br />

O<strong>the</strong>rwise domestic work will cont<strong>in</strong>ue to be a loose-ended means by which o<strong>the</strong>r<br />

unskilled labourers enter <strong>the</strong> country (Said B<strong>in</strong> Belaila 2001 and Latifa Al-Maissi: Kul-Al-<br />

Usra, 2001).<br />
