Section G introduces <strong>the</strong> various AU mech<strong>an</strong>isms, including <strong>the</strong> Afric<strong>an</strong> Peer Review Mech<strong>an</strong>ism,<br />

<strong>an</strong>d examines <strong>the</strong> relev<strong>an</strong>t regional documents for <strong>HIV</strong> <strong>an</strong>d hum<strong>an</strong> <strong>rights</strong>.<br />

A criticism of <strong>the</strong> UN’s hum<strong>an</strong> <strong>rights</strong> instruments is<br />

that <strong>the</strong>y focus <strong>to</strong>o much on individual <strong>rights</strong>, without<br />

examining <strong>the</strong> <strong>rights</strong> of <strong>the</strong> collective. While reflecting<br />

<strong>the</strong> universality of hum<strong>an</strong> <strong>rights</strong>, <strong>the</strong> AU<br />

hum<strong>an</strong> <strong>rights</strong> instruments, take in<strong>to</strong> account <strong>the</strong><br />

<strong>rights</strong> of groups, as much as <strong>the</strong> <strong>rights</strong> of individuals.<br />

Rights (Afric<strong>an</strong> Charter)<br />

• The Pro<strong>to</strong>col <strong>to</strong> <strong>the</strong> Afric<strong>an</strong> Charter on <strong>the</strong> Rights<br />

of Women in Africa (Women’s Pro<strong>to</strong>col)<br />

• The Afric<strong>an</strong> Charter on <strong>the</strong> Rights <strong>an</strong>d Welfare<br />

of <strong>the</strong> Child (Afric<strong>an</strong> Children’s Charter).<br />

These instruments were developed by Afric<strong>an</strong> states<br />

<strong>an</strong>d recognise <strong>the</strong> import<strong>an</strong>ce of <strong>the</strong> collective in<br />

Afric<strong>an</strong> societies.<br />

These treaties provide, among o<strong>the</strong>rs, for <strong>the</strong> <strong>rights</strong><br />

<strong>to</strong> equality, dignity, security <strong>an</strong>d health. They also<br />

give a central place <strong>to</strong> <strong>the</strong> principle of <strong>the</strong> best<br />

The AU treaties, Afric<strong>an</strong> Hum<strong>an</strong> Rights Court <strong>an</strong>d<br />

<strong>the</strong> APRM will be discussed in detail below.<br />

AU treaties<br />

At <strong>the</strong> regional level <strong>the</strong>re are three main binding<br />

hum<strong>an</strong> <strong>rights</strong> treaties that apply <strong>to</strong> <strong>the</strong> <strong>HIV</strong> <strong>epidemic</strong>:<br />
